Subject: Pierce Road /Saratoga - Sunnyvale Rd. intersection
Comments for the Saratoga Safety Committee meeeting of April 12:
1. The new intersection of Pierce Road and Saratoga /Sunnyvale Road is a very bad design! The original design
was adequate and reasonably safe. The new 110 degree right turn onto Pierce from the north is NOT easy; for
long vehicles and towed trailers it can be quite difficult and dangerous.
2. The new walkway on the north side of Pierce Rd. is O.K. - -but walking on the north side is very
uncomfortable; the south side of Pierce happens to be easier to walk on, but is far from perfect!
3. It is assumed that cars should/will slow down for the Pierce Road 90 degree curve at the Foothill Lane
intersection. Unfortunately, the single bump just before Foothill Lane barely slows anyone going west and has
almost no effect on cars going east (as attested by the continuing battering of the large aluminum square signs,
bearing black chevrons pointing around the curve!). A similar bump, between Comer Drive and the curve might
help, or stop signs at Comer Drive (going west) and Houston Court (going east) would really help - -even if the
cars made only "hollywood" stops!

Dear Kristin:
Thank you for visiting our complex and listening to our concerns. I would like to follow up with a
brief summary of my input on the cars parked on Saratoga Ave. in front of Saratoga Parkside.
There are two entrances to Saratoga Parkside off Saratoga Ave. (these are also exits). I m ref -
ferring to cars exiting onto Saratoga Ave. My complaint is the blind spot that is caused by trucks
and SUV's parked on Saratoga Ave .causing a blind spot for both cars and bicycles. There has
been an incident where a bicyclist ran into a car parked waiting to exit onto Saratoga Ave. The
40 mile an hour speed limit does not leave room for error. Hopefully you will consider a way
To help eleminate an accident. One car length painted red in each entrance would be of help.
We also have a problem of cars parked that are there for more than 72 hours without being
moved. I realize you cannot patrol this situation with a great deal of efficiency. Anything
that you can do to improve our situation would be greatly appreciated.

Dear Ms. Borel:
Thank you for meeting with us recently to discuss our concerns regarding the cars parked on
Saratoga Avenue in front of Saratoga Parkside.
When leaving our complex it is very difficult to see the on coming traffic because of all the cars
parked on the street.
Leaving the complex on two occasions I came close to hitting a bike rider and his dog because
there was a very large white truck with a camper shell parked next to the drive way and I .could
not see beyond it.
It would really help our situation to have at least one car length painted red on both sides of the
two drive ways into our complex.

Dear Kristen
I am writing to you about a dangerous traffic situation that exists at
the two exits from our. subdivision, Saratoga Parkside. Both exits open .unto.
Saratoga Avenue. They are the only exits from our 76 unit condominium
complex, so they are busy all day.
At the north side of each exit parking on Saratoga is allowed. right to
the very edge of our exit. This makes it very difficult to turn right into the
northbound right lane of Saratoga Avenue. Cars leaving our sub have to
enter both northbound lanes to get out.
On the south side of each exit the curb is striped red, but just for a
very short distanc. Cars parked ob Saratoga on the south side of the two
exits block our view of traffic coming along Saratoga Avenue from the signal
light at Cox.
The suggested solution is to paint a red "no parking" stripe on the
curb on the north side of side of each exit .two or three car lengths long. The
red stripping on the south side of each exit should be extended at least two
or three car lengths.
I have discussed this problem with several of my neighbors and we all
agree that it is serious. Your assistance in getting it solved would be
appreciated by all of us.

Thank you for visiting our complex. I would like to address some of my concerns in regard to the
Parking problem we have on Saratoga Ave. in front of our complex, Saratoga Parkside.
My concern is being able to see over the SUV'S, trucks, and cars parked along Saratoga
Ave at our street exists. Because of this problem an accident could happen at anytime.
This complex was originally a 55 and older, consequently we still have many senior
Citizens living here.
My thoughts would be to paint the whole curb red to avoid these problems. This also would
Take care of trucks and cars that are parked there and not being used for weeks, months,
Or years.

Per our conversation, my wife and I live at 14760 Aloha Ave, which is at the intersection of Komina.
We have a stop sign that was installed sevral years ago in front of our house to slow down the traffic
between Lomita and Komina on Aloha. The stop sign has helped, but most cars fly down the hill (from
Lomita to Komina) and only slow down for the stop sign. The lump installed on Komina would be a
perfect solution to further slow down this traffic. This email is a request to appear at the April meeting to
further explain the danger that currently exists and the solution I have outlined in this email.

