SUBJECT: 1995/96 BUDGET AMENDMENTS
Recommended Motion(s): Approve resolution amending the Fiscal Year
1995/96 Budget.
Report Summary: Attached is a resolution amending the 1995/96
Budget for the following two contingency transfer items: 1)
transfer to the Financial Management (Program 7074) for an increase
in liability claims and 2) transfer to Scotland /Sunnyvale Ave.
Signalization Project (Project 9605) . Also included with the
resolution are a Budget Resolution Supporting Worksheet and
Resolutions Approved schedule for your consideration.
With respect to the first item, liability claims were under
budgeted for FY 1995/96. Based on information supplied to us by
ABAG, the City's Claim Administrator, we now estimate that the
actual payout for the year will be $30,000.00. Accordingly, a
transfer of $17,500.00 is required.
With respect to the second item, supporting documentation is
attached.
Fiscal Impacts: $200,000 in contingency monies were appropriated
when the 1995/96 Budget was adopted. Accordingly, transfer of
these monies to General Fund programs \projects results in no impact
to the General Fund balance.
Overall appropriations remain unchanged.
Follow Up Actions: None.
Consequences of Not Acting on the Recommended Motions: Outstanding
liability claims can not be paid and the Scotland /Sunnyvale Ave.
Signalization Project can not be implemented.

SUBJECT: Establishment of Capital Project No. 960 Jr- Saratoga
Avenue Traffic Signalization

Pursuant to the City Council's decision made on Tuesday evening to
proceed with the installation of a traffic signal on Saratoga
Avenue at Scotland Drive and Kerwin Ranch Court, this is to request
that you prepare the necessary Resolution and supporting
documentation for the Council to make a supplemental budget
appropriation to fund the project. The Resolution is to appear on
the agenda for the March 20 regular meeting.
The new project should be designated as Capital Project No. 960
Saratoga Avenue Traffic Signalization.
The total project budget is $145,000 of which $115,000 is to come
from General Fund Contingencies, and $30,000 is to come from a
transfer from Capital Project No. 9504 (Fruitvale Ave. /Saratoga
Ave. Intersection Improvements). In effect, Capital Project 9504
will be rolled into Capital Project 9600, and there will no longer
be a Capital Project No. 9504.
A breakdown of expenditures for the new Capital Project 960 is as
follows:

SUBJECT: Final Map Approval for Tract No. 8821 (Nine lots at 20851
Saratoga Hills Rd.), Application No. SD 95 -008 (The
Community Foundation of Santa Clara County)
Recommended Motionfs
1. Move to adopt Resolution No. SD 95 -008 granting final map
approval of Vesting Tentative Map Application No. SD 95 -008 for
nine lots at 20851 Saratoga Hills Road.
2. Move to authorize the Mayor to execute the Subdivision
Improvement Agreement.
3. Move to authorize the City Manager to execute the agreement
waiving the right of the property owner to protest annexation into
a future assessment district formed for the purpose of
undergrounding utilities.
Report Summary:
Attached is Resolution No. ►SD 95 -008 which, if adopted, will grant
final map approval for nine lots located at 20851 Saratoga Hills
Road. I have examined the final map and related documents
submitted to me in accordance with the provisions of Section
14.40.020 of the Municipal Code and have determined that:
1. The final map substantially complies with the approved
vesting tentative map.
2. All conditions of the approved vesting tentative map, as
contained in Planning Commission Resolution No. SD 95 -008,
have been completed or will be completed concurrent with
development of the nine lots.
3. The Subdivision Map Act, the City's Subdivision Ordinance
and all other applicable provisions of law have been
complied with.
4. The final map is technically correct.
Consequently, I have executed the City Engineer's certificate on
the final map and have filed the final map with the City Clerk
pursuant to Section 14.40.040 of the Municipal Code for action by
the City Council.
Fiscal Impacts•
The subdivider has paid $6,964.72 in Engineering fees and $57,120
in Park Development fees required for this subdivision. In
addition, the subdivider has deposited $585,000 into an escrow
account in the City's name, the proceeds of which will be released
to the City upon the upholding of the Tentative Cancellation of the
Williamson Act Contract covering the property.
Follow Up Actions:
The signed map will be released to the subdivider's Title Company
for recordation along with recording instructions. Escrow
instructions have already been issued.
Consequences of Not Acting on the Recommended Motions:
The final map must either be approved or rejected by the City
Council. If the map is rejected, it would be returned to the
subdivider with findings as to why the map was rejected.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
APPROVING THE FINAL MAP OF TRACT 8821 (SD 95 -008)
20851 SARATOGA HILLS ROAD
The City Council of the City of Saratoga hereby resolves as
follows:
SECTION 1: Lots 1 - 9 as shown on that certain map of Tract
No. 8821, prepared by NA Engineering, dated
February, 1996, and filed with the City Clerk of
the City of Saratoga on March 20, 1996, are
approved as NINE (9) individual parcels.
SECTION 2: r All streets and easements shown on said map and
offered for dedication to public use are hereby
rejected on behalf of the public, save and except
for public utility easements; and to the limited
extent that any offers for public street purposes
either expressly or implicitly include offers for
easements for utility purposes along or beneath said
street rights of way, then as to such express or
implied offers of easements for public utility
purposes, the same are hereby accepted on behalf of
the public.
The above and foregoing resolution was passed and adopted by the
Saratoga City Council at a meeting held on the 20th day of March,
1996, by the following vote:

