APPROVAL`& SUBJECT: LANDSCAPING AND LIGHTING DISTRICT LLA -1 (Annexation) At your April 19, 1989 meeting you adopted Resolution No. 2565, a resolution describing the improvements and directing preparation of the Engineer's Report for fiscal year 1989 -1990 for the continuation of the Landscaping and Lighting District LLA -1. Addi- tional Council action is required for this district to proceed. The Engineer's Report is not included because of the following: Engineer's Report contains the Total Assessment for each zone, Rules for Spreading Assessment, Cost Estimate for each zone, Description of Work, Assessment Roll and Assessment Diagram. This report is similar in size to the existing Landscaping and Lighting District report and will be available on May 17, 1989 for Council review. Fiscal acts: The costs for the administration, maintenance and servicing, and lighting costs are charged to the various zones within the District based on benefit received. The Santa Clara County Assessor's Office will collect the amounts through the taxes and., in turn, send to the City. Exhibits /Attache -ents : 1. Engineer's Report to be presented Wednesday night. 2. Resolution No. Reccnunended Action: Adopt the following: Resolution "Resolution of Preliminary Approval of Engineer's Report" "Resolution of Intention to order the Annexation of Territory to an Existing Assessment District and the Levy and Collection of Assessments within said Territory Pursuant to the Landscaping and Lighting Act of 1972 ". This Resolution also sets the time and place for the public hearing for said District on June 21, 1989. SUBJECT: CONDITIONAL FINAL MAP APPROVAL FOR TRACT 8220 Saratoga - Sunnyvale Road & Cox Avenue Recommended Motion: Approve Resolution No. SD 87 -019.2 for Conditional Approval for Tract 8220. Report Summary 1. Developer has completed all conditions for Tract 8220 except encroadl-unent permit from Cal Trans and Santa Clara Valley Water District. 2. A11 fees have been paid. 3. SD-88 -019.2 RESOLUTION APPROVING FINAL MAP OF (AL) TRACT 8220 WHEREAS, a final subdivision map of TRACT 8220 having heretofore been filed with this City Council for approval, and it appearing that all streets, public ways and easements shown thereon have not been satisfactorily improved nor completed, and it further appearing that otherwise said map conforms with the require- ments of Division 2 of Title 7 of the Government Code of the State of California, and with all local ordinances applicable at the time of approval of the tentative map and all rulings made thereunder, save and except as follows: \ Qbtain encroadmpnt perm man Cal, and Clara �T�lley V ter. D lct / \ / NOW THEREFORE BE IT RESOLVED: (1) The aforesaid final map is hereby conditionally approved. Said approval shall automatically be and become unconditional and final upon compliance by subdivider with such requirements, if any, as set forth immediately above as not yet having been complied with, and upon compliance with Section (3) hereof. (2) All street dedications, and all other dedications offered on said final map (except such easements as are declared to be accepted by the terms of the City Clerks certificate on said map), are hereby rejected pursuant and subject to Section #66477.1 of the Government Code of the State of California. (3) As a condition precedent to and in consideration of the future accept- ance of any streets and easements not by this resolution now accepted, and as a condition precedent to the City Clerk certifying the approval and releasing said map for recordation, the owner and subdivider shall enter into a written agreement with the City of Saratoga, secured by good and sufficient surety bond or bonds, money or negotiable bonds, in amount of the -1- f e l estimated cost of improvements, agreeing to improve said streets, public ways and easements in accord with the standards of Chap. 14. Municipal Code as amended and with the improvement plans and specifications presently on file, and to maintain the same for one year after completion. The form and additional terms of said written agreement and surety bond shall be as heretofore adopted by the City Council and as approved by the City Attorney. The mayor of the City of Saratoga is hereby authorized to exe- cute the aforesaid improvement agreement on behalf of said city. (4) Upon compliance by subdivider and /or owner with any remaining require. ments as set forth in the preamble of this resolution (if any) and with the provisions of Section (3) hereof, the City Clerk is authorized and directed to execute the City Clerk's certificate as shown on said map and to transmit said map,as certified to the Clerk of the Santa Clara County Board of Supervisors. SD -87 -019.1 RESOLUTION APPROVING TENTATIVE MAP OF SARATOGA PARTNERS, APN 393 -01 -001, SARATOGA- SUNNYVALE ROAD WHEREAS, application has been made to the Advisory Agency under the Subdivision Map Act of the State of California and under the Subdivision Ordinance of the City of Saratoga, for tentative map approval of 10 lots, all as more particularly set forth in File No. SD -87 -019.1 of this City, and WHEREAS, this Advisory Agency hereby finds that the proposed subdivision, together with the provisions for its design and improvement, is consistent with the Saratoga General Plan and with all specific plans relating thereto, and the proposed subdivision and land use is compatible with the objectives, policies and general land use and programs specified in such General Plan, referenced to the Staff Report dated 9/14/88 being hereby made for further particulars, and WHEREAS, this body has heretofore received and considered the Negative Declaration prepared for this project in accord with the currently applicable provisions of CEQA, and WHEREAS, none of the conditions set forth in Subsections (a) through (g) of Government Code Section 66474 exist with respect to said subdivision, and tentative approval should be granted in accord with conditions as hereinafter set forth. WHEREAS, the Planning Commission has conducted a duly noticed public hearing at which time all interested parties