We have lived at our present address on Ravenwood for over 40 years. Durin g that
period of time parents, late to school, have sped down our street in order to drop off or
pick up their children at Marshall Lane School. Unfortunately, Ravenwood is a long
straight street in which drivers can exceed 35-40 miles per hour. We have been very
lucky that a small child has not been seriously injured or killed.
Recently a police officer tickets a motorist in front of our home for speeding.
In the past couple of years, several new families have moved into our neighborhood.
Many young children are now residing along Ravenwood along with our seven
grandchildren that are with us many days.
Please before a tragedy occurs — install speed bumps. We have been in contact with the
city for many years about this necessity. Absolutely nothing has been done!! You have
in your possession a letter we wrote in the last several years and also a response letter
from the city.
Please once again install speed bumps — it's an absolute necessity. It will slow down
traffic to a legal limit.
We will not be able to attend the April meeting. We will be in Australia for the month of
April. However, if you give us the date, time and location we will inform as many
neighbors as possible.

. Dear Ms Surdin,
Per our conversation on November 20`b, I am to request that the Ravenwood Drive's ever -
increasing speeding problem be placed on the City Council's agenda as quickly as
possible. We have lived here for over 38 years and the cars speeding down our street
(mostly to take children to school) is getting continually worse.
We would like to suggest that a speed bump be placed in front of our home. We have
seen them in other neighborhoods and to my knowledge are slowing down the traffic.
The City has in the past placed an electronic speed sign on Ravenwood, but this only
slows people down when it is in place. We have observed that as soon as it is removed
from the street, people resume their "normal" speed.
Our greatest fear is that someone will be hurt or a life lost before anything has been done
to remedy the situation.
Please place this item on the City Council's December 9`h agenda. I would like the
Council to discuss and handle this issue ASAP.

Thank you for contacting the City regarding speeding cars on Ravenwood Drive. I
wanted to touch base with you regarding the status of your issue.
Several of your neighbors contacted the City regarding this issue last spring and.
submitted petitions requesting that the Marshall Lane/Ravenwood neighborhood be put
officially in the queue for the City's `Neighborhood Traffic Management Program"
(NTMP). There are currently six other neighborhoods ahead of Ravenwood. The NTMP
process is very effective, but is also. very time intensive. In addition, City staff and .
resources are spread thin due to limited funds.
Let me know if you are interested in getting in touch with your neighbor who contacted
the City about this issue last spring. I would be happy to pass on your contact:. .
information to her. Also, feel free to contact me if you have any additional questions. I
work part-time on Monday, Tuesday and Thursdays from 8 AM until 3 PM.

The problem is as follows:
The intersection of Winter. Ln. and Chateau is a dangerous, uncontrolled intersection where cross traffic
is likely to collide -- especially if there is someone unfamiliar with the intersection. Drivers from each
direction may claim right of way. To make matters even worse, the intersection is blind (1) turning left
from Chateau onto Winter, heading toward Cumberland, AND (2) turning right from Winter onto
Chateau away from Cumberland. The high bushes on the corner house may attribute to the "blind"
aspect of the situation. Every time a driver comes to the intersection, no matter how slowly and
carefully, there is a possibility of being hit because the other driver coming from the opposite direction
may not be as careful and diligent. It is never a good idea to leave an intersection without any controls
such that everyone's safety is dependent upon the careful attention of the OTHER driver. There really
should be a four -way stop at this intersection.
A minimum of a two -way stop would be beneficial; however, much less effective. For example, the
two -way stop at Cumberland and Via Escuela is inadequate because people coming to the stop sign on
Cumberland expect that the cross traffic from Via Escuela will also stop. Over and over, drivers who
have actually stopped at the stop sign proceed to drive through the intersection before the cross - traffic
from Via Escuela has cleared. They seem surprised that the cross - traffic has not stopped. I have
witnessed many close -calls here as well. It is unusual in intersections like these for there to by only a
two -way stop; four -way is the norm. Giving drivers what they expect leads to safer intersections --
safer intersections in our neighborhood would be greatly appreciated.
Additionally, the intersection at Winter can be .quite busy since the school traffic comes through from
Argonaut Elementary.

