SUBJECT: Resolution amending fee schedule to reduce the fees for both administrative and Planning Commission appeals. RECOMMENDED MOTION: Adopt the attached Resolution amending the Fee Schedule to reduce appeal fees to $150 for appeals of administrative decisions to the Planning Commission and to $250 for appeals of Planning Commission public hearing decisions to the City Council. REPORT SUMMARY: Upon the recent adoption of the FY 1997/98 and 1998/99 Budget and Fee Schedule, the City Council discussed lowering Saratoga's current appeal fees. At the October 21, 1997 regular adjourned meeting, the Council directed staff to prepare the attached Resolution amending the fee schedule for the November 50' meeting. Specifically, the Council moved to adopt the following fees on a trial basis for the remainder of this fiscal year: • $150 for appeals of administrative decisions to the Planning Commission • $250 for appeals of Planning Commission public hearing decisions to the City Council The current fees are $450 and $675, respectively. FISCAL IMPACTS: It is unknown at this time if reducing the appeal fees will result in an increased number of appeals and staffing expenditures. At the end of FY 1998, staff and the City Council can evaluate the number of appeals submitted and the costs and benefits of the reduced fees. The Appeal Fees Page Two Council could then decide to maintain the lowered fees, adjust them or consider other alternatives to off -set any additional unrecovered costs incurred. ADVERTISING, NOTICING AND PUBLIC CONTACT: Nothing additional. CONSEQUENCES OF NOT ACTING ON RECOMMENDED MOTION: The Resolution will not be adopted and the appeal fees would remain $450 and $675. An explanation from the City Attorney of the role of Dr. Rhea Williamson as an independent expert consultant retained by the City to produce a report on Saratoga Creek water quality issues. 2. A briefing session by Santa Clara Valley Water District staff about the Urban Creek Assessment Program (UCAP). 3. An evaluation by staff of certain issues raised in connection with Dr. Williamson's report and subsequent presentation to the City Council. 4. August 29, 1997 letter from Mr. Sam Mitchell (14969 Jerries Drive) re: Saratoga Creek Materials on the above four items are attached to this memo. -76 (3J4) TO: Mayor & City Council FROM: Interim City Manager SUBJECT: Saratoga Creek Coliform Investigation prepared by Dr. Rhea Williamson & August 29, 1997 letter from Sam Mitchell (14969 Jerries Drive) DATE: October 31, 1997 Summary: The subject report dated December 30, 1996 was presented to the City Council on February 5, 1997 (see attached minutes). At the May 7, 1997 Council meeting, Messrs. Schwartz and Whetstone presented the Council with a list of 15 "Issues that should be examined" about Dr. Williamson's report and her presentation to the Council (also attached). At the October 1, 1997 Council meeting, the Council requested staff to evaluate the 15 issues. This memo provides staff's evaluation and recommends further actions the Council may wish to consider to address the elevated levels of coliform bacteria observed in Saratoga Creek. Evaluation of issues re: Williamson report and presentation: Dr. Williamson's report is the result of an independent scientific study commissioned by the City to assess certain water quality characteristics of urban creeks, and more particularly, coliform bacteria levels documented for Saratoga Creek. Dr. Williamson performed no water quality tests as part of her contract work. Instead, she relied on data provided by the City as well as other published data such as that available through the State's STORET data base. Her conclusions in the report appear to be based upon a review of all available data and are drawn from her knowledge as an expert in the subject matter. On the contrary, the 15 issues raised by Messrs. Schwartz and Whetstone are not supported to my knowledge by any similar scientific expert analysis. Further, in my opinion, they do not provide enough contradictory evidence to dispute the basic conclusions reached by Dr. Williamson and stated in her report (see attached report pages). Dr. Donald E. Kirk, Dean of the College of Engineering at San Jose State University, has also reviewed the 15 issues. His comments are contained in a June 19 letter to Mr. Whetstone (copy attached). From my "layperson's" point of view, Dr. Kirk's comments satisfactorily and appropriately address each of the 15 issues, and there is little more that I, as City staff, would add to his comments. August 29, 1997 from Sam Mitchell: The attached letter dated August 29 from Mr. Mitchell makes two recommendations. First, that the City send information about elevated bacteria levels in Saratoga Creek to creekside property owners with guidelines for safely engaging in contact with the