SUBJECT: Saratoga Community Center Improvements -- Award of
Construction Contract
Recommended Motion(sl:
1. Move to award a construction contract to Bob Tager, Saratoga
Builders, in the amount of $8,405.
2. Move to authorize staff to execute change orders to the
contract up to $1,095.
Report Summary:
Included in the approved 1995 -96 budget is an allocation of $9,500
to make some minor improvements at the Community Center. Pre-
school Room changes include enlarging the room by converting the
existing storage closets to allow for additional classroom space.
Changes to the Patio Room will be the addition of storage closets
and a few cosmetic improvements. Enlarging the Pre - school Room
will allow staff to increase participation, and the improvements to
the Patio Room will help entice small group private rentals.
A total of three contractors submitted bids for the work and are
summarized as follows: 1. Bob Tager, Saratoga Builders - $9,500;
2. Phil Blake Construction - $11,250; 3. Rehder Construction -
$20,123. It is recommended that the lowest bidder, Bob Tager,
Saratoga Builders be awarded the contract. The bid has been
carefully reviewed and references checked.
Fiscal Impacts•
During the Fiscal Year 95 -96 budget process, staff agreed to
recover part of the building improvement expense by increasing fees
to the pre - school participants. It is estimated that revenue in
this area will have increased by approximately $5,000 during the
year. The total expense for this project will not exceed $9,500,
and w4s approved in Activity 4041 -6720.

Follow Up Actions:
The contract will be executed and the contractor will begin work
immediately. The job is expected to be completed by January 4,

SUBJECT: Revision of Facility & Park Rental Fee Schedule
Recommended Motion(s):
Adopt Resolution revising the fee schedule for the rental of the
Community Center, Warner Hutton House, Wildwood and E1 Quito Parks.
Report Summary:
In July, 1995, the City Council approved the hiring of a facility
coordinator. This new employee was given the responsibilities of
generating revenue through the marketing and rental of city parks
and facilities. She began her task by visiting facilities in the
surrounding cities, and reviewing their rental fees and policies.
After four months of working with the current city fee schedule,
she has made several recommendations to make our rental program
more competitive, and also to remove some of the unnecessary
complexities.
Currently, there are varying fee levels for rental of the Community
Center and the Warner Hutton House. There is a set -up rate, actual
event rate, and clean up rate. These fee rates have been averaged,
and it is being recommended that one hourly rate per room be
established. Also, instead of having resident and non - resident
rates, it is further recommended that there is one room rate
schedule, and residents receive a 10% discount. For marketing
purposes, this is a much more positive approach.
The non - profit group policy for city facilities needs to be
clarified. The current policy states that if a non - profit is
having an event open to the public, no entry fees are charged, and
the majority of the people attending are Saratogans, then the group
is charged $35 per hour regardless of the room being utilized. The
only exception is in the case of fundraising activities, and then
the full rental rate is charged. In the past, non - profits have
been allowed to utilize city facilities for a business meeting at
no cost, but if the same group was having a social event the full
rental fee would be charged. It is being recommended that the new
non - profit rate be 50% of the regular room rate and be assessed for
both business and social meetings. The policy for charging the
full rate for fundraisers is recommended to remain the same.
When the Facility Coordinator was hired in July, the responsibility
for park rentals was shifted from the Public Works Department to
Recreation. In reviewing the fee schedules for both facilities and
parks, it was noted that a processing fee and refundable security
deposit are only charged to a customer when reserving space at a
city building. These fees should be consistent for all city
property, and it is recommended that a $15 processing fee be
assessed for each park reservation processed. Further, it is
recommended that the current processing fee of $55 for facility
rentals be lowered to $25. Most people do not mind paying $500 -
$600 to rent the Community Center for a wedding reception, but they
always complain about the high processing fee. The park processing
fee is lower because it takes less staff time to handle this type
of rental. The recommended refundable security deposit fee for
Wildwood and E1 Quito Parks is $50.
There are two distinct picnic areas at Wildwood Park, and it is
being recommended that staff be given the opportunity to
accommodate 2 groups. Also, the current park rental fee for
fundraisers is extremely low. Last year a community group utilized
Wildwood Park and made several thousand dollars in profit. They
tied up the park all day, required extra park maintenance staff for
cleanup, and their rental fee was only $200 It is recommended,
not only to increase this fee to $500, but also to require groups
to pay the over -time costs for the park maintenance crew if over
500 people are expected at their event.
There are exceptions to both the facility and park fee schedule.
The city has never charged Saratoga school groups for use of the
parks. There is heavy school usage in September, May, and June.
Wildwood is mainly utilized for beginning and end of the year
picnics, grade level, or school /family gatherings. Staff will
continue waiving the fees unless otherwise directed by the City
Council.
The Recreation Director has always had the authority to negotiate
the best possible rate for long term rentals, even though it might
be less than the regular room rental. An example of this is the
Saratoga Rotary Club. They have rented the multi - purpose room and
kitchen at the Community Center for over 25 years. Rotary Club
utilizes the facility 30 -35 Fridays each year for their weekly
luncheon meetings. The city has never charged them the regular
rate, and they currently pay $55 per week. For ongoing group
usage, the Director will continue as she has in the past, unless
otherwise directed by the City Council.
Fiscal impacts:
To determine the overall effect of the rate increase, staff took
six actual building rentals and six park rentals from this year and
applied the new rates. On this basis, it is estimated there will be

a 4% increase in revenue from facility rentals and 14% from parks.
An increase was already factored into the Fiscal Year 1995 -96
revenue projections.

Nothing additional except notification of this meeting to groups
who have used the parks for fundraising activities within the last
year.
Conseauences of Non Acti
No change in the fee schedule would result in the continuation of
the large number of complaints regarding in the high processing fee
for use of city facilities; confusion regarding varying rental
rates; inconsistency of the Facility Coordinator charging a
processing fee and security deposit for facilities, but not for
parks; allowing one group to tie up a park all day long for a very
low fee, and to continue to allow groups to raise revenue at a park
with very little compensation to the city.
Follow Up Actions:
Initiate new fee schedule, effective December 7, 1995.

SUBJECT: Authorization to purchase replacement riding mower
Recommended Motion(s):
Move to authorize the issuance of a $17,395.76 purchase order to
West Star Distributing, Inc. for replacement of the 52" riding
mower.
Report Summary:
The attached memo from the Buildings and Grounds Superintendent
explains the needs and rationale for replacing the 52" riding mower
used by the Parks Maintenance staff. The current unit, which is
programmed for replacement in FY 96 -97, is in need of extensive
repairs. Rather than spending additional funds to keep this unit
operational until that time, staff is recommending its replacement
now and deferring replacement of the 72" riding mower, programmed
for the current year, until next year.
Staff is further recommending an upgrade of the 52" mower to a 62"
mower for reasons specified in the memo. The model specified by
staff is a Toro Groundmaster Model GM223D distributed by West Star
Distributing, Inc. of Hayward. Their quotation includes a $500
trade -in allowance for the 52" unit owned by the City. Staff
believes this is a fair allowance for the City's unit in light of
its condition, and offers the most efficient means of disposing of
the fixed asset.
Fiscal Impacts•
The current budget contains $22,000 in Activity 82 (Equipment
Operations), Account 6795 (Fixed Asset Replacement), for
replacement of the 72" riding mower, while the FY 96 -97 budget
contains $20,000 for replacement of the 52" riding mower.
Consequently, there are sufficient funds to cover replacement of
the 52" unit this year with the recommended 62" model, and if
necessary, the surplus funds from this year's budget can be carried
over to next year's budget to fund replacement of the 72" mower.

Consequences of Not Acting on the Recommended Motions:
The replacement purchase will not be approved as recommended.
Staff will assume it is directed to repair the 52" riding mower
unless instructed otherwise.