CONTRACT FOR THE IMPROVEMENT OF SD 95 -008
AGREEMENT, made and entered into this day of
1996, by and between the CITY OF SARATOGA, a Municipal corporation
of the State of California, hereinafter called "City ", and The
Community Foundation of Santa Clara County, subdivider and Owner,
hereinafter collectively called Subdivider:
W I T N E S S E T H:
WHEREAS, Subdivider is engaged in subdividing that certain
tract of land known and designated as 20851 Saratoga Hills Road
situated in the City of Saratoga, County of Santa Clara, State of
California; and
WHEREAS, a final map of SD 95 -008 has been filed with the
City Clerk of the City of Saratoga for presentation to the Council
for its approval, which map is hereby referred to and by said
reference incorporated herein; and
WHEREAS, Owner and Subdivider has requested approval of said
final map prior to the completion of improvements of all streets,
highways or public ways and sewer facilities which are a part of or
appurtenant to the abovementioned subdivision, including, but
without limiting the foregoing, the necessary paving, catch basins,
pipes, culverts, storm drains, sanitary sewers where required,
street trees and street signs where required, and including a water
system and fire hydrants acceptable to the San Jose Water Works and
the City of Saratoga, all in accordance with and as required by the
plans and specifications for all of said improvements in or
appurtenant to said subdivision, which plans and specifications
were prepared by NA Engineering , Civil Engineer, approved by the
City Engineer and now on file in the offices of the Clerk of said
City and /or the City Engineer's Office of said City, and
WHEREAS, the City Council of said City did on the
day of , 1996, adopt a Resolution approving
said Final Map, rejecting certain dedications therein offered which
rejection did not and does not, however, revoke the offers of
dedication therein contained and requiring as a condition precedent
to the future acceptance of said offers of dedication that the
Subdivider improve the streets and easements thereon shown in
accord with the standards of the City's Subdivision Ordinance, as
amended, of the City of Saratoga and in accord with the improvement
plans and specifications on file as hereinabove referred to, and
requiring as a condition precedent to the release of said final map
for recordation that the subdivider agree in writing to so improve
said streets and easements in accord with this agreement,
NOW, THEREFORE, in consideration of the above and in
consideration of the City accepting all of said dedications after
the hereinafter agreed to covenants on the part of the Owner and
Subdivider have been complied with and in accord with Government
Code Section 66462(a) of the State of California, it is hereby
agreed as follows:
1. Subdivider at this cost and expense shall construct all of
the improvements and do all of the work hereinafter mentioned, all
in accordance with and to the extent and as provided in the above
mentioned plans and specifications on file in the office of said
City, for the construction of said improvements, in, for, or
appurtenant to said subdivision, and all in compliance with the
City's Subdivision Ordinance as amended and the laws of the State
of California, and shall complete the same within one year from
date hereof and shall maintain the same for a period of at least
one year after the satisfactory completion of the same.
2. Subdivider shall, before the release of said final map by
City and as condition precedent to recordation thereof, furnish to
the City and file with the City Clerk a good and sufficient surety
bond or bonds, money or negotiable bonds, in form to be approved by
the City Attorney, securing the faithful performance by Subdivider
of all work and the construction of all improvements herein in this
Agreement mentioned within time specified, and securing the
faithful performance by Subdivider of the maintenance of said
improvements for a period of at least one year after completion of
the same, and for such additional period of time as may be
necessary in order that Subdivider may cure and correct all