creek. Second, that the City replace the existing warning signs along the creek with signs that indicate that elevated bacteria levels do occur in the creek. I agree with both of Mr. Mitchell's suggestions and recommend the Council authorize staff to follow up with both as part of the current year's Storm Water Management Program efforts. The Coyote Creek Riparian Station through their ongoing contract work with the City could be requested to both produce and distribute an informational brochure to creekside property owners, and new signs could be developed, acquired and installed by Public Works staff. Neither of these two efforts should cost very much, and I'm confident that there are sufficient funds available in the stormwater management program budget to cover these costs. Additional Recommendations: As for further actions the City could consider to address water quality concerns about the creek, I recommend the following: That the City explore options for requiring the abandonment of septic systems in the City beyond what requirements currently exist, including the possibility of initiating some sort of incentive program to encourage property owners served by septic systems to connect to the sanitary sewer system. This will very likely require close coordination between the City and the West Valley Sanitation and Cupertino Sanitary Districts and the resources of the City Attorney's office to research what sort of police powers are available to the City in this regard. 2. That the City continue to cooperate with the UCAP staff as they continue their pilot study to pinpoint sources of coliform bacteria in the creek. Larry I. Perlin attachments: 1. BY CONSENSUS, COUNCIL APPROVED THE MINUTES OF JANUARY 15 AND JANUARY 21 AS CORRECTED. There was a recess from 9:37 -9:47 p.m. 10. CITY COUNCIL ITEMS 'Mayor Moran moved the agenda to Item 10.B. B. Report from Dr. Rhea Williamson on Saratoga Creek Coliform Investigation Director of Public Works Perlin introduced Dr. Rhea Williamson, Associate Professor in the Department of Civil Engineering and Applied Mechanics at San Jose State University and a recognized expert in the fields of water quality and water chemistry and some of the environmental sciences. About a year ago, Council approved an agreement for Dr. Williamson to look into water quality issues of Saratoga Creek and prepare a report. She and some of her graduate students have done that and she will summarize their findings tonight. Dr. Williamson showed overheads which summarized the 5 tasks undertaken in the study as follow: 1. Review existing data. 2. Identify potential contaminants and sources. 3. Analysis of impact of dry weather storm drain flows algae growth conditions. 4. Review of Coliform levels in other water bodies. 5. Review of health based Coliform levels. She noted that while indicator organisms are present when pathogens are, pathogens are not always present when indicator organisms are. She answered Council's questions about fecal Coliform levels at various locations in the Creek. She said she and her students had hiked the creek and taken photographs. Councilmember Bogosian asked a series of questions which Dr. Williamson answered as shown below (not verbatim): 1. Bogosian: Did you consider the possibility of sags in the drain lines that could accumulate material that would explain high levels of fecal coliform at the outfall into Saratoga Creek at Big Basin Way and Saratoga - Sunnyvale? Williamson: We had some conversations about sagging and where there would be accumulation, and I reviewed documents which mentioned some sags. I understood that had been resolved, but that might be a better question for Mr. Perlin. But we did not do testing or monitoring during the city Council Minutes 1997 February 5, study; we looked at existing data. Jacobs: I presume any creek has numerous spots where greater levels of fecal coliform could accumulate. Did you say areas in the hills had high levels? Williamson: There are areas well above the Village where there are levels of fecal coliform higher than the published standards. Jacobs: I understand that even in the relatively wild streams of our national parks there are high levels of fecal coliform. Perhaps the only way to control fecal coliform would be to have the Corps of Engineers concrete and fence the entire creek. Williamson: There are various other methods that can be used. One factor is that there is a large number of animals that may use storm drains as passageways; there are no bars on the storm drains. Jacobs: Even if the animals didn't go into the drains, if they were in the creek their wastes would flow into the•creek. Williamson: Yes. 2. Bogosian: You indicated that there were higher- than - government standard levels both in the hills and below the Village, but the levels were much greater than that in the outfall at Saratoga - Sunnyvale Rd. Williamson: That's right. Wolfe: Is the level higher than from outfalls in other urban creeks? Williamson: No, it is within the reported ranges. ,3. Bogosian: How do you know there are animals in storm drains? Williamson: We stated that these were potential sources of contaminants. We asked County Vector Control Agency about animals in storm drains. We have anecdotal information but could .not get numbers of wild animals such as opossums or deer. The Coyote Creek Riparian Station has given out information about skunks and raccoons. 