The 52" riding lawn mower is used by the Parks Maintenance Division
primarily to mow the turf medians along Saratoga Avenue and the
small turf areas in Gardiner, Foothill, Beauchamps, Wildwood and
Brookglen Parks. This unit was purchased in 1988 and was scheduled
to be replaced in fiscal year 1995/96. Recently, this mower has
developed engine trouble, it has lost one of its four cylinders,
and it was recommeded by the City's equipment mechanic that the
engine be replaced for a total cost of approximately $3,000.
Currently, this unit is virtually nonoperational and the engine
could freeze at anytime.
Staff is recommending that the 52" riding mower be replaced this
fiscal year. In this years' Equipment Operations budget (8082) the
72" riding mower, which maintains the larger turf areas in the park
system, (El Quito, Congress Springs and Kevin Moran Parks) , is
scheduled to be replaced. Staff is recommending that the
replacement of the 72" riding mower be deferred one more year to
allow for the replacement of the 52" mower this year. The 72"
mower is too large of a unit to mow the turf medians and the small
park sites.
Staff is recommending replacement of the 52" mower with a little
larger unit that has a 62" cutting width with a recycling mulching
deck which is the same overall width as the 52" mower. This
mulching deck cuts the turf without any discharge of the cuttings.
It is designed with special deflectors that cycle the clippings to
be cut and recut, forcing the smallest of the clippings back into
the turf. Currently with the 52" mower, it is necessary to bag all
the clippings which prevents unsightly windrowing appearance to the
turf areas. This is also very important on the medians strips to
give it the desired after -cut appearance. This bagging process is
very time consuming because the operator must stop mowing from time
to time and replace the full bag of cuttings. The recommended
replacement mower is designed to elimate this process making mowing
of the turf medians and small areas a more productive procedure.
Additionally, the small mulch cuttings that are distributed back in
the turf have a beneficial effect and will aid in the overall
health and appearance of the turf.
Staff has specified the Toro Groundmaster 62" mower due to a number
of important factors that make this unit the best choice for the
City's park maintenance operation. This unit is very maneuverable
which is extremely important when mowing in the very tight areas on
the Saratoga Avenue medians. Toro mowers are very reliable and
they have a proven maintenance record with the City. Both units in
operation have had very little down time and replacement parts are
readily available from a local distributor.
Fiscal Impacts•
In the current Equipment Operations budget, replacement of the 72"
riding mower was scheduled for $22,000. Staff is recommending
purchasing a new 62' riding mower for a total cost, which includes
a trade -in and sales tax, of $17,395.76. Staff is confident that
deferring the replacement o the 72" mower until next fiscal year
will not increase the recommended budget for the replacement,
scheduled at a cost of $20,000.
Consequences of Not Acting on the Recommended Action:
Authorization to purchase the replacement of this mower will not be
provided. Staff would have to mow the Saratoga Avenue medians and
small park turf areas with a small walk behind mower. This would
greatly add to the total time required to mow these ares. Overall,
not replacing this mower will allow for an increase in the total
man -hours allotted for the mowing operation and will generally make
the overall park maintenance operation less productive.

Recommended Motion(s):
Move to authorize issuance of a $30,000 purchase order to Saturn of
Sunnyvale for replacement of the two CSO vehicles.
Report Summary:
Staff is requesting Council authorization to purchase two 1996
Saturn SL -1 passenger vehicles from Saturn of Sunnyvale as
replacements for vehicles #67 and #68 assigned to the Community
Services Officers. As part of the purchase contract, both CSO
vehicles (1988 Dodge Diplomats) would be traded in to the Saturn
dealership. Because of their age, mileage and condition, staff
believes that the trade -in offer should be accepted because it
represents the most efficient and practical method for surplusing
the two City vehicles.
As the attached memo from the Street Maintenance Superintendent
explains, a number of local dealerships were contacted to submit
quotations for the vehicle replacements based on certain criteria
and performance characteristics specified by the City. Of the
dealerships contacted, four responded with quotations as summarized
in the memo. Upon evaluating the quotations and comparing the
different vehicle options available, staff believes that the
quotation from Saturn of Sunnyvale offers the best package at the
lowest price.
The recommended purchase would consist of two 1996 model SL -1
Saturns equipped with Option Package #1 for $15,823.09 each, or
$31,646.18 total. The trade -in allowance offered by the dealer is
$1,646.18 so that the net purchase price for the two vehicles is
$30,000, or exactly what is programmed in the current year's
budget. Staff also believes that the recommended purchase is more
competitive than what will be available on the 1996 State bid list
based on conversations with the State Dep't.of General Services and
what was available on the 1995 State bid list. Passenger vehicle
options on the State bid, with the exception of police vehicles,
are generally pretty limited and don't offer the level of savings
over direct dealing that truck purchases do. Also, 1996 vehicles
purchased through the State would not be available to the City
until sometime in mid - summer. Staff does not believe that the
amount of repair and maintenance work needed to keep the current
vehicles operating until then is justified, and therefor recommends
making the replacement purchase at this time.
Fiscal Impacts•
As noted, the current budget contains $30,000 in Activity 82
(Equipment Operations), Account 6785 (Rolling Stock Replacement),
for the replacement of vehicles #67 and #68. The recommended
replacement purchase can be achieved for this amount.

Nothing additional.
Consequences of Not Acting on the Recommended Motions:
The recommended replacement purchase would not be authorized. The
Council could authorize the replacement purchase through one of the
other dealerships which submitted a quotation, direct staff to wait
for the results of the 1996 State bid, direct staff to solicit
additional quotations, or direct staff to perform the necessary
repairs to the current vehicles to keep them operational until
further direction or authorization is given.
Follow Up Actions:
If approved, a $30,000 purchase order will be issued to Saturn of
Sunnyvale. Delivery of the two vehicles would occur within ten
days.

SUBJECT: Authorization to Purchase Replacement Vehicles
Action Requested: Authorization to purchase replacement vehicles
through local dealerships
Background: Vehicles #67 and #68 are 1988 Dodge Diplomats used
exclusively by Community Service Officers. Both units are several
years beyond their original scheduled replacement date and are
resulting in excessive maintenance and repair costs.
The rear -end in vehicle #67 has a loud hum, and will require a
complete overhaul within the next 3000 miles. Vehicle #68 has had
numerous problems with the electrical system and running gear. The
interiors in both units are in need of replacement, and both units
had to be re- painted this year.
The FY 95 -96 budget contains $30,000 in Activity 82 for the
replacement of the two vehicles assigned to the CSO's. The State
Dept. of General Services informed me the bid for 1996 passenger
vehicles will be out in late December, and not to expect delivery
for at least 150 days after the order is received by the state.
This means delivery to the City may not occur until mid -summer of
1996. Also, State vehicles are generally limited in make, model &
option packages and the recent bid suggest no savings by purchasing
through the State unlike for trucks.
In an effort to locate vehicles that will meet the needs of the
Community Service Officers, I have contacted several local
dealerships such as Carl Chevrolet, Capitol Oldsmobile, Dodge of
Stevens Creek and, Saturn of Sunnyvale just to mention a few. All
replacement vehicles considered are equipped alike, to include
Air Bags, Air Conditioning, Power Brakes, Power Steering, Power
windows and Door Locks. The bids for comparable vehicles
are as follows.

The replacement vehicles recommended are Saturn SL -1 models with
option package #1 to include air, power door locks, power windows
and power mirrors for $14,685 plus sales tax. We have two 1988
Dodge Diplomats to offer as a trade -in. A value of approximately
$1700.00 per vehicle was established by using the 1995 Kelly Blue
Book as a reference. It should be pointed out, that the $1700.00
value is based on a fully operational vehicle that would require no
servicing or detail work prior to resale by the dealer. The Saturn
Dealer was the only one to offer a trade -in allowance for the City
vehicles to bring the net replacement cost within the approved
budget of $30,000.00. The trade -in allowance is fair in my opinion
and represents the most practical and economical method to surplus
the two City vehicles.
Reviewed with CSO staff & Community Development Director the
Saturns are the preferred choice regardless of cost. They have the
best features suited to the needs of the CSO's. Also highly rated
by mechanics & consumer reports.
By not replacing units #67 and #68 we risk monies being expended on
major repairs and having a unit down.

SUBJECT: CORPORATION REPRESENTATIVE TO SMALL CLAIMS COURT
Recommended Motion(s):
Adopt resolution.
Report Summary:
The Small Claims Division of the Municipal Court requires that
cities pass a resolution each December appointing representatives
to the court. The required annual resolution is attached.
The Council may recall that a similar resolution was passed on
September 20, 1995. The purpose of that resolution was to change
the representatives slightly due to the placement of the Community
Services Officers under the Community Development Department. In
addition, the Finance Director has requested that an Account Clerk
also be authorized to represent the City. The attached resolution
is identical to the one passed in September except for the addition
of the Account Clerk.
Fiscal Impacts•
In 1994 the City won all its small claims court cases, resulting in
recovery of $350, plus court costs. Moreover, the mere threat of
Small Claims Court is enough to persuade many individuals to pay
their fines. The alternative to the Court would be prosecution by
the City Attorney's Office, which would cost much more. Although
the amount recovered appears small, it is probably worth while to
continue prosecuting cases in Small Claims Court. If we did not do
so, more and more individuals would refuse to pay their fines,
resulting in a greater revenue loss to the City.