deficiencies of construction to the satisfaction of the City
Engineer of the City of Saratoga (in all events at least
$2,100.00 of said bond to be in cash, with the right of City to use
the same in its discretion for emergency maintenance and repairs in
addition to any other rights of use) the total amount of said bond
to be in the sum of $ 21,000.00 ; and also a good and sufficient
surety bond in form to be approved by the City Attorney securing
the payment by subdivider of all bills for labor and materials
incurred in the construction of any and all of said improvements,
and the doing of all other work herein agreed to be done by the
said Subdivider, the amount of said bond to be Twenty -One Thousand
Dollars ($ 21,000.00 ).
3. Subdivider does hereby expressly agree to indemnify and
hold harmless the City and in their capacity as such, its
councilmen, officers, boards, commissions and its employees, from
any and all loss or damage, and from any and all liability for any
and all, loss or damage, and from any and all suits, actions,
damages, or claims filed or brought by any and all person or
persons because of or resulting from the doing by Subdivider or any
and all things required of Subdivider by this contract, or because
of or arising or resulting from the failure or omission by
Subdivider to do any and all things necessary to and required by
this contract or by law, or arising or resulting from the negligent
doing by Subdivider, his agents, employees or subcontractors of any
and all things required to be done by this contract, or arising or
resulting from any dangerous or defective condition arising or
resulting from any of the above said acts or omissions of
subdivider, his agents, subcontractors, or employees. Subdivider
having heretofore certified, by the certificate upon the
abovementioned subdivision map, that he can convey clear title to
the land within said subdivision, and City having relied upon said
certificate and the representation contained therein, the foregoing
provisions of this paragraph are specifically made to apply to any
destruction or damage to or removal of utilities, water lines or
pipe lines of any kinds, and any other improvement, whether said

destruction, damage or removal is required or caused by the plans
or specifications or by direction of an officer, agent or employee
of the City.
4. Subdivider shall, before the release of said final map by
the City, and as a condition precedent to the recordation thereof,
furnish to the City and file with the City Clerk certificates or
policies of public liability and property damage insurance in form
satisfactory to the City Attorney, and Subdivider shall at all
times during the entire term of this agreement maintain the same in
full force and effect, which policies shall insure the City of
Saratoga, its Councilmen, officers, boards, commissions and
employees against loss or liability for bodily injury and property
damages arising or resulting from subdivider's operations and
activities in the construction of any and all improvements
mentioned in this agreement and the doing of any and all work
mentioned in this agreement, within or outside the abovementioned
subdivision, and /or arising or resulting from the doing or failure
of subdivider to do all things required to be done pursuant to this
agreement. Said policies of insurance shall cover bodily injury
and property damage on both an accident and occurrence basis, with
completed operations coverage for one (1) year after completion and
acceptance of improvements, and shall be in amounts of not less
than ONE MILLION DOLLARS ($1,000,000.00) for each person, ONE
MILLION DOLLARS ($1,000,000.00) for each accident or occurrence and
property damage coverage of ONE- HUNDRED THOUSAND DOLLARS
($100,000.00) for each accident or occurrence and property damage
coverage of ONE - HUNDRED THOUSAND DOLLARS ($100,000.00) for each
accident or occurrence. Said policies of insurance shall in
addition contain the following endorsement: "Other insurance - the
coverage afforded by this insurance shall be primary coverage to
the full limits of liability stated in the declarations. If the
assured has other insurance against the loss covered by this
policy, that other insurance shall be excess insurance only, after
the entire face value of this policy shall have been exhausted by
payment."

5. In consideration of City allowing Subdivider to connect
said subdivision to certain existing or proposed out -of -tract storm
sewer lines, and in consideration of City relieving Subdivider of
any obligation which City might legally impose on Subdivider to
acquire any right -of -way for, and /or to construct, any out -of -tract
storm sewer drainage pipe lines and appurtenances which might
reasonably be necessary to drain said subdivision and carry storm
waters from said subdivision to natural drains, Subdivider
shall, before the release of said final map by City and as a
condition precedent to the recordation thereof, pay the City the
sum of Zero dollars ($ 0 ).
6. In consideration of City agreeing to accept, in accord
with this agreement, the in -tract storm drain lines and facilities
constructed or to be constructed by Subdivider within or outside of
said subdivision in accord with the plans and specifications now on
file with the City offices, including the streets and other
easements in or beneath which said facilities lie, Subdivider
shall, before the release of said final map by City and as a
condition precedent to the recordation thereof, pay the City the
sum of Zero Dollars ($ 0 ).
7. Subdivider shall, before the release of said final map by
the City, and as a condition precedent to the recordation thereof,
pay to the City the sum of Two - Thousand - One - Hundred Dollars
($ 2,100.00) to be applied by City to the payment of expenses to be
incurred by City for engineering and inspection services to be
performed by the City in connection with said subdivision.
8. Upon Subdivider completing in accord with this agreement
all of the improvements to be made and done by said Subdivider as
hereinabove set forth and as shown on the plans and specifications
on file as hereinabove referred to, and upon Subdivider having
properly maintained the same for a period of at least one year
after the completion of said improvements as hereinabove specified,
and upon the Subdivider complying with all covenants and conditions
on his or its part to be done and performed in accord with the
within agreement, then and in that event, City agrees to rescind

