Recommended Motion: Authorize the issuance of a Special Events Permit
for the PTSA Fun Run as proposed on Sunday, June 4, 1989. Additionally,
authorize the closure of Herriman Avenue to through traffic as
proposed on June 4, 1989 from 11:30 a.m. to 12:30 p.m.
Report Summary: The California Congress of Parents, Teachers and
Students, Inc. (a.k.a. the Saratoga Parent - Teachers - Students Association
or PTSA) in cooperation with the Community Against Substance Abuse (CASA)
has proposed holding a fun run on Sunday, June 4, 1989. This is a repeat
of their first Fun Run approved by the City and held on May 31, 1987.
The run will extend from Saratoga High School down Herriman, to Lexington,
to Franklin, on to Hammons, then to Glen Brae, and will terminate at
Congress Springs Park. PTSA has indicated no more than 500 participants
will be involved in the event.
Fiscal Impacts: The $50 Filing Fee and $250 clean -up deposit
have been paid. No fiscal impacts are anticipated.

A majority of
participants are
planning
to run
or walk
to the Congress
Springs Park and
then walk
back to
the high
school after the
picnic. Little
League's
Opening
Day exceeded 700, so we
anticipate no parking problems.
3. Provisions for emergency vehicle traffic.
We intend to keep the participants in the right lane only (the
lane farthest away from Saratoga High School). Therefore, the
left lane will be free for emergency vehicle traffic. There
will also be two policemen present to help handle any
emergencies.
E. Proposed sanitary facilities to accommodate event
participants.
The Congress Springs Park has several baseball games every
Saturday and their new bathroom facilities easily handle the
crowds. They were also able to handle those present at Little
League's Opening Day. We feel the existing bathrooms will be
sufficient.
F. Identification of food and beverages available at the event,
including how each will be prepared and handled.
CASA will be handling different food booths. These
refreshment booths will be arranged on the grass of the minor
league field. The individual clubs from the high school will
be preparing food for the booths. The refresments offered
will include ice cream, soft drinks, hot dogs, hamburgers and
nachos.

This is_to acknowledge receipt of your application for a special
events permit from the City of Saratoga to hold a "fun run" on
the morning of June 4, 1989. In order to proceed with the
processing of this special events application I need the
following information:
1: Please confirm in writing that this event is being co-
sponsored by the Community Against Substance Abuse (CASA)
organization and the California Congress of Parents, Teachers,
and Students, Inc., with the latter organization assuming full
liability for this event. An authorized representative from the
California Congress of Parents, Teachers, and Students, Inca
should co -sign this written statement.
2. In accordance with our ordinance, we still need some
statement from the insurance company that they are specifically
covering thus event proposed for June 4, 1989. In addition., the
statement from the insurance company needs to indicate that they
are providing the City of Saratoga (including its officers and
agents) primary insurance coverage on an occurrence basis. I
recommend you get started on this right away since it may take
some doing on your part. This is a new provision in our
ordinance that we cannot ignore.
3. You should notify the residents living along Herriman
affected by the road closure of your proposed event. I recommend
that you have them contact either yourself or the City if they
have any problems with this proposal.
4. You need to contact the Santa Clara County Health Department
to advise them you will be serving food and beverage to the
public. They have certain standards you must meet to insure the
health and safety of the general public.
I am tentatively scheduling this matter to go before the City
Council at their May 3, 1989, meeting. Therefore, I would need
the information requested herein by April 24, 1989, in order to
complete your application for the staff report to the Council.

The Heritage Preservation Commission received an application for
Heritage Resource Designation for property at 14510 -14540 Big Basin
Way, known as the Judge James E. Foster House. An application for
designation of this property was originally submitted in 1984; the
application was subsequently deactivated in 1985 for incompleteness.
The applicant now wishes to proceed with the designation.
After careful consideration of the application and supporting
materials, the Commission determined that the property meets the
criteria for designation, per Section 13- 15.010 of the City Code. At
their March 15, 1989 meeting, the Commission voted unanimously to
recommend to the City Council approval of the designation. The
Commission would like to qualify their recommendation however, by
stating that the action should not be seen as one which encourages the
relocation of historic structures. Relocations should only be used as
a preservation' method when other methods are not available or not
feasible. When structures are moved, they should follow the Secretary
of the Interior's standards for rehabilitation and relocation, as
occurred with this property.
RECOMMENDATION
The City Council should conduct the public hearing and, if it can make
the findings for approval, introduce the ordinance designating 14510-
14540 Big Basin Way as a Heritage Resource. A second reading is
required at the next Council meeting, and the ordinance would go into
effect thirty (30) days after the second reading.

