SUBJECT: Resolution Opposing Recent Redistricting Legislation Issue Summary Council received copy of resolution similar to attached.resolution passed by City of Los Altos. Councilmember Mallory requested item be agendized. Reapportionment follows decennial census. The most recent reapportionment resulted in the configurations shown on the maps attached. Such configurations are objectionable for reasons stated in resolution. Recom;nendation Adopt resolution. Fiscal Impacts None. Exhibits /Attachments Resolution. Reapportionment maps. Council Action 11/18: Mallory/Watson moved to adopt resolution amending it to say in place of the paragraph regarding the registered voters to sign petitions, we encourage the legislature to set up a bipartisan commission to deal with redistricting. Passed 4 -1 (Jensen opposed). RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA OPPOSING RECENT REDISTRICTING LEGISLATION WHEREAS, the residents of Santa Clara County should have State Senate, Assembly, and Congressional Districts which respect communities' interests; and WHEREAS, said Districts should be compact so as to enhance the ability of legislators to better represent, communicate with, and provide service for these districts' respective constituents; and WHEREAS, the redistricting bills passed by the California Legislature blatently disregard the above criteria by establishing districts which are geo- graphically far - flung, and which, in the case of the current 10th and 12th State Senate Districts, do not even grant many of the residents of these districts representation for two years; NOW, THEREFORE, BE IT HEREBY RESOLVED that the City Council of the City of Saratoga does protest the State Senate, Assembly, and Congressional redistrict - ing as passed by the California Legislature as not being in the best interests of the residents of the City of Saratoga and the County of Santa Clara; BE IT FURTHER RESOLVED that the City Council of the City of Saratoga urges all registered voters within the City of Saratoga and the County of Santa Clara to sign petitions that are currently being circulated which oppose the redistrict- ing. Hd. C. Atty. C. Mgr. Issue Summary n response to City Council discussion of this matter, the following information is pro- vided. The City Code, Section 8 -72 requires a City issued permit for the cutting down/ removal of any tree measuring forty (40) inches or more in circumference at a point twenty -four (24) inches above grade. Section 8 -75 sets the conditions necessary for the issuance of a tree removal permit. 1. Condition of tree with respect to disease, danger of falling. 2. Location of tree with respect to proposed improvements unreasonably restricts the economic enjoyment of the property in question. The reporting /complaining neighbor did inform Mr. Kraja that a permit was needed, from the City, prior to actual cutting down of the trees in question. Therefore, it appears, Mr. Kraja did know of the City required permit, but cut them down anyhow. The "Tree Preservation Ordinance" does not set a fine schedule for its violation. Of course it is a misdemeanor to violate any section of the City Code. The City has been using the formula set by various arboricultural associations to attach a montetary value to trees. This formula was developed for situations such as this. It was felt, several years ago, this formula would be best to establish tree value since; in the past, some beautiful trees have been cut illegally down. This problem /violation comes up several times a year. The City is usually informed, of this violation, by a concerned neighbor. This ordinance has been enforced: the Arrillaga's on Beaumont Avenue, Lee's Tree Surgeons, the Chong's on Chiquita Way, the Warrings on Sobey Road, and the Bondi's on Bondi Court. Recommendation The reporting - neighbor insists that Mr. Kraja cut down the two trees fully aware that a City permit was required. Therefore, it is recommended the full amount of $1,582.00 be enforced. However, another option would be to treat this as a misdemeanor and fine Mr. Kraja $500. In any event the City Code should be enforced. These were mature street trees and their removal. has left a gap in the overall atmosphere of the immediate area. SUBJECT: Housing and Community Development Act, Revised 1982 -85 Joint Powers Agreement and Acknowledgement Resolution Issue SuTmry At their regular meeting of October 21, 1981 the City Council took action to rescind the previously authorized 1982 -85 HCDA Joint Powers Agreement and Acknowledgement Resolution, so as to include in a revised SPA, recent (1981) amendments made by Congress to the Act. Subsequent to meetings of participating city City Managers, HCD City and County staff and direction agreed to by the HCD Council Committee, the attached, revised JPA has been drawn by county counsel at the direction of the Board of Supervisors. Reconmendation • Approve attached Joint Exercise of Powers Agreement and Cooperation Agreement to undertake or to assist in the undertaking of essential activities pursuant to title of the Housing and Community Development Act of 1974, as amended; and • Adopt Resolution No. acknowledging execution of the Joint Powers Agreement and authorizing the Mayor execute said Agreement; and # Review and comment on proposed projects and their priority, as assigned by staff for HCDA activities to be carried out during FY 1982 -83. Fiscal Impacts The revised JPA provides 50% of net Block Grant Funds to participating cities and the County to be used for any eligible purpose under the Act vs. the previously proposed 35% which was to be used exclusively for housing activity including housing rehabilitation. Under the currently proposed JPA, the remaining 50% of net funds would be open for competition to all eligible applicants, for housing purposes only, including rehabilitation. It is estimated, using this years grant amount minus 