The Committee met on three separate occasions to develop alternatives for a trail system in the Quito /Sobey Road area. Staff has included maps (Exhibit 1 -3) which represent the three alternatives, plus a fourth alternative to amend the General Plan. REPORT TO MAYOR AND CI'T'Y COUNCIL DATE: 2/19/82 COUNCIL MEETING: 2/ 2/82 SUBJECT Ad Hoc Committee Re: Trails and Pathways in the Chester Road Area ---------------------------------------------------------------------- - - - - -- In July of 1981, the City received a letter from the Emerald Hills - Tersora Homeowners Association requesting that the equestrian easement on upper Chester Avenue be abandoned. At that time, staff analyzed the situation and recommended to the City Council that an Ad Hoc Committee be formed consisting of a representative from Emerald Hills - Tersora Homeowners Association, members of the Parks and Recreation Commission and an individual who is interested in maintaining the equestrian trail. The Committee was to develop alternatives to be used by the Planning Commission and City Council in dealing with the trail issues on upper Chester Avenue. Staff met with the Committee on several occassions to discuss possible alternatives. Please note the two memos which were forwarded to the Council dated 10/8/81 and 10/22/82 regarding,the status of the project at that time. The most recent meeting was on January 11, 1982 at which time there was another alternative discussed which resulted in no access across the Oddfellow's property. (It should be noted that there is a letter oft file from Mr. Ross Conklin of Oddfellows formally requesting that the City Council abandon the equestrian easement that runs between Chester Avenue to Fruitvale Avenue on the Oddfellow's property.) With this in mind, the Committee evaluated an alternative that would meet the needs of the children who had horses in the area while minimizing the conflict between autos, motorcycles, bicycles and horses and eliminated the eques- trian easement across the Oddfellow's property. Following is a list of the alternatives discussed by the Committee during the past several months. (Exhibits correspond to alternatives.) Alternative 1: Propose a change to the demonstration trail system by eliminating the equestrian portion along upper Chester Avenue while maintaining a 1 to 2 foot wide pedestrian easement within the street on Chester Avenue. The new trails ant-L pathways plan would have an equestrian trail from the Trails & Pathways --Chester Road February 19, 1982 Page 2 Quito Road /Sobey Road intersection through the two major vacant parcels (Brookman Estate) to San Marcos Road and eventually to Fruitvale Avenue. There will be a loop from Sobey Road -Ten Acres to lower Chester eventually connecting with Allendale Avenue. Alternative 2: A trail system commencing at the intersection of Quito Road /Sobey Road proceeding south to a point in the vicinity of Springbrook Lane. Alternative #2 would also have the extension from Sobey via Ten Acres to lower Chester Avenue to Allendale Avenue. There would be a 1' -2' wide pedestrian easement along upper Chester Avenue. Alternative 3: A trail system commencing at the intersection of Quito Road /Sobey Road proceeding south on Sobey Road to the two major parcels (Brookman Estate). The trail system would encircle the Brookman Estate and end on Sobey Road. Alternative 4: 'Modify the General Plan Trails & Pathway Plan to eliminate the equestrian easement along upper Chester Avenue and adjacent to IOOF. It should be noted that all three options involve a "No Parking" lane on upper Chester Avenue, and a l' -2' pedestrian easement along upper Chester Avenue. Discussion of Alternatives: Alternative 1 appears to meet the needs of the Emerald Hills - Via Tersora Homeowners Association while still maintaining the trails and pathways plan from the Quito Road area to the western hillsides. The major problem associated with this alternative is that staff has received no application from the owners of the Brookman Estate, and no trail system will be completed until such time as the Brookman property is subdivided and the Chester Avenue extension is completed. The issue of a trail easement across the Oddfellows is not resolved with this particular alternative. Alternative 2 would have the trail from the Quito -Sobey intersection to an area just south of Springbrook Lane and would provide minimal east -west connections to the hillsides. The advantages of this alternative is that the equestrian easement on upper Chester could be abandoned as well as the easement across the Oddfellow's property. Alternative 3 would in fact eliminate the trail plan that the Parks Commission has worked on for several years. 