REPORT OY FINDINGS FOR HERITAGE RESOURCE DESIGNATION
OF THE JUDGE JAMES E. FOSTER HOUSE
(per Section 13- 15.010 of the City Code)
1. The property meets selection criteria (a) in that it exemplifies
and reflects the early pioneer settlement period of Saratoga's
history.
2. The property meets selection criteria (b) in that it is identified
with Judge James E. Foster, Justice of the Peace and County
Roadmaster in Saratoga from 1892 to 1898.
3. The property meets selection criteria (c) in that the structure is
characteristic of the early pioneer style distinctive in Saratoga,
and even though the structure has been relocated and significantly
reconstructed, the owner has maintained the original appearance
and materials to closely resemble the original house.

III. New Business
A. Application for Heritage Resource Designation:
14510 -14540 Big Basin Way
Chairman Heid gave a brief history of this application,
noting that it had originally been submitted in 1984 and
deactivated in 1985 for incomplete information. The
information that was needed related to how much of the
structure was original and how much was new construction.
Gene Zambetti, owner and applicant, showed photographs and
gave a history of the house move which occurred in 1983.
The house was originally on a mud sill and had significant
termite and roof damage. The back and one side wall are
new, as well as the foundation, floor, roof, and a small
addition at rear. The other side wall and the front,
including the porch columns, are original. The walls were
picked up in pieces and moved to the new site. Zambetti
stated that the Secretary of the Interior's Standards for
Rehabilitation were used. in the relocation and
reconstruction.
Chair Heid then led discussion on the application for
designation. He felt that the house was a replica and
suggested adding the date of relocation /reconstruction to
Item C on page 3, to indicate when the building was
renovated. Commissioner Ansnes asked if it was the change
to a commercial use that required the structural changes.
Mr. Zambetti replied in the affirmative.
Commissioner Voester felt that the house merits
designation, but that this should not be seen as an
encouragement to move a structure; she felt that moving
destroys the integrity of the house and the neighborhood
from which it is taken. Commissioner Cameron felt that
the descriptive word "replica" was not appropriate because
the house still retained original parts.
M/S Voester /Cameron to recommend to the City Council
approval of the designation because the property meets
criteria (a), (b) and (c) of the findings. The Commission
further recommended that the findings be "qualified" as
not encouraging relocations in the future and, if
structures are moved, they should follow the Secretary of
the Interior's Standards for Rehabilitation and
Relocation. This designation should not be viewed as
precedent- setting for relocated structures. Motion passed
unanimously.
Commissioners Heid and Landsness left the meeting at 4:15
p.m.

This single -story Pioneer cottage was removed in 1983 from its original
location at 20680 Marion Avenue to the rear of a retail complex which
fronts on Big Basin Way. It is located in the corner of a parking lot,
with residences to the rear and to one side. The only remaining portions
of the original structure are the front and side elevations, which are the
only parts that could be saved because of moving requirements. The roof,
floor and interior are new construction. The roof, front facade and front
porch have been reconstructed to closely resemble the original. The front
wall is of overlap siding with double hung windows. The hipped roof is
wood shingled. The front porch features turned columns and posts. An
addition to the rear extends out from the west side of the building and has
a separate entrance.

Recommended Motion: Review and direct transmittal of draft
correspondence responding to the author's concerns.
Report Summary: The Council received the letter from Klaus Pache
raising issues with regard to access from the new condo and retail
project currently under construction on Big Basin Way. Staff has
prepared a draft response which indicates that on April 19, 1989, the
Council acted to include the condo /retail project in the Landscape and
Lighting District which covers Parking District No. 1. Further, the
draft response indicates that primary access to the project was approved
from Big Basin Way, not from Parking District No. 1. If the developer
desires continuous access to the parking district, then arrangements can
be made to include the project in the parking district. If restricted
emergency access is desired by the developer, then a permanent fixed
gate can be required to preclude routine vehicular access to the
district and no participation in Parking District No. 1 would be
required.