Report Summary:
At their August 14 meeting, the Public Safety Commission voted to
recommend to the City Council to institute a parking restriction on
the east side of Paseo Presada between Cox Ave. and Bucknall Rd.
(across from E1 Quito Park). The action was taken in response to
various complaints received from residents who live across from the
park about the parking problems which arise during periods of heavy
usage of the park primarily by recreation league participants.
These same residents have also noted other problems stemming from
users of the park, however these were not dealt with by the Public
Safety Commission.
In the ensuing month I developed concerns about the Commission's
action and suggested at their September 11 meeting that they
reconsider and even reverse their previous decision to recommend
the elimination of parking on Paseo Presada. The Commission
declined to reverse their recommendation by a vote of 2 -4 -1. My
primary concern is that the parking problem on Paseo Presada is a
result of a lack of adequate parking facilities at the park, and
that the recommendation made by the Commission to deal with the
problem would do so by eliminating more parking directly across the
street from the park potentially pushing the problem further onto
the side streets, and not doing anything to improve the situation.
In other words, the recommendation deals with one of the symptoms
of the problem, and not the problem itself.
While I understand and am sympathetic to the concerns of the
residents directly across from the park, I do not support the
recommendation of the Commission. Nonetheless, I am obliged to
forward the recommendation to the Council for consideration. If
the Council supports the Commission's recommendation, your action
should be to direct staff to implement the parking restrictions
through installation of the necessary signage and curb markings,
and to prepare the required authorizing resolution to memorialize
that action. If the Council does not support the Commission's
recommendation, then you should be prepared to provide staff and /or
the Commission with whatever other direction you feel is warranted.
Fiscal Impacts•
Approximately $300 to install signs and curb markings if the
Council opts to implement the parking restrictions.

Nothing additional. The six residents on the east side of Paseo
Presada between Cox Ave. and Bucknall Rd. have been sent copies of

present to follow -up on their request to have a "No Parking" zone
placed in front of their homes on Paseo Presada across from E1
Quito Park. Mrs. McGoldrick expressed her concern that Mr. Perlin
had reversed his decision since the last meeting to eliminate
parking on Paseo Presada and on either side of Paseo Pueblo and
Paseo Tierra.
After a lengthy discussion, the Public Safety Commission voted 7 -0

DISCUSSION:
Subsequent to your August meeting, staff has conducted a postcard
survey of residents along portions of Paseo Pueblo and Paseo Tierra
to gage the level of support for removing on- street parking in the
vicinity of E1 Quito Park (see copy of survey attached) . Of 22
residents surveyed, 11 have so far responded, 10 of which do not
want any of their on- street parking to be eliminated.
Further, a number of the residents surveyed, and even some who were
not, have expressed concerns about the proposed elimination of
parking on Paseo Presada between Cox Ave. and Bucknall Rd. These
residents believe the elimination of this on- street parking will
only worsen the existing parking situation due to the lack of
parking at the park, and simply push more of the problem onto their
streets. Once again, there is .a feeling that residents of some
streets are being treated more favorably than others and that a
more equitable solution must be achieved.
Additionally, I have received several calls from the parents of
children who participate in organized athletic activities at the
park and who are also concerned about the proposed parking
prohibition on Paseo Presada. At a minimum, they are suggesting
that passenger loading zones be established along Paseo Presada to
at least allow them to drop off and pick up their children without
the risk of being ticketed for stopping in a red (no stopping or
parking) zone. The alternative they say would be for them to stop
in the middle of the street.
Because of the concerns raised by the residents of Paseo Pueblo and
Paseo Tierra, and the parents I have heard from, I am inclined to
rethink my earlier recommendation to eliminate parking on Paseo
Presada. I no longer can support this recommendation and would ask
that the Commission reconsider, and reverse, its previous decision.
While I am sympathetic to the concerns and problems of the
residents of Paseo Presada, I no longer believe that eliminating
on- street parking is the proper approach to use to deal with their
concerns when looking at the issue from a larger perspective.
Unless and until additional parking opportunities can be created at
E1 Quito Park, I believe that all of the existing on- street parking
in the vicinity of the park must remain available.
In the foreseeable future, it may be possible to create significant
additional parking along the frontage of the park on Paseo Presada.
Staff is studying the possibility of widening the street along the
park to create angled or head -in parking stalls which could double
or even triple the number of on- street parking spaces along the
park. If this were done, then I believe the parking prohibition on
the opposite side of the street could be then implemented as an
equitable tradeoff. Thus, I believe that the residents along Paseo
Presada, along with the Commission, should endorse such a plan when
it is developed. In the interim, I believe the City can install
some signage along Paseo Presada advising users of the park to not
litter and /or block driveways, and of the additional parking
available in adjacent private parking lots during the evening
hours.

My neighbor and I were shocked to receive the last minute reversal recommendation from
staff. It appears to be based on two things:
"Several calls from the parents of children who participate in organized athletic
activities at the park ", and
2. "The concerns raised by residents of Paseo Pueblo and Paseo Tierra ".
As for the former, "several" does not seem like scientific data upon which to base your
decision. However, I believe if you were to propose a "timed loading zone only" area in
front of our residences, you would find no objections. Child safety has always been our
focus.
Regarding the second, I have serious concerns about what I consider a flawed survey of
my neighbors on Paseo Pueblo. By giving a forced choice yes or no survey, they were
forced to protect their right to park in front of their homes by saying, "No ". Moreover, by
not mentioning the small number of spaces involved, naturally these neighbors would be
concerned that a vast overflow would affect their property rights.
I strongly feel that the survey should have mentioned permit parking as an option. It
works in other cities and we asked for that consideration months ago.
As for diagonal parking or putting a parking lot in the park, I hardly think the city has the
funds for projects of this magnitude. As a citizen I would question such expenditures
when there are lots with parking to spare on either end of Paseo Presada.
It is clear to me that the park is overused at certain times causing severe disruption
to my neighborhood and an accident waiting to happen. I believe that my neighbors
would agree that making left or rights turns from either of the side streets is a
tremendous risk due to the parking on the residence side of Paseo Presada. The survey
should have mentioned this as well. It's too bad you did not have neighborhood input
regarding this instrument.
In conclusion, I cannot understand staffs leap of logic which has joined what were
two separate issues of side street parking and Paseo Presada parking, and I again
respectfully request no parking, permit parking or loading zone parking on Paseo
Presada. I feel that the recommendation is based on flawed data and should be set aside.

extending the parking prohibitions onto the side streets is not so
clear, the Commission decided that a survey of the potentially
affected property owners should first be conducted.
The survey on the enclosed postcard is being mailed to the first
five properties on both sides of Paseo Pueblo and Paseo Tierra east
of Paseo Presada, essentially midway between Paseo Presada and
Quito Rd. Unless there is unanimous support to extend the parking
prohibition onto Paseo Pueblo and Paseo Tierra, the on- street
parking will only be eliminated on Paseo Presada as was previously
decided.
Please .take a moment to complete the survey and return it no later
than Friday, September 8. The results will be tallied and reviewed
by the Public Safety Commission at their next meeting on Monday

diverters and signs that had previously been installed in the City
of Cupertino and stated his opposition to closing off roads as was
recently done in the Devon /McFarland neighborhood. He concluded
that unless the closure is part of a comprehensive plan, which
residents have an opportunity to comment on, hard feelings will
develop throughout the neighborhood. and the traffic devices will
eventually end up being changed or removed. In addition, Captain
Wilson does not believe that residential burglaries in the area of
E1 Quito Park are associated with people who visit the park
The Sheriff's Department will lend the Public Safety Commission a
bullhorn to use during the appreciation picnic. Captain Wilson's
secretary will contact the City to advise Staff of the number of
Sheriff's Deputies attending the event.
TRAFFIC MATTERS:
Devon /McFarland
Public Works Director Larry Perlin moderated a public hearing to
receive input on the experimental traffic diverter in the
Devon /McFarland neighborhood and to determine the next step to deal
with the cut - through traffic problems. Approximately 200 residents
attended the hearing after 425 postcard notices were mailed to all
property owners in the area of Cox Avenue, Quito Road and Saratoga
Avenue informing them of the meeting.
Mr. Perlin began the hearing by reviewing a chronology of recent
events leading up to the installation of the traffic diverter. A
question and answer period followed with many residents expressing
their beliefs that the cut - through traffic problems had not been
resolved, but merely shifted to Montrose Street, Afton, Carrick and
McCoy Avenues. In addition, residents communicated their
frustration at not having been given an opportunity to contribute
their input prior to the installation, as many of them must now
travel out of their way to get to their homes. The hearing
proceeded with Mr. Perlin listing and evaluating the problems the
audience identified, joint consideration of alternative solutions,
and prioritization of the best options. The immediate solution,
based on the consensus of the audience, was to remove the diverter
and to install stop signs at the intersection of Devon, McFarland
and Montrose Streets and "No Through Traffic" signs throughout the
neighborhood. Mr. Perlin will compile the recommended solutions,
conduct a feasibility analysis, and present his final
recommendation during a second hearing on this matter at the
September 11 meeting.
Parking Concerns El Quito Park
Mr. Unadkat and Ms. McGoldrick were present to follow -up on their
request to have a "No Parking" zone placed in front of their homes
on Paseo Presada across from E1 Quito Park. In addition, they
reiterated other safety concerns regarding the park which were