'This alternative would allow individuals riding horses in the area to start at Quito Road, circle the existing Brookman Estate and return to Sobey Road. Staff has received no indication of when these properties will be developed. Trails & Pathways - Chester Road February 19, 1982 Page 3 Alternative 4 would have the General Plan modified to eliminate trail easements. Based on the alternatives discussed with the Ad Hoc Committee, it appears that the most logical is Alternative #1. Staff recommends that the current equestrian /pedestrian easements which have been recorded on Chester Avenue and the Oddfellow's property be maintained until such time as a trail system is developed in conjunction with extension of Chester Avenue. Once the road is constructed, and the trail system established, then staff would recommend that the existing equestrian easement on upper Chester Avenue be abandoned at the property owner's request. In the interim, the City may wish to place a "No Horses Allowed" sign on the area from Ten Acres Road to upper Chester Avenue from the standpoint of safety. One of the participants on the Ad Hoc Committee indicated that upper Chester is not a safe area for horses to travel, and that she has been able to keep her students and other children from using that portion of the trail system. The above recommendation has been discussed with the City Manager and he concurs with the importance of maintaining the trail ease- ments until such time as there is an option to insure the viability of the equestrian - pedestrian trailways. Saratoga City Council ' Saratoga, CA To Whom It May Concern: Two years ago, a proposal to establish a 2.2 mile combined equestrian, bicycle, jogging and walking trail was voted on and rejected by the Saratoga City Council. A portion of this trail was to have been on the south side of Chester Avenue from Ten Acres Road to almost the end (south- west of Chester). At the time the proposal was defeated, the Emerald Hills Tesora Homeowner Association (seventeen homesites along the affected portion of Chester Avenue) were unanimously apposed to the proposal for many different reasons. Major concern is for the safety problem associated with the "blind spot" of that portion of the proposed trail by 14033 Chester Avenue. We would like to take the opportunity to respectfully submit to the Saratoga City Council that all elements along this portion of Chester Avenue for the above mentioned trail be returned to the Homeowners as a permanent part of their respective property. TO: City Council FROM: Director of Planning and Policy Analysis SUBJECT: Chester Avenue 0 DATE: 10/22/81 During the last month, staff has met twice with members of the Parks and Recreation .Commission, the Emerald Hills-Via Tesoro Homeowners Association and an involved neighbor to discuss the equestrian easement.on upper Chester Avenue. The principal issue at hand is whether or not it's appropriate to have an equestrian easement along upper Chester Avenue. The first meeting discussed various options, which would alleviate - the issue of an equestrian easement along upper Chester Avenue while establishing the demonstration trail.and p_ossibly.main- taining the Sobey Road to Fruitvale Avenue connection through an alternate location, The next meeting was on October 19, 1981 and the following points were discussed; 1. Willingness of both groups to support the immediate abandon- ment of the equestrian easement on upper Chester Avenue in return for support of demonstration trail from Quito Road via Ten Acres to the corner of Chester Avenue. 2, The pedestrian easement.would be indicated along, upper Chester Avenue by a 2' -0" wide path (white stripe). This will require "No Parking" along one side of the street. 3. Insure that a pedestrian / equestrian easement is taken and constructed from Sobey'Road via the Chester Avenue exten- tion (undeveloped) via San Marcos ?load to Fruitvale Avenue. 4. The ability of the City to maintain the demonstration trail system and consideration to its financial burdens. The representatives were to return to their respective groups (Homeowners Association and Parks and Recreation Commission) with the most recent proposals. The individuals will return in early November so the Council can review the issues at._a study session. City Manager DATE: October 8, 1981 FROM Director of Planning & Policy Analysis SUBJECT: Status Report, October 6, 1981 Meeting Re: Demonstration Trails and Pathways --------------------------------------------------------------------------- In accordance with the direction established by the City Council at their meeting of September 16, 1981, staff met with represent- atives from the Emerald Hill -Via Tesora HomeownerFs Association, the Park and Recreation Commission, and a neighbor interested in the Trails and Pathway Plan. The purpose of the meeting was to: 1. Identify problems associated with the proposed demonstra- tion trails through Chester Avenue; 2. Develop options; 3. Determine the feasibility of implementing the options and 4. Present the problem and options to the City Council at their October 27th Committee of the Whole Meeting. Air. Ed Gomersall, Chairman of the Parks and Recreation Commission gave an overview of the proposed demonstration trails and some of the concerns that went into developing the plan which was presented to the City Council in August of 1979. Of the three areas selected for the. initial study, the Parks and Recreation Commission indicated that the plan which showed a connection between Sobey via Chester to San Marcos way was the most logical plan. Mr. Gommersal stated that the Parks and Recreation Commission "did not scrimp on any of the cost estimates" in putting the proposal together and that they always assumed the more expensive of the options. The Parks Commission's repre- sentatives'felt very strongly that the safety conditions would be improved once the trails were establish, because children are now walking in the streets versus the easements. Dr. Ron Mancuso, Vice President of the Homeowner'sAssociation, expressed such immediate concerns as the pedestrian /auto/ motorcycle /equestrian conflict which currently exists. It was made clear that the homeowners were not in opposition to an equestrian trail but that it was important to relate the area of greatest use to the trails system. C� V�, 4), 81 to - d Demonstration Tr and Pathways October 8, 1981 Page 2 Alternatives There were several alternatives mentioned which involved some give and take on both the Homeowner's Association and that of the Parks and Recreation Commission. 