AMEND THE HERITAGE PRESERVATION ORDINANCE BY INCREASING THE SIZE OF THE
SUB=: COMMISSION FROM FIVE TO SEVEN MEIVBERS
Issue Summary
1. At the City Council meeting of March.2, 1983, the Heritage Preservation. Commission
requested that the size of the Commission be increased from five to seven members to
make the Commission more effective.
2. The Council directed Staff to prepare an amendment to the ordiance to accomplish this.
3. The amendment is hereby submitted for Council consideration.
Recommendation
1. Have the first reading of the amended ordinance (no public hearing is required).
2. If ordinance is acceptable, set ordinance for second reading at Council meeting
of May 1 -8, 1983.
3. Adopt ordinance amendment at second reading. Ordinance goes into effect 30 days
after adoption.

SUBJECT: MODIFICATION OF HERITAGE PRESERVATION ORDINANCE
Staff has revised the Heritage Preservation Ordinance as directed by
the Council at its May 4, 1983, meeting., A copy of Ordinance No.
66.1 is attached which eliminates the Planning Commission member
slot and creates 5 at -large members for the Heritage Preservation
Commission.
This meeting will constitute the second reading of ,the ordinance,
which will go into effect 30 days from its adoption at this meeting.
Staff is already preparing public notices to advertise the 3 vacancies
on the Heritage Preservation Commission.

MODIFICATION OF HERITAGE PRESERVATION ORDINANCE

At its meeting of April 20, 1983, the City Council had its first
reading of the modification to the Heritage Preservation Ordinance
(Ord. No. 66) proposed by the Heritage Preservation Commission.
The purpose of that modification was to increase the number of
members on the Commission from five to seven.
Staff indicated that the membership r slot for a Planning Commission
member on the Heritage Preservation Commission was vacant and that _
Staff would be working with( —the Planning Commission to fill
that slot. This vacancy was discussed with the Planning Commission
at its meeting of April 26, 1983. The Planning Commission stated
that due 'to its workload, it did not feel that any commissioner
would be available to fill that slot. However, the Planning Com-
mission might designate a member who would act as an informal liaison
with the Heritage Preservation Commission but would not attend their
meetings.
Considering the fact that the Planning Commission will be unable to
have one of its members attend Heritage Commission meetings, Ordinance
No. 66 should be further modified to eliminate the need for a Planning
Commissioner as a member of the Heritage Preservation Commission. ,
Another at -large membership could be created so that the Commission
would still have seven member.s. To accomplish this, Section 3(a) of
Ordinance No. 66 would have to be amended to read as follows:
(a) Creation of Commission. There is hereby established a
Heritage Commission consisting of seven unpaid members who
shall be residents of the City of Saratoga appointed by the
Saratoga City Council, with the following qualifications:
(1) One member who shall have been a candidate
nominated by the Saratoga Historical Foundation.

(2) One member who, by reason of training and ex-
perience, is knowledgeable in the field of
construction and structural rehabilitation,
such as a licensed architect, engineer, con-
tractor or urban planner:
(3) Five members appointed at large having demon-
strable interest in preservation of the heritage
resources within the City of Saratoga.
RECOMMENDATION
If the City Council determines that Ordinance No. 66 should be
modified as indicated above, it should have the first reading of
this new modification at this meeting. Staff will then prepare
a revised Ordinance No. 66 for final approval at the Council meeting
of May 18, 1983. The ordinance will take effect 30 days after that
final approval.

SUBJECT MODIFICATION OF HERITAGE PRESERVATION ORDINANCE
At its meeting of March 2, 1983, the City Council heard a short presentation
by the Heritage Preservation Commission on that Commission's activities. As
part of that presentation, the Heritage Preservation Commission requested that
the Commission be expanded from five members to seven members. The Commission .
felt this increase was necessary in order for it to adequately deal with its
workload and to make the Commission more effective. The Commission also men-
tioned considering creating an 180 day demolition delay for historic structures.
The City Council directed Staff to prepare a revision to the Heritage Preserva-
tion Ordinance increasing the number of Commission members from five to seven.
Attached to this report is an ordinance amendment modifying Section 3(a) of
Ordinance No. 66 increasing the number of at- large. Commissioners from two to
four. A report from the Commission on the 180 day demolition permit delay will
be forwarded to the.Council at a later date.
It should be noted that there is one vacancy on the Heritage Preservation Commission
since the Pl.anning'Commission has not appointed.someone to replace Commissioner
Bolger. Staff will be, working with the Planning Commission to get a new member
appointed d. There was some concern expressed that Planning Commissioners had
difficulty attending afternoon meetings due-to their work schedules.
Staff has received some comments from Saratoga residents indicating a high degree
of interest in serving on the Heritage Preservation Commission, so it appears
there will be no shortage of applicants to choose from. If the Council. approves
the ordinance amendment, then a second reading of the amendment will be scheduled.

after. In the meantime, Staff can be distributing and collecting applications
for membership on the Commission. The Council should set a deadline for applica-
tion acceptance and set aside some time to interview the applicants at its
earliest convenience.

ORDINANCE NO. 66.1
AN ORDINANCE OF THE CITY OF SARATOGA AMENDING ORDINANCE
NO. 66, THE HERITAGE PRESERVATION ORDINANCE, BY INCREASING
THE NUMBER, OF HERITAGE PRESERVATION COMMISSIONERS FROM
FIVE TO SEVEN.
The City Council of the City of Saratoga does hereby ordain as
follows:
Section 1: Section 3(a) Heritage Preservation Commission --
Creation of Commission is hereby amended to read as follows:
(a) Creation of Commission. There is hereby established
a Heritage Preservation Commission consisting of seven un-
paid members who shall be residents of the City of Saratoga
and appointed by the Saratoga City Council, with the following
qualifications:
(1) One member who shall have been a candidate
nominated by the Saratoga Historical Foundation;
(2) One member who, by reason of training and experi-
ence, is knowledgeable in the field of construction
and structural rehabilitation, such as a licensed
architect, engineer, contractor or urban planner;
(3) Five members appointed at large having demonstrable
interest in preservation of the heritage resources
within the City of Saratoga.
Section 2: If any section, subsection, sentence, clause or phrase of
this Ordinance is- -for any reason held by a court of competent juris-
diction to be invalid, such decision shall not affect the validity of
the remaining portions of this Ordinance. The City Council of the
City of Saratoga hereby declares that it would have passed this Ordi-
nance and each section, subsection, sentence, clause and phrase thereof
irrespective of the fact that one or more sections, subsections,
sentences, clauses or phrases may be held invalid or unconstitutional.
Section 3: This ordinance shall take effect and be in full force
and effect thirty (30) days from and after the date of its passage
and adoption.