discussed at the July meeting. Chair Ken Johnson advised them that
the Public Safety Commission would only be dealing with parking
related issues and that their other complaints concerning E1 Quito
Park would be addressed by the Parks and Recreation Commission.
The Public Safety Commission voted. 5 -0 to accept Mr.. Perlin's
recommendation to place parking restrictions on the east side of
Paseo Presada between Cox Avenue and Bucknall Avenue, and to
conduct a postcard survey of the.first seven lots on both sides of
Paseo Pueblo and Paseo Tierra, east of Paseo Presada, before
deciding whether to extend the parking ban down these streets.
"No Ricrht on Red" - Saratoga Avenue/Saratoga/Sunnyvale Road
Based on results of recent sight distance surveys, Mr. Perlin
recommended retaining the current right turn on red prohibition
from Saratoga Avenue onto Saratoga - Sunnyvale Road. Staff proposes
to improve the operation of the signal by either increasing the
sensitivity of the loop detector, or by extending the loop detector
to where vehicles turning right wait at the intersection.
Additionally, the signage and striping at the intersection will be
improved to eliminate any confusion about where to stop while
waiting for the green light, as well as to satisfy the Sheriff's
Deputies, concerns about their ability to enforce the turn
prohibition. Commissioner Hexamer moved, and Commissioner Biester
seconded a motion to accept Mr. Perlin's recommendation regarding
this matter. The motion carried with a 5 -0 vote.
Mr. Perlin is currently working with Traffic Engineer Erman Dorsey
to determine the appropriate installation of a Red Zone and /or
Passenger Loading Zone in the front of ViaggioIs Restaurant on 4th
Street. If the loading zone is installed, a valet service at the
restaurant could operate this side of the street as a passenger
loading only zone between 6 p.m. and midnight.

DISCUSSION:
A group of residents who live on Paseo Presada, Paseo Pueblo and
Paseo Tierra across from E1 Quito Park have petitioned the City to
eliminate on street parking along those streets in response to
parking and other problems attributed to various users of the Park.
Staff has evaluated the request and believes that an immediate
parking prohibition is justified on Paseo Presada, but should be
further reviewed with potentially affected residents of Paseo
Pueblo and Paseo Tierra before it is extended onto either of those
two streets.
The, parking restriction on Paseo Presada would be on the east side
of the street only, between Cox Ave. and Bucknall Rd. Since there
are very few legitimate parking spaces along this stretch of Paseo
Presada and since all of the residents fronting on the street have
consented to have their on street parking eliminated, staff is
inclined to support the request as it would not exacerbate any
existing parking problems and may encourage the park users to
utilize the Challenger School parking lot on Bucknall Rd.
Recently, the Recreation Department staff arranged for the use of
the Challenger School lot by sports league participants.

Before extending parking restrictions onto either Paseo Pueblo or
Paseo Tierra however, staff suggests conducting a postcard survey
of the first seven or so residents along those streets to gauge the
willingness of the residents to eliminate some of their on street
parking too. The survey can be conducted over the next couple of
weeks and the results tallied and summarized for your September
meeting. Staff suggests that any decisions on this aspect of the
parking restriction be postponed until then. However, the
Commission should decide as a policy up front that both streets
will be treated equally, as will both sides of both streets. In
other words, I am suggesting that parking not be eliminated on one
street only, or on just one side of one street.

The purpose of this memo is to inform the Public Safety Committee
of issues and concerns expressed to the Parks and Recreation
Commission by the neighborhood adjacent to El Quito Park. One of
the issues that was discussed at the May 15 Commission Meeting was
that of on street parking. Many of the residents claim that cars
continually park in front of their homesr- blocking their driveways.
Both Ms. Kathy McGoldrick Un!=ve quested that some form
of parking restriction this issue. They
discussed either a Permi Parking Zone or No Parking Area in front
of the home across from park along Paseo Presada. The
Commission informed them that all parking issues should be referred
to the Public Safety Committee for their review. They stated that
they will be contacting you requesting that this issue be discussed
at a future Public Safety Committee Meeting.
I have attached two letters and a recent City complaint referral
addressing the parking issue. The Parks and Recreation Commission
has discussed with the residents the other issues and concerns
regarding E1 Quito Park and they may be considering an alcohol ban
in all City parks.

This letter is to express concern over the traffic hazard and the
safety of the children in the neighborhood near El Quito park on
Paseo Presada. We feel that these hazards are mainly caused by the
following events. .
1 The baseball league attracts a lot of people and cars are
parked on both sides of the street, blocking vision from the
residents, driveway. The noise level is extremely high due to
the screaming and shouting of the players and their audience.
All this disturbs the peace in the neighborhood, sometimes
until 9 o'clock in the evening. Frequently, the ball comes
into the yards of residents across the street which is
extremely dangerous. It seems that the location of the
baseball diamond is very inappropriate and it is designed with
total disregard to the residents living across the street. We
would greatly appreciate some respect for the privacy of the
residents. We recommend relocating the baseball diamond or
removing it from this park if another suitable location is not
available, to preserve the peace and safety of the
neighborhood.
2 volleyball game on Monday afternoons. There is a volleyball
game every Monday. We feel that the participants are not even
Saratoga - residents. Although, our suggestion is not to
discourage nonresident use at a public park, we strongly urge
that the peace and quiet of the neighborhood not be
sacrificed. The. park is too noisy and messy and most
residents avoid using the park on Mondays because of all the
nuisance caused by the volleyball players. These people park
their cars in front of our driveways and walkways leading to
our doors. They also play loud music in their cars. When
requested to move their cars or stop the music they claim they
do not understand English.
3 Even though the park is only supposed to remain open until
sunset, there are people in the park long after the sunset.
At nights there have been several juvenile arrests for
drinking alcohol. We have found broken glass from these
bottles, late in the morning, the next day,. after such
drinking sessions. We recommend alcohol be banned from this
park, like it has been at other parks and specific hours be
posted at the park.'
4 People block our driveways with thalX.cars all the time. We
have to walk all over-our landscape because our walkways are
blocked. Our sprinkler systems get damaged by the-wheels of
these cars. We recommend that parking on one side of Paseo
Presada be changed' to permit parking to facilitate parking
only for the residents and their guests. . If permit parking is
not readily achievable, parking should be restricted to one
side of the street. This has also been recommended by the
sheriff's department on numerous occasions when they have
responded to our 911 calls. "
5 The sheriff's department has confirmed issuing a lot of
speeding tickets on this street. We would like to bring to
your attention that there is also a day care and a preschool
on this street. The safety of children should be of utmost
importance on this street.
6 The latest trend has- been the people breaking into our
backyards and stealing things including lawn mowers, bikes or
just looking for valuables.
We hope that these issues will be resolved very soon to restore the
peace and safety in the neighborhood and once again the residents
will have the great quality of life, the city of Saratoga is known
to offer.

Please be advised of the problems re. the safety of the residents
adjacent to El Quito Park:
1) Theft - On Monday, March 27, 1995, I returned from work to find
my home had been entered. Several screens were removed and
damaged in the attempt to break in. Because they did not have
access into the main part of the house, which is alarmed, nothing of
value was taken. However, the feeling of violation which I
remember from the burglaries of 1974, is no less strong. As a result I
must now padlock all access to my property, which is cumbersome,
and could be dangerous in case of an emergency.
Moreover, my neighbor's properly was recently entered with a
resulting costly loss of property.
2) Parking - Except for the rainy months, the park is constantly used
for sports leagues. This means we virtually become prisoners, as the
participants or their parents park in our driveways for hours at a
time.
I spent quite a sum putting in a circular drive about 14 years ago
because I felt it was dangerous to back my car onto Paseo Presada.
The traffic and speed today greatly exceed that of 1981. Yet,
because people park in my driveway exits, I am lucky if I can
perform this • treacherous manuever in order to keep appointments.
Re. Noise, Trash and Vandalism:
1) Coaches and teams arrive to practice soccer or baseball as early as
7 :30 A.M. on weekend mornings, with much gusto, hollering, car-
,, door - slamming, and even horn - blowing. More than once, I have
been awakened and crossed the street in a robe to request that the
adults have some consideration and control of the team behavior.
The response has not always been what I would expect of coaches
from Saratoga.
Partying with alcohol after dark became so incessant that I have
resorted to ear plugs to get rest. I hardly think . that is a solution for
my neighbor when his. toddler is awakened.

2) I must continuously pick up orange skins, drink cups, beer
bottles, and other trash from my property. _
3) I have timed my landscape lights on the. Pasco Pueblo corner to
illuminate where it is dim in street lighting in order to discourage
parking and partying. In retaliation, vandals broke the landscape
lights.
In conclusion, my neighbors and I resent the abuse of our
neighborhood. We request relief from the constant parking problems
which prevent us from having the use of our property. We would
like more frequent sheriff patrols, especially after sunset, during
commute hours, and when sport teams are being picked up.

