PLACE: Oak Street School PPFSENT: Councilmen 'Rrrazil, Jepsexn,Langwill, Rosasco, Williams As t;t1mnorary chairman, Dr. Rosasco cmentd a srecial official meeting of the Saratow: Council by indicqting that a certified cony of the order by the Board of Supervisorn declaring the City of Saratoga incorporated was filed today at 4:30 P.M. with the Secretary of St8te. The tem chalrman, as the first order of business, called for nominations for Aayor, Mr. Langwill nomincited Burton R. Brazil and ther were no further nominations Vote was unanimous for Dre At t! time, Dro3razil assumed his position as Mayor and chairman of the council, A call for nominations for Mayor nr-tem was made and Mr. Jepsen mominated Dr. Rosasco. N(Dmintions were closed. Dr. Rosasco was elected unanimously. Call for nomthattors for acting City Clerk and acting City Administrator v•its made. Dr. Rosasco nomin Franklin C. Bachmar, No further nominations were Tad,. Vote was unanimous. Call for nominations for City Attorney and Denuty City Attorney was made and Mr,Williams nomintei Faber L, Johnston, Jr. as City Attorney and Williim G. Clark as Deputy City Attorrey. No further nominntions were m9de. The vote was unnimous, Mayor Brazil read into the record a lett--r d:ited October 1, 1956, from Mayor Warner M, Wilson of the City of Cupertino congratulating the City Council of Saratoga on the recent incornonittor. -1- Mayor Brazil askd th l! to comment on Insurance coverage for the City, Acing City Clerk stated that a Comprehensive Multiple Liability Policy form which Inclbles Automo- bile and General Liability coverges with the following limits of liability: *100,000 each 7erson (bodily injury); $300,000 each accident (bodily Injury); 410,000 each accident (auto nrcynerty damage); $10,000 each accident (other) prop damage; $25,000 aggregate (other) property damage; had been obtained from the Indemnity Insuranco, Company of North America. The insurance comnany hack been bound on this policy as of 12.01 P.T.7. October 22. 1956. The Council unanimously indicated that the City should continue with the coverage and Instructd the Acting City Clerk to make this arrangement. ORDINANCE 5: "AN ORDINANCE OF THE CITY OF SAHTOGA REGULATING THE ESTABLISHMENT AND DFVELOPMENT OF REAL E:)TATE SUBDIVI- SIONS AND THE SUBDIVIDING OF LAND AND THE ?PPARATION AND A?PROVAL OF SUBDIVISION MAPS AND PRESCRIBING THE FORMS THEREOF AND THE PPO- CEDURE THEREIN" was adopted unanimously by the Council. ORDINANCE #'6: "AN OPrINANCE PROVIDING FOP THF SANITARY DISPOSAL OF SEWAGE IN THE CITY OF SARATOGA, CALIFORNIA" was adonted unanimously by the Council. OROINANCE #7: "AN ORDINANCE FIXING DEPOSITORY OF THE CITY FUNDS AND PRESCRIBING MANNFP OF P DEMANDS :AGAINST TH7 CITY" was adopted uhanimously by the council. ORDINANCE #8: "AN ORDINANCE OF THE CITY OF S,iRATOGA AS TO THE CONTROL OF CANINES, AND DECLAFING AN EMERGENCY, TO TAK EFFECT IMMEDIATELY AND WITH PENALTIES" was adonted unanimously by the Council. Three Ordinances were introduced but not adopted because of rur walting periods. These Ordinances were: 1. An Ordinance of the City of Saratoga electing that duties performed by the City Assessor and City Tax Collector be performed by the County Assessor and County Tax Collector. 2. An Ordin9nce relating to the care of exnenditures of arpriles receive' from the State of California under th rovisions of Article 5, Chapter 1, Division 1. of the Strets and Highways Code. 3. An Ordinance providing Penalties for violation of all orlirances not otherwise specifically provided for, and preacribirg im- Prisonment of all violators in the county jail. RESOLUTION #1 relating to posting ordinances was adopted unanimously by the Council. FESOLUTION #2 relating to the public health was adopted unanimously by the Council.. A STATEMENT OF COUNDARIES ON INCORPORATION OF THE CITY OF SARATOGA was lopted unanimously by the Council. The Acting City Clerk was directed totubmit a copy of the statement to the Board of Eoualization and to the County Assessors office. Pursuant to government code 5022.1 an ordinance was in- troduced proposing to adopt certain provisions of the Santa Clara Code by reference and the title to the same having been read, the clerk was directed to rublish a notice of hearing on same as reluired by law. An agreement relative to the n'I.drformance by the County and City of certain municipal functions including health services, build Inv inspection and pl3nning services was read by the Acting City Clerk. Councilmn JeDsen moved that the agreement be executed by the Mayor and the Acting City Clerk. Motion unanimously adonted. Discussi7)r was then h ccncerntng the establishment of a City Clerk's office. Councilman Langwill moved that the nremises at 20454 Saratoga-Los Gatos Road be established as the City Clerk's office of the City o Saratoga and thAt all official rcor and documents be moved to rremises as soon as same are available; but in the interim, and untfl_ that time.the nremises located at 20776 Reid Earle, which is the residence of the Acting City Clerk, he established as the te.m7 City Clerk's office. This motion was seconded and unanimously crried. -4- Councilman Jepsen offered a resolution appointing Mel Hawley, Sheriff of Santa Clara County, as Acting Chief of Police for the City of Saratoga. The resolution was unanimously adopted. Councilman Rosasco offered a resolution setting the fiscal year of the City of Saratoga as July 1 through June 30. The resolution was unanimously adopted. Councilman Williams offered a resolution that the City of Saratoga adopt a seal of the City and that base of said seal should bJ historical in nature. Resolution was adopted unanimously. Mayor Brazil appointed Councilman Williams and Rosasco as a committee to study the procedures to be used in accenting changes of zoning, zoning variances and permits. Mayor Brazil appointed Councilmen Jepsen and Langwill as a committee to negotiate traffic protection. Mayor Brazil explained, at this point, the reason for the lengthy time spent in the reading and explaining of the new ordinances was to show that the Council in adopting essentially the county ordinances enmas se was keeping promises made during the campaign for incorporation. Mayor Brazil declared that theCounc il, in the future, would entertain grievances or petitions from individuals or groups at each Council meeting. He then inruired as whether there. were any such grievances or petitions to be submitted. There was no response. The Mayor adjourned the greeting at 10 :45 P.M. until the next regular meeting of November 1, 1956. -5
