the improvements and directing preparation of the Engineer's Report for fiscal year
1982 -83 for the continuation of the Landscaping and Lighting District LLA -1. Additional
Council action is required for this district to proceed.
Recommendation
Adopt the following:
Resolution 1075 -A, "A Resolution Appointing Attorneys"
Resolution 1075 -B, "A Resolution of Preliminary Approval of Engineer's Report"
Resolution 1075-C, "A Resolution of Intention Setting and Time and Place of
the Public Hearing for said District"
Fiscal Impacts
The costs for the administration, maintenance and servicing, and lighting costs are
charged to the various zones within the District based on benefit received. The Santa
Clara County Assessor's Office will collect the amounts through the taxes and, in turn,
send to the City.

A RESOLUTION APPOINTING ATTORNEYS
CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA -1
RESOLVED, by the City Council of the City of Saratoga, California, that
WHEREAS, this Council has determined to undertake proceedings for the levy
and collection as assessments upon the several lots or parcels of land in City of
Saratoga Landscaping and Lighting District LLA -1 pursuant to the Landscaping and
Lighting Act of 1972 for the construction or installation of improvements, including
the maintenance or servicing, or both, thereof for the fiscal year 1982 -1983; and
WHEREAS, the public interest and general welfare will be served by appointing
and employing attorneys for the preparation and conduct of said proceedings;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That the law firm of WILSON MORTON ASSAF AND MCELLIGOTT, San Mateo,
California, be, and it is hereby, appointed and employed to do and perform all
legal services required in the conduct of said proceedings, and that its compensation
be, and it is hereby fixed at not to exceed $1,200.00.

A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT
CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA -I
FISCAL YEAR 1982 -1983
RESOLVED, by the City Council of the City of Saratoga, California, that
WHEREAS, on the 21st day of April 1982, said Council did adopt its
Resolution No. 1075, Describing Improvements and Directing Preparation of Engineer's
Report for Fiscal Year 1982 -1983 pursuant to the Landscaping and Lighting Act of 1972,
for the City of Saratoga Landscaping and Lighting District LLA -1 in said City and
did refer the proposed improvements to the City Engineer, and did therein direct
said City Engineer prepare and file with the Clerk of said City a report, in writing,
all as therein more particularly described, under and pursuant to the Landscaping
and Lighting Act of 1972;
WHEREAS, said City Engineer prepared and filed with the Clerk of said City
a report in writing as called for in said Resolution No. 1075 and under and
pursuant to said Act, which report has been presented to this Council for consideration;
WHEREAS, said Council has duly considered said report and each and every part
thereof, and finds that each and every part of said report is sufficient, and that
neither said report, nor any part thereof should be modified in any respect;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as follows:
1. That the plans and specificiations for the existing improvements and the
proposed new improvements to be made within the assessment district or within any
zone thereof, contained in said report, be, and they are hereby, preliminarily approved.
2. That the Engineer's estimate of the itemized and total costs and expenses
of said imporvements, maintenance and servicing thereof, and of the incidental
expenses in connection therewith, contained in said report, be, and each of them are
hereby, preliminarily approved.
3. That the diagram showing the exterior boundaries of the assessment district
referred to and described in said Resolution No. 1075 and also the boundaries of
any zone_therei.n and the lines and dimensions of each lot or parcel of land within
said district as such lot or parcel of land is shown on the County Assessor's maps for
the fiscal year to which the report applies, each of which lot or parcel of land has
been given a separate number upon said diagram, as contained in said report, be , and
is hereby, preliminarily approved.
4. That the proposed assessment of the total amount of the estimated costs
and expenses of the proposed improvements upon the several lots or parcels of land
in said district in proportion to the estimated benefits to be received by such lots

- or both, thereof, and of the expenses incidental thereto, as contained in said report,
be, and they are hereby, preliminarily approved.
5. That said report shall stand as the Engineer's report for the purpose of
all subsequent proceedings to be had pursuant to said Resolution No. 1075•

RESOLVED, by the City Council of the City of Saratoga,
California, as follows:
WHEREAS, pursuant to Resolution No. 1075, Describing Improvements
and Directing Preparation of Engineer's Report for Fiscal Year 1982 -1983 for
City of Saratoga Landscaping and Lighting District LLA -1, adopted on April 21,
1982, by the City Council of said City, pursuant to the Landscaping and Light-
ing Act of 1972, the City Engineer of said City has prepared and filed with
the Clerk of this City the written report called for under said Act and by

NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND ORDERED, as
follows:
1. In its opinion the public interest and convenience require and
it is the intention of this Council to order the levy and collection of
assessments for Fiscal Year 1982 -1983 pursuant to the provisions of the Land-
scaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and
Highways Code of the State of California, for the construction or installation
of the improvements, including the maintenance or servicing, or both, thereof,
more particularly described in Exhibit "A" hereto attached and by reference
incorporated herein.
2. The cost and expenses of said improvements, including the
maintenance or servicing, or both, thereof, are to be made chargeable upon
the assessment district designated as "City of Saratoga Landscaping and
,Lighting District LLA -1 ", the exterior boundaries of which district are the
composite and consolidated area as more particularly described on a map
thereof on file in the office of the Clerk of said City; to which reference
is hereby made for further particulars. Said map indicates by a boundary
line the extent of the territory included in the district and of any zone
thereof and the general location of said district.