In your recent letter, you cite concerns regarding access from the
condominium project under construction and its access to Parking
District No. 1. On April 19, 1989, the City Council moved to
include the condo project in the Landscape & Lighting Assessment
District requiring the property owner's participation in the
maintenance of these improvements in Parking District No. 1. Your
letter raised very timely questions which fortunately the Council
was able to quickly address by including this project in the
maintenance program for the district.
Regarding the condo project's access to Parking District No. 1, I
should advise you that primary access to the project is via Big
Basin Way, and secondary, emergency access was approved through the
district to Fourth Street. The developers have the option of
limiting access to Parking District No. 1 to emergency vehicles only
and installing a fixed gate or participating and joining in the

Report Summary
Presently there is a gap in the bike lane along the southerly side of
Prospect Road between Lawrence Expressway and the City's easterly Citv limit.
In this reach of roadway there is a very wide outside curb lane (approximately
31' ±) of which vehicles frequently drive in while either making a right turn
into one of the businesses along the south side of Prospect or wanting to
turn right at Saratoga Avenue. This maneuver has created quite an accident
history, by collisions with vehicles turning left from the dual left turn
lane during heavy commute. By creating the bike lane outside of the 8' park-
ing lane, this unsafe driving in the wide curb lane would be illegal. The
Public Safety Commission unanimously supports this recommendation.
Fiscal Impacts:
The cost to stripe 800 L.F. of Bike Lane, place the necessary signs and
paint the legends would amount to approximately $1,000.00 and would come from
the Traffic Safety Budget (3033 - 3010).

The City Council of the City of Saratoga hereby resolves as follows:
Section 1: Based upon an engineering and traffic study, and pursuant to
to Section 9- 60.050 of the Saratoga City Code, the following designated portion
of street in the City of Saratoga is hereby declared to be a bicycle lane.

SUBJECT: Bike bane - Prospect RDad
There has been a history of accidents developing over the past years
along Prospect Road, between Lawrence Expressway and Saratoga Avenue,
involving vehicles driving eastbound in the right outside portion of
the roadway and vehicles travelling westbound making left turns into
gypping areas on the southside of Prospect Road, and vehicles crossing
Prospect Road frcan the northside to the southside. These accidents occur
on weekdays between 3:00 p.m. and 8:00 p.m., when eastbound traffic is
very heavy stop- and -go in the two lanes of travel, which is caused from
the signal at Saratoga Avenue. Vehicles wanting to turn right at either
Saratoga Avenue or one of the businesses along the southerly side of
Prospect Road., drive in the wide curb lane outside of the two designated
striped lanes. During this heavy stop-and-go traffic, vehicles will leave
an opening'for the traffic wanting to turn left or cross the roadway, which
results in a collision with the vehicles travelling eastbound in said wide
curb lane.
From the existing striped lane line to the curb line on the south side
of Prospect Road, there is a distance of 31 feet, which means that we
would be able to create an eight foot parking lane along the curb and also
stripe a six -foot bicycle lane adjacent to said parking lane leaving a
seventeen foot outside eastbound lane for traffic. This would then make
it illegal for cars to drive, outside the striped outside traffic lane,
in the striped bike lane.
We reccannend this solution to discourage the traffic movements which
cause the particular type of collision described above.

Lots in the R -1 Zoning District
Recommended Action: Adoption of Ordinance.
Report Summary: This matter was considered by the Council at its meeting on
April 19, 1989, at which time it was decided that no action would be taken on the
proposed ordinance until the conduct of a public hearing on May 17, 1989. If the
Council decides to adopt the ordinance, the procedural requirements are the same. A
4 /5ths vote is required and the measure will remain effective for an initial period of
45 days, after which it may be extended (following the conduct of an additional public
hearing) for a maximum period of 22 months and 15 days. An extension for such length
would not be required. Staff estimates that approximately 6 months would be needed
for a deliberation on this issue by the Planning Commission and the establishment of
new regulations if so directed by the Commission.
Notwithstanding the conduct of a public hearing, the Council
must still make the finding that a current and immediate threat to the public health,
safety or welfare exists that necessitates a moratorium during the period in which the
issue is being studied.