4. Bogosian: Do you have anything to substantiate the anecdotal information? Williamson: We did site reconnaissance and looked at all the storm drains entering the creek at Fourth Street and other sites. We took photographs during the reconnaissanceand did observe materials such as horse manure, diapers, etc. that could end up in the creek during a storm. Jeff Schwartz said his Ph.D. is in experimental psychology. He said Saratoga Creek has been the subject of controversy, conflict and litigation. He identified himself as one of the principals in Friends of Santa Clara County Creeks, one of two plaintiffs who have been in litigation in Federal court against the City of Saratoga over the issue of enforcement of the Clean Water Act and clean water standards in Saratoga Creek. He said he thought it was unfair and misleading to have had a presentation without making a similar acknowledgment of Dr. Williamson's role as an expert witness for the City. He said the expert witnesses for the Friends group have reached remarkably different conclusions. Mr. Schwartz said the report is not a study but more of an essay. There was no testing done, nor did the report review the videos, or have access to the videotapes and photos that the Friends had provided. He said the report is far more speculation on what may be causing pollution in the creek than it is providing any new information on the causes of existing pollution. One area of agreement is that there are federally applicable standards for contact recreation water. In regard to some of the common misunderstandings, he said we are talking about dry weather flow but most of the report deals with wet weather explanations. -He described the results of testing of samples he had taken at the upper reaches of the Creek and those taken in the Village portion of the Creek. In regard to the statements about animal droppings, he said they wouldn't get into the Creek except in wet weather flow. He said the whole approach is wrong, there is very poor evidence to support the findings, and the situation is not substantially as the report would present it. He said the report did not contain any new information. Councilmember Jacobs observed that he did not think there had been acknowledgment by anyone in the City that federal recreational water standards apply to the Creek, but those standards can be used. City Council Minutes 8 February 5, 1997 Rick Jarvis, attorney representing the City in the litigation, said the standards in the basic plan do legally apply to all the creeks in the area. However, any knowledgeable expert will agree that those standards are not realistic for urban creeks and that they should not apply to those creeks. Councilmember Wolfe asked if Dr. Williamson believed that the children in the photographs of an urban creek in San Luis Obispo were in danger, and is Saratoga Creek different from that one. Dr. Williamson said she would be willing to state that she would expect that water quality data here would be similar to many creeks. Discussion followed regarding the possibility of septic tanks being a solution for the higher incidence of indicator organisms in Saratoga Creek. Dr. Williamson said she had found no documentation relating to this. Public Works Director Perlin said it is important to recognize that the City is not responsible for regulation of septic systems. They are regulated by the County Department of Environmental Health. In addition, the sewer system is not owned and operated by the City. One of the difficulties is the City does not control them and has to rely on other agencies carrying out their responsibilities. In regard to septic tanks, Mr. Perlin said a survey had been done a few years ago and in all cases septic systems were functioning adequately. In answer to Councilmember Bogosian's questions regarding Dr. Williamson's knowledge of the existence of springs she said she had not 'been given maps pinpointing the location of springs. Mayor Moran clarified that it was not the intention to collect samples, but the focus was on existing data. Dr. Williamson said they had looked at data provided by the Santa Clara Valley Water District. Mayor Moran thanked Dr. Williamson and moved the agenda to Item 10A. A. Agenda items for adjourned regular meeting February 11 1) Joint Meeting with Planning Commission Councilmembers requested that staff provide them with a history of leaf blower issues including a communication from a citizen that had an article attached. 