The Heritage Preservation Commission received an application for
Heritage Resource Designation for property at 18490 Ravenwood Drive,
known as the Brandenburg House. The applicants are owners of the
property; they initiated the application after receiving notice that
the property is listed on the Heritage Resource Inventory.

II. New Business
A. Application for Heritage Resource Designation - 18390
Ravenwood Drive (Brandenburg House)
V. Young made a brief staff report. Mrs. Colyar, owner
and applicant, was present to answer questions, noting
that the application form was complete in and of itself.
She briefly described the ownership history of the house
and the rehabilitation work she and her husband had done.
Chairman Heid referred to the findings that must be made,
and noted that the house met the selection criteria for
inclusion on the Heritage Resource Inventory.
Commissioner Ansnes expressed her appreciation to the
Colyars for their participation in the designation
program.
MIS Landsness /Cameron to accept the application and
recommend to the City Council approval of the designation
because the property meets criteria (a) and (c) of Section
13- 15.010 of the City Code for designation of a heritage
resource. Motion passed unanimously.
V. Young told Mrs. Colyar the application now would be
forwarded to the City Council for approval; she would
notify Mrs. Colyar of that date.
B. Review planning application for subdivision in the
vicinity of Madrone Hill and Peach Hill Roads.
V. Young gave a brief staff report, noting that the
Heritage Commission was being requested for input on this
project because it involved the rock work which was on the
Inventory preview list.
John DiManto, owner, and Bill Heiss, project engineer,
described the project in detail, emphasizing that the goal
was to preserve as much of the rock work as possible. The
road will follow its present alignment, with some
modifications for fire protection purposes. They noted
that the walls were built between 1924 -1932 with rock from
Knight's Ferry in the Sierra foothills.
The Commission expressed appreciation at the opportunity
to review the project and commended Mr. DiManto for his
commitment to preserving the special-ambiance of the site.
They felt that Lot #2 was the most sensitive in terms of
the building site location. Mr. DiManto noted that the
fountain area and the foot bridge would be preserved. He
further stated that all repair work and new rock
construction would be done by special craftsman to match

structure and describe any major alterations from its original
condition:
This two -story farmhouse was originally surrounded by agricultural lands
with access through a long driveway from Quito Road, principal thoroughfare
in the area. Today the house is surrounded by a residential subdivision.
The front porch now opens onto a short driveway from Ravenwood Drive and a
two -car garage of open lath construction. There are two principal
additions to the original house, a two -story extension to the west with a
decked roof, and a one -story extension to the south connecting the main
house with the former tank house. Both additions are well integrated into
the original house design. The walls of the house are of shiplap siding,
with fishscale shingles in the gable roof end. The front porch features
turned columns, a low railing and a hipped roof. The house has a variety
of wood window types: double -hung, casement and horizontal sliding. A very
large and impressive oak tree overhangs the house.

This house was built in 1888 by C. H. Brandenburg and Hy Hutton.
Mr. Brandenburg and his wife, Sarah, were the original owners. In
1917, the house was purchased by Anna E. Dierks, who added the south
wing and made a number of improvements. In 1953, the house was sold
to George Ansok who, in turn, sold it to his nephew, Arnold Berwick.
Mr. Berwick and his wife retained ownership until 1973.

SUBJECT: TRAFFIC SAFETY IMPIMDENI'S - SOBEY ROAD
Recommended Motion:
Authorize the proposed Traffic-Safety Improvements on Sobey Road and approve
an Appropriation Resolution for the amount of $12,000 dollars to cover the cost
of said improvements.
Report Summary:
The property owner at 14133 Sobey Road (Patrick Moore) has requested that the
City make certain improvements along the outside-of the curve adjacent to his property
located just southwesterly of Sobey Meadows Court. There have been 3 accidents at
this location, all involving single vehicles traveling at an unsafe speed and ending
UP on his property.
The installation of 250 L.F. of guardrail and placing W81 (chevrons) along with
curve warning.sighs• and advisory speed signs, uuuld make this curve much );safes for
not only vehicles but also for the adjacent property.
The Public Commission unanimously supports this proposed traffic safety improvement.
Fiscal-Impacts:
The estimated cost to make the above recommended improvements.is $12,000, and is
presently not budgeted. ,An Appropriation Resolution will have to be adopted trans-
ferring this _amount into the Traffic Safety Budget (3033 - 3010).