I recently parked on Oak St. one morning and found evidence that
another vehicle "touched or scratched" my auto. I got that taken
cared of (ie, police report and auto repair shop) , and I have a

I believe this street should be a one -way only, similar to Aloha (one
block away).
This would deter people from making a 3 -pt turn and would use. the
next intersecting street (name of street is unknown to me) Where.I
parked for this incident to take place was in- between Hwy 9 and this
unknown street. It does not matter if owner of the vehicle which
touched my auto backed in to me without seeing my auto. If we make
Oak a OW street (one -way) then the history of this fine city would be
more preserved.
Oak St. to me is a narrow street to make a U -turn or 3 -pt turn. I
have done this safely but with traffic at both sides of my auto in
the past - -2005.

Montalvo Road has safety issues. I have lived off Montalvo Road for over ten years. During that time, I have had
numerous near miss head -on collisions on Montalvo Road. I am pleased to see that the City is taking action to
address this.
The basic issue is that a significant number of people use the opposite "lane" to navigate the turns in the road.
This is not a surprise because historically there has been no lane designation on the road. After the City painted
lane designations (dots on the road), the situation improved.
However, the lane designation breaks down when cars are parked on either side of the road — parked cars shift
the traffic toward the center and opposite side of the road and well beyond the lane designation. This situation is
particularly dangerous due to the fact that in many places, where the road ends isn't all that clear and cars
frequently park in the traffic lanes. When cars are randomly parked on both sides of the road, the road is so
narrow that traffic shifts to avoid the parked cars and the lane designations are irrelevant. Emergency vehicles
would have a very difficult time navigating the available road. When there are parties in the area, the useable
road surface is reduced to barely one lane by parked cars. This is particularly dangerous because this often
occurs at night. Whether the solution to parking is to designate some areas no parking zones or to clearly
designate the parking areas and the road surface will require traffic engineering studies.
Regarding the issue of raised dots, there are noise issues to consider. Possibly the City can use paint and see if
that remedies the situation. If paint doesn't work, dots can be installed later.
The clear designation of lanes on Montalvo Road is sorely needed. When you determine where to locate the lane
designations, please pay particular attention to the affects of cars parking on both sides of the road. I have little .
doubt that in many places the road cannot accommodate parking.

Thanks for your very prompt response. I'm very impressed with the 24 -hr turnaround in installing the knock -down sign and
Bott's dots after Karen sent her first email. I look forward to seeing the flashing lights installed very soon.
I also request the city to study the traffic congestion on Herriman Ave and come up with a long term solution.Heniman
Ave is majorly congested during the morning and evening school hours, it will only get worse as more and more high
school seniors drive to school. Some kind of grandiose plan would be required to solve the problem.One of our neighbors
suggested two great plans:
1. Move the High School main entrance to Sunnyvale- Saratoga road which can handle heavy traffic (there is already a back
entrance to High School from Sunnyvale- Saratoga road).
- The advantage of this plan is the Heniman entrance can be used mainly by pedestrians. This will encourage majority of
the kids in the "Golden Triangle" bike or walk to School. I can easily see this will reduce atleast 100 cars during the peak
hours.
2. Align the High School entrance with Lexington Ct and add traffic signal to streamline traffic in the 4 -way intersection.
After the bad experience we are very scared of letting our daughter walk or bike to School. My daughter and her friend
were planning to bike to the Middle School but now both the girls and the parents are scared to let them do it. We can't help
but add to the traffic mess by driving them to School. We only live 1 -2 blocks away from High School. Unless the street
crossing on Heriman is made very safe, we will be very apprehensive of letting them walk even to High School.

I'm the mother of the I Oyr old girl involved in the accident. I'm glad to see that knock down sign is installed in the
crosswalk on Hen-iman Ave and Lexington Ct. The other plan to install Bott's dot is not sufficient to solve the problem.
Installing the flashing light pedestrian crossing will be more effective. When pedestrians want to cross the road, they can
press a button that will cause the lights to flash along the crosswalk. The flashing lights will actually convey the intention
of a pedestrian to cross the road and will alert the drivers from a distance that a pedestrian is getting down to the crosswalk.
This will also work well in the night. The mechanism is similar to the walk sign at the traffic lights. Kids are more familiar
with it and it will help the kids to stop and wait for the lights to flash before getting on to the crosswalk, giving them an
extra opportunity to look both sides.
I have seen the flashing lights installed along the crosswalk on Miller Ave in Cupertino near Miller Middle School and
being more effective in giving the pedestrians the right of way. I'm also told that the streets near the schools in the city of
San Jose have flashing lights installed along the crosswalk.
I hope the city council will take the extra step to make the roads safe for our kids to walk to School. The more kids walk to
School, the less cars on the road. Herriman Ave is a major thoroughfare for the Saratoga High, Redwood Middle and
Foothill Elementary schools, investing in making the road safe will be a great benefit for the residents.