2) Closed Session on Phipps Appeal of Constantin Project 3) Report on Study Issues Form City Manager Peacock explained that this form was brought forward by the Heritage Preservation Commission. C. Other Referring to a recent Planning Commission hearing regarding Starbuck's, Councilmember Shaw asked the City Attorney to advise the Commission to proceed with more open meetings in the future, as he was led to believe that testimony regarding economic viability was not allowed to be considered. City Attorney Riback responded that the state of law is clear that economic viability of other businesses is not a subject that can be used in a land use context to determine whether or not a new business should be allowed in the community. One exception is if a community has made a determination that only a certain number of a particular type of business be allowed. Mr. Riback said he had advised Mr. Curtis of this provision of law. City Manager Peacock clarified when the City held hearings, stating Williamson Final Report and Presentation to Council ISSUES THAT SHOULD BE EXAMINED 1. The 920 MPN data (above Saratoga Springs) is false and is the sole basis of one key conclusion in Williamson's report and is one half of the basis for another key conclusion. 2. "And then of course when you get to Crestbrook Drive, Saratoga Creek at Crestbrook Drive, the numbers are in the same range as what we found up above Saratoga Springs.". (Council meeting transcript, lines 375 -383). "and then when you get to Crestbrdok Drive... the numbers are in the same range as what we found up above Saratoga Springs." (Council meeting transcript, lines 467- 471.) False conclusion. No such data. Numbers at Crestbrook Drive do not begin to. decrease to the levels found above Saratoga Springs. 3. "Data for the FC /FS ratio indicate that the origin ... are of non-human sources." (Final Report; Executive Summary; page 1; Council meeting transcript, lines 246- 250.) That conclusion is based on a ratio that is no longer used or accepted 4. "The apparent incidence of water borne illness related to surface water contact in Santa Clara and Santa Cruz counties is low to non - existent." (Final report, Executive Summary, page 3.) There is no data or other evidence to support that conclusion. 5. "There is extremely limited data available in dry weather flows within Saratoga Creek." (Council meeting transcript, page 3.) "In summary, there are very few data available that would help in identifying the sources and /or causes of total and fecal coliform numbers during dry flow conditions in storm drain lines, including the outfall at Saratoga - Sunnyvale Road." (Final report, page 12.) False statements. There is far more dry weather data available for Saratoga Creek than runoff and /or rainy season data. Her report focuses on storm water runoff, when the issue here is and has been dry weather flows. 6. "Direct deposits of wildlife and domestic animal feces may be responsible for elevated dry weather numbers." (Final report; Executive Summary, page 2.) No data or other evidence to support this conclusion. To the contrary, over the last four years many individuals have been in the creek to collect samples or for observations, without a single report of animal feces deposited directly in the creek. 7. "But one thing that we did determine is that there are an enormous number of wild animals, raccoons, opossums, ..." (Council meeting transcript, lines 407- 408.) "We have no way of actual counting (animal populations)." (Council meeting transcript, lines 492 -493.) "Santa Clara County Vector Control does not have a record of any wildlife nuisances in this area." (Final report, page 8.) Only Issues That Should Be Examined May 6, 1997 information cited indicates no exceptional numbers of animals. There are ways to count., including scientifically well established protocols. 8. "There were two point sources identified. This was to the outfall..." (Council meeting transcript, lines 87 -89.) Not true. More than two such sources identified. 9. "There is indication that Saratoga Creek does exceed the criteria set by the Regional Water Quality Control Board on occasion." (Council meeting transcript, lines 173 -177.) There are places, particularly at Saratoga - Sunnyvale Big Basin Way interchange there, at the storm drain, where fecal coliform levels have been fairly elevated on particular specific dates, and on one day you could go in and measure a level of greater than 16,000 and the next day measure a level that meets the standard." (Council meeting transcript, lines 322 -325.) Grossly misleading. The available data demonstrate these RWQCB and federal standards have been exceeded almost all the time. (For ex., at Crestbrook Drive, 59 of the 63 samples collected by UCAP through 1215196 exceeded those federal limits). That is not. "occasionally", or "one day this, one day that ". 