ANNOUNCEMENT OF CLOSED SESSION CONFERENCE WITH LABOR NEGOTIATORS (Gov't Code Section 54957.6) A. Employee organizations: Northern California Carpenters Regional Council, Carpenters Forty Six Counties Conference Board Agency designated representatives: Deanna Mouser, Monica LaBossiere, and /or Dave Anderson CONFERENCE WITH LEGAL COUNSEL ANTICIPATED LITIGATION Significant exposure to litigation (Government Code section 54956.9 (b): 1 case CONFERENCE WITH LEGAL COUNSEL ANTICIPATED LITIGATION Initiation of litigation (Government Code section 54956.9(c): 1 case The City Council adjourned Closed Session at 6:00 p.m. and called the Joint Meeting with the Saratoga Chamber of Commerce to order in the Administrative Conference Room. SARATOGA REGULAR CITY COUNCIL MEETING JANUARY 18, 2012 Mayor Page called the meeting to order at 7:08 p.m. and led the Pledge of Allegiance. ROLL CALL PRESENT Council Members Manny Cappello, Howard Miller, Emily Lo, Vice Mayor Jill Hunter, Mayor Chuck Page ABSENT: None ALSO PRESENT: Dave Anderson, City Manager Richard Taylor, City Attorney Crystal Morrow, City Clerk John Cherbone, Public Works Director Mary Furey, Finance and Administrative Services Director James Lindsey, Community Development Director Michael Taylor, Recreation and Facilities Director Monica LaBossiere, Human Resource Manager Michael Fossati, Planner Adam Henig, Recreation Supervisor REPORT OF CITY CLERK ON POSTING OF AGENDA City Clerk Crystal Morrow reported that pursuant to Gov't. Code 54954.2, the agenda for this meeting was properly posted on January 12, 2012. REPORT FROM CLOSED SESSION City Attorney Richard Taylor shared that there was nothing to report from Closed Session. ORAL COMMUNICATIONS ON NON- AGENDIZED ITEMS Ron Hills addressed the Council and asked that the Council revise the definition of impervious and pervious surfaces in the City Code. Scott Anderson, Saratoga Chamber of Commerce President, summarized the Chamber's joint meeting with the Saratoga City Council. Mr. Anderson shared the Chamber's objectives for the year ahead and announced that the Chamber would continue holding the Wednesday MarketPlace and has planned to hold a Spring Wine Stroll, Classic Car Show, Celebrate Saratoga, and Holiday Village Open House. COUNCIL DIRECTION TO STAFF Council Member Miller and Council Member Cappello requested that discussion on the definition of impervious and pervious surfaces by added to a future City Council agenda. ANNOUNCEMENTS Council Member Miller announced that Santa Clara County's first Express Lane will open on February 27, 2012 on the State Route 237 connector to Interstate 880. Council Member Miller also shared that there is still space in the Saratoga Recreation and Facilities Department oil painting class for children. Information about available classes can be found in the Saratoga Recreation Activity Guide or on the City of Saratoga website. Council Member Lo informed the Council that there will be a Chinese New Year Celebration on January 28, 2012 at the Joan Pisani Community Center from 11:00 a.m. to 3:00 p.m. Vice Mayor Hunter announced that Saratoga Love Notes will be posted on the windows of Village businesses. Mayor Page shared that the City is accepting applications for 2 openings on the Heritage Preservation Commission and 1 opening on the Traffic Safety Commission. Mayor Page added that one of the openings on the Heritage Preservation Commission must be filled by a nominee of the Saratoga Historical Foundation. CEREMONIAL ITEMS 1. Commendation Honoring Assistant Sheriff Carl Neusel Recommended action: Read and present the commendation honoring Assistant Sheriff Carl Neusel. Mayor Page read and presented the commendation honoring Assistant Sheriff Carl Neusel. 2. Appointment of Youth Commissioner and Oath of Office Recommended action: Adopt the attached resolution appointing one (1) member to the Saratoga Youth Commission and direct the City Clerk to administer the Oath of Office. RESOLUTION NO. 12 -001 MILLER/CAPPELLO MOVED TO ADOPT THE RESOLUTION APPOINTING ONE (1) MEMBER TO THE SARATOGA YOUTH COMMISSION AND DIRECT THE CITY CLERK TO ADMINISTER THE OATH OF OFFICE. MOTION PASSED 5 -0 -0. 