Dear Members of Saratoga City Council,
I read the article in this week's Saratoga News about the pedestrian accident on Big Basin Way with great interest.
The Council is to be commended for its rapid response in installing the Botts' Dots and knock down signs at multiple
crossings within the village.
I am curious to know, however, why the much more serious pedestrian accident at the school crossing on Herriman
Ave on February 5, when a ten year old girl ended up hospitalized at Valley Medical Center for more than a week, has
received little or no official attention at all. In case you are unaware of the details of this accident, the child (who usually
walks home with my daughter from Foothill Elementary, but my daughter was home ill that day) was walking eastbound on
Herriman Ave along the high school around 3:30pm. Two cars were already stopped at the school crossing at Lexington Ct
allowing a bicycle to cross. She assumed they had seen her, since one of them waved to her, and she entered the school
crossing. Unfortunately, the other driver had not seen her, and hit the accelerator just as the girl entered the cross walk. The
car struck the girl, causing a compound fracture of her lower leg. I found it odd at the time that the accident never appeared
in
the Saratoga News, but thought that might be because it was a child. The child involved remains confined at home, with
the school district providing home schooling, because of the severity of the fracture.
The paper described the school district's discussion of the accident, where the subject of a crossing guard for this
school crossing came up. Foothill's principal was quoted as having instructed.her students on making eye contact before
crossing the street. Every child has already been told that by their parents a hundred times - does that mean they do it
consistently, every time? Of course not! They're kids. It is our job as adults to try and minimize the hazards around them
while they gain the maturity to be consistent about safety rules. The consensus of the article was that crossing guards were
expensive, and no official action needed to be taken.
I drive through this intersection multiple times a day, and it is absolutely unsafe for pedestrians. I have pulled to the
right (because I turn onto Lexington to reach my house) and stopped for pedestrians to cross, only to have cars pull past me
on the left to zoom by, clearly paying no attention to the law that says they must stop. Crossing there myself, I frequently
have to wait for multiple cars to pass before one will deign to stop to allow me to cross. At drop off and pick up time for the
schools, it is a hundred times worse, with cars jockeying to turn left into and out of the high school parking lot, which is
offset from Lexington just enough that no -one seems to know who has the right of way. Of course, this is the time that our
kids, whether they are elementary, middle school or high school age, are trying to cross. If you don't believe me that it is
this bad, I challenge you to come out and sit from 8- 8:30am or 3- 3:30pm one day (checking the high
school schedule first to make sure they aren't on some alternate schedule that day, since it seems to change week by week
just to confuse the parents.)
Something must be done about this pedestrian crossing before another accident, potentially a fatal one, occurs.
Botts' dots and knock down signs would be the minimum needed. Several school crossings in Cupertino have lights along
them that illuminate in response to a button pressed by a pedestrian wishing to cross. I'm sure these wouldn't be cheap, but

neither would a lawsuit if you fail to act and another accident occurs. A four way stop, to encompass Lexington and the
outflow from the high school parking lot might be another alternative. A crossing guard would also work, but'then next
year the funding might evaporate, or there would be an argument over who was paying, and I could easily see this not being
a long term solution. A final idea would be a side walk from Lexington to Saratoga - Sunnyvale Ave on the church side of
the street, so the kids can cross at the light (this would not solve the high schoolers' problem, because you would never get
them
to walk the extra distance, but would help the kids in our neighborhood who want to walk to Foothill.)
There is a push right now to get our kids more active, and moaning in the press about why kids don't walk to school
anymore the way they did when we were young. I walked to and from school starting in second grade. We, however, had
sidewalks, and everyone walked so there were far fewer cars on the road. My daughter is now frightened to walk home
from school.
Having safe school crossings for our children is part of our city's responsibilities, not just safe intersections in the business
district. Please show that Saratoga cares as much for its younger citizens as it does for its consumers. Take action and fix
this dangerous school crossing now.