10. "What we did with our database was to try to focus on urban creeks located within the Bay Area so that we could eliminate any differences in climate, differences in slopes of the land, different types of land uses - we focused on urban creeks." (Council meeting transcript, lines 49 -51.) Bay Area creeks differ dramatically in climate, slope, etc. (Santa Cruz creeks vs. Contra Costa creeks, for ex.). 11. "There is a limited number of septic systems located within the City of Saratoga." (Final report; Executive Summary, page 1; Council meeting transcript, lines 814- 815.) The number of septic systems within Saratoga is unknown. 12. "I've been in Saratoga Creek in my reconnaissance and walked over horse manure, I've seen baby diapers in that creek." (Council meeting transcript, lines 331 -333.) Final report provides detailed description of other findings during reconnaissance (e.g. restaurants), but there is no indication of these observations presented. 13. Dr. Williamson did not review available data and information concerning the known sags in the storm sewer lines, and she did not review and is not familiar with the videotapes and photographs that are in the City's files on this matter. She additionally did not familiarize herself with the situation with regard to septic systems within the City of Saratoga. 14. The only significant independent observation in the report was the finding that the situation behind the Big Basin restaurants continues to exhibit grease in storm drains, overflowing dumpster areas, unsecured tallow and other waste containers, etc. This important observation, confirming that this long standing creek pollution problem remains unabated, was omitted from both the summary and the conclusions of the final report in favor of a contradictory conclusion that the consultant's client was doing an effective and good faith effort to prevent such situations. /Y . Ia( -efTnl dafa ,t,jtd, ,,of af( //Y dq- tz . 2 In 1993, restaurants were identified as a major source of illegal discharges to the storm drain system (Letter to Steven R. Ritchie from H.R. Peacock, April 22, 1993). As a result, an outreach program aimed at restaurants and food establishments was initiated in 1994 to address the disposal of putrescible wastes, grease and oil, and other related problems. In 1994, the City was one of two co- permittees to participate on the Restaurant Task Force. The purpose of this task force was to develop a pilot outreach program targeted at restaurants and food service establishments. As part of the task force development, Environmental Health restaurant inspectors have been encouraged to incorporate inspections related to NPS issues. The City has also worked with the Fire District to implement inspections of commercial properties for compliance with NPS standards. New Development and Construction Controls Program. The City of Saratoga currently routes new or redevelopment projects to the Public Works Director for review and inspection. The City has mandated required construction BMPs for new developments and for projects covered by a State General Permit. These BMPs include controls for erosion, prevention of spills and leaks, and other runoff controls (SCVNPSPCP, 1995). Public Agency Control Measures. As of September 1, 1995, the following control measures have been implemented in the City of Saratoga to aid in the prevention of pollution entering the storm drain system: street sweeping, litter pick -up and control, storm drain inlet/line cleaning, cleaning of drainage channels, recycling, and household hazardous waste disposal (SCVNPSPCP, 1995) 4.0 CONCLUSIONS As a result of the investigation of the presence of coliforms in Saratoga Creek for the City of Saratoga, several notable conclusions can be made. These are summarized below. Conclusions Based on our review of data pertinent to water quality in Saratoga Creek, numerous documents on file with the City of Saratoga, the Santa Clara Valley Water District, the West Valley Sanitation District and numerous other offices; telephone' conversations with a large number of individuals; a literature review; a survey of urban creeks, and other information contained in this report, it appears that the City of Saratoga is making a good effort to reduce the impact of debris, wastes, illegal discharges, and other potential sources of indicator organisms to Saratoga Creek. Saratoga Creek is similar to most urban creeks located in the San Francisco Bay area with respect to total and fecal coliforms concentrations. While levels do sometimes exceed the criteria set by the RWQCB, there