SUBJECT: Recommendations from Public Safety Commission on E1 Quito
Park neighborhood traffic issues
Recommended Motion(s):
1. Move to adopt the Resolution removing stop signs, designating
stop intersections, and designating four -way stop intersections in
the El Quito Park neighborhood.
2. Move to adopt the Resolution prohibiting turn movements from
Quito Road and Saratoga Avenue.
3. Move to accept the remaining recommendations from the Public
Safety Commission on the El Quito Park neighborhood traffic issues.
Report Summary:
Between March and September of this year, the Public Safety
Commission has been attempting to resolve various traffic concerns
in the E1 Quito Park neighborhood raised by the residents as a
result of the opening of Route 85. In particular, residents of
Devon and McFarland Avenues were very concerned about an increase
in traffic observed on their streets as motorists attempted to
shortcut between Quito Road and Saratoga Avenue, as well as an
increase in the speed of traffic through the neighborhood.
The Public Safety Commission held the first of four public hearings
on the matter in March. At that meeting, the residents of mainly
Devon and McFarland Aves. explained what they perceived as the
problems that needed to be addressed, and potential solutions to
the problems. Staff then proceeded to evaluate the issues and
develop alternative solutions for consideration at the June
meeting.
The matter was next continued from the June meeting to the July
meeting due to a budget study session scheduled by the City Council
for the same evening as the June PSC meeting, and staff's
unavailability to attend both meetings. At the July meeting, a
second hearing with the Devon and McFarland Ave. residents was held
at which time the Commission heard that the interim measures which
had been put into place since the March meeting while appreciated,
were not effective at curbing the problems and that additional,
more aggressive, traffic control measures would be required. This
ultimately resulted in the decision to experiment with a traffic
diverter at the Devon /McFarland /Montrose intersection for two weeks
at the end of July. The matter was then continued to the August
meeting.
At the August meeting, a large public hearing was held in the
multi - purpose room of the Community Center. Over 100 residents
from throughout the E1 Quito Park neighborhood attended the hearing
to express views about the traffic diverter and to develop
consensus based solutions to the traffic problems that would be
acceptable to the entire neighborhood. At the conclusion of the
hearing, a series of alternative measures were identified which
staff would then evaluate further. The matter was then continued
to the September meeting.
At the September meeting, a final hearing was held on staff's
recommendations of the measures developed at the August meeting.
After more public input and considerable Commission discussion, the
Commission ultimately passed on a set of recommendations to forward
to the City Council. These recommendations can be summarized as
follows:
1. Retain the left turn prohibition from northbound Quito Rd.
to westbound Devon Ave.
2. Reduce the right turn radius from eastbound Devon Ave. to
southbound Quito Rd.
3. Install four -way stops at the Devon /McFarland /Montrose,
Devon /Paseo Presada, and Martha /Paseo Presada intersections.
4. Rotate the two -way stop at the McFarland /Paseo Presada
intersection to force motorists on McFarland Ave. to stop, and
install a stop sign on McCoy Ave. at Paseo Presada.
5. Retain the right turn prohibition from northbound Saratoga
Ave. to eastbound McFarland Ave. between the hours of 4:00 p.m. -
7:00 p.m., Monday through Friday.
6. Deploy the SMART radar trailer in the neighborhood on a
regular basis to address the speeding problems.
7. Commit to an appropriate level of traffic enforcement by
the Sheriff to encourage adherence to the various traffic controls.
8. Monitor the effectiveness of the various traffic controls
and continue the matter for approximately six months for further
review if necessary.
Additionally, the Commission felt the TETAP traffic consultant
working for the City should look into the following three issues as
a part of their work:
1. Examine whether dual left turns from westbound Cox Ave. to
southbound Saratoga Ave. can be created at that intersection.
2. Examine whether dual turn lanes from eastbound Cox Ave. to
Quito Rd. can be created at that intersection (one lane for left
turns and one lane for right turns).
3. Examine the right turn movement from northbound Saratoga
Ave. to eastbound Cox Ave. to see whether any improvements can be
made at the intersection to accommodate such turns.
Of the first eight recommendations above, no's. 1, 3, 4 & 5 require
a legislative action (passage of a Motor Vehicle Resolution) on the
part of the City Council to officially implement. As such, two MV
Resolutions are attached to this report for Council's consideration
and adoption. The first resolution deals with the various stop
sign proposals in items 3 and 4, while the second resolution deals
with the two turn prohibitions in items 1 and 5. Staff is in
agreement with the Commission's recommendations made thus far, and
recommends adoption of both MV Resolutions.

Consequences of Not Acting on the Recommended Motions:
Enforcement of the stop signs and turn restrictions cannot continue
without Council's approval of the traffic controls. Any citations
issued would be voided by the Traffic Court if challenged.
Follow Up Actions:
Staff will continue to monitor the situation for the next several
months. The TETAP Consultant will evaluate the second set of three
recommendations and offer their input in their final report which
should be in draft form by the end of December. The PSC will
review the draft report at, most likely, their January meeting.

DISCUSSION:
At Monday's meeting, the Commission will resume discussion of the
traffic concerns raised by the Devon /McFarland area residents. At
the conclusion of the meeting, I will hope to have accomplished two
things. First will be to update the Commission and the residents
on what has and has not occurred since your March 13 meeting.
Second will be to develop an acceptable strategy for bringing
closure to this matter in the next couple of months.
Unfortunately, what seemed like a relatively straightforward
traffic matter to deal with back in March, instead became an
increasingly difficult (and frustrating) problem to solve. While
I admit that I am not entirely pleased with our handling. of this
matter, I also recognize that a combination of factors beyond
staff's control have complicated our efforts to progress towards an
ultimate solution to the traffic problems. The most noteworthy of
these are the City's recent budget deliberations and the resultant
uncertainties in available funding for future traffic counts and
solutions requiring'any significant expenditures; the timing of the
offsite storm drainage improvement work along Devon and McFarland
Aves. by the developer of the former Paul Masson Champagne Cellars
on Saratoga Ave.; and the continuing adjustments to the Route 85
ramp metering lights by Caltrans.

These external factors have prevented the City from completing the
post freeway traffic counts this past spring. As a result, it is
now planned to begin taking counts in mid to late September which
means the initial results won't be known until early October.
Without the counts, it is virtually impossible for staff to
accurately quantify traffic patterns in the Devon /McFarland
neighborhood since the opening of the freeway, and to predict with
any degree of certainty whether a proposed solution to deal with a
traffic problem is appropriate and /or will work.
On the other hand, I do not believe that the City can defer taking
any action at all until traffic count results are known later this
summer. The reasons for this are that enough residents have voiced
concerns about increased freeway related traffic along Devon and
McFarland Aves. to justify some level of response on the part of
the City, and the City Council as far back as 1989 has instructed
staff to develop and implement contingency plans to specifically
deal with such traffic if it in fact became a problem in this
neighborhood. In my opinion, there probably is enough of a problem
to warrant some response on the City's part, but the response must
be carefully measured so as to not shift the problem elsewhere or
create additional traffic burdens.
With this in mind, staff has attempted to craft an interim solution
which would satisfy the following criteria:
► It must be easy to implement from both a cost and labor
standpoint.
P. It should be easy to enforce, if necessary.
► It should be flexible enough such that it could be easily
modified or terminated if deemed necessary.
P. It is not a "band -aid" solution.
P. Its effectiveness can be readily evaluated absent any
traffic count data.
Based on this set of criteria, staff has developed a two phased
solution involving firstly, turning restrictions onto Devon and
McFarland Aves., and secondly, installation of a traffic diverter
at the Devon /McFarland /Montrose intersection if necessary. The
turning restrictions were established last Friday (June 30) and are
intended to prevent left turns from northbound Quito Rd. onto
westbound Devon Ave. at all times, and right turns from northbound
Saratoga Ave. onto eastbound McFarland Ave. between the hours of
4 p.m. and 7 p.m., Monday through Friday.
The Sheriff's Dept. began enforcement of the turning restrictions
on Monday of this week primarily during the morning commute hours.
By the end of the week, 28 motorists were stopped and warned of the
turning restrictions. The Deputies will begin issuing citations
next week after an additional sign on Quito Rd. is installed. Only
one area resident has called to complain about the turning
restriction (the resident lives on Montrose Ave. and was upset
about the restriction from Saratoga Ave. onto McFarland Ave.), but
after learning why the turn restrictions went into effect, the
resident agreed that the restrictions were a good solution to the
cut - through traffic problem.
In the event the turning restrictions are not effective, or should
they become an unacceptable inconvenience to a majority of the
residents in the neighborhood, then consideration may be given to
the traffic diverter at the Devon /McFarland /Montrose intersection
(see attached sketch). The concept of the diverter is to prevent
convenient direct access between Quito Rd. and Saratoga Ave. along
either Devon or McFarland Aves., while not restricting access to
residents of the neighborhood. It. is possible to set up the
diverter using traffic barricades this summer on an experimental
basis and if feedback from the neighborhood is positive, it can be
permanently installed later this summer as part of the work that
will occur on Devon and McFarland under the Pavement Management
Program. It is also possible to experiment with different
variations of diverters at other intersections in the neighborhood
if that is desired instead.
At this time, I believe staff has done about all it can absent
further input from the neighborhood and the Commission. The course
of action I would recommend adopting at your meeting is as follows:
1. Continue enforcing and monitoring the effectiveness of the
turn restrictions through the first week of August.
2. Continue discussion of the item to your August meeting. At
that time, determine whether the turn restrictions are
working or whether the traffic diverter should be
experimented with.
3. If it is determined to experiment with the traffic
diverter, develop plans for doing so in August. Continue
discussion to your September meeting.
4. Preliminarily review, if necessary, the effectiveness of
the diverter at your September meeting. Tentatively
schedule a final review of the diverter for your October
meeting when traffic counts should be available.
Lastly, we must remember the necessity of keeping the entire
neighborhood informed of what is taking place at all times.