Study to Rbvise Subdivision Standards and a
Temporary Moratorium for "Flag Lot" Applications
Recommended Motion
Staff recommends that the City Council enact a moratorium ordinance
drafted by the City Attorney.
Background
The Council has concluded in its recent policy development
conference that the Planning Commission initiate and complete a
comprehensive program reducing the appearance of residential
overcrowding and neighborhood intensification. Prior to initiating
workshops and hearings with the Planning Commission, staff is
recommending that a temporary moratorium be established to preclude
application for minimum access lots or "flag lots" in the R -1
districts that a part of a minor subdivision. Flag lots proposed as
a part of a major subdivision (5 or more parcels) would not be
affected by the proposed moratorium.
The Planning Commission, at its recent policy retreat, discussed the
specific land use problem associated with the development of minimum
access or flag lots. In general, the Planning Commission noted that
flag lot development resulted in concerns regarding privacy,
neighborhood intensification and incompatibility. However in
certain areas such as the NHR and HC -RD and to a certain extent the
R -1- 40,000 districts, the Planning Commission determined that flag
lots can be appropriately designed. Primarily, flag lots in less
dense neighborhoods are provided ample open space and natural
landscape to buffer privacy and compatibility concerns. Further,
flag lots in these areas contribute to the countrified appearance
by employing driveway access from arterial or collector streets.
Analysis
Prior to initiating the Planning Commission study of the City's
subdivision standards, the staff recommends that a temporary
moratorium on flag lots be considered. While staff is sensitive to
the "draconian" appearance enactment of a temporary moratorium will
have, there are several specific advantages to support such action.
First, a moratorium enacted prior to a study will separate policy
questions from issues of a specific development proposal. Should
the Planning Commission continue to accept and review applications
for flag lots while a study occurred, policy questions not yet
resolved would inevitably arise. Applications could conceivably be
reviewed and judged not by standards, but a presumption of standards
based on preliminary findings of a study in progress. This would
adversely affect all potential applicants, particularly those that
may eventually conform to future regulations.
Secondly, a Planning Commission study to add regulations may
artificially encourage a spate of flag lot applications from
applicants seeking relief under the current more lenient rules. The
purpose of the study and Planning Commission analysis is to adopt
logical standards to judge impacts caused by this type of
development. While the City receives a handful of proposals, the
attention fostered by a Planning Commission study could raise the
number of applications which would detract from the intended purpose
of the study.
Lastly, moratoria statutes clearly indicate that such actions are to
be used to enable the City to address a specific land use problem.
The problem facing Saratoga is that the current code does not
address the overcrowding in the City neighborhoods. The moratorium
provides the proper tool to create an environment to deal with the
problem without suffering the ill- effects of increasing the number
of applications. The required Council finding that a "current and
immediate threat to the public, safety or welfare which necessitates
a moratorium" stems from the City Code's inadequacy in dealing with
flag lot development. The problem does not stem from sheer numbers
of this type of development application.

surrounding area, thereby increasing crime.
We hope you will pass this ordinance and make it retroactive for any
application that has not yet been approved. If a flag lot is not
o.k. for tomorrow, it is not o.k. for yesterday if it has not yet

I wish to encourage you in your efforts to create an
ordinance banning the creation of any more flag lots in
Saratoga. Personally, I believe flag lots are an eyesore
wherever they occur but particularly bad in a residential
neighborhood as nice as Saratoga. Usually they result from
adding a house to an existing property where there is
insufficient frontage for more than one house. This means
one home becomes virtually landlocked and both homes end up
with inadequate space surrounding them.
Since a developer is currently trying to create a flag lot
directly across from my home, I am particurlarly interested
in seeing that this ordinance becomes retroactive to all
projects which have not received final map approval.
Thank you for your efforts in this matter and I applaud your
vision.

This Wednesday, May 17, 1989, you will be considering an
emergency ammendment to the Zoning Ordiiinance regarding flag
lots.
I would like to state my support for a permanent ordinance
baning flag lots. Flags lots are a bad idea. They create a
hodge -podge look within the neighborhood, and a loss of
privacy is suffered by the surounding parcels. The passing
of such an ordinance would be a positive step towards curbing
some of the questionable development that is spoiling the
"country atmosphere" of Saratoga.
As a property owner and resident of Saratoga I would like to
voice my suppport of an ordinance baning flag lots in
Saratoga.