is no evidence to date of associated illnesses. Specific statements that support these conclusions follow. Saratoga Creek Final Report Page 28 • During the search of existing data, we found that limited data are available for several of the locations historically monitored. When multiple data points for a location were available, the numbers for total and fecal coliforms were generally variable. Data for the FC /FS ratio indicate that the origin of the fecal coliforms and fecal streptococci are of non -human sources (FC /FS < 0.7). • Within the developed Saratoga Creek watershed, several potential sources of total and fecal coliforms were identified. In general, the sources are likely associated with residential land uses and urban runoff. These sources include wastewater from sanitary sewers, stormwater (sanitary sewer overflow and urban runoff), recreational activities, septic systems, wildlife, horses, dogs, and cats. Review of available documents indicate that efforts to reduce the pathogen numbers in Saratoga Creek are extensive and on going. In evaluating the most likely sources of pathogens, the following information is of great value: 1. In FY 1994 -1995, no illicit sanitary sewer connections to the storm sewer were identified (SCVNPSPCP, 1995). 2. Numerous recreational activities were identified during the site reconnaissance of Saratoga Creek on January 20, 1996, including hiking, horseback riding, and picnicking. There are also camping facilities and RV hookups at campgrounds located along the creek. These activities can result in increased coliform levels in the creek due to inappropriate waste disposal, and inputs of animal and human feces along the trails. 3. There is a limited number of septic systems located within the City of Saratoga. In 1993, the City of Saratoga completed an investigation of parcels without sewer connection permits that are adjacent to Saratoga Creek and found no evidence of septage seeping into the creek from any of the properties examined. 4. Wildlife species which may be present in the Saratoga Creek watershed include rabbits, mice, raccoons, opossum, coyote, black tailed deer, bobcat, roof rats, Norway rats, bats, skunk, and various species of birds. Santa Clara County Vector Control personnel stated that wildlife, such as raccoon, opossum, and skunk, may be using the storm drain system as a transportation route or dwelling (R. Parman, pers. comm., 19 January 1996). Additionally, rats and raccoon may be attracted to food wastes generated by the downtown restaurants. Wildlife can contribute significant amounts of fecal matter to a natural system. Saratoga Creek Final Report Page 29 5. Throughout the Saratoga Creek watershed are numerous trails frequented by equestrians. Often the trails follow along Saratoga Creek or its tributaries (e.g., along Sanborn Creek). Horse manure is often observed along the trails. This manure will ultimately end in the creek during a storm event, resulting in significant loading of pathogens (i.e., 12,600 and 6,300,000 fecal coliforms and fecal streptococci, respectively per gram of horse feces). 6. The contribution of dog and cat feces to the water bodies in the Saratoga Creek watershed could be significant. The average density of fecal coliforms and fecal streptococci per gram of cat feces is 7,900,000 and 27,000,000, respectively. The average density of fecal coliforms and fecal streptococci per gram of dog feces is 23,000,000 and 980,000,000, respectively. • In summary, there are multiple potential sources of coliforms to Saratoga Creek. Based on land use trends, it is likely that sources associated with residential land uses and urban runoff will be significant. Inputs from direct discharges of wastewater to Saratoga Creek have not been substantiated. Stormwater containing sanitary sewer overflow and urban runoff may be responsible for wet weather inputs. Urban runoff and direct deposits of wildlife and domestic animal feces may be responsible for elevated dry weather numbers. • Data on dry weather flows are limited. Two Vint sources of dry weather flows to the Saratoga- Sunnyvale Road outfall have been identified. Neither of the discharges are known to contain coliforms, but may serve to flush or transport other materials deposited or disposed of in the storm drain system. • Increased algae growth below the storm drain at the junction of Saratoga- Sunnyvale Road and Saratoga Avenue may be a result of any one of several parameters. These include increased sunlight, increased temperature, and elevated nutrient loadings. The latter may be a result of discharges from the Gatehouse Condos ponds, runoff from lawns containing nutrients from fertilizers and animal waste, additions of soap /detergents from car wash service areas, deposits of guano from a bat colony located in the vicinity of elevated