TRAFFIC MAT XRS :
Public Works Director Larry Perlin resumed the discussion of the
traffic concerns raised by the Devon /McFarland area residents who
were present at the hearing. Mr. Perlin stated that turning
restrictions were put into effect on June 30 preventing left turns
from northbound Quito Road onto westbound Devon Avenue at all
times, and right turns from northbound Saratoga Avenue onto
eastbound McFarland Avenue between the hours of 4 p.m. and 7 p.m.,
Monday through Friday.
Residents of the Devon Avenue neighborhood did not feel that these
measures were adequate to control the large number of vehicles
which continue to use their street as a convenient access between
Quito Road and Saratoga Avenue. They requested that a diverter be
set up immediately to prevent this cut - through traffic.
After a lengthy discussion, the Public Safety Commission
unanimously agreed with Public Works Director Larry Perlin's plan
to install a traffic diverter at the Devon /McFarland /Montrose
intersection on a trial basis, subject to a review of the
effectiveness at the August meeting.
Based on concerns over emergency vehicle access, Mr. Perlin is
currently working with Traffic Engineer Erman Dorsey to determine
the appropriate installation of a Red Zone and /or Loading Zone in
front of the restaurant on 4th Street.
Now that the budget issues have been resolved and a determination
has been made that the crossing guards will be funded for the
1995/96 school year, Commissioner Fredrick, Staff Paula Reeve and
Public Works Director Larry Perlin will meet to make a final
determination on the crossing guard locations. This information
will be presented to the City Council at the July 25 joint meeting.
Mr. Perlin also noted that the City -wide traffic counts will be
conducted in the fall and that the traffic policy has been
finalized with minor
revisions.

RECOMMENDATION:
Receive neighborhood input on the experimental traffic diverter to
determine what the next step in dealing with the cut- through
traffic problem should be.
DISCUSSION:
A public hearing has been scheduled for 7:30 p.m. at your meeting
on Monday in order to receive input from the El Quito neighborhood
on the experimental traffic diverter which was installed at the
Devon /McFarland /Montrose intersection. Approximately 425 postcard
notices were mailed last week to all of the property owners south
of and including Cox Ave. between Quito Rd. and Saratoga Ave.
informing them of the meeting. A sample of the postcard is
attached.
The experimental traffic diverter was installed on Friday, July 28.
Since then it has received mixed, albeit mostly negative reviews.
The most commonly expressed complaints about the diverter can be
summarized as follows:
• It has not solved the cut - through traffic problem, but
merely shifted it to Montrose St., Afton, Carrick and McCoy Aves.

• It has divided the neighborhood by creating a perception
that residents of certain streets are being treated more favorably
than those of other streets.
• It has frustrated even those residents who live in the
neighborhood and who must now travel out of their way to get to
their homes resulting in excessive speeding along Montrose St. and
Afton Ave.

• It is ugly.
• It was installed without any neighborhood input.
• It represents a breach of faith by the City to the residents
of Afton Ave. who fought against any extension of Afton Ave. into
the Greenbriar property and out to Saratoga Ave.
Based on the written input we have received thus far (see
attached), and the testimony you will receive Monday evening, the
Commission will need to decide what is the next appropriate step to
deal with the cut - through traffic problem. Ideally, the ultimate
solution will have the support of the vast majority of the
neighborhood, and will solve the problem with minimal inconvenience
to the residents in the neighborhood. The Commission should also
consider whether additional polling of the neighborhood is needed.
At your meeting, I will be prepared to present a brief background
on how and why we have gotten to the point where we currently are,
and options which the Commission and the neighborhood may wish to
consider along with my .evaluation of the pros and cons of each
option. I will attempt to have this information in presentation
format i.e. overhead projector or large wall displays. I then
suggest that the Public Hearing be viewed as a problem solving
exercise using the facilitation and problem solving techniques we
were previously taught. Because of the considerable interest in
this matter and what I perceive is a genuine desire of the
neighborhood to reach consensus, I believe that a desirable
solution will be achieved.

of Cupertino and stated his opposition to closing off roads as was
recently done in the Devon /McFarland neighborhood. He concluded
that unless the closure is part of a comprehensive plan which
residents have an opportunity to comment on, hard feelings will
develop throughout the neighborhood and the traffic devices will
eventually end up being changed or removed. In addition, Captain
Wilson does not believe that residential burglaries in the area of
81 Quito Park are associated with people who visit the park.
The Sheriff's Department will lend the Public Safety Commission a
bullhorn tq use during the appreciation picnic. Captain Wilson's
secretary will contact the City to advise Staff of the number of
Sheriff's Deputies attending the event.
TRAFFIC MAT EM :
Public Works Director Larry Perlin moderated a public hearing to
receive input on the experimental traffic diverter in the
Devon /McFarland neighborhood and to determine the next step to deal
with the cut - through traffic problems. Approximately- 200 residents
attended the hearing after 425 postcard notices were mailed to all
property owners in the area of Cox Avenue, Quito Road and Saratoga
Avenue informing them of the meeting.
Mr. Perlin began the hearing by reviewing a chronology of recent
events leading up to the installation of the traffic diverter. A
question and answer period followed with many residents expressing
their beliefs that the cut - through traffic problems had not been
resolved, but merely shifted to Montrose Street, Afton, Carrick and
McCoy Avenues. In addition, residents communicated their
frustration at not having been given an opportunity to contribute
their input prior to the installation, as many of them must now
travel out of their way to get to their homes. The hearing
proceeded with Mr. Perlin listing and evaluating the problems the
audience identified, joint consideration of alternative solutions,
and prioritization of the best options. The immediate solution,
based on the consensus of the audience, was to remove the'diverter
and to install stop signs at the intersection of Devon,-McFarland
and Montrose Streets and "No Through Traffic" signs throughout the
neighborhood. Mr. Perlin will compile the recommended solutions,
conduct a feasibility analysis, and present his final
recommendation during a second hearing on this matter at the
September 11 meeting.
Parking Concerns B1 Quito Park
Mr. Unadkat and Ms. McGoldrick were present to follow -up on their
request to have a "No Parking" zone placed in front of their homes
on Paseo Presada across from 91 Quito Park. In addition, they
reiterated other safety concerns regarding the park which were

BACKGROUND & DISCUSSION:
At Monday's meeting, the Commission will resume discussion of the
E1 Quito Park (Devon /McFarland) traffic matter. A postcard notice
reminding residents of -the meeting was again mailed to all E1 Quito
Park residents south of and including Cox Avenue. -Earlier this
week I discussed the format of the agenda item with the Commission
Chairman and suggested the following for your meeting:
a) Staff presentation - I will briefly summarize the
discussion which occurred at the August 14 meeting and then explain
staff's latest recommendations for dealing with the traffic issues.
During this time, the Commission should ask any questions about the
recommendations and /or the evaluation process used to arrive at
them.
b) Public input - This portion of the meeting should be viewed
as a continuation of the Public Hearing. Unlike the facilitation
process used at the prior meeting, I would prefer not responding to
specific questions or engaging in any direct dialogue with
individual speakers during this time.
c) Commission deliberation - After hearing all public input,
the Commission should then be prepared to express their views on
the matter and preferences for addressing the traffic issues. I
can answer additional questions at this time or respond to comments
made during the public input.
d) Commission action - The Commission decides what should
happen next. This may involve asking staff to evaluate additional
options, conducting some type of survey of the neighborhood,
experimenting further with various alternatives, formulating a
recommendation to the City Council, or any combination of the
above.