its rejection of the offers of dedication of streets and storm
drain easements contained on the aforesaid final map, and at that
time accept said offers of dedication.
9. Should the Subdivider and Owner hereinabove referred to
not be the same person, firm or corporation, then this agreement
shall only be effective upon both the subdivider and the Owner
separately executing the same, and wherever the term Subdivider is
used, the same shall include Owner and wherever the term Owner is
used, the same shall include Subdivider.
10. This agreement shall be binding upon the heirs, personal
representatives and assigns of Subdivider and Owner, and time is of
the essence hereof, save and except that the City Council of the
City of Saratoga may, but need not, extend any time or times for
the doing or performing of any acts as required under the terms of
this agreement by resolution, if in the opinion of the City Council
any such delay is without fault on the part of the Subdivider and
Owner.
Execution of the within agreement by the Owner or Subdivider
shall constitute an irrevocable authorization to City to insert the
date of passage of the Council resolution approving the final map,
and to insert the date of this agreement as of the date of such
resolution.

day and year first above written.

RESOLUTION NO. SD -95 -008
RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SARATOGA APPROVING
VESTING TENTATIVE SUBDIVISION MAP
Trinity Development Company; 20851 Saratoga Hills Rd.
WHEREAS, application has been made to the Advisory Agency
under the Subdivision Map Act of the State of California and under
the Subdivision Ordinance of the City of Saratoga, for Vesting
Tentative Subdivision Map approval to subdivide two existing
parcels into nine single family residential parcels, all as more
particularly set forth in File No. SD -95 -008 of this City; and
WHEREAS, an Environmental Impact Report has been prepared for
this project which concludes that the net increase of seven single
family'homes on this property will not cause any significant and /or
unavoidable impacts on the environment, and the mitigation measures
identified in the EIR have been incorporated into this approval
Resolution and are highlighted in bold text; and
WHEREAS, this Advisory Agency hereby finds that the proposed
subdivision, together with the provisions for its design and
improvement, is consistent with the Saratoga General Plan and with
all specific plans relating thereto, and the proposed subdivision
and land use is compatible with the objectives, policies and
general land use and programs specified in such General Plan,
reference to the staff report dated January 10, 1996 being hereby
made for further particulars; and
WHEREAS, none of the conditions set forth in Government Code
Sections 66474 (a) - (g) and 66474.6 exist with respect to said
subdivision, and tentative approval should be granted in accord
with conditions as hereinafter set forth; and
WHEREAS, Final Map approval of the proposed subdivision is
contingent on City Council approval of the related recommended
Environmental Impact Report and General Plan and Zoning Ordinance
Amendments; and
WHEREAS-, the Planning Commission has conducted a-duly noticed
public hearing at which time all interested parties were given a
full opportunity to be heard and to present evidence;
NOW, THEREFORE, BE IT RESOLVED that the Vesting Subdivision
Tentative Map for the hereinafter described subdivision, which map
is dated December 13, 1995 and marked Exhibit "A" in the herein -
above referred file, be and the same is hereby conditionally
approved. The conditions of said approval are as follows:
Community Development
Acknowledged. 1. Future development on all lots shall require Design Review
approval. All building sites shall be left in a natural state
until Design Review approval has been granted and Building
Permits have been issued. Appropriate building sites shall be