First and foremost I would like to thank you for helping me address my concerns regarding the safety issue on
Montalvo Road. I will not be able to attend the meeting on the 12th due to violin performance of my son. I will
outline my concerns and hope you can make.
I have lived in montalvo for the past 8 years and have the opportunity to observe the traffic on the monadvo
road both by car and by foot.
1. The gate of montalvo is very oddly placed which causes near misses in both directions by cars, if at all it can
be fixed it will be great.
2. The turn near the first house on the right when you enter the montalvo gate is a blind turn and routinely the
service people park their vehicles on both sides causing a major traffic hazard. The road narrows down to a
single lane. If we can limit the parking to only one side and install mirrors maybe we can eliminate just a bit of
this problem i.e I would prefer to have no vehicles parked on the montalvo road.
3. Montalvo road is really not a normal residential street because of the historic landmark villa montalvo. As a
result there is just too much traffic on the road which tends to not follow the speed limit as I literally got run
over by a speeding driver at the blind turn that I mentioned above. This happened while I was going on my
morning walk to downtown Saratoga. If we could have speed bumps that would definitely limit the speed of
the drivers.
I can guarantee that something bad is bound to happen on this road as I have walked and driven on this road at
all hours of the day being a stay home mom. We also need more supervision by the traffic cops so that people
are more careful. I have lived here 8 years never seen any cops.
4. Also because there are no lines dividing the two sides on the road, drivers tend to drive in the middle which
also is a huge traffic hazard. I have had many near misses..I definitely support the markings for dividing the two
sides of the road.

I will try to attend. this meeting, but may be going camping.
I have a couple of thoughts.
The first is that if a traffic study is done, it needs to be before school gets out, and on days the high school is in
session. The traffic counters need to know the school schedules and count at the peak times to get a sense of
how it is on the worst days. For reasons I don't know, Wednesday mornings seem to be the worst, when the high .
school starts later, perhaps because the folks going to the high school end up interfering with those of us
returning from dropping kids at the elementary schools.
Second, although I had some trouble understanding the first public speaker at the Council meeting at the time,
when he was talking about a sidewalk on both sides of Lexington on Herriman, if you look at the corner, he has a
point. It would be much safer for pedestrians if there was at least a sidewalk on the corner itself so there was a
safe place to stand while waiting to cross, so that the cars doing rapid right turns onto Lexington and not looking
where they are going don't run you down while you are waiting or on the close approaches to the corner. Visibility
around that corner is poor, and especially if cars are parked there (I know it is a "no parking zone" but I've been
watching and at least half the time there are cars parked in that stretch during school hours), pedestrians end up
in the middle of the road as they approach the intersection.
Thirdly, I believe that since the high school changed its car line drop off pattern to allow only a one way circle
through their lot, traffic through our intersection has increased, since cars.go through once, turn left into the lot at
the entrace past Lexington (causing cars to back up behind them while they wait to turn), then exit at the far end
of the high school and often go through a second time on their way out to Saratoga - Sunnyvale. Perhaps this isn't
the cause, but it seems like there are many more cars coming from the left as I am trying to turn right onto
Herriman in the morning. I know this traffic pattern has been otherwise beneficial, but it may be having mixed
results.

I know my former neighbor, Kathy Waite, asked about speed bumps on Lexington around ten years ago and was
told that the city didn't believe in them due to "liability" issues. On the other hand, I've seen speed bumps going in
on other streets in recent times. That should be considered in the overall plan. It would help the safety of the
intersection by cutting down on cut through traffic, by making it a less attractive route to cut through.
A non - safety issue, but to forward to the appropriate body would be the need to pave Lexington in the near future.
They keep patching it, but with the amount of traffic it gets, the patches don't hold. Somehow Thelma has been
repaved twice since the last time Lexington got repaved...

It was my pleasure as well tallking to you. Know that I appreciated your phone call and
efforts to deal with the City traffic problems. Sounds like you have tons of work lined up with all of the
citizen requests for various traffic reliefs.
I forwarded your email to our neighborhood email list so hopefully you will receive some
positive input and some worthwhile suggestions regarding the neighbors concerns.
In addition to the speeding and crosswalk incident experiences I mentioned to you, I would
like to request that "speed bumps" be considered as a possible soulution to the whole problem. I dislike
them; however, I know they work. While I believe speed bumps would
alleviate some problems on Herriman, I know it may be difficult to implement the idea as
there would probably be much opposition in the form of public protest and funding.
The solution to Herriman may only be realized by strict law enforcement, but that is always an on going
effort and subject to availability of traffic patrol. Speed bumps are always
present with warning signs and definitely will slow vehiclar traffic, and may even give some
protection to the crosswalks. Please consider the speed bump. idea for Lexington as
a good remedy to the speeding problem to and from the High School. I do not suggest speed bumps like
those on Elva off of 4th street, but rather the dual type which are quite smooth, highly visible and
extremely effective. Two dual bumps would be needed on Lexington near the addresses of 13688 and
13749. This would provide for a much slower and safe speed on the street which would make those

