RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
APPROVING BUILDING SITE OF Mark Allen
The City Council of the City of Saratoga hereby resolves as
follows:
SECTION 1: The 0.276 acre parcel shown as Lot #20 on the Tract
Map 1756 recorded in Book 73 of Maps at Page 31 and submitted to
the City Engineer, City of Saratoga, be approved as one (1)
individual building site.
The above and foregoing resolution was duly and regularly intro-
duced and passed by the City Council of Saratoga at a regular
meeting held on the 19thday of October

across the street from the subject site. The residence to the east is set deeper into
the lot than the subject residence. To the west, is a single story residence. The Sara-
toga Creek riparian area separates the subject site from homes to the rear.
ADDITIONAL CONCERNS OR COMMENTS: Staff has no concerns with the building site approval
application nor do the responsible agencies.
BUILDING SITE APPROVAL
PROJECT STATUS: Said project complies with all objectives of the General Plan, and all
requirements of the Zoning and Subdivision Ordinances of the City of Saratoga.
The housing needs of the region have been considered and have been balanced against the
public service needs of its residents and available fiscal and environmental resources.
A Categorical Exemption was prepared relative to the environmental, impact of this project,
if- approved under this application. Said determination date: August 19, 1983
The Staff Report recommends approval of the tentative map for SDR -1550 (Exhibit "B" filed
August 11, 1983) subject to the following conditions:
I. GENERAL CONDITIONS
Applicant shall comply with all applicable provisions of Ordinance No. 60, in-
cluding without limitation, the submission of a Record of Survey or parcel map;
payment of storm drainage fee and park and recreation fee as established by
Ordinance in effect at the time of final approval; submission of engineered im-
provement plans for any street work; and compliance with applicable Health.Depart-
ment regulations and applicable Flood Control regulations and requirements of the
Fire Department. Reference is hereby made to said Ordinance for further parti-
culars. Site approval in no way excuses compliance with Saratoga's Zoning and
Building Ordinances, nor with any other Ordinance of the City. In addition
thereto, applicant shall comply with the following Specific Conditions which are
hereby required and set forth in accord with Section 23.1 of Ordinance No. 60.
11. - SPECIFIC CONDITIONS -- PERMIT REVIEW-DIVISION "
A. Design Review Approval required on project prior to issuance of permits.
B. Prior to issuance of building permits, individual structures shall be re-
viewed by the Permit Review Division to evaluate the potential for solar
accessibility. The developer shall provide, to the extent feasible, for
future passive or natural heating or cooling opportunities on /in the sub-
division /building site.
III. COMMENTS
A. Tree removal prohibited unless in accord with applicable City Ordinances.

PROJECT CONSIDERATIONS:
Setbacks, Height and Floor Area: The proposal complies with setback, height and imper-
vious coverage requirements for the zone. The proposed floor area is slightly more than
the 3,500 sq. ft. standard for the zone, which is mitigated by the lot size also being
larger than the 10,000 sq. ft. standard for the zone.
Privacy Impacts: The request is for a 531 sq. ft. 2nd story addition over an existing
garage. There is only a single opaque glass window on the right side yard elevation and
windows on the front and rear elevations are not a problem for adjoining residences.
FINDINGS:
1. Interference with Views and Privacy
The proposal would not interfere with the views or privacy of adjacent residences as
no viewsheds are impacted and there are no windows proposed which have a privacy
impact.
2. Preserve the Natural Landscape
The proposal does not require tree removal or significant grading.
3. Excessive Bulk and Compatible Bulk and Height
Cw
The proposal is similar to other two -story residences in the neighborhood and does
not appear bulky due to the location of adjoining structures and the roofline on the
front elevation. It will not impair the solar access of adjoining properties.
RECOMMENDATION: Staff recommends approval per the staff report dated 9/22/83 and Exhibits
"B and C ". -

SUBJECT: SEAL COATING OF CERTAIN CITY STREETS
Issue Sunrary
The contract involved the surfacing of certain city streets with a
single course of "oil and screening ". The contractor, McCarthy &
Spiesman has completed the project. The Engineer's Estimate was
for $70,404.11. The final cost is $81,080.72 which reflects the
actual amount of materials used.
Recommendation
Approve final acceptance and file Notice of Completion.
Fiscal Impacts
$81,080.72 from the Gas Tax Construction and maintenance fund.