determined at the Design Review stage based on current Zoning
Ordinance regulations and City policy. The site development
plan reviewed by the Planning Commission was an informational
document only, intended to indicate that feasible building
sites exist.
Acknowledged. 2.. Future homes shall be sited and designed to minimize the
amount of pad grading necessary and the removal of significant
existing native trees. At the time an application is submit-
ted for Design Review for Lot #1, the conceptual driveway
indicated on the Tree Plan, Exhibit "A ", shall be relocated to
retain tree #119, a nine inch Coast Live Oak.
Prior to approval of the Final Grading Plan, an oak tree
restoration plan shall be developed to ensure that adequate
habitat restoration occurs. If the one oak tree identified
for potential removal cannot be relocated onsite, the plan
will include the replanting of oak saplings in a sufficient
ratio to replace the oak tree potentially lost with project
development. This plan shall be prepared by a qualified
restoration ecologist and approved by the City of Saratoga
Community Development Director. Replacement trees shall be
planted onsite in designated open space. Temporary irrigation
equipment will be installed and operated during the first
several years of growth to ensure sapling survival. During
the revegetation process, tree survival will be maximized by
using gopher cages, deer screens, regular maintenance, and
replanting as needed. This plan shall also include measures
designed to enhance the long -term maintenance and preservation
of oaks not approved for removal.
Oaks not approved for removal that are within 200 feet of
grading activities shall be protectively fenced 5 feet beyond
the dripline and root zone of each (as determined by a
certified arborist) . This fence, which will prevent soil from
being pushed down beneath the canopies or over the root
collars, shall be maintained until all construction activities
are completed. No grading or trenching shall be allowed
within-this area and construction equipment and-vehicles and
debris shall be excluded. Protection for oak trees on slopes
and hillsides will also include installation of a silt fence.
The silt fence shall be installed at the base of the protec-
tive fence to prevent any soil from drifting down over the
root zone. Construction equipment and debris- shall be
excluded from the dripline of each tree.

design with the existing adjacent residences, that it is in
conformance with the City's Residential Design Guidelines and

the purposes of undergrounding utility lines serving the
properties.
Notice filed. 27. Prior to approval of the Final Map, the applicant shall file
a Notice of Intent (NOI) with the Regional Water Quality
Control Board to obtain coverage under the State General
Construction Activity NPDES Permit. Satisfactory evidence of
the filing of the NOI shall be furnished to the Director of
Public Works. The applicant shall comply with all provisions
and conditions of the State Permit, including preparation and
implementation of a Storm Water Pollution Prevention Plan
( SWPPP). Copies of the SWPPP shall be submitted to the
Director of Public Works prior to Final Map Approval and
maintained on site at all times during construction of the
subdivision improvements.
Prior to issuance of grading permits, the project applicant
shall submit an erosion control program which indicates proper
control of siltation, sedimentation and other pollutants will
be implemented per NPDES permit requirement. Best Management
Practices (BMPs) will be used to maintain downstream water
quality which may include standard drop inlet silt and grease
trap structures, detention basins, overflow collection areas,
and oil and sedimentation traps.
Prior to Final Subdivision Map approval, the project applicant
shall submit final drainage plans which demonstrate the
downstream drainage facilities along the segment of Trinity
Avenue east of Pontiac Avenue can accommodate the project -
related increase of 0.6 cfs for a 100 -year storm. The
applicant shall replace 12" inflow pipeline with an 18"
Pipeline to eliminate local ponding at the Trinity Ave-
nue /Malcolm Avenue inlet. If ponding cannot be improved near
this intersection, the project applicant shall provide onsite
detention facilities that will retain surface runoff during
peak flow period. Implementation of this measure would reduce
impacts to a less- than - significant.
Prior to Final Subdivision Map approval, the project applicant
shall submit final drainage plans that indicate how the site
grading, in conjunction with the drainage conveyance systems,
including applicable catch basins, storm drains and flood
water retarding, will allow building pads to be safe from
inundation from stormwater runoff which may be expected from
all storm up to and including the 100 -year storm event. The
City Engineer shall ensure that project structures are
consistent with the City's Grading and Zoning Ordinances.