I would like to request an extention until April of the discussion of markers /lines on Montalvo Road. Judy
Magnuson and I will both be out of town for the Feb 15 meeting.
We are greatly concerned about having lines and markers on our road. Montalvo Road is a located in a lovely
setting. It is not a "city" type road. It is narrow in places necessitating driving in the middle of the road. If
someone is parked on the side of the road it is impossible to get around. Walkers are on our road all the time
and naturally it is necessary to go over the center line to pass them.
What will be achieved by putting markers on our road - not much and who will monitor the activity of the
drivers? No one will observe the markers/ line so the city will have incurred an unnecessary expense and will
have ruined the looks of Montalvo Road. Let's just leave it alone. PLEASEII

It is with a great deal of concern that I have observed a crew from Saratoga prepping our lovely street for some
sort of road markers. I just wonder what those markers will achieve. I drive my street several times a day and I
can assure you that no one will be able to drive within the markers unless no parking signs are put on the

We, the residents of Montalvo Road in Saratoga, CA would like to petition you to
permanently stop all work pertaining to traffic markers on Montalvo Road. As told to 015
you via Kristen Doyle and to Mr. Norman Kline, former mayor of Saratoga, we strongly �1
object to anything that makes our beautiful road look like a major highway. These jr </1 r
markers were never requested by any of the residents on this road. We are aware of C
speeders on this road, but as previously stated, we also know that the violators are not
visitors to Montalvo, because most visitors are uncertain of where Montalvo is, and
usually drive quite slowly. Rather we feel that they are members of staff or artists
residents from Montalvo who are familiar with the road. These drivers will not be slowed
down by the markers but will just avoid them. We further feel that it is the responsibility
of the Montalvo Association to tell the former- to be aware that this is a neighborhood and
to drive carefully.
Mr. Kline told me that I would be contacted by your office as to how to proceed
concerning this. I have not yet been contacted and know that there is a meeting in
February. Since I will be out of town at that time, I am forwarding this letter stating our
concerns.

fall and giving us a chance to respond to this.

Attached are the Ravenwood counts. There definite is a spike in the # of cars during the peak school hours,
however the 85th percentile speeds are 26 mph in the EB and 29 mph in the WB direction.
Those vehicles that travel more than 30 mph are primarily during school peak hours, though the total number of
speeders is low (a combined total of approximately 20 vehicles for the morning and afternoon peak).

We spoke at the CERT graduation on March 10th at the Sunnyoaks Fire Station. I was expressing my concern
about the speed of the traffic on Lexington traveling to Saratoga High School, particularly on Wednesday
mornings at approximately 8:45 AM. Last Friday afternoon, an accident occurred on Lexington @ Herriman
involving two vehicles at school dismissal time. I know you are aware that my 5th grade neighbor was hit by a car
in the crosswalk at Herriman just a short time ago.
Can we get some help out here on Lexington ASAP? I discussed the speeding issue with the new vice principal
at Saratoga High a few weeks ago when I was almost hit while walking my dog on Lexington by a teenage driver
in route to Saratoga High. That incident was on a Wednesday morning when Lexington becomes a freeway for
late students and their parents. I have a child who walks on Lexington to get to Saratoga High and I am
particularly concerned about his safety.
I have sent a copy of this e -mail to Jeff Anderson, principal at Saratoga High. Any help the two of you could
provide would be much appreciated. Thank you.

Hi Kristin,
Saratoga is participating in the May 19th wide regional cleanup event through the City's stormwater program
( WVCWP).
Here is the high school address where we meet for the event (9am to noon): 4805 Westmont Avenue
Campbell, CA 95008. Although we are not doing this with the high school, many students come and help out.
Students receive certificates signed by our Program for three hours of community service, which they can turn
into their schools for credit. Some schools require community service for all students.
The assembly spot is between the high school and Quito Rd, at the edge of Westmont's gated athletic field, next
to San Tomas Creek. We will be easy to spot from Westmont Ave with our Clean Water Program banners and a
set up of tables, snacks and tools for litter pick. The Water District already has us listed as participants for
National River Cleanup Day, which is the same day (May 19th)
FYI, Saratoga's stormwater pollution prevention program is also sponsoring a private Wildcat Creek cleanup in
partnership with Sacred Heart School students, teachers and parents on Wednesday April 18th. We have don't
this for several years now. WVCWP staff brings the treats and tools and the students clean up the schoolyard
which backs up to the creek and then they go into the area along the banks of the creek and remove litter.
I thought Ann might want to know this.
One year the Saratoga News joined us and printed a cover page article with photographs.
Kudos to Saratoga for having residents who care!

