Conucents: The William King Residence is an important heritage resource for our community because the original structure, built in approximately 1870, represents a period of Saratoga history when early structures were simple in design and represented the pioneer atmosphere of the community. The original redwood structure, though modified and added to in recent years, is still intact and has the Two -story Pioneer style clearly defined. The original owner, who was one of the founders and owners of the Paper Mill, was an important and prominent member of the community, thus giving an added quality to this resource. 4 C. Findings: 1. The William King Residence exemplifies and reflects special elements of the architectural history of Saratoga in that it is one of the oldest existant residences in Saratoga representing the pioneer atmosphere and simple design characteristic of the 1870's. 2. The residence is identified with William King one of the founders and owners of the Paper Mill who was an important and prominent member of the community. 3. The line will pass one other property not connected to a sewer line which might help reduce the cost to the applicant of the hook up:. The City's policy has been to require a sanitary sewer for a project whenever that is possible. The housing needs of the region have been considered and have been balanced against the public service needs of its residents and available fiscal and environmental resources. A Negative Declaration was prepared and will be filed with the County of Santa Clara Recorders' Office relative to the environmental impact of this project, if approved under this application. Said determination date: May 25, 1984 The Staff Report recommends approval of the tentative map for SDR -1569 (Exhibit "B" filed June 6, 1984) subject to the following conditions: I. Garage (existing) 420 sq. ft. 3576 sq. ft. 6/1/84 Page 6 COMPLIANCE: The existing detached garage maintains a minimum 1.51 side yard setback where a 10' setback would be required. (Normally a 20' side yard setback is required in the R- 1- 40,000 district but this site is only 100' wide and is allowed a side yard 100 of the site width under Section 14.3 of the zoning ordinance.) The existing garage is only separated from the main structure by 6' where a minimum of 10' is required. - The project complies with other ordinance requirements including being 2,624 sq. ft. under the 6,100 sq. ft. allowable floor area permitted in the R -1- 40,000. STAFF ANALYSIS Staff can find no record of the building permit for the garage and the main dwelling because of the age of the structures. It is not known if the garage or the garage addition which is closest to the property line are legal. The garage appears to have been located on the site for sometime but does not seem to have created any significant adverse impacts thus far. The minimum distance required between structures is 10'. This dis- tance is increased by 1' for every 2' in height above the lowest 14' of either structure. Thus, if the second story is built the distance separating the structures should be 15'. However, it should be noted that the garage would be close to the single -story rather than the two -story portion of the structure. Report to the Planni q Commission 6/1/84 SDR- 1569, V -637, A- Page 7 OPTIONS Although the site is narrower than what is normally permitted in the R -1- 40,000 district, there are options available to the applicant which would not require a variance: #1. The applicant could tear down the existing detached garage and build a new detached garage behind the main dwelling in compliance with ordinance setback requirements. This option would require the extension of the existing driveway and the removal of a fruit tree and portions of the rear yard landscaping. #2. The applicant could attach a new garage to the front or rear of the main dwelling and eliminate the existing garage. This option could significantly impact the floor plans proposed by the applicant and existing landscaped areas although there is sufficient room on the site to accommodate either alternative without a variance. Both of the options listed above would cost the applicant substantially more to complete the project than anticipated. It should be noted that cost to the applicant.for compliance with a regulation can not be the sole reason for 'gran'ting'a_va.riance., All five findings as required by Article 17 must be made before a variance is granted. FINDINGS: 1. 2. 3. 4. Practical Difficulty or Unnecessary Physical Hardship The subject property is 50' narrower than required in the R -1- 40,000 District. However, this circumstance in itself does not warrant a variance in that there are options available to the applicant which would not require a variance. There are no physical cir- cumstances associated with the property which make these options untenable. Exceptional or Extraordinary Circumstances There are two exceptional circumstances associated with this property not generally applicable to other properties in the R -1- 40,000 district: 1) the site is 100' wide where 150' is required; and, 2) the structure which is subject to the variance has existed on the site for a considerable period of time. How- ever, the options listed above are not made untenable by these circumstances so a variance is not warranted because of them. Common Privilege A strict or literal interpretation and enforcement of the ordinance would not be a denial of common privilege since there are options available to the applicant which would allow reasonable development of the property. Public Health, Safety and Welfare The granting of the variance would be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. A 1.5' side yard could create an adverse fire hazard. RECOMMENDATION: Staff cannot make all five of the required findings and therefore recommends that variance request V -637 be denied. However, if the Planning Commission determines that a variance is appropirate for this project, approval should be subject to the following conditions: 1. The existing garage shall be-modified so that it maintains a minimum 6:5' side yard setback (the existing setback of the northeastern corner of the garage) to improve access to the eastern side of the structure. Revised plans showing this shall be submitted for staff review and approval prior to issuance of building permits. 2. Applicant shall submit: elevations of any revisions to the appearance of the garage. . PROJECT CONSIDERATIONS -' DESIGN REVIEW Exterior Materials: Stucco - dove gray and white Roof Materials: Natural Wood.Shakes Impact on Privacy and Views: The proposed second level deck and .rear master bedroom windows could have an adverse impact on the privacy of the adjacent property to the west. This can be mitigated by removing the deck and and installing landscaping to screen the master bedroom windows. Opaque.windows could be used for the bathroom area on the eastern side of the second- story. -to eliminate privacy impacts. The project will not have an adverse impact.on views due to its location and relatively low profile height. Site Restrictions: The site is 100' wide. The standard width for a R -1- 40,000 lot is 1501. Compatibility: There is a low profile two - story structure to the west of the site and what appears to be a small two -story structure to the east of the site. The proposed expansion will keep the structure well within the allowable floor area of the R -1- 40,000 District and will be comparable in size with other structures in the vicinity. Design Considerations: The proposed expansion will completely change the architectural style of the main dwelling which is about 36 years old. Unreasonable Interference with Views or Privacy: The project will not have an adverse impact on views due to its location and the low profile nature of the second story addition. The pri- vacy impacts associated with the project can be mitigated.by deleting the second -story deck, the addition of evergreen land- scaping, and the use of opaque windows in the second story bath- room. 2. Preservation of the Natural Landscape: No major trees or signi- ficant grading will be required to accommodate the project. 3. Perception of Excessive Bulk: Due to the low profile nature 24' height associated wi the expansion and the relatively modest size of the proposed structure there will be no perception ofi� excessive bulk. 4. Compatible Bulk & Height: The size and height of the proposed project will be compatible and comparable with the other two - story structures in the vicinity. The proposed project will not adversely impact the light, air, or solar access of adjacent pro- perties. RECOMMENDATION: Staff recommends approval per the Staff Report dated June 1, 1984,.Exhibits "B" and "C ", subject to the following conditions: 1. Prior to issuance of building permits, submit the following for staff review and approval: A. Any modifications to the site development plan or elevations of the main dwelling or garage. B. Landscaping plans showing how the privacy of the adjacent property to the west will be protected. East growing, ever- green materials shall be utilized in this plan. 2.