Prior to Final Subdivision Map approval, the project applicant
shall submit final drainage plans which demonstrate the future
post - development stormwater quality discharged from the
project site will not deteriorate from the existing stormwater
quality.
City Geotechnical Consultant
Acknowledged. 28. A final Geotechnical Clearance shall be.required for Lots 5,
7, 8 and 9 prior to acceptance of Design Review applications
on these lots as complete. Prior to obtaining a Geotechnical
Clearance for Lots 5, 7, 8 and 9, site - specific geologic and
geotechnical investigations shall be performed. As part of
these investigations, the applicants, geologic and geotechni-
cal consultants shall: (1) review the subdivision level report
by Freeman -Kern Associates, Inc. and City review memorandums,
(2) identify and evaluate areas on the lots underlain by
surficial materials (fill, colluvium, landslide and fan
deposits), (3) evaluate the long -term stability of slopes on
the lots (including artificial and natural slopes), and (4)
provide supplemental geotechnical design recommendations, as
needed, for the proposed construction. The investigations
shall include, but not necessarily be limited to the follow-
ing:
a. An original, engineering geologic map and cross sections
shall be prepared at an appropriate scale (i.e., 1:480 or
larger) for each lot. The maps and cross sections shall
extend beyond the lot boundaries to ensure that off -site
conditions have been considered with respect to the
proposed developments. Engineering geologic maps and
cross sections shall provide the following information:
(1) extent and probably thickness of surficial earth
materials (including existing fill, colluvium, land-
slides, and alluvium or fan deposits), (2) natural and
artificial slopes and slope profiles, (3) type and
structural orientation of underlying bedrock, (4)
location and extent of filled creek channel, and (5)
locations of existing- and proposed structures and
improvements.
b. Specific geotechnical issues on Lots 5, 7 and 8 to be
evaluated shall include: demolition and removal of
existing structures; mapping and subsurface exploration
to determine the extent of buried structures and filled
watercourses and mapping stability evaluations of the cut
slopes on Lot 8. Grading recommendations, considering
the proximity of the proposed structures to the buried
watercourse, septic tank and well, shall be provided in
the site - specific reports.
C. Specific geotechnical issues on Lot 9 to be evaluated
shall include: evaluation of the long -term stability of
cut slopes along Saratoga Hills Road; characterization of

the area of thick colluvium (possible landslide) in the
western portion of the lot; mapping and evaluation of the
cut slope in the eastern portion of the lot; and consid-
eration•of the cut slope with respect to proposed grading
for the residential structure and driveway. Specific
drainage and /or landscaping practices should be recom-
mended to ensure stability of the western portion of the
lot.
d. The site - specific geotechnical conditions on these lots
shall be explored, and representative earth materials
(i.e., bedrock, colluvium, artificial fill, etc.) shall
be sampled and tested to provide engineering parameters
for foundation and retaining wall design. The geotechni-
cal consultants shall specifically: (1) determine the
thicknesses of surficial materials (artificial . fill,
colluvium and fan deposits) on the property, and (2)
document, with appropriate data, the location and extent
of the buried watercourse that extends through the
central portion of the property. Recommendations for
drainage improvements shall be provided, as well as
specific recommendations for structural foundations, as
needed.
The results of the site - specific geologic and geotechnical
investigations shall be summarized in written reports with
appropriate illustrations, and submitted to the City to be
reviewed and approved by the City Engineer and City Geotechni-
cal Consultant prior to the granting of a Geotechnical
Clearance for Lots 5, 7, 8 and 9.
Acknowledged. 29. Prior to the issuance of a grading permit for each lot, the
project geotechnical consultants shall review and approve all
geotechnical aspects of the final foundation and grading plans
(i.e., building setbacks, site drainage improvements and
design parameters for foundations and retaining walls, etc.)
to ensure that the consultant's recommendations have been
properly incorporated.
The results of the plan reviews shall be summarized in letters
by the geotechnical consultants and submitted to the City for
review and approval by the City Engineer.
30. Prior to final sign -off of a grading permit for each lot, the

Utility and Public Safetv Providers
31. Sanitary sewer service for all parcels shall be required per
the requirements of the West Valley Sanitation District.
32. Domestic water shall be supplied by San Jose Water Company.
33. The owner (applicant) shall install additional fire hydrants
as determined by the Saratoga Fire District.
City Attorney
34. All funds required by the Memorandum of Understanding to be
paid to the City of Saratoga as a result of the City granting
approval of a Final Subdivision Map, shall instead be paid by
the Community Foundation into an escrow account established at
the First American Title Company. Such account shall bear
interest at the prevailing rate of invested escrow funds.
Upon the expiration of any applicable appeals period following
the entry of final judgment in the matter of The Friends of
the Nelson Garden Foundation v City of Saratoga et al and
the Community Foundation of Santa Clara County, Superior Court
Case No.: CV751374, and any further cases filed, challenging
the City's approval of this project, such funds and all
interest thereon shall be:
a. Paid to the City of Saratoga forthwith if the Tentative
Williamson Act Cancellation challenged by this lawsuit
remains in full force and effect, or; - -
b. Paid to the Community Foundation if the Tentative
Williamson Act Cancellation is vacated.
35. Applicant agrees to hold City harmless from all costs and
expenses incurred by the City or held to be the liability of
City in connection with City's defense of its actions in any
proceeding brought in any State or Federal Court, challenging
the City's action with respect to the applicant's project.
36. Noncompliance with any of the conditions of this permit shall
constitute a violation of the permit. Because it is impossi-
ble to estimate damages the City could incur due to the
violation, liquidated damages of $250 shall be payable to this
City per each day of the violation.
Section 1. Conditions must be completed within 24 months or
approval will expire.
Section 2. All applicable requirements of the State, County,
City and other Governmental entities must be met.
Section 3. Unless appealed pursuant to the requirements of
Article 15 -90 of the Saratoga City Code, this Resolution shall
become effective fifteen (15) days from the date of adoption.