biomass, discharges from the Chevron Station Remediation Site that may have contained nutrients, and wastes deposited by domestic and wild animals. • Historical data for streams, creeks, and storm drains located within the San Francisco Bay Area show that higher levels of coliforms are typical for these urban areas. It is also notable that mean values for the indicator species far exceed the Regional Water Quality Control Board guideline that applies to water bodies with water contact recreation as a principle beneficial use. The conclusion that urbanization causes Saratoga Creek Final Report Page 30 an increase in coliform levels is supported by these data. Another important conclusion to draw from the data is that the Saratoga Creek coliform data are similar to other Bay Area natural streams and creeks, such as Alameda Creek and Calabazas Creek. • When applying coliform data to determine indications of potential pollution problems, several limitations occur. These include problems with identifying the sources, and the occurrence of highly variable numbers that result of changes in flow, temperature, and organic matter present in the water of concern. A pronounced conclusion drawn from the historical data is that the total and fecal coliform levels vary significantly by location and over time. Total and fecal coliform data collected for the Alameda County Wide Clean Water Program indicated that levels were high and variable thus, the parameters have been eliminated from the sampling plan. • Estimations of bacteriological parameters are not easy, accurate, or reliable. Considerable variability can occur as a result of collection method, storage time and temperature, frequency of collection and other factors. Criteria are that the data are from at least five samples that are evenly spaced over a 30 day period and that are collected during the swimming season (APHA, 1995). In order to determine a method of identifying bacteriological contamination by humans, BioVir (1995) designed and completed an analysis of several bacteriological organisms. They concluded that the current science for using bacteriological parameters is inadequate in identifying the contaminant source, and that with additional research, the methodology may be improved on by the use of new parameters, including RNA and colifage data. These techniques are not readily available at this time. The use of the FC /FS ratio as a means of differentiating between human and animal contamination is also disputed (APHA, 1995). Variable survival rates among the different species and questionable detection methods (e.g., the KF membrane filter test has false positive rates ranging from 10 to 90 percent in marine and fresh waters) have decreased confidence in the use of this ratio. • The current literature suggests that fecal coliforms may not be consistently reliable in identifying human health risks from urban runoff pollution ". According to L. Levin (pers. comm. 1996), it is difficult to pin down a specific source in that all sources are initially grouped together (i.e., river water, spa or pool water, unwashed or raw vegetables). In addition, the database for reported diseases does not contain specific source information (e.g., a creek name), in part, because association does not indicate causality. Often, individuals have participated in multiple actions that are potential causes of the illness, and the long incubation period (up to weeks and months) makes identification of a cause difficult. The Santa Clara County Public Health Department does not specifically track any occurrences of illnesses contracted from water contact in creeks, and there are no statistics available (L. Levin, pers. comm., 1996). In Santa Clara Valley, since creeks are not considered bathing waters, they are not routinely monitored (C. Rummel, pers. Saratoga Creek Final Report Page 31 comm., 1996). The apparent incidence of waterborne illnesses related to surface water contact in Santa Cruz and Santa Clara counties is low to non - existent. The Santa Clara Valley Water District has provided me with a copy of the creek test data and I have performed some analyses of that data. It is clear to me that the water often exceeds standards for coliform set by government authorities. I have also read the Superior Court decision by Judge Infante. Although responsibility for the pollution remains to be determined by the legal process, the decision clearly states that "the parties do not dispute that level of pollutants, in particular fecal coliform, in Saratoga Creek exceed water quality objectives, at least at times." I live beside Saratoga Creek not far downstream from the Saratoga - Sunnyvale Rd. bridge - the location of the highest values of pollutants. My now grown children spent many hours playing in the creek when they were young. Thus I have a special