3. Saratogan Readership Drawing Recommended action: Randomly draw the name of one person who responded to the Saratogan readership poll and announce the winner. Mayor Page and Youth Commissioner Nihar Agarwal conducted the drawing. Cathy King was selected as the winner of a $50 gift certificate from a Saratoga business of her choice. SPECIAL PRESENTATIONS 4. TeenForce Presentation Recommended action: Watch a short presentation given by John Hogan on TeenForce. John Hogan of TeenForce gave a brief presentation on TeenForce, which helps teenagers between the ages of 13 and 20 gain work experience. Information about TeenForce is available online at http: /www.teenforce.org CONSENT CALENDAR 5. City Council Regular Meeting Minutes for December 21, 2011 Recommended action: Approve minutes. MILLER/HUNTER MOVED TO APPROVE THE MINUTES. MOTION PASSED 5 -0 -0. 6. Review of Accounts Payable Check Registers Recommended action: That the City Council review and accept check registers for the following accounts payable payment cycles: December 15, 2011 December 21, 2011 January 5, 2012 MILLER/HUNTER MOVED TO ACCEPT CHECK REGISTERS FOR THE FOLLOWING ACCOUNTS PAYABLE PAYMENT CYCLES: DECEMBER 15, 2011; DECEMBER 21, 2011; AND JANUARY 5, 2012. MOTION PASSED 5- 0-0. 7. Amended A1ertSCC Participant Agreement Recommended action: Authorize the City Manager to sign: 1. Amended agreement between the County of Santa Clara and participants for use of A1ertSCC, Santa Clara County Regional Mass Notification System; and 2. Amended AIertSCC Policy Manual. MILLER/HUNTER MOVED TO AUTHORIZE THE CITY MANAGER TO SIGN: 1. AMENDED AGREEMENT BETWEEN THE COUNTY OF SANTA CLARA AND PARTICIPANTS FOR USE OF ALERTSCC, SANTA CLARA COUNTY REGIONAL MASS NOTIFICATION SYSTEM; AND 2. AMENDED ALERTSCC POLICY MANUAL. MOTION PASSED 5 -0 -0. 8. Council Resolution to Adopt Memorandum of Understanding for the "UNION" (Northern California Carpenters Regional Council, Carpenters Forty Six Northern California Counties Conference Board And Their Affiliated Local Unions) Recommended action: Adopt the Memorandum of Understanding between the City of Saratoga and the "UNION" (Northern California Carpenters Regional Council, Carpenters Forty Six Counties Conference Board and Their Affiliated Local Unions) July 1, 2011 to June 30, 2015. Council Member Miller removed this item from Consent Calendar. City Manager Dave Anderson noted a correction to the staff report included in the City Council Agenda Packet. Council Member Miller commented on the labor negotiations process and outcomes. City Manager Dave Anderson reviewed the savings that will result from the new Union Memorandum of Understanding. No one requested to speak on this item. RESOLUTION NO. 12 -002 MILLER/HUNTER MOVED TO ADOPT THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SARATOGA AND THE "UNION" (NORTHERN CALIFORNIA CARPENTERS REGIONAL COUNCIL, CARPENTERS FORTY SIX COUNTIES CONFERENCE BOARD AND THEIR AFFILIATED LOCAL UNIONS) JULY 1, 2011 TO JUNE 30 2015. MOTION PASSED 5 -0 -0. PUBLIC HEARINGS 9. 2012 Hazardous Vegetation Program Resolution Declaring Abatement of Public Nuisance Recommended action: Conduct public hearing and adopt resolution. City Clerk Morrow presented the staff report and invited Moe Kumre, Santa Clara County Weed Abatement Program Coordinator, to provide additional information on the Weed Abatement Program. Santa Clara County Weed Abatement Program Coordinator Moe Kumre explained how properties are identified as containing hazardous vegetation and the abatement process and added that he could be reached at (408) 282 -3123 to answer questions about the program, the abatement process, or timing of inspections or abatement. Mayor Page invited public comment on this item. No one requested to speak on this item. RESOLUTION NO. 12 -004 CAPPELLO/MILLER MOVED TO ADOPT THE RESOLUTION DECLARING ABATEMENT OF A PUBLIC NUISANCE AS TO SPECIFIED PROPERTIES CONTAINING HAZARDOUS VEGETATION. MOTION PASSED 5 -0 -0. 