After the August meeting, the experimental traffic diverter at the
Devon /McFarland /Montrose intersection was removed and replaced with
a 4 -way stop. Additionally, signs reading "No through traffic on
Devon, McFarland, Montrose" were installed on McFarland between
Saratoga Ave. and the intersection. A few additional telephone
calls have been received and only one additional letter, a copy of
which is attached. Also attached is a copy of the comments and
ideas (the Group Memory) generated during the facilitation exercise
conducted at.the August meeting.
RECOMMENDATIONS:
At this point, the package of recommendations I will be
presenting at your meeting include the following:
Prevent left turns from NB Quito onto Martha, Devon, and Paseo
ado by initially striping median islands which would render such
turning movements as illegal. This would occur later this summer
,Ip as part of the road improvements planned for Quito (currently out
f� to bid). The only left turn allowed from NB Quito into the El
A� Quito Park neighborhood would be -at McCoy. I feel it is
important to retain at least one such allowable movement for the
residents of the neighborhood and McCoy seems the most
appropriate since it is the only street which extends east of
Quito, and since it would serve the large number of residents in
the southern half of the neighborhood who would otherwise have to
drive well out of their way to reach their homes. In the future,
it may be possible to construct permanent medians on Quito to
further deter violations of the turn restrictions.
Install directional signs to Route 85 along Quito and Cox.
ese would be designed and placed to direct and encourage
;1 {0-e. motorists to use Cox to get to the freeway. Some additional
V signs could also be installed to direct motorists to the shopping
area along Cox.
3 Reduce the turning radius for right turns from EB Devon to SB
uito. Initially, this would be done by installing chatter bars,
or pavement markers. Ultimately, this could be accomplished by

installing a sidewalk along the west side of Quito whereby the
curb and gutter would be extended further into the street thus
reducing the turn radii at all of the intersecting side streets.
The purpose of reducing the right turn radius at Devon is to
force motorists to stop before they proceed onto Quito.
kpoved,qr) Install 4 -way stops at Devon /Paseo Presada and Martha /Paseo
e sada, and retain the 4 -way stop at Devon /McFarland /Montrose.
Rotate the 2 -way stop at McFarland / Paseo Presada to force
cFarland traffic to stop and install a stop on McCoy at Paseo
Presada. These changes, along with the 4 -way stops above, are
pr {adesigned to improve safety in the neighborhood by appropriately
assigning right of way for traffic at key intersections in the
neighborhood. An added benefit is that they will help to control
speeding in the neighborhood although it is important to note
that they are not being justified for that reason
(VNo one or more signs on Paseo Presada near Cox indicating
No Through Traffic on Paseo Presada ". This is intended to
discourage primarily EB motorists on Cox from turning onto Paseo
Presada and shortcutting to SB Quito.
/ 0 Prevent left turns from McFarland onto Saratoga by extending a
portion of the median island on Saratoga. Left turns from
Saratoga to McFarland would still be permitted, as would right
N turns from McFarland to Saratoga. This is designed to
essentially eliminate any shortcutting through the neighborhood
to get to the freeway, while retaining the ability of residents
in the neighborhood to use McFarland to get into and out of the
neighborhood.- It would also retain-access - into the neighborhood
via McFarland from the Cox Ave. fire station if that were needed.
8 Retain the right turn prohibition from Saratoga to McFarland
during certain hours which the neighborhood can decide upon and
install appropriate signage along Saratoga Ave. This is to
NpOfdl pr event the reverse cut - through problem during those times when
the neighbors believe it is most pervasive while still allowing
residents to make this turn during other times.' Retain the "No
Through Traffic on Devon, McFarland, Montrose" signs. Upon
considering the many options, I am still of the opinion that
McFarland should not be permanently closed to traffic.
Deploy the SMART radar trailer in and around the neighborhood
�tl as needed to further address the speeding concerns.
ff 10. Commit to an appropriate level of traffic enforcement in and
.IDVlp•around the neighborhood on a regular basis to discourage
violations of any of the above restrictions or traffic controls.
11. Periodically monitor the effectiveness of these traffic
control measures through traffic counts, speed surveys, citation
D.K. monitoring and visual observation. Develop additional controls
as any evidence may warrant. Continue the matter for six months
after the controls are established to allow feedback from the
neighborhood. .
At your meeting, I will explain my rationale for making these
recommendations which will include the criteria staff used to
evaluate the various options considered. I welcome a thorough
and critical review of staff's work.

In.general, a majority of the E1 Quito Park residents believe so
although some feel that more data (traffic counts) is needed to

Sheriff's Report Continued
had not received any complaints about the party, up until the time
of the shootings, although approximately 150 young adults were
present. A verbal argument between two brothers, who were hired as
bouncers at the front door, and another male partygoer, erupted and
eventually escalated to the point where the third party shot both
of the brothers with a small caliber handgun. The injured men were
transported to the hospital where one underwent surgery and the
other was treated and released.. The suspect was identified, but
was not arrested at the scene. Sheriff's Department personnel will
be talking to City Attorney Mike Riback to clarify whether the
costs to have 14 patrol units and two sergeants respond to
investigate the incident may be recouped from the property owner.
Captain'Wilson met with City staff to develop procedures to have
the Sheriff' S Department transport the radar trailer on agreed upon
days of the week. In addition, he has approved the route for the
upcoming October 1, foot race sponsored by Saratoga High School.
Lt. Huber distributed several reports containing parking citation,
burglary, vandalism and collision statistics from the Sheriff's
Department for the past ten months. The Red Cross has obtained a
donation from the Rotary Club to fund cots, blankets and comfort
kits for the City of Saratoga' s ARK and the ARK located at Saratoga
High School.
The next Sheriff's Community Police Academy begins September 12.
Captain Wilson mentioned that the Sheriff's SWAT Team would be
holding a competition at the Metcalf range on September 14 and 15.
TRAFFIC MATTERS:
Public Works Director Larry Perlin moderated a second public
hearing to discuss his recommendations on the experimental traffic
diverter in the Devon /McFarland neighborhood. Once again, a
postcard notice was mailed to residents south of and including Cox
Avenue reminding them of the meeting.
Mr. Perlin resumed the discussion by briefly summarizing the
deliberations which occurred at the August 14 meeting and
summarizing his latest recommendations for dealing with these
traffic issues. The public was then allowed to offer their input
on Mr. Perlin's suggestions. After hearing all public input, the
Public Safety Commission expressed their views on the matter and
voted on the following recommendations referenced in Mr. Perlin's
September.7, 1995 letter.

Mr. Perlin addressed Mr. Unadkat and Ms. McGoldrick who were

had reversed his decision since the last meeting to eliminate
parking on Paseo Presada and on either side of, Paseo Pueblo and

not to endorse parking restrictions on either side of Paseo Pueblo
or Paseo Tierra, and voted 2 -4 -1 to approve eliminating parking on

additional recommendations to the Public Works Department. These

Recommended Motion:
Adopt resolution ordering abatement.
Report Summary:
The attached resolution represents the second step in the weed
abatement process for this season. The County has sent the owners
of the parcels requiring weed abatement notices informing them that
the weeds must be abated, either by the owners or by the County.
The notice also informed them that they may present objections at
tonight's public hearing.
Follow -up Actions:
The final steps take place next summer, when the County presents
the Council with a list of properties whose abatement bills have
not been paid, and the Council, after hearing any objections,
passes a resolution declaring liens on those properties.
Fiscal Impacts:
None to City. County recovers costs from administrative portion of
fee charged.
Consequences of Not Acting on the Recommended Motions:
Weed abatement could not be performed by the County. It would be
necessary to depend upon property owners to take care of their own
abatement.

SUBJECT: CERTIFICATION OF INITIATIVE PETITION
Recommended Motion:
Order a staff report on the initiative petition to be presented at the
December 20 Council meeting. Order staff to prepare a resolution calling an
election for the initiative measure and any other measures as may be
determined by the City Council, to be presented at the December 20 meeting.
Report Summary:
Since the attached petition has been certified by the Registrar of Voters as
meeting the 15% signature requirement, the City Council has three options at
this meeting: 1) Introduce the ordinance without alteration; 2) Order a
special election to be held 88 to 103 days from this meeting; or 3) Order a
report from staff.
Option 1 is self - explanatory. If the Council takes Option 2, the election
would have to be held prior the March 26 primary election, causing a very
great expenditure of funds for a stand -alone election. If the Council takes
Option 3, the report must be submitted to the Council within 30 days. At the
meeting when the report is submitted, the Council must either introduce the
ordinance or order an election.
The Council may direct that the report cover the measure's fiscal impact;
its effect on the internal consistency of the city's general and specific
plans, including the housing element, the consistency between planning and
zoning, and the limitations on city actions under various sections of the
Government Code; or any other matters the Council requests.
NOTE: In order to place a measure on the March 26 ballot, the Council must
order the election by adopting a resolution which must be delivered to the
Registrar of voters before 5:00 p.m. in the time period from December 14
through December 29.
Fiscal Impacts:
Fiscal impacts of the measure, if any, would be determined by staff if
directed to prepare report.
Follow Up Actions:
To be determined by Council.
Consequences of Not Acting on the Recommended Motions:
Elections Code 9214 requires action; inaction is not an option.

Enclosed is a Certificate for the Saratoga City Initiative Petition entitled
"Neighborhood Preservation Ordinance."
The Petition contained 3847 signatures. A random sample of 500 signatures
was checked. Four Hundred Fifty -five (455) were valid (91% of the random
sample). This Projects out to 3501 valid signatures. There were two duplicate
signatures. Using the Secretary of State's formula for penalizing for duplicate
signatures on a random sample, 103 signatures were subtracted from the 3501
valid signatures, leaving a total of 3398 valid signatures. A total of 3155
signatures were needed, based on the random sample, in order to qualify under
California Elections Code Section 9214 (15% of the 19121 registered voters as
of the last report to the Secretary of State, times a projected 110% of needed
valid signatures).