Background - Community Development Block Grant Program
The City of Saratoga, eight other "nonentitlement" cities
(population under 50,000) within Santa Clara County, and the County
itself receive federal Housing and Community Development Act (HCDA)
Community Development Block Grant (CDBG) funds, which are
administered by the Department of Housing and Urban Development
(HUD) , for eligible projects and activities. By regulation,
nonentitlement cities receive funds through a cooperative Agreement
with the Urban County of Santa Clara (the locally responsible grant
recipient).

expected to be approximately $3,510,000. Of this total grant,
twenty percent will be used for administration costs. Forty

where funds are prioritized for projects and activities that
contribute to increasing the supply of affordable housing in the

County. The other sixty percent of the total grant will go to the
nonentitlement cities and the County for direct allocation for any
HCDA eligible activity.
The City of Saratoga will receive an allocation of approximately
$160,000 for project costs, plus $15,000 for staff administrative
costs, and an additional $15,000 to cover the costs of County
rehabilitation services, totalling $190,000 for 1996 -97. $35,652
of this amount may be spent on 1996 -97 Human Services Grants.
In general to be eligible for CDBG funds, proposals must primarily
benefit those of very low or low income (for FY96/97 the amount for
a family of four is $41,600 /annual income).
Backcrround -Human Services Grants
A maximum of fifteen percent of the total County grant may be used
for human services activities. Human services include, but are not
limited to: child care, job training, counseling, recreation
programs, and services for senior citizens. In the past, Council
policy provided for the use of General Funds in making some grants
to human services agencies because of the constraint on using Block
Grant money for this purpose, i.e. the number of proposals which
the City receives each year for providing necessary services to low
income, elderly and disabled residents. The policy set a maximum
dollar amount to be allocated annually for human services grants at
1.3% of the City's projected general revenues. The policy also
provided that proposals for both Block Grant funds and general
revenues will be considered at one hearing.
Current Considerations
In February 1995, the City Council conducted a public hearing to
receive comments and recommendations on proposed projects for
1995 -96 HCDA funds and other available funding. At the February
21, 1995 adjourned meeting, awards were made for HCDA project funds
and Human Services Grants.
In June 1995, due to budget constraints, the City Council reduced
the General Fund allocation for human services grants to $19,225.
This entire amount was allotted to the Senior Center operations,
and all other Human Services Grants previously approved for 1995 -96
using General Funds were eliminated.
The FY 96 -97 approved budget also allocates $19,225 for Human
Services from the General Fund. In recent years, the City has
allocated the total amount of Block Grant Human Services funding to
SASCC for the Adult Day Care Program, and subsidized the Senior
Center operations with General Fund money. In following Council's
direction, the proposed Human Services Grants awarded by the City
will be the $35,625 funding for SASCC, and $19,255 General Fund
money for Adult Day Care operations, totaling $54,850. On January
23, 1996, the Council confirmed its decision not to allocate
additional General Funds to increase 1996/97 Human Services Grants.

