At the May 6, 1981 meeting, City Council adopted Resolution No. 1004 -C, a
Resolution of Intention setting time and place of .the Public Hearing for the
above district. The Public Hearing for the District is scheduled for 8:00 p.m.,
Wednesday, June 3, 1981.
Recommendation
Upon closing the Public Hearing, adopt Resolution NO 1004 -D, "A Resolution
Overruling Protests, Ordering Improvements and Confirming the Diagram and
Assessments."
Fiscal Impacts
The costs for the administration, maintenance and servicing and lighting costs
are charged to the various zones within the district based on benefit received.
The Santa Clara County Assessor's Office will collect the amounts through the
taxes and, in turn, send to the City.

WHEREAS, on April 15 19 81, the City Council
of the City of Saratoga , California, pursuant to the
provisions of the Landscaping and Lighting Act of 1972 adopted its
Resolution No. 1004 , describing improvements and directing
preparation of Engineer's Report for Fiscal Year 1981 -1982, more
particularly therein described.
WHEREAS, said Resolution No. 1004 directed the Director
of Public Works to prepare and file a report presenting
plans and specifications for the proposed improvements, an estimated
of the costs, a diagram for the assessment district, and an
assessment of the estimated costs of the improvements upon all
assessable lots or parcels within the assessment district, to which
Resolution reference is hereby made for further particulars.

And I do hereby assess and apportion said portion of said
total amount of the costs and expenses of said construction and
installation of the improvements including the maintenance and
servicing thereof and the costs and expenses incidental thereto upon
the several lots, pieces or parcels or portions of lots of land
liable therefor and benefited thereby, and hereinafter numbered to
correspond with the numbers upon the attached diagram, upon each,
severally and respectively, in proportion to the benefits to be
received by such lands respectively, from the construction and
installation of the improvements and maintenance and servicing
thereof and more particularly set forth in the list hereto attached
and by reference made a part hereof.
As required by said Act, a diagram is hereto attached
showing the assessment district and also the boundaries and
dimensions of the respective lots or parcels of land within said
assessment district as the same existed at the time of the passage
of said Resolution No. 1004
Said assessment is made upon the several lots or parcels
of land within said assessment district in proportion to the
estimated benefits to be received by said lots or parcels
respectively, from said construction and installation of the
improvements and maintenance and servicing thereof. The diagram and
assessment numbers appearing herein are the diagram numbers
appearing on said diagram, to which reference is hereby made for a
more particular description of said property.
I hereby place opposite the number of each lot or parcel
of land assessed the amount assessed thereon and the number of the
assessment. Each lot or parcel of land is described in the
assessment list by reference to its parcel number as shown on the
assessor's maps of the County of Santa Clara for the Fiscal
Year of 1981 - 19 82to the right of the parcel numbers and includes
all of such parcel.

-RULES FOR SPREADING ASSESSMENT -
I. Administrative Costs
The assessment for administrative costs for this district shall
be spread equally among all of the lots, pieces and parcels of
land located and benefited in each zone of the district and as
shown on the Assessment Diagram.
II. Assessment by Zone
A. Zone 1: The assessment for cost of repairs, maintenance and
services in Zone 1, as described in Resolution No.1004, shall
be spread equally among all of the lots, pieces and parcels
.of land located and benefited within said Zone 1 of this dis-
trict and as shown on the Assessment Diagram.
B. Zone 2: The assessment for cost of repairs, maintenance and
.services in Zone 2, as described in Resolution No.1004, shall
:be spread equally among all of the lots, pieces and parcels
of land located and benefited within said Zone 2 of this dis-
trict and as shown on the Assessment Diagram.
C. Zone 3: The assessment for cost of repairs, maintenance and
services in Zone.3, as described in Resolution No.1004, shall
be spread equally among all of the lots, pieces and parcels
of land 'Located and benefited within said Zone 3 of this dis-
trict and as shown on the Assessment Diagram.
D. Zone 4: The assessment for cost of repairs, maintenance and
services for street lighting in Zone 4, as described in Reso-
lution No.1004, shall be spread equally among all of the lots,
pieces and parcels of land located and benefited within said
Zone 4 of this district and as shown on the Assessment Diagram.
E. Zone 5: The assessment for cost of repairs, maintenance and
services for street lighting in Zone 5, as described in Reso-
lution No.1004, shall be spread equally among all of the lots,
pieces and parcels of land located and benefited within said
Zone 5 of this district and as shown on the Assessment Diagram.
F. Zone 6: The assessment for cost of repairs, maintenance and
services for street lighting in Zone 6, as described in Reso-
lution No.1004, shall be spread equally among all of the lots,
pieces and parcels of land located and benefited within said
Zone 6 of this district and as shown on the Assessment Diagram.
G. Zone 7: The assessment for the cost of repairs, maintenance
and service for street lighting in the commercial area of
Zone 7, as described in Resolution No.. 1004 shall be spread
equally among all of the lots, pieces and parcels of landlo-
cated and benefited within said commercial area of Zone 7 of