Recommended Motions
Adopt the California Building Code, Plumbing Code, Mechanical
Code, Electrical Code, Fire Code, Uniform Housing Code and
Uniform Code for the Abatement of Dangerous Buildings Code, with
amendments, by ordinance and waive reading.
Report Summary:
At the regular City Council meeting on November 15, 1995, staff
introduced the proposed adoption of the California model codes
with local amendments. During the public hearing, there were no
proposed modifications to the recommended codes. Staff was
instructed to submit the proposed codes in ordinance form for
adoption at the December 6, 1995 Council meeting. Staff
recommends adoption of the proposed ordinance as submitted.
Adoption at this time represents the final phase of the code
adoption process. The new codes will become effective thirty
days from adoption.

Notice required for public hearing.
Consequences of Not Acting on the Recommended Motions:
Local amendments will be invalid.

Recommended Motion(s):
Move to grant final acceptance of the improvements and authorize
staff to release the maintenance /warranty securities for the
improvements.
Report Summary:
All of the improvements required of the developer of SD 92 -006
(14350 Douglass Lane) have been satisfactorily maintained since
Construction Acceptance was granted on September 21, 1994.
Consequently, it is appropriate for the Council to grant final
acceptance of the improvements at this time and authorize staff to
release the owner's warranty /maintenance security posted with the
City.
Fiscal Impacts•
Little, if any at all. The public improvements to be acquired by
the City consist of a pedestrian pathway connecting the two
segments of Douglass Lane across Wildcat Creek. As a result, there
will be an incremental increase in the City's sidewalk and trails
maintenance activities.
Advertising, Noticing and Public Contact:
Nothing additional.
Consequences of Not Acting on the Recommended Motions:
The improvements would not receive final acceptance and the
warranty /maintenance security would not be released. Staff would
inform the owner of any further work required by the Council before
the improvements could receive final acceptance.

securities

improvements. for SD 92 -006 and authorize staff to release the
performance - securities posted to guarantee completion of the work.
Report Summary: All improvements required of the developer of
SD 92 -006 (14350 Douglass Lane) have been satisfactorily completed
and accepted by staff. Consequently, it is recommended that the
Council grant Construction Acceptance-of the improvements at this
time and authorize staff to release the performance securities
posted by the developer to guarantee satisfactory completion of the
required work. Upon taking this action, the one year -maintenance
period covering the improvements will begin. The required
maintenance is secured by a maintenance bond also posted with the
City by the developer.
Fiscal Impacts: None directly. The cash bond to be refunded to the
developer is in the amount of $8,467.32.

Acceptance of the improvements, would not be granted and the
performance securities would not be released. Staff would advise
the developer of any additional requirements of the City Council
before Construction Acceptance could be granted.

maintenance period will commence. A final inspection .of the
improvements will occur approximately ten months from now.

Request for Waiver of Annexation.
Recommended Motion:
Deny the request for Waiver of Annexation.
Background:
By agreement with the County of Santa Clara and the Local Agency
Formation Commission (LAFCO) annexation is generally required when
development is proposed on parcels that are contiguous to the City
boundary and that are located within the City's Urban Service Area
(USA) . Owners of these contiguous parcels may request a waiver from
annexation if they desire to develop under County regulations. The
City has usually denied these waiver requests except in cases where
severe geologic conditions exist or when urban services are not
readily available.
Report Summary:
The requested waiver relates to a vacant, 1.014 acre parcel on
Peach Hill Road which is contiguous to the current City boundary
and is located within the City's USA.
The property has direct access to the County maintained portion of
Peach Hill Road. All required services are available to the
property. The site offers limited views of the valley floor but
appears to be screened by vegetation from most neighboring
properties with the exception of the adjacent developed parcel to
the east.
Staff has identified the following issues in consideration of this
waiver request:

1. Site Development Control
The current Santa Clara County development regulations would allow
for a 35 foot high, three story structure with no limits on floor
area to be built on this site. A proposal that meets basic County
zoning standards does not require a public hearing and is approved
by staff through an administrative process.
The City would allow, at maximum, a 26 foot high, two story
structure with a floor area of approximately 4300 square feet. The
City would require any new home proposal on this site to complete
the Design Review process which includes a Public Hearing before
the Planning Commission.
2. Geology
The site is located in a PS soil zone which is characterized by
moderately steep to very steep slopes common to the hillside areas
of Saratoga and Santa Clara County. The Berocal Fault is known to
be located just north of the subject property. A detailed geologic
review to determine acceptable construction standards for this site
would be required as part of the City's Design Review process.
3. Fiscal Impacts
The annexation of this property to the City would result in
additional costs to the City for Sheriff services and street
maintenance for the annexed portion of Peach Hill Road. This cost
would be partially offset by an increase in property taxes and
utility user fees. Road improvement issues, if any, would be
addressed during the Design Review process and subsequent
development of the site.
Follow -up Action:
If the Staff recommendation to deny the annexation waiver is
accepted, the applicants would need to complete a Request for
Annexation application for consideration at a future City Council
meeting.
Consequences of not Acting on the Recommended Motion:
If the waiver is granted, the property will be developed under the
zoning regulations of Santa Clara County as discussed earlier in
this report.

Ascension Church and Congregation Beth David; Miller

Deny the Waiver of application filing fees for the Use Permit.
A request has been received from the Ascension Church and
Congregation Beth David to waive the filing fees for a Use Permit.
The Use Permit is required to permit both churches to participate
with other churches on a permanent basis in a program to provide
housing for homeless persons during the months of June and August.
A Planning Commission public hearing is required for the Use Permit
because the use is considered an "expansion of use" for the church
facilities. The fee for a Use Permit public hearing is $2325.
In May 1995, the City Council denied an appeal of the neighbors of
the Ascension Church thereby approving a Temporary Use Permit for
the rotating shelter in August. The Planning Commission had
approved the request. There was substantial neighborhood
opposition at both meetings. The full filing fee was paid for this
TUP application, the first application at this location.
The City Council has previously considered similar requests for
waiver of fees. In 1993, Prince of Peace Lutheran Church paid the
entire filing fee for its first Temporary Use Permit requesting a
similar rotating homeless shelter. The full fee was required
because this was the first request and involved substantial staff
work as is typical with all zoning applications. On two subsequent
occasions in 1993 -94, the City Council partially waived the fees
for a Temporary Use Permit and a permanent Use Permit for Prince of
Peace for the shelters. The Council directed staff to apply fees
on an "actual cost" basis which did not include staff time in
research, report writing, meetings, overhead, etc., typically
required to achieve full -cost recovery. The partial waiver of fees
was justified by previous staff work and familiarity with the
identical project and similar neighborhood issues.
Staff is recommending denial -of the fee waiver request for two
reasons.
• Although this is the second request by the Ascension Church,
this is the first request and public hearing for both churches
involving two months during the summer. Given the controversy
in the first request, staff assumes similar response in this
City Council

application and would anticipate significantly more work than
just reviewing a previously approved permit.
Significant budget cuts have resulted in staff reductions in
the Planning Department. As a result of budget discussions
and City Council direction, staff was instructed to require
filing fees which resulted in full cost recovery. Waiving the
fee would not provide full cost recovery for this application.

Dear Members of the City Council:
Last August Church of the Ascension hosted the Faith In Action
Rotating Shelter Program. It was truly a rewarding experience
for all of those connected with this program. Most important
was the opportunity to assist individuals who want to improve
their economic status so they can be self - reliant versus
dependent on social programs for their economic support. Seeing
the reinforcement and support being provided by those guests who
had employment, to those guests facing day to day employment
rejection while seeking a job, was a benefit of the program I
hadn't even considered. Due to the positive experience of this
program, the various religious groups and neighbors who donated
their time to prepare and serve meals want this program to
continue.
The single, largest expense for the host Church is the temporary
Use Permit. The payment of a $900 fee last year was significantly
greater than we expected when our outreach group originally
decided to host this program. The recent fee increase for
temporary and conditional Use Permits makes it very difficult for
the community to reach out and help those who are in need of a
helping hand.
We are hoping some relief on the permit fee can be obtained from
the City of Saratoga since the permit is to allow us to provide a
service to the Community and not to raise funds. Cupertino
Community Services informed us that the Cities of Cupertino and
Sunnyvale do not require a permit fee.

Church of the Ascension will be applying for a conditional Use
Permit to host the program in the coming year for the month of
August and Congregation Beth David will join the application for
a conditional Use Permit to host the program for the month of
June.
The Rotating Shelter Program jointly sponsored by Faith In Action
and Cupertino Community Services is patterned after the same
model program utilized by InnVision, under which Prince of Peace
has obtained a reduction or waiver of the Use Permit fees.