HUMAN SERVICES AND CDBG FUNDING RECOMMENDATIONS
HUMAN SERVICES
RECOMMENDED FUNDING $35,625
Five proposals were submitted in this category, totalling $61,057.
The grant request amounts are listed .in the attached spreadsheet.
No new applications were received in this category.
Council has adopted funding criteria for the Human Services Grant
program which includes consideration for the benefit of Saratoga;
the need for the service provided; financial need of the applicant
agency; and provision of essential services to Saratoga aIs low
income, elderly, and /or disabled residents.
Staff recommends funding the Saratoga Adult Day Care Center with
the total $35,625 available for Human Services Grants, and adding
$19,225 from the General Fund for SASCC's Operating expenses.
SASCC is targeted towards Saratoga Seniors and the services make -up
a large portion of its budget. The City has a long term
relationship with this agency. In addition, the County recommends
funding projects above $5,000 because it costs the agency nearly
half of the grant to obtain the award and comply with the reporting
process. It also simplifies the administrative process for City
Staff when fewer, larger grants are awarded.
OTHER CDBG PROJECTS
RECOMMENDED FUNDING $124,348
Four agencies have submitted proposals for rehabilitation projects.
These grant request amounts are also listed in the attached
spreadsheet. Funding for requests of this type can come either
from the "new" money or from the City's housing rehabilitation loan
program. Staff recommends that the Council approve the use of new
monies since the County along with HUD encourage the annual
turnover of funds to eligible projects.
Emergency Housing Consortium (EHC) submitted a proposal for
$20,000 to complete essential rehabilitation work at five sites in
order to provide a safe, sanitary environment for homeless and
disabled adults at three apartments in San Jose. Examples include:
smoke detectors, new asphalt, replace uneven concrete, replace and
repair broken window frames and replace kitchen equipment in
apartment units. The Council awarded $13,000 to this agency last
year and $37,000 for two projects in 1994. Staff recommends
granting $20,000 to EHC during 1996/97.
Fellowship Plaza submitted a proposal for $14,560 to retro -fit new
gas valves, generators and thermostats in seventy -five of their 150
unit gas furnaces. The units to be retrofitted are those being
occupied by disabled and frail low income residents. Fellowship
Plaza is a 150 unit apartment complex for low- income Seniors in the
City of Saratoga providing affordable housing and other related
services to the area's elderly population. A grant approved by the

City of Saratoga in 1990 provided the installation of automatic
entry doors. Staff recommends funding $14,560 for this project,
and does so noting that the request appears to be for emergency
needs. If Council approves funding, staff will convey that this is
not a precedent for ongoing funding.
InnVision, is a community- based, nonprofit organization that
provides year -round shelter and supportive services to homeless
people in Santa Clara County. InnVision has requested $5,000 from
Saratoga to assist in the rehabilitation of the Commercial Street
Inn, a nighttime shelter for homeless women and mothers with
children. The facility is in need of safety and health related
improvements including heating and ventilation repairs and
upgrades, floor repairs, installation of exterior awnings for
temperature control, and improvements to the children's play area.
The Council approved $5,000 for a similar project last year and
Staff recommends the same amount for 1996/97.
TRI -Aegis has established seven homes in Santa Clara County for
persons with developmental disabilities; one of them being in
Saratoga located off of Allendale Avenue. Last year, the Council
awarded TRI -Aegis $50, 00 to aid in the acquisition of the Allendale
Group Home which serves six very low income individuals. However,
the owner decided not to sell the home and this money has not been
spent. The agency is currently seeking $50,000 in additional
funding to cover the cost to modify a conventional home to
accommodate persons with disabilities. Staff recommends that the
$50,000 from 1995/96 still be made available to purchase the
property, and the additional $50,000 is approved to complete the
improvements. Staff further recommends that a condition be placed
on the approval which provides that these funds will revert to the
City if the money is not spent during FY 96/97.
Housing Rehabilitation Administration
Staff recommends allocating $10,000 to cover the cost of having
Community Development Staff administer the Housing Rehabilitation
Program ($5,000), and an additional $5,000 to hire a part -time,
contracted housing assistant to market the program. There has been
an increasing need to develop a better marketing system to inform
the community about this program and the availability of funds.
General CDBG Administration
Staff recommends allocating $15,000 for general administration of
the program by City Staff. This is an on -going annual allocation.
Staff would like to propose that the remaining $9,788 be allocated
for the development of low - income senior housing within Saratoga.
These funds could be used to leverage the establishment of another
home or living situation similar to the Shared Senior Home project
located on Johnson Avenue.

Subject: Changes to Council Report on FY 1996/97 Housing and
Community Development Act Funds and Human Services Grants
I am sending an amended Attachment 3 to my staff report for the
March 20 meeting. Please refer to the following clarifications:
1. Six Human Services proposals were received totalling $82,457.
SASCC submitted two proposals: one for the Day Care ($38, 942) ,
and another for Day Care Operations ($21,400) totalling
$60,342. My recommendation is to grant SASCC the total
1996/97 Human Services allocation for the Day Care ($35.,625).
An additional $19,225 has been approved from the 1996/97
General Funds for the Day Care Operations. The proposed total
grant to SASCC is $54,850.
2. The Emergency Housing Consortium (EHC) sent an update to its
proposal. The proposal should have stated a request for
$10,000, not $20,000. Therefore, the additional $10,000 has
been added to the Low Senior Income Housing Fund.