The assessment for the cost of repairs, maintenance and services
for street lighting in the residential area of Zone 7, as de-
scribed in Resolution No.1004 shall be spread equally among all
of the lots, pieces, and parcels of land located and benefited
within said residential area of Zone 7 of this district and as
shown on the Assessment Diagram.
H. Zone 8: The assessment for cost of repairs, maintenance and
services in Zone 8, as described in Resolution No.1004, shall
be spread equally among all of the lots, pieces and parcels
of land located and benefited within said Zone 8 of this dis-
trict and as shown on the Assessment Diagram.

DESCRIPTION OF WORK
a) The construction or installation, including the maintenance or
servicing, or both, thereof, within Zones 1, 2 and 3 as herein-
after described, of landscaping, including trees, shrubs,
grass, or other ornamental vegetation, statuary, fountains and
other ornamental structures and facilities, including the cost
of repair., removal or replacement of all or any part thereof,
providing for the life, growth, healtih and beauty of land-
scaping, including cultivation, irrigation, trimming, spraying,
fertilizing or treating for disease or injury, the removal of
trimmings, rubbish, debris and other solid waste, water for the
irrigation of any .landscaping, the operation of any fountains
or the maintenance of any other improvements.
b) The construction or installation, including the maintenance or
servicing, or both, thereof, within Zones 4, 5, 6 and 7, as
hereinafter described, of public lighting facilities for the
lighting of any public places, including ornamental standards,

CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA -1
RESOLVED, by the City Council of the City of Saratoga,
California, as follows:
WHEREAS, on the 15th day of April, 1981, said Council adopted its
Resolution No. 1004, Describing Improvements and Directing Preparation
of Engineer's Report for Fiscal Year 1981 -1982 for the City of Saratoga
Landscaping and.Lighting District LLA -1 Pursuant to the Landscaping and
Lighting Act of 1972, and directed the Director of Public Works to
prepare and file with the Clerk of this City a written report called.
for under said Act and by said Resolution No. 1004;
WHEREAS, said report was duly made and filed with the Clerk of
said City, whereupon said Clerk presented it to the Council for its
consideration;
WHEREAS, said Council thereupon duly considered said report and
each and every part thereof and found that it contained all the matters
and things called for by the provisions of said Act and said Resolution
No. 1004, including (1) plans and specifications of the existing
improvements and the proposed new improvements; (2) estimate of costs;
(3) diagram of the District; and (4) an assessment according to
benefits, all of which were done in the form and manner required by
said Act;
WHEREAS, said Council found that said report and each and every
part thereof was sufficient in every particular and determined that it
should stand as the report for all subsequent proceedings under said
Act, whereupon said Council pursuant to the requirements of said Act,
appointed Wednesday, the 3rd day of June 1981, at the hour of 7:30

follows:
1. That protests against said improvements, including the
maintenance or servicing, or both, thereof, or to the extent of the
assessment district or any zones therein, or to the proposed assessment
or diagram, or to the Engineer's estimate of costs thereof, for Fiscal
Year 1981 -1982 be, and each of them are hereby, overruled.
2. That the public interest, convenience and necessity require
and said Council does hereby order the levy and collection of
assessments pursuant to said Act, for the construction or installation
of the improvements, including the maintenance or servicing, or both,
thereof, more particularly described in said Engineer's Report and made
a part hereof by reference thereto.
• 3. That the City of Saratoga Landscaping and Lighting District
LLA -1 and the boundaries thereof benefited and to be assessed for said
costs for the construction or installation of the improvements,
including the maintenance or servicing, or both, thereof, are situate
in Saratoga, California, and are more particularly described by
reference to a map thereof on file in the office of the Clerk of said
City. Said map indicates by a boundary line the extent of the
territory included in said - District and of any zone thereof and the
general location of said District. .
4. That the plans and specifications for the existing
improvements and for the proposed improvements to be made within the
assessment district or within any zone thereof contained in said
• report, be, and they are hereby, finally adopted and approved.