10% (budget cut to the National HCDA) and subtracting city and county program administration that Saratoga's share of the 50 %, guaranteed of "non - designated funds" as defined in the JPA, shall be approximately $187,500. The city still has the ability to compete for funds in the 50 %, housing category. S SUBJECT: Report from Library Commission ------- Re: Sunday— Hours— for_ Saratoga — Community _Library ----------- - - - - -- Issue Sun-nary During the October 7, 1981 City Council Meeting, the Council requested the Library Commission to examine the feasibility of expanding hours at the Community Library with special attention to the possibility of opening on Sundays. The Council also requested County Librarian, Barbara Campbell to collect some data regarding the potential cost of Sunday openings and figures from other libraries open on Sunday. The report attached is from the Library Commission as a result of a meeting held on October 28, 1981. The Library Commission voted against Sunday openings and voted to spend available funds ($5,909) for books, tapes and other materials for the collection. Recomnendation Review report and recommendations from Library Commission. If Council concurs with Library Commission recommendation, no further action is required. If the Council does not concur the Council should, by motion, direct staff to inform Library Commission and County Librarian of Council's position regarding allocation of funds ($5,909). November 4, 1981 6 1981 To: Mayor Callon and Saratoga City Council From: Saratoga Library Commission Re: Proposal for Sunday Hours for Saratoga Community Library The Saratoga Library Commission, at- their October 28 meeting, voted 4 to 2, with Monte Sereno Commissioner abstaining, against the proposal for Sunday hours at Community Library, and that available funds ($5909) be used for books; tapes and other materials to improve the collection.. The following points werer'dzscussed� 1. Traditionally, the County Library System has not had Sunday hours. Cupertino Library is.the only one in.*the System that is open on Sundays, (12 -4).. The City of Cupertino subsidizes these hours. ri?nertino =`ZS a Central .. Library... Saratoga is not. Sunday patrons-are primarily Cupertino and San Jose citizens.' Only four Saratoga residents used this facility on Sundays between`September 13 and October 18.(Exhibit 3) 2. West Valley College Library is open on Sundays (1 -4) and is open to the public. This library is less than a mile from Community and Cupertino'Library is four miles. These distances are immater- ial as almost all residents using Community Library drive. 3. Sunday staffing would be difficult (Cupertino finds it to be) and the Sunday staff would not be the regular staff. 4. Adding hours while funds are shrinking appears ill advised. The funds available (Exhibit 1) are a one time windfall due to (a) a vacancy at Village filled by a back -up (substitute) staff (b) and savings in delay of Thursdays evening opening. 5. Additional services already committed to Community are: (a) Thursday evening hours and (b) additional staff, which means additional services. 6. Funds for books and other tangible materials have been greatly reduced, $7000 since 1977 -78. Inflation has cut the number of books purchased. (Exhibit 4) 7. It is possible some Saratogans would use the library on Sundays. (Family recreation, employed, seniors) However, The Community Library is open'sii days each week and four evenings. These hours should accommodate all residents. Most public buildings are open five days each week. 8. It would appear to be poor public relations to have Sunday hours for a short period and to be forced to close when funds are depleted. There is no prospect for increased funding in 1982 -83. A library is books...not hours. Capi6Eell Saratoga Library Commission County Librarian SUBJECT DATE REPORT ON SUNDAY SERVICE AT CUPERTINO 0/29/81 As you requested, I am forwarding a copy of the latest report on Sunday library ser- vice at Cupertino, with the following explanations and comments: I. Explanation of the Report: A. Meter Reading. The counter which is attached to the security system reports the number of times the bar is pushed on exit. Cupertino has two entrances, but one exit, so this is a full count. It does not count accurately when a whole family exits with one push of the bar, so this figure would be lower than the actual number of persons. B. Library Cards Issued9 The S listed is for Saratoga. Apparently a comment was made to the Cupertino City Manager about the use of the Cupertino Library by residents of Saratoga, and he. requested that we keep track. C. Circulation. The Res. count refers to all County Library service area residents. N -R are residents of the other cities in South Bay Cooperative, etc., of which the largest number are from San Jose. D. The S figure showing items checked out is -for Saratoga, and is part of the Res. count shown in the report. II. As I reported to you last evening, the figures do not show any extensive use of the Cupertino Library on Sundays by Saratoga residents, but Janice Yee reminded me this morning that we have not advertised the Sunday opening to any extent out- side of the Cupertino region. Sunday service is normally very popular and successful in libraries where it is offered. I appreciate the very difficult decision on this matter which the Library Commis- sion faced. The funds available ($5,909) come from essentially one -time sources: the fact that we did not begin Thursday night service until September 17, and that we had a vacancy at the Village Library which we filled with back -up staffing has resulted in some salary savings. There is no question that we have every reason to expect difficult funding pro - blems for next fiscal year. The problems of financing at the state level, from which we receive about forty -five percent of our funding,.appear serious.