10. Appeal of New Wireless Antenna and Associated Equipment Installation Highway 9, North of Farwell Recommended action: Deny the appeal, thus affirming the Planning Commission Design Review approval of the installation of three wireless telecommunication antennas and associated equipment shed. Mayor Page opened the public hearing and invited Michael Fossati to present the staff report. Michael Fossati, Planner in the Community Development Department, presented the staff report and answered Council questions regarding the appeal. Mayor Page invited the appellant, Chang -Yung Tung, to speak. The appellant, Chang -Yung Tung, presented his argument for appealing the Planning Commission approval of the installation of three wireless telecommunication antennas and associated equipment shed. Mr. Tung cited health concerns and proximity of the wireless facility to his home. Mayor Page invited the applicant to speak. James Singleton spoke on behalf of the applicant, Verizon Wireless. Mr. Singleton reviewed changes made to the plans for the wireless antennas and equipment shed to minimize the visual impact of the facility and integrate the facility with the surrounding environment. Mr. Singleton invited Lynn Bruno, Community Relations Director for Hammett Edison, Inc. to answer questions regarding health and safety. Lynn Bruno, Community Relations Director for Hammett Edison, Inc., explained health and safety requirements for the proposed wireless communications facility. Mayor Page invited public comment on this item. The following people requested to speak on this item: Grace Tung spoke in favor of upholding the appeal Barbara Susman spoke in favor of upholding the appeal Jerina Kapoor spoke in favor of upholding the appeal Uday Kapoor spoke in favor of upholding the appeal Terry Snowden spoke in favor of upholding the appeal Al Castellano spoke in favor of upholding the appeal JR Rivers spoke in favor of upholding the appeal Scott Emery asked for clarification regarding the project No one else requested to speak on this item. Mayor Page invited the appellant and applicant to make rebuttals. The appellant, Chang -Yung Tung, thanked his neighbors for their support and questioned health studies done on wireless facilities. The applicant, James Singleton on behalf of Verizon Wireless, urged the Council to uphold the Planning Commission's decision. Mayor Page closed the public hearing. RESOLUTION 12 -003 CAPPELLO /LO MOVED TO DENY THE APPEAL, THUS AFFIRMING THE PLANNING COMMISSION DESIGN REVIEW APPROVAL OF THE INSTALLATION OF THREE WIRELESS TELECOMMUNICATION ANTENNAS AND ASSOCIATED EQUIPMENT SHED. MOTION PASSED 4 -1- 0 WITH HUNTER OPPOSED. OLD BUSINESS None NEW BUSINESS None ADHOC AGENCY ASSIGNMENT REPORTS Mayor Chuck Page West Valley Sanitation District At the last meeting, a new Chair and Vice Chair were selected. Recruitment for a new Director has begun. Vice Mayor Jill Hunter Historical Foundation Hunter reported she was unable to attend the last meeting. KSAR Community Access TV Board Hunter reported she was unable to attend the last meeting. Council Member Emily Lo Library Joint Powers Authority Lo reported that she would be unable to attend the next meeting as it will take place at the same time as the Saratoga Council Retreat. Council Member Howard Miller Valley Transportation Authority PAC Miller reported that the full funding agreement to bring BART to Santa Clara County is before the Congress. Miller noted that VTA bus ridership is up 4 percent. Additionally, the new Express Lane on the 237/880 connector will open February 27, 2012. Council Member Manny Cappello Chamber of Commerce Cappello provided an update on Chamber membership and activities. Additionally, Cappello acknowledged the Chamber's participation in discussions and public meetings on the update of the City's sign ordinance. CITY COUNCIL ITEMS Council Member Miller invited the public to attend the City Council Retreat on January 26, 2012 at the Saratoga Prospect Center.