Subject: Traffic Safety Improvements - Sobey Road
This is in response to your memorandum of October 4, 1988, con-
cerning the above referenced subject. At their regular meeting
of October 10, 1988, the Public Safety Commission unanimously
supported your recommendation to install curve warning signs and
speed limit signs at both approaches to the curve, install
chevron curve indicators spaces 30 feet apart, and construct 250
lineal feel of standard guardrail along the outside of the curve.
The Commission further recommended that the Council appropriate
the additional $12,000 required to accomplish these improvements.
It should be noted that Mr. Patrick Moore was invited to, and
attended, the PSC meeting in support of his request for improve-
ments to Sobey Road. Should you have any further questions,

SUBJECT: Traffic Safety Inprovements - Sobey Road
We have been requested, by Patrick Moore - 14133 Sobey Road, to make the
following safety inprovements at the curve on Sabey Road just southwesterly
of Scbey Meadows Court: (letter is attached).
1. Post a sign with a speed limit indicating a curve ahead.

2. Reflectors, not just on the street, but positioned on the curve show-
ing the direction of the curve.
3. A guard rail suitable in construction to restrain autos from entering
our Property.
The reason for Mr. Moore's request is that there have been three (3) accidents
during the past year or so, which have involved single vehicles traveling at
an unsafe speed going off the roadway of this curve. All of these accidents
have involved teenage drivers, late at night, with one being under the influence.
(Accident data and diagram is attached). After reviewing the accident reports
and conducting a field analysis the Engineering Department concurs with Mr. Moore's
concerns and we reccetmend the following:
1. Install W3 (curve warning sign) and W6 (20 mph) signs at both approaches
to curve.
2. Install W81 (Chevron) curve indications in a "head on" position, spaced
at 30 feet centers.
3. Construct 250 lineal feet standard guard rail along the outside of
curve.

Estimated cost of the above safety improvements is $12,000, of which is
presently not budgeted. If approved, there would have to be an appropria-
tion resolution by the City Council to cover the cost of these improvements.

Along with the above recation, we would encourage stepped up enforce-
ment on the entire length of Sobey Road particularly late nights and on weekends
to monitor the speeding and drinking drivers.

Re: Accidents on Sobey Road
Dear Mr. Shook:
We've been instructed by your Mr. Ermin Dorsey to write to you
regarding the recent events or accidents at the curve on Sobey
Road, which fronts and is adjacent to our home at 14133 Sobey
Road.
In as much as you've been made aware of this situation, via
your traffic reporting system, and conversations with Mr.
Dorsey, I'll not attempt to cover in detail all that has
occured on this section of road since we've resided at the
above address. I'll only state that my wife and I are
extremely concerned about our and our childrens physical. safety
as well as our emotional well being relative to these continued
accidents.
In the last 10 months, we've experienced three separate
incidents involving automobiles leaving the road and wreck -
lessly entering on to our property. One such accident caused
some $2000.00 in damages to our property. Another involved an
auto winding up nose down in the creek that passes through our
property some 100 feet from the street where the car went out
of control.
All three of these latest accidents have involved teenagers - 9
in total, driving at excessive speeds, at night.
The above three accidents are by now a matter of record.
However, since we've resided at this address, we have exper-
ienced two additional such incidents where motorists have left
the road and wiped -out portions of our once tree lined hedge
and left the scene without notifing us.
Up to this point, all parties involved, the teenagers, my
family and the City of Saratoga, have been extremely lucky - no
one has been killed or seriously injured. However, that is

today. How can this be prevented in the future?
It has been suggested to us that signs could be posted and
additional patrolling could be implemented to deter this type
of accident - all of which may help. However, we doubt that it
will prevent motorists who, for reasons of their own, or who
while driving under the influence, would chose to pay no
attention to either of these two measures.
Therefore, our recommendations would be the following:
1) Post a sign with a speed limit indicating a curve
ahead.
2) Reflectors, not just on the street, but positioned
on the curve showing motorists the direction of
the curve.
3) A guard rail suitable in construction to restrain
autos from entering our property.
We think the above measures would be the minimum precautions
that should be taken in light of what has transpired of late
and especially, in consideration of the future residential
development now taking place in the Sobey Creek area - this
development will surely increase the probability of this kind
of continuing mishap.
I hope our suggestion will assist you in a prompt resolution to
this problem.
I urge you to quickly come to some conclusion for the safety of
all of us.