5. That the Engineer's estimate of the itemized and total costs
and expenses of said improvements, maintenance and servicing thereof,
and of the incidental expenses in connection therewith, contained in
said report, be, and it is hereby, finally adopted and approved.
6. That the public interest and convenience require, and said
Council does hereby order the improvements to be made as described in
and in accordance with said Engineer's Report, reference to which is
hereby made for a more particular description of said improvements.
7. That the diagram showing the exterior boundaries of the
assessment district referred to and described in said Resolution
No. 1004, and also the boundaries of any zones therein and the lines
and dimensions of each lot or parcel of land within said District as
such lot or parcel of land is shown on the County Assessor's maps for
the fiscal year to which it applies, each of which lot or parcel of
land has been given a separate number upon said diagram, as contained
in said report, be, and it is hereby, finally approved and confirmed.
8. That the assessment of the total amount of the costs and
expenses of the said improvements upon the several lots or parcels of
land in said District in proportion to the estimated benefits to be
received by such lots or parcels, respectively, from said improvements,
and the maintenance or servicing, or both, thereof, and of the expenses
incidental thereto, contained in said report, be, and the same is
hereby finally approved and confirmed.
9. That said Engineer's Report for Fiscal Year 1981 -1982 be, and
the same is hereby, finally adopted and approved as a whole.

10. That the City Clerk shall forthwith file with the Auditor of
Santa Clara County the said assessment, together with said diagram
thereto attached and made a part thereof, as confirmed by the City
Council, with the certificate of such confirmation thereto attached and
of the date thereof.
11. That the order for the levy and collection of assessment for
the improve mants and the final adoption and approval of the Engineer's
Report as a whole, and of the plans and specifications, estimate of the
costs and expenses, the diagram, the assessment, as contained in said
.Report, as hereinabove determined and ordered, is intended to and shall
refer and apply to said Report, or any portion thereof, as amended,
modified, revised or corrected by, or pursuant to and in accordance
with.any resolution or order, if any, heretofore duly adopted or made

Parcel No. 517- 11 -66, Assessment No. 66 and Assessor's Parcel No.
517- 11 -67, Assessment No. 67, will not be benefited by said
improvements and said assessments should be reduced to zero.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED, as
follows:

SUBJECT: Notice of Completion - Phase II Hakone Garden Restoration
Issue Summary
The City Council awarded a contract on September 3, 1980, to Lenox Design and Construction
Company for Phase II Restoration at Hakone Garden. Phase Ii included the Upper House,
the Pavi'llion and all platforms, the main gate, the bridge, fences and dry garden. The
contract called for work to be performed on a time and materials basis, plus 15% overhead,
with costs not to exceed $92,600 and the project to be completed within 180 days. The
Phase II Restoration of Hakone Garden is now completed.
Recommendation
Approve the Notice of Completion for the contract with Lenox Design and Construction
for Phase II Restoration of Hakone Garden.
Fiscal Impact
The final estimate for Phase II Restoration was $92,600. Not only has Lenox Design and
Construction done an outstanding job of the work performed, but they have completed the
Project for an amount less than final estimate. Total cost of Phase II Restoration was
$74,444, providing the City with a savings of $18,000.

On May 20, 1981, the City Council upheld the appeal of Cheriel Jensen
regarding the proposed two -story structure. Council directed the applicant
to lower the roof over the garage area of the dwelling.
Summary of Staff Report:
1. Staff met with Architectural Review Committee May 26, 1981.
2. A.R.C. came up with two options to lower height:
a. Use Mansard roof.

SUBJECT' A -759, Danny Ray, Quito Road
At its meeting of May 20, 1981, the City Council upheld the
appeal of Cheriel Jensen regarding the construction of a two -
story dwelling. The Council indicated that the roof over the
garage should be lowered and directed Staff to contact the
Architectural Review Committee (A.R.C.) to explore how the roof
could be lowered.
On May 26, 1981 the Architectural Review Committee reviewed the
plans originally proposed by the applicant and suggested two
options:
1. Utilization of a mansard type roof.
2. Reduce the size of the garage storage area, thus lowering
the roof while keeping at the same pitch. A second hip
roof section could also be added to the rear of proposed
dwelling to cover the area that would not be reduced.
In initial discussions with the applicant, he has indicated a
preference for the first option. The applicant will prepare
revised plans to illustrate the visual impact of Option #1.