3. Said Engineer's Report prepared by the City Engineer of said
City, preliminarily approved by this Council, and on file with the Clerk
of this City is hereby referred to for a full and detailed description of
the improvements, the boundaries of the assessment district and any zones
therein, and the proposed assessments upon assessable lots and parcels of
land within the district.
4. Notice is hereby given that Wednesday, the 2nd day of June,
1982, at the hour of 8:00 o'clock p.m.. in the regular meeting place of
said Council, City Hall, 13777 Fruitvale Avenue, Saratoga,-.California
95070, be and the same are hereby appointed and fixed as the time and
place for a hearing by this Council on the question of the levy and col-
lection of the proposed assessment for the construction or installation of
said improvements, including the maintenance and servicing, or both, thereof,
and when and where it will consider all oral statements and all written pro-
tests made or filed by any interested person at or before the conclusion of
said hearing, against said improvements, the boundaries of the proposed
assessment district and any zone therein, the proposed diagram or the pro-
posed assessment, to the Engineer's estimate of the cost thereof, and when
and where it will consider and finally act upon the Engineer's Report.
5. The Clerk of said City be, and is hereby, directed to give
notice of said hearing by causing a copy of this Resolution to be published
once in the Saratoga News, a newspaper published and circulated in said
City, and by conspicuously posting a copy thereof upon the official bulletin
board customarily used by the City Council for the posting of notices, said
posting and publication to be had and completed at least ten (10) days prior
to the date of hearing specified herein.
6. The office of Assistant Director of Maintenance of said City
be, and is hereby designated as the office to answer inquiries regarding any
protest proceedings to be had herein, and may be contacted during regular
office hours at the City Hall, 13777 Fruitvale Avenue, Saratoga, California
95070 or by calling (408) 867 -3438.

a) The construction or installation, including the maintenance or servicing,
or both, thereof, within Zones 1, 2 and 3 as hereinafter described, of
landscaping, including trees, shrubs, grass or other ornamental vegetation,
staturary, fountains and other ornamental structures and facilities including
the cost of repair, removal or replacement of all or any part thereof,
providing for the life, growth, health and beauty of landscaping including
cultivation, irrigation, trimming, spraying,fertilizing or treating for disease
or injury, the removal of trimmings, rubbish, debris and other solid waste,
water for the irrigation of any landscaping, the operation of any fountains or
the maintenance of any other improvements.
b) The construction or installation, including the maintenance or servicing,
or both, thereof, within Zones 4,5,6 and 7, as hereinafter described, of public
lighting facilities for the lighting of any public places,, including ornamental
standards, luminaries, poles, supports, tunnels, manholes, vaults, conduits,
pipes, wires, conductors, guys, stubs, platforms, braces, transformers, insulators,
contacts, switches, capacitors, meters, communication circuits, appliances,
attachments and appurtenances, including the cost of repair, removal or replacement
of all or any part thereof, electric current or energy, gas or other illuminating
agent for any public lighting facilities or for the lighting or operation of
any other improvements.
c) The construction or installation, including the maintenance or servicing, or
both, thereof, within Zone 8 as hereinafter described, of landscaping, including
trees, shrubs, grass or other ornamental vegetation, statuary, fountains and
other ornamental structures and facilities and public lighting facilities
for the lighting of any public places, including ornamental standards, luminaries,
poles, supports, tunnels, manholes, vaults, conduits, pipes, wires, conductors,
guys, stubs, platforms, braces, transformers, insulators, contacts, switches,

SUBJECT: Overlaying McCoy Avenue; between Qnito Road and Vllanova Road
Issue Sumnary
This project was awarded on October 21, 1981 to Piazza Construction Company
for the bid amount of $27,840.00. The Sunland Park Homeowners deposited
$27,000.00 with the City to cover costs of northerly half of McCoy Avenue.
The City of San Jose deposited $10,000.00 with the City to cover costs of
the southerly half of McCoy Avenue. In addition the Sunland Park Homeowners
have agreed to pay for an additional $1,500.00 worth of work,, to be paid
from the $27,000 already deposited.
Recomnendation
Approve final acceptance and file Notice of Completion on the above project.

SUBJECT: Examination of Local Sales and Use Tax Records

Issue Summary
Under the provisions of the Bradley -Burns Uniform Local Sales and Use
Law, a City Council may authorize its City Manager or his representative
to audit the sales tax record for the City. This is a very common
practice throughout California.
The purpose of such an audit is to allow the City to understand its
future revenues as well as to insure the City is receiving all of its
sale and tax revenues from the State.