OBJECTIVES AND PLANNED PERFORMANCE:
To provide for the maintenance of all signs, signals, safety lights,
pavement marking, crosswalks and striping. This activity includes the
personnel equipment, supplies and materials needed to maintain
approximately 128 miles of City streets. With the proper regulatory
and informational signs, pavement marking and street name signs.
This also includes the expenses of traffic signal maintenance repairs,
electrical energy for the operation of the signals. This activity also
funds the 24 hour emergency response to install and repair all
regulatory signs. Street name signs which have lost their reflectivity
will be replaced during this fiscal year. Lane lines and center lines
throughout the City will be restriped.

BACKGROUND

The Residential Design Handbook has been under preparation by the
Saratoga Planning Department staff and Planning Commission for the
past year. The purpose of the Handbook is to assist in the
implementation of the City's single - family residential design
review regulations, which appear as Article 15 -45 of the City Code.
No changes to those regulations are proposed in the Handbook.
Rather, the design policies and implementation techniques set forth
in the Handbook embody the intent of the findings that must be made
for design review applications. The handbook will serve as a guide
to the citizens of Saratoga, architects and developers, and the City
Council, Planning Commission and Planning Staff in the design review
process for both new single - family residences and the remodeling of
existing homes.
The Handbook is organized into two sections. The first section
outlines the five broad single - family residential design policies
for Saratoga, which are:
1) Minimize perception of bulk
2) Integrate structures with environment
3) Avoid interference with privacy
4) Preserve views and access to views
5) Design for energy efficiency
Each policy is briefly defined, then followed by design techniques
that can be used to achieve the intent of the policy.
The second section of the Handbook contains the residential zoning
standards that apply to single- family residential development, which
are:

1) Height

3) Impervious coverage
4) Allowable floor area
The second section also contains information on the City's tree
removal and fence regulations. Diagrams and sketches are used
throughout the Handbook to illustrate the policies, techniques, and
standards. After the Handbook is adopted, it will be professionally
printed, with the use of color in the diagrams and sketches and the
addition of a logo to the front cover.
PUBLIC NOTICE
This item was advertised as a public hearing when the Planning
Commission heard the item on October 12, 1988. Public notice
was given by legal and display ads in the Saratoga News, mailing to
the Community Mailing List and mailing to the original list of
developers /architects /designers who received notice on the design
review amendments last year. No one from the public spoke on this
item at that meeting. Council adoption of the Handbook by
resolution does not require a public hearing. For this reason, and
because no one spoke on the item at the Planning Commission meeting,
Staff has not re- advertised the item.
ACTION BY THE COUNCIL
At its October 12, 1988 meeting, the Planning Commission unanimously
recommended to the City Council adoption of the Handbook, with a few
minor changes. The Commission further recommended that consistency
with the Handbook be referenced in Section 15- 45.050 (Additional
Standards and Guidelines) of the design review regulations, as a
third item between a standard and a guideline. If the Council
concurs with both recommendations of the Commission, the appropriate
action would be to adopt the Residential Design Handbook by
resolution. After the Council adopts the Handbook, Staff will
proceed with preparing the document for publication and
distribution, and the City Attorney will prepare a Zoning Code
Amendment to reference the document.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA ADOPTING THE RESIDENTIAL DESIGN HANDBOOK
WHEREAS, the City of Saratoga adopted revised design review
regulations (Ordinance 71.27) in October, 1987, establishing
standards, guidelines and procedures for the review of single family
dwellings in residential districts; and
WHEREAS, a RESIDENTIAL DESIGN HANDBOOK has been prepared to
assist in the implementation of those regulations (Article 15 -45 of
the City Code); and
WHEREAS, no changes to those regulations are proposed in the
Handbook; and
WHEREAS, the Handbook will serve as a guide to the citizens of
Saratoga, architects and developers, City Council, Planning
Commission and City Staff in the design review process for both new
single - family residences and the remodeling of existing homes; and
WHEREAS, the design policies and implementation techniques set
forth in the Handbook embody the intent of the findings that must be

NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Saratoga hereby adopts the Residential Design Handbook, set
forth in Exhibit "A" and incorporated herein by reference.