Proposed in Saratoga Sphere of Influence
BACKGROUND REPORT
The owner of two parcels (a total of S.S acres) seeks annexation
to Sanitation District No. 4. The larger parcel and existing
dwelling unit are in Monte Sereno's urban service area; the
smaller adjacent parcel is within the part of Saratoga's sphere
of influence which was removed from the urban service area on
June 13, 1979 at Saratoga's request and with LAFCO's unanimous
concurrence.
The 1979 action was the removal of 149 acres of steeply - sloping
hillside land from Saratoga's unincorporated southeast urban
service area. A City study and a subsequent County environmental
analysis determined that the area was not suited for urban
development.
The study was originally prompted in 1978 by a request to annex
the Littlebrook Drive area to the Sanitation District, facilitat-
ing development of some large parcels with Limited access. A
petition from area residents opposed the annexation. The parcel
proposed for annexation in this current application adjoins on
the east the parcels which would have been serviced by this prior
annexation request.
Saratoga's request for, removal of the 149 acres from the urban
service area was based on the conclusion that urban development
would cause adverse environmental and fiscal impacts. The area
is fire hazardous,''the water supply is inadequate, major road
and drainage improvements would be needed, and there would be
potential contamination of existing streams. Whereas the pre-
dominant soil types pose severe limitations for septic tanks,
the constraints of the topographic and geologic characteristics
of the area make extension of sewers unwise.
LAFCO supported the City's contention that it could not provide
services to the area and that urban development was not suitable;
it was also determined that Saratoga's urban service area was

larger than LAFCO's policies could endorse. The County subsequent-
ly rezoned the area from RHS to RHS -20s (minimum lot size of 20
acres).
The attached map indicates the pre -1979 and the current urban
service areas for Saratoga. The unincorporated area adjacent to
Saratoga and Monte Sereno which is presently in the Sanitation
District is shown. The parcels proposed for annexation to the
district are apparent.
RECOMMENDATION
Council should direct Staff to send a letter to LAFCO, stating
that the City opposes the inclusion of the parcel which lies
within Saratoga's sphere of influence in the Sanitation District
boundaries. Monte Sereno has no objection to the extension of
sewers to the existing dwelling unit in their urban service area;
if that is approved by LAFCO, it should be with the understanding
that it is only to service an existing dwelling and not to facilitate
development of lands within Saratoga's sphere.

The proposed annexation to Sanitation District No. 4 in-
volves 5.5 acres. The parcels are located off Oakridge
Road in the steep slopes of the Santa Cruz mountains which
form the backdrop to Monte Sereno, Los Gatos and Saratoga.
The annexation would connect existing dwelling unit
to sanitary sewers and would allow the addition of one single -
family residence. The application was submitted as cat-
egorically exempt from CEQA.
Planning Department's research of this project has brought
to light the fact that the territory is split between the
sphere of influence of Monte Sereno and Saratoga. Although
Monte Sereno has indicated they do not object to the annex-
ation to the Sanitabon District comments to date have not
been received from Saratoga. The parcel within the Saratoga
sphere of influence was removed from the city's urban service
area in 1979. The City of Saratoga felt that this parcel
was inappropriately included in the urban service area since
service extension to the area was very difficult due to slope
and environmental constraints. Planning staff feels that
the categorical exemption, therefore, is unwarranted due to
(an. f the impacts on this environmentally sensitive hillside area.
t is staff's recommendation that this matter be continued
o the July 1 meeting in order to allow the City of Saratoga
opportunity to comment and to allow time for preparation
an initial study.

ARTICLE II OF CHAPTER 9 OF THE SARATOGA CITY
CODE, CREATING COMMERCIAL LOADING ZONE ON BIG BASIN P:A"
The City Council of the City of Saratoga does hereby ordain as
follows:
SECTION 1: The following described street and area thereof, hereby
being declared to be a congested area designated as a
commercial loading zone: Section 9 -18, Article II, Chapter 9 of the
Saratoga City Code is hereby amended by adding thereto the following,
as a commercial loading zone:

competent jurisdiction to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance. The City Council of
the City of Saratoga hereby declares that it would have passed this or-
dinance and each section, sub - section, sentence, clause and phrase thereof,
irrespective of the fact that any one or more sections, sub - sections,
sentences, clauses or phrases be held invalid or unconstitutional.
SECTION 4: This ordinance shall be in full force and effect thirty
(30) days after date of its passage and adoption.