SUBJECT Examination of Local Sales and Use Tax Records
SUMMARY:
In order to effectively projact the City's revenues fcr forthcomina
years, it is necessary to have a better understanding of the City's
sales tax base.
The attached Resolution .,7i.11 authorize the City Planager cr his
representative to audit the sales and use tax transactions which
are collected by the State Board of Equalization. An important
factor to note is that the records are totally confidential and
cannot be released to the general public. (Exhibit 1 - Section
7056, Revenue and Taxation Code).
BACKGROUND:
The information being requested from the State Board of Equal-
ization is authorized under the Bradley -Burns Uniform Local Sales
and Use Tax law. The City has an old resolution on record
authorizina the information to be sent to the City but recent
changes in the law require stricter control of the information;
therefore, the necessity for a new resolution.
INTENDED USE:
As mentioned in the Summary section of this report, staff will
use the sales tax information to make more accurate projections
of revenue as well as other studies needed to understand the
City's financial future. One such study is to determine if the
City is receiving all of its authorized sales tax and if all
individuals are applying for business licenses. The business
license is one of the instruments which causes sales tax to be
returned to the City.

SECTION 7056, REVENUE AND TAXATION CODE
7056. Excepting the information set forth on permits issued
under Article 2 (commencing with Section 6066) of Chapter 2 of
this part, it is unlawful for the board of any person having an
administrative duty under this part to make known in any manner
whatever the business affairs, operations, or any other information
pertaining to any retailer or any other person required to report
to the board or pay a tax pursuant to this part, or the amount or
source of income, profits, losses, expenditures, or any particu-
lar thereof, set forth or disclosed in any return, or to permit
any return or copy thereof or any book containing any abstract or
particulars thereof to be seen or examined by any person. however,
the Governor may, by general or special order, authorize examina-
tion by other state officers, by tax officers of another state,
by the federal government, if a reciprocal arrangement exists,
or by any other person of the records maintained by the board
under this part. The information so obtained pursuant to the
order of the Governor shall not be made public except to the
extent and in the manner that the order may authorize that it be
made public.
When requested by resolution of the legislative body of any
county, city and county or city, the board shall permit only duly.
authorized officer or employee of such county, city and courity,
or city, to examine all of the sales and use tax records of the
board pertaining to sales and use taxes collected for the county,
city and county or city by the board pursuant to contract entered
into between the board and the county, city and county or city
under. the Bradley -Burns Uniform Local Sales and Use Tax Law
(Part 1.5, commencing with Section 7200, of Division 2 of the
Revenue and 'Taxation Code). Information obtained by examination
of board records as herein permitted shall be used only for pur-
poses related to the collection of local sales and.use taxes by
the board pursuant to the contract.
When requested by resolution of the legislative body of a
district the board shall permit any duly.authorized officer or
employee of such district to examine the records of the board
pertaining to transactions and use taxes collected for the dis-
trict by the board pursuant to contract entered into between the
board and the district. Information obtained by examination of
the board records as herein permitted shall be used only for
purposes related to the collection of district transactions and
use taxes by the board pursuant to the contract.
Successors, receivers, trust =ees, executors, administrators,
assignees, and guarantors, if directly interested, may be given
information as to the items included in the measure and amounts
of any unpaid tax or amounts of tax required to be collected,
interest and penalties.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AUTHORIZING EXAMINATION OF SALES AND USE TAX RECORDS

CITY CLERK
WHEREAS, pursuant to Ordinance 12, the City of Saratoga
entered into a contract with the State Board of Equalization to
perform all functions incident to the administration and collections
of local sales and use taxes; and
WHEREAS, the City Council of the City of Saratoga deems it
desirable and necessary from time to time for a representative of
the City to,audit for and in its behalf the sales and use tax
transactions and collections that are made for the City by the
State Board of Equalization; and
WHEREAS, Section 7056 of the Revenue and Taxation Code of
the State of California states in part that the Board shall permit
--
any duly authorized officer, or employee of such city, to examine
all of the sales and use tax'records of the City;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SARATOGA
HEREBY RESOLVES AS FOLLOWS:
SECTION 1 That the City Manager, or any designated nated assistant or
employee of such officer, is hereby appointed to represent the City
of Saratoga with full authority to investigate and review-sales
and use tax transactions and collections for the City, contained in
t
the records of the State Board of Equalization.
SECTION 2. That as provided in Section 7056 of the Revenue and

Taxation Code, the information so gained by the City Manager or
any designated assistant or employee of such officer shall be used
only for purposes related to the collection of local sales and use
taxes by the Board pursuant to the contract.
The above and foregoing resolution was passed and adopted
by the City Council of the City of Saratoga at a regular meeting