Commissioner Siegfried noted that the Oak tree was on the property line; he questioned how the
house could be oriented to take advantage of the tree; the living area could not be placed within 10
ft. of the sideyard setback area.
Commissioner Harris responded that perhaps adjoining houses could open out onto a common
driveway. She noted that the fence was placed directly under the tree and asked the Applicant to
address this situation.
The Public Hearing was opened at 8:29 P.M.
The Project Architect stated that the home was designed and sited as requested by the Applicants.
He concurred that the Oak tree was beautiful, especially from a distance; however, the view from
the home would be that of a very large trunk. He did not feel applicants could be required to share
a common driveway
BURGER/TUCKER MOVED TO CLOSE PUBLIC HEARINGS AT 8:31 P.M. Passed 7 -0.
Commissioner Burger noted the site constraints and agreed that the beauty of the tree was better
viewed from a distance. Commissioner Siegfried concurred and added that the 19 ft. height
proposed was in keeping with the site and the Oak tree.
Commissioner Kolstad agreed it would be nice to better utilize the Oak tree; however, a 60 inch
trunk limited the possibilities. He noted the shading from the Oak that would benefit the house.
SIEGFRIEDBURGER MOVED APPROVAL OF DR -88 -073 PER THE MODEL RESOLUTION

SIEGFRIED /HARRIS MOVED TO CLOSE PUBLIC HEARINGS AT 8:35 P.M. Passed 7 -0.
Commissioner Harris thought that at the Commissioner's Retreat, Page 13., A Technique Regard-
ing Landscaping, had included wording on the "use of full, compact plants against buildings and
cascading plants above and on front of retaining walls; tall, slender and spare plants away from
buildings, lining driveways, walkways, etc." Planner Young stated that the concept would be
included in the Residential Design Handbook by adding an appropriate phrase.
Commissioner Burger suggested that Page 21. be titled, Use Landscaping to Enhance Privacy.
In response to questions about how the Handboo should be referenced in the City Code, the City
Attorney discussed differences between standards and guidelines; he noted that it was important
that the Commission have the ability to enforce design concepts contained in the Handbook. There
was consensus among the Commission to direct the City Attorney to site the Handbook in the City
Code.

Recommended Motion:
By minute motion, waive the $400 filing fee.
Report Summary: Per the attached letter dated October 7, 1988, Mr. Mike
Costanzo, the junior class advisor for Saratoga High, has requested a
waiver of the required $400 filing fee for a temporary use permit to sell
Christmas trees. The Council has previously waived school fees (sign
permit, March 2, 1988), so the precedent has been established. Waiving
the fee would be consistent with the past Council action and is appropriate '
given that the school district, like the City, is supported by taxes.
Fiscal Impacts: Loss of $400 filing fee.

The Saratoga High junior class is currently planning a
fund raiser of selling Christmas trees. As part of the
process for this fund raiser we are required to apply for a
"use permit ". We are requesting that the fee for this permit
be waived on the basis that we too are a public agency and
are a non - profit organization. Thank you very much for your
consideration of this matter as it is vital for us to be
granted a waiver if we are going to sell these trees.