Is Your Posted Speed Limit Leggy

There has been a recent change in
standards and legal requirements for
establishing speed zones in California that
affects all jurisdictions in the state. Upon
the adoption of the 2003 MUTCD as
amended with the California Supplement
on May 20, 2004, the following language
was incorporated in the California
Supplement regarding speed limits (Section
2B.116, bottom of page 2B -51):
"The speed limit should be established at
the nearest 10 km /h (5 mph) increment to the
85" percentile speed. However, in matching
existing conditions with the traffic safety needs of
the community, engineering judgment may
indicate the need for a further reduction of
IOkm /h (5 mph). " [emphasis added]
This is a change from the superseded
Traffic Manual provision that allowed
establishing a posted speed limit at the
nearest five -mile -per -hour increment below
the 85" percentile speed, and then allowing
an additional 5 mph reduction for other
traffic safety- related considerations.
The new standard has already resulted
in a legal challenge in Orange County, in
which a Superior Court judge issued an
opinion invalidating a citation issued on a
street with a posted speed limit of 35 mph
where the 85th percentile was 44.2 mph
(Superior Court of California, County of
Orange; People vs. Perez, Rebecca
Dolores; Case No. FL727253; August 4,
2005). Referring to the above - mentioned
section of the California Supplement, the
court decided that the 85'" percentile of
44.2 mph should result in a posted speed
limit of 45 mph (nearest 5 mph increment)
which then may be reduced by another 5
mph to a 40 MPH speed limit (based on
written and documented engineering
justifications). However, the involved
jurisdiction had used the prior standard of
40 mph (first 5 mph increment below the
85th percentile speed), and then had further
reduced it by another 5 mph (as allowed by
the prior standard, for conditions not
readily apparent to the driver) resulting in
the posted speed limit of 35 mph. The

While most states around District 6
do not have legislative sessions in summer
or fall, California's legislature is just

have been reduced another 5 mph using
"documented" traffic safety considerations.
However, in this case, the judge also raised
concern that the involved jurisdiction had
also failed "to show justification for the
downward adjustments of more than 5
miles per hour as discussed in People v.
Goulet 1992, 13 Cal App 4th Supp 17." .
Although there is concern that this
opinion might have failed to consider that
the engineering and traffic survey (ETS) for
this highway segment was done prior to
May 20, 2004 (the date of adoption of the
new California Supplement) and the new
standards should not be required
retroactively; nonetheless, it has raised
awareness among municipalities about the
new standards and legal requirements for
establishing speed zones.

Standard:
A logo and any secondary message (along with colors) shall be agreed upon by the Task Force.
The logo and secondary message shall not cover more than 25 percent of the.sign's surface area.
The Department of Transportation shall purchase and install the S33 (CA Code) signs.
Support:
The Task Force is to advise the Department of Transportation, in writing, as to how long the signs are to
remain on the highway.
Guidance:
This time period should not exceed three years.
Section 2B.116 Speed Limits and Zones
Support:
Speed limits in California are governed by the Califomia Vehicle Code (CVC), Sections 22348 through
22413; also, pertinent sections are found in Sections 627 and 40802 and others referenced in this section.
See Section IA.l l for information regarding this publication. .

Basic Speed Law and Prima Facie Speed Limits — See CVC 22350 & 22352
Support:
The basic speed law states "No person shall drive a vehicle upon a highway at a speed greater than is
reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of,
the highway, and in no event at a speed which endangers the safety of persons or property."
Standard:
Prima facie speed limits are specific limits and shall apply unless changed based upon an
engineering and traffic survey and signs are posted that display the new speed limit.
Option:
. Prima facie speed limits may be preempted by the basic speed law, when roadway, traffic or weather
conditions warrant a lower speed.
Use of Metric System Designations — See CVC 21351.3
Option:
Dual units for speed limits on signs may be placed on local streets and roads in both Metric and English
units.
Guidance:
If used, dual unit speed limits should be rounded to the nearest 10 km/h for Metric and 5 mph for English
units for posting on signs on local streets and roads.
Support:
Refer to AASHTO's Traffic Engineering Metric Conversion Factors. See Section IA.l l for information
regarding this publication.
Standard:
Metric speed limits shall not be placed on State highways. For use in this Supplement, 70 mph
shall be shown as a metric equivalent of 110 km /h, neither of which shall be used on any local street or
road.
Legal Authority for Establishing Speed Limits
Support:
Delegation of legal authority to set speed limits on State highways is given to Department of
Transportation's District Directors. The District Director of each transportation district is authorized to issue
orders regulating the speed of traffic, up to 110 km/h (65 mph) on State highways. The Director of the