interest in the its water quality. I would like to make two recommendations for consideration and action by the city: • The court and both parties to the lawsuit have agreed that fecal coliform is often present. To my knowledge the city has never officially acknowledged this fact. I recommend that the city send a letter to all property owners bordering the creek advising them of the true situation. The letter should also include guidelines from the county health department similar to those published in the Saratoga News. • The signs which were placed at several locations alongside the creek several years ago are obsolete and incorrect. The signs say "the city is investigating the possibility of pollutants" They should be modified or replaced and the message should affirm that at times pollutants are present. The attachment to this letter provides my suggestions for modified wording. In my opinion the city has a responsibility to notify the affected citizens of the truth. I hope that you follow through on these recommendations. Report Summarv: The attached resolution represents the first step in Saratogals annual weed abatement program administered by the County Fire Marshal. The County has determined that the parcels in Saratoga on the attached list have excessive weed growth which is a fire hazard or otherwise noxious or dangerous. The Council should pass the resolution setting the public hearing for weed abatement -- November 19 this year. Fiscal Impacts• None to City. County recovers its costs from administrative portion of fee charged to property owners. Follow Up Actions: The County sends the owners of the parcels notices informing them that the weeds must be abated, either by the owners or by the County; when County abatement will commence; and how they may present any objections at the public hearing. The public hearing is noticed in the newspapers as well. After the public hearing, the Council passes another resolution ordering abatement on properties whose owners did not object or whose objections the Council felt were invalid. The final steps take place next summer, when the County presents the Council with a list of properties whose abatement bills have not been paid, and the Council, after hearing any objections, passes a resolution declaring liens on those properties. Consequences of Not Acting on the Recommended Motions: Weed abatement could not be performed by the County. It would be necessary to depend upon property owners to take care of their own abatement. REPORT SUMMARY: Pursuant to Council's authorization granted on October 21, I have obtained a commitment from Deborah S. Larson to serve as Interim Administrative Services Director. A copy of an Agreement for Professional Services covering the terms of this interim assignment developed by the City Attorney's office and signed by Mrs. Larson is attached as is a copy of Mrs. Larson's resume. The agreement calls for Mrs. Larson to be compensated at the rate of $47 per hour plus reimbursement for any direct expenses incurred while on the job, and limits the amount of work to be performed in any one month to 180 hours unless a greater amount is first approved by the City Manager. As Mrs. Larson is expected to begin full time work with the City the week of November 3, it is recommended that the City Council approve her appointment as Interim Administrative Services Director and authorize the City Manager to sign the Agreement for Professional Services. FISCAL IMPACTS: The adopted budget contains sufficient funds for full -time wages and benefits for the position of Administrative Services Director to cover the compensation anticipated to be paid to Mrs. Larson while on assignment with the City. A budget transfer will need to be made to reallocate these funds from the wages and benefits accounts to the account for contract services where payments to Mrs. Larson for her services will be charged. Report Summary: The attached resolution represents the second step in the weed abatement process for this season. The County has sent the owners of the parcels requiring weed abatement notices informing them that the weeds must be abated, either by the owners or by the County. The notice also informed them that they may present objections at tonight's public hearing. Follow -up Actions: The final steps take place next summer, when the County presents the Council with a list of properties whose abatement bills have not been paid, and the Council, after hearing any objections, passes a resolution declaring liens on those properties. Fiscal Impacts: None to City. County recovers costs from administrative portion of fee charged. Consequences of Not Acting on the Recommended Motions: Weed abatement could not be performed by the County. It would be necessary to depend upon property owners to take care of their own abatement.