Recommended Motion:
Adopt resolution declaring weeds growing on certain described
property to be a public nuisance.
Report Summary:
The attached resolution represents the first step in Saratoga's
annual weed abatement program administered by the County Building
Official. The County has determined that 378 parcels in Saratoga
this year have excessive weed growth which is a fire hazard or
otherwise noxious or dangerous. The Council should pass the
resolution setting the public hearing for weed abatement -- December 7
this year. The County then sends the owners of the 378 parcels
notices informing them that the weeds must be abated, either by the
owners or by the County; when County abatement will commence; and how
they may present any objections at the public hearing. The public
hearing is noticed in the newspapers as well. After the public
hearing, the Council passes another resolution ordering abatement on
properties whose owners did not object or whose objections the Coucil
felt were invalid. The final steps take place next summer, when the
County presents the Council with a list of properties whose abatement
bills have not been paid, and the Council, after hearing any
objections, passes a resolution declaring liens on those properties.
These procedures are the same as those followed for the last several
years.
Fiscal Impacts•
None to City. County recovers its costs from administrative portion
of fee charged to property owners.

RESOLUTION APPROVING TENTATIVE MAP OF
Fox & Carskadon, 12029 Prospect Rd.
WHEREAS, application has been made to the Advisory Agency under
the Subdivision Map Act of the State of California and under the
Subdivision Ordinance of the City of Saratoga, for tentative map
approval of a lot, site or subdivisions of 1 lots, all as more
particularly set forth in File No. SD -87 -007 of this City, and
WHEREAS, this Advisory Agency hereby finds that the proposed
subdivision, together with the provisions for its design and
improvement, is consistent with the Saratoga General Plan and with
all specific plans relating thereto, and the proposed subdivision
and land use is compatible with the objectives, policies and general
land use and programs specified in such General Plan, reference to
the Staff Report dated December 9l 1987 being hereby made for
further particulars, and
WHEREAS, this body has heretofor received and considered the
(Categorical Exemption) prepared for this project in accord with the
currently applicable provisions of CEQA, and
WHEREAS, none of the conditions set forth in Subsections (a)
through (g) of Government Code Section 66474 exist with respect to
said subdivision, and tentative approved should be granted in accord
with conditions as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED that the tentative map for the
hereinafter described subdivision, which map is dated the 23rd day
of November, 1987 and is marked Exhibit C in the hereinabovereferred
to file, be and the same is hereby conditionally approved. The

shall be installed, tested and accepted by the Central
Fire District prior to the issuance of a building permit.

IV. Specific Conditions _ Santa Clara Valley Water District
A. As a condition of development, applicant shall dedicate an
easement for flood control purposes. The easement should
be essentially 22 feet from the high bank of the creek.
No access road or removal of any tree is permitted in this
easement. In order to obtain access to the easement,
applicant shall provide a general ingress /egress easement
over the adjacent parking area.
B. In accordance with District Ordinance 83 -1, the owner
should show any existing well(s) on the plans. The
well(s), if any, should be properly registered with the
District and either maintained or abandoned in accordance
with District standards. We request that any wells be
sealed in accordance with District standards unless they
are to be used for the proposed development. In this
case, they should only be used after proper testing and
inspection. Applicant shall provide written confirmation
regarding the existence of any wells and their proposed
disposition.
C. Plans for improvements within 50 feet of the creek must be
sent to the District for review and issuance of a permit.

This agreement between the CITY OF SARATOGA, hereinafter referred
to as CITY, and EMFT J. CASEIN &.DOFOlIff C. CASEIN
hereinafter referred to as "Owner ".
WHEREAS, Owner desires to develop the property described in Exhibit
"A" but wishes to defer construction of permanent improvements beyond the
time limits otherwise required and City agrees to such deferment provided
Owner agrees to construct improvements as herein provided.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
I. AGREEMENT BINDING ON SUCCESSORS IN INTEREST
This agreement is an instrument affecting the title and posses-
sion of the real property described-in Exhibit "A ". All the terms, cove-
nants and conditions herein imposed shall be binding upon and inure to the
benefit of the successors in interest of Owner. Upon any sale or division
of the property described in Exhibit "A ", the terms of this agreement shall
apply separately to each parcel and the owner of each parcel shall succeed
to the obligations imposed on Owner by this agreement.
II. STREET AND DRAINAGE IMPROVEMENTS
A. City and Owner agree that the improvements set forth in this
section may be deferred because:
The public interest is served by having all improvements for landscape
medians along Saratoga- sunnyvale Road done at one time, that time to be
determined in the future.
B. Owner agrees to construct the following improvements on the pro-
perty described in Exhibit "A" as well as required off site improvements in
the manner set forth in this agreement:

erally described on Exhibit "B ". (Cross out improvements that are not re-

All or any portion of said improvements may be required at' a specified
time. Each Owner shall participate on a pro rats basis in the cost of the
improvements to be installed. If Owner is obligated to pay a pro rata
share of a cost of a facility provided by others, the notice shall include
the amountta be paid and the time when payment must be made.
III. PERFOM\LANCE• OF THE WORK
Owner agrees to perform-the work and make the payments required by
City as set fo -th herein or as modified by the City Council. Owner shall
cause plans Pnd specifications for the improvements to be prepared by com-
petent persons legally : - qualified to do the work and to submit said improve
nlent plans and specifications For approval prior to commencement of the
work described in the notice, and to pay City inspection fees. 'The work
shall be done in accordance with City standards in effect at the time the
improvement plans are submitted for approval. .Owner agrees to cormence
and complete the work within the time specified in the notice given by the
Director Of Public Wprks and to notify the City at least 48 hours prior to
start of work. In the event Owner fails to construct any improvements re-
quired under this agreement, City may, at its option do the work and colle
all the costs from Owner, which costs 'shall be a lien on all. the property
described in Exhibit "A" hereof. Permission to enter onto the property
of the Owner is granted to City or its contractor as may be necessary to
construct such improvements.
IV. JOINT COOPFRAT'IVE PLAN
Owner agrees to cooperate upon notice.by City with other property
.owners, the City and other public agencies* to provide the improvements
set forth herein under a joint cooperative plan including the formation
of a local improvement district, if this method is feasible to secure the
installation and construction of the improvements.
V REVIEW OF REOUIREMENTS
If Owner disagrees with the requirements set forth in any notice
to commence installation of improvements he shall, within 30 days of the
date the notice was mailed, request a review of the requirements by the
City Council. The decision of this Council shall be binding upon both
the.City and the Owner.
VI MAUNTENANCF. OF IMPROM!E•NTS
City agrees to accept for maintenance those improvements speqified
in Section II which are constructed and completed in. accordance with City
standards and requirements and are installed within rights -of -way or ease-
ments dedicated and accepted by resolution of the City, after the expira-
tion of one year frorn date of satisfactory completion, Owner to maintain
said improvements at Owm cr's sole cost and expense at all times prior to 1'
such acceptance by City.

access road or other required improvements, to assume responsibility for
the proper fuactioninl; thereof, to submit plans to the appropriate City
agency for review, if required, and to maintain said improvements and

That certain property situated in the City of Saratoga,
County of Santa Clara, State of California, more particularly
described as follows:
That real property shown as Lot A on the Final Parcel Map
recorded in Book of Maps, Page in the County
of Santa Clara.
EXHIIBIT "B"
Owner agrees to pay pro-rate share and participate in the
Assessment District for Landscape Medians along Saratoga - Sunnyvale
Road between Prospect Road and the Southern Pacific Railroad crossing.

Prior to approval of improvement plans by the City, Owner may be
required to execute and deliver to City a 'faithful performance bond and
.n labor and materials bond in an nniount and form acceptablelto City,_to
be released by City Council in whole or in part upon completion of the
work required and payment of all persons furnishing labor and materials
iii the perfornnande of the work.
VIII. INSURANCE
Owner shall maintain or shall require any contractor engaged to
perform the work to maintain, at all times during.the performance of the
work called for herein, a separate policy of insurance in a form and
amount acceptable to City,
IX. INDEMNITY
The Owner shall assume the defense and indemnify and save harmless
the City, its officers, agents and employees, from every expense, liability
or payment by reason of injury, including death, to persons, or damage to ,
property suffered through any act or omission, including passive negligence
or act of negligence, or both, of the Owner, his employees, agents, con-
tractors, subcontractors, or his employees, agents, contractors, subcontrac-
tors, or anyone directly or indirectly employed by either of them, or
• arising in any way from the work called for by this agreement, or any part
of the premises, including those matters arising out of the deferment of
permanent drainage facilities or the adequacy, safety, use or non -use of
temporary drainage facilities, the performance or non - performance of the
work.