1. Parks and Recreation Commission: The Parks and Recreation representatives agreed to pursue the following items: a. Support "no horses" along upper Chester Avenue. b. Propose a change to Demonstration Trails by eliminating the equestrian portion along upper Chester Avenue (while maintaining a 2' -3' wide pedestrian trail along upper Chester Avenue). C. Support City Council resolution (through General Plan process) for abandonment of equestrian easement along upper Chester Avenue once eques- trian trail is established. d. Revise Trail Master Plan to show route (upper Chester to Sobey Road). 2. Homeowner's Association: The Homeowner's representative agreed to: a. Return to the Association and ask that there be no parking along.:the southeastern side of Chester Avenue from the intersection of Ten Acres to San Marcos Road area. b. Support the Parks and Recreation Commission for a two -three foot (2 -3') wide pedestrian (no horses - see item #1 above) trail indicated by a white strip in the street and that the status of the current pedestrian /equestrian easement along Chester would be maintained until such time as the pedestrian/ equestrian easement and trail is established or an acceptable alternative established from Sobey Drive to San Marcos. C. Support the Parks and Recreation Commission and the implementation of the demonstration trail minus the equestrian portion of upper Chester Avenue. 3. Staff Responsibility: The staff is responsible for: d. Determining the status of the tentative map of the Gerald Kendall, Brookwood Estates and the easements along Chester Avenue, Leland Court and the Oddfellows. I reviewed the Kendall Subdivision which is immediately adjacent to the extension of Chester Avenue and there is a condition which requires trail dedications in conjunction with the Master Trails and Pathways Plan. The Homeowners Association will support a two trail concept whereby: 1�1/1 1) An equestrian only trail be established which will be remote from residential and from automobile traffic -(i. e. a single purpose trail). 2) A lane be established for walking, jogging or bicycle riding; only in residential areas. Motor driven bicycles etc. will not be included. Proposed lane be two feet from the curb to street delineated by a white 1 ine.- 3) Equestrian easement be abandoned on Chester Avenue immediately. This easement abandonment will include all properties of each homeowner on Chester Avenue. 4) The City Council justifies all expenses regarding Item #1. This easement was granted by the Home at the time the property on which the Fellowship Plaza is located was transferred to that corporation. Shortly after Chester Avenue was built along our property boundary the Residents of this Home and Fellowship Plaza experienced a considerable amount of vandalism to our property and our cars. In addition, some of the teenaged population of the new housing located to the north of our property began to use our driveway for a shortcut to their schooling and activities west of Fruitvale Avenue. Many of these youngsters proved to be rude and crude, most impolite to our aged Residents strolling on our Home property as they passed them. 'Several of the youngsters had mopeds and speeded through our property on their way to and from school. One of them even knocked down a stop sign as he passed through the property. To remove the dangers mentioned above the Home was forced to install a 6' chain link fence along our north boundary. SUBJECT: Resolution _Revising Salary Rate for City Manager Issue Stm ury The employment agreement between the City and the City Manager provides that. the Council will evaluate. the Manager's performance and review salary and benefits approximately on October 1, 1981. The Council has completed that review and has determinded that the adjustment in salary submitted is merited. Recommendation Adopt the attached Resolution authorizing salary adjustment and a change in group insurance benefits to conform with other management benefits and appropriating monies from the reserve set aside for this purpose. Fiscal Impacts The salary adjustment is at the rate of 8% and amounts to $1,200 for the balance of the fiscal year. An additional $266 is needed for PFRS and insurance adjustments. A RESOLUTION OF THE COUNCIL OF THE CITY OF SARATOGA REVISING THE SALARY AND BENEFITS FOR THE CITY MANAGER AND APPROPRIATIi;G FUNDS THEREFORE VHEREAS the City Council has reviewed and evaluated the performance of the City Manager in November, 1981 Now Therefore be it Resolved: (1) That the monthly salary rate for the City Manager, effective March 1, 1982 shall be $4,050. (2) That the amount provided for insurance benefits, including health, life, long term disability and dental coverage, shall be the same as provided for other management positions, $215.00 per month. (3) The amount of $1,466 is hereby appropriated to the proper budget accounts from General Fund Reserves set aside for this purpose.