were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, HE IT RESOLVED that the tentative map for the hereinafter described subdivision, which map is dated the 6th day of September, 1988 and is marked Exhibit A in the hereinabove referred file, be and the same is hereby conditionally approved. The conditions of said approval are as follows: N.A. 1. Pay storm drainage fee in effect at the time of obtaining Final Map approval. Done 2. Submit "Final Map" to City for checking and recordation and pay required fees. Done 3. Submit "Irrevocable Offer of Dedication" to provide for a 30 foot half- street on Cox Avenue. Done 4. Submit "Irrevocable Offer of Dedication" to provide easements as required. Done 5. Improve Cox Avenue to City Standards, including the following: 4 f Ir SD -87- 019.1, Saratoga - Sunnyvale Road a. Designed structural section 20 ft. between center line and face of curb. b. P.C. concrete curb, gutter and sidewalk (V -24) Shown on Improvement 6. Widen Cox Avenue bridge over Rodeo Creek on the southerly side of Cox Avenue to provide 20 feet between the centerline and face Plan of curb, and construct curb, gutter and sidewalk. 7. Improve Saratoga - Sunnyvale Road to City standards, including the following: a. Widen Saratoga - Sunnyvale Road to City standards, at easterly side approximately four feet, and construct curb, gutter and sidewalk for the entire length of the site along Saratoga - Sunnyvale Road. b. Underground existing overhead utilities. 8. Construct storm drainage system as directed by the City Engineer including constructing storm drains with outfalls to Rodeo Creek. Done 9. Install traffic signal system at the intersection of Saratoga - Sunnyvale Road and Pierce Road to Caltran standards. 10. Construct standard driveway approaches. 11. Provide adequate sight distance and remove obstructions of view as required at driveway and access road intersections. 12. Watercourses must be kept free of obstacles which will change, retard or prevent flow. 13. Protective planting required on roadside cuts and fills. Done 14. Obtain encroachment permit from Caltrans for work to be done within State right -of -way. 15. Engineered improvement plans required for: a. Street improvements b. Storm drain construction 16. Pay plan- check and inspection fees as determined from improvement plans. 17. Upon satisfaction of all conditions of tentative subdivision approval, either through performance thereof or the execution by applicant of City's standard form of improvement agreement and 5 SD -87- 019.1, Saratoga - Sunnyvale Road the posing of security satisfactory to City to assure performance thereunder, but in no event later than six (6) months after the date of tentative approval, applicant shall file an application for final building site or subdivision approval. Done 18. Pay the cost of adjusting utilities, signals, etc. to accomplish the improvements described in Condition #'s 7, 8, 9 and 11. N.A. 19. Within sixty (60) days after the granting by City of final map approval, applicant shall file complete applications for such grading and building permits as required to be issued by City for construction of the project. Shown on Tract Map 20. An easement for flood control purposes shall be transferred to the SCVWD per that agency's specifications. A plat and description of the proposed easement shall be submitted to and approved by SCVWD. Shown on Tract Map 21. Ingress - egress easements shall be transferred to SCVWD over the driveway in the commercial area to enable the district to access the proposed easement. All paving should be designed for H -20 loading. Shown On Improvement 22. An easily removable guardrail shall be installed between the Plan commercial parking area and the creek. A curb should be installed three feet back from the guardrail to prevent damage to the guardrail. N.A. 23. All existing trees in the proposed easement shall remain. Done 24. There should be no overbank drainage from the proposed development to the creek. The site's drainage should be incorporated into an existing storm drainage system. If a storm drain outfall into the creek is necessary, it should be designed in accordance with SCVWD standards. N.A. 25. In accordance with District 75 -6, the owner should show any existing wells on the plans. The wells should be properly registered with SCVWD and either maintained or abandoned in accordance with District standards. With Building Plans 26. Install a fence along the easterly side of the SCVWD easement 18 feet back from the top of bank to separate the town houses and pool from the creek. Working with 27. Developer shall install two fire hydrants that meet the Saratoga San Jose Water Works Fire District's specifications. The hydrants shall be installed and accepted prior to final map. Not Done 28. Applicant shall obtain an encroachment permit for any work within the state right -of -way. 6 SD- 87- 019.1, Saratoga - Sunnyvale Road 29. The applicant shall submit C.C.& R.'s for the townhomes to include the following: Approved b Plann � y 1.17CJ a. Maintenance of all common areas; Department b• Prohibition on exterior alterations unless approved by the Planning Department. C. Prohibition on amending the C.C. &R's without consent of the City. These C.C. &R's shall be submitted for Planning Department review and approval prior to final map approval. d. Restriction on the hours of the pool and spa, 8:OOa.m. to 10:00p.m. Done 30. The applicant shall enter into a Landscape Maintenance Agreement with the City for those landscaped areas within the pubic right - of -way. 31. Tree removal prohibited unless in compliance with City requirements. Section 1. Applicant shall sign the agreement to these conditions within 30 days of the passage of this resolution or said resolution shall be void. Section 2. Conditions must be completed within 6 months or approval will expire. Section 3. All applicable requirements of the State, County, City and other Governmental entities must be met. Section 4. Unless appealed pursuant to the requirements of Article 15 -90 of the Saratoga City Code, this resolution shall become effective ten (10) days from the date of adoption.