SUBJECT.- Approval of Memorandum of Understanding with the Santa Mara
Valley Chapter American Red Cross
Issue Summary: Under Federal law, the Red Cross is mandated to undertake
activities for the purpose of mitigating the suffering caused by natural
disasters and other emergencies. The City's Emergency Serviced Coordina-
tors have determined that-the City of Saratoga does not have a current '
written agreement with the Red Cross to provide relief assistance in
accordance with Red Cross established policy, procedures and guidelines.
The attached agreement,which is the standard form in use with other cities
and counties, will formalize the respective roles and responsiblities of the
Red Cross and the City in disaster preparedness' planning and operations.
Recommendation: Approve the Memorandum of Understanding between the Santa
Clara Valley Chapter of the American Red Cross and the City of Saratoga;
authorize the City Manager to execute the agreement on behalf of the City.
Fiscal Impacts : The only cost to the City would be payment of staff
salaries and benefits during both possible preparedness training by the
Red Cross, and during operational assignments. Since under the rules of
the California Emergency Council, all state, regional and local govern-
ment employees become disaster workers, this would not likely be an
increase over the cost to the City without the agreement.

MEMORANDUM OF UNDERSTAIv'DING
BETWEEN THE
SANTA CLARA VALLEY CHAPTER
AMERICAN RED CROSS
AND THE
CITY OF SARATOGA
1. PURPOSE
A. To recognize the respective roles and responsibilities of the
American Red Cross (Red Cross) and the City of Saratoga
in disaster preparedness planning and operations for natural
disaster, (fires, floods, earthquakes, windstorms, explosions,
etc.) or chemical accidents and other emergencies.
B. To serve as a basis for mutual understanding and collaboration
by.which the resources of the Red Cross and the City can be most
effectively brought to bear for the relief of all persons affected
by the above types of disasters.
C. To reaffirm that the Red Cross and the City will discharge their
respective responsibilities as described in the State of California
Emergency Plan and as the Red Cross is mandated to do by Congressional
Charter.
II. LEGAL BASIS FOR OPERATIONAL RELATIONSHIPS
A. The Red Cross is mandated by Federal law as defined in 36 USC -5 to
undertake activities for the purpose of mitigating the suffering
caused by natural disasters and other emergencies. The Red Cross
does not have the power to surrender the mandate created by its
Congressional Charter. This responsibility has been restated in
the Federal Disaster Relief Act of 1974 (Public Law 93 -288).
B. City responsibilities derive from the State of California Emergency
Services Act and the Saratoga Municipal Code, Chapter 5.
III. ROLE OF TBE RED CROSS
A. In all natural disasters and other emergencies, the Red Cross
provides relief assistance in accordance with its established
policy, procedures and guidelines.
B. The Red Cross response in disasters does not require a government
declaration of any type. Regardless of the size of the disaster
or the number of families affected, all assistance will be provided
on a uniform basis. All Red Cross assistance to disaster victims
is an outright gift. No payment is ever required or requested and
no Red Cross disaster supplies are ever sold.
C. In time of major disasters or other emergencies, Red Cross recognizes
the City as a resource for staff whose skills are readily adaptable
to Red Cross relief assistance programs.

D. Red Cross will provide training for the City staff who may be assigned
to Red Cross disaster operations.
IV. ROLE OF THE CITY
A. The City recognizes that in time of natural disasters the Red Cross
has the primary responsibility for meeting urgent and emergency needs
of disaster victims by providing food, clothing, shelter in
congregate care or other facilities, welfare registration and
inquiry, and other basic elements for human comfort and survival.
B. The City will coordinate the capabilities of its departments to
respond to disasters of all types.
C. The City will continue to provide usual public assistance services
during a disaster situation or a declared emergency.
D. The City will provide needed staff, as available, to assist Red Cross
in disaster operations. City staff may also be given time off to
participate in Red Cross training courses. Staff salaries and benefits
will be provided by the City to its staff in both preparedness
training and operational assignments.
E. In the event of an officially declared state of emergency, and
pursuant to the rules and regulation of the California Emergency
Council, all state, regional, and local government employees will
become disaster workers; duties may include support of Red Cross.
V. ADMINISTRATIVE AND FINANCIAL CONTROLS
It is basic Red Cross policy that administrative and financial control
of its disaster related services cannot be delegated or assumed
by others. Individuals and organizations, including government,
cannot represent Red Cross without prior agreement with and approval
by Red Cross.
VI. OTHER FUNCTIONAL RELATIONSHIPS
A. The Red Cross has agreements with a number of United States government
agencies, including the U.S. Department of Defense, for the obtaining
and shipment of essential equipment and personnel to supplement
emergency operations.
B. The Red Cross may enter into contracts with public and private agencies,
on a reimbursable basis, to provide Red Cross support in rendering
assistance to victims in emergency situations.
C. The Red Cross will support to the best of its ability, governmental
efforts to alleviate suffering in war caused disaster situations.

either party gives notice to the other party that it desires to

The one (1) year maintenance period for SDR 1472
has expired and all deficiencies of the improvements have been corrected.
Therefore, I recommend the streets and other public facilities be accepted