Department of Transportation retains the authority to approve variable, minimum, and maximum speeds up
to 110 km/h (70 mph) on State freeways.
20 km /h (15 mph) - See CVC 22352.a.1
Standard:

survey:
• At a railroad grade crossing with an obstructed view.
• At an uncontrolled highway intersection with an obstructed view.
• On an alley.
20 & 30 km /h (15 & 20 mph) - See CVC 22358.3 & 22358.4
Standard:
The following speed limits shall apply, unless changed upon the basis of an engineering and traffic
survey:
• Based upon an engineering and traffic survey where the prima facie speed of 40 km /h (25 mph)
is more than is reasonable or safe.
• Due to .a narrow street not exceeding 7.6 in (25 ft), other than a State highway, in a business or
residential area or in a public park.
• Near a school or senior center facility.
40 km /h (25 mph) - See CVC 22352.a.2 & 22357.1
Standard:
The following speed limits shall apply, unless changed, based upon an engineering and traffic
survey:
• On any highway other than a State highway in any business or residence district.
• In a school zone.
• When passing a facility primarily used by senior citizens and contiguous to a street other than
a State highway.
• Adjacent to a children's playground in a public park, but only during particular hours or days
when children are expected to use the facilities. This limit is effective when signs giving notice
of the speed limit are posted.
40 to 100 km /h (25 to 60 mph) on State highways - See CVC 22354 & 22354.5
Option:
The following speed limits may apply:
• Whenever the Department of Transportation determines based upon an engineering and traffic
survey that the limit of 110 km/h (65 mph) is more than is reasonable or safe upon a State highway,
the Department may determine and post a prima facie speed limit of 100, 90, 80 70, 60, 60, 50, 40
km/hr (60, 55, 50, 45, 40, 35, 30, 25 mph) whichever is found most appropriate to facilitate the
orderly movement of traffic and is reasonable and safe.
• Local city council or county board of supervisors may conduct a public hearing on proposed
increases or decreases to posted speed limits and the Department shall take into consideration the
results of the public hearing.
40 to 110 km /h (30 to 65 mph) on Local Streets & Roads - See CVC 22357
Option:
The following speed limits may apply:
• Whenever a local authority determines based upon an engineering and traffic survey that a'speed
greater than 40 km/h (25 mph) would facilitate the orderly movement of vehicular traffic and would
be reasonable and safe upon any street other than a State highway otherwise subject to a prima facie
limit of 40 km/h (25 mph), the local authority may by ordinance post a prima facie speed limit of 50,
60, 60, 70, 80, 90, or 100 km/h (30, 35, 40, 45, 50, 55, or 60 mph), or 110 km/h.(65 mph), whichever
is found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe.

vehicles mentioned in CVC 22406 with specified weight requirements, the department or local
authority, with respect to highways under their respective jurisdiction, may determine and post a
speed limit of 80, 70, 60, 60, 50, 40 or 30 km/h (50, 45, 40, 35, 30, 25 or 20 mph), whichever is
found most appropriate to facilitate the orderly movement of traffic and is reasonable and safe when
appropriate signs are posted upon the highway.
90 km /h (55 mph) — See CVC 22349.b &.c and 22406
Option:
The following speed limits may apply:
• On a two -lane, undivided highway.
• On any highway if driving any of the following vehicles:
a. A motortruck or truck tractor having three or more axles or any motortruck or truck tractor
drawing any other vehicle.
b. A passenger vehicle or bus towing any other vehicle.
c. A schoolbus transporting any school pupil.
d. A farm labor vehicle when transporting passengers.
e. A vehicle transporting explosives.
f. A trailer bus.
110 km /h (65 mph) Maximum Speed Limit- See CVC 22349(a) & CVC 22349
Option:
The following speed limits may apply:
• On any highway, or portion thereof, posted at 110 km/h (65 mph) based upon an engineering and
traffic survey.
110 km /h (70 mph) Maximum Freeway Speed Limit - See CVC 22356
Option:
The following speed limits may apply:
• Whenever the Department of Transportation, after consultation with the California Highway Patrol
(CHP), determines based upon an engineering and traffic survey on existing freeway segments that
are otherwise subjected to a maximum speed limit of 110 km/h (65 mph), or upon the basis of
appropriate design standards and projected traffic volumes in the case of newly constructed freeway
segments, that a speed greater than 110 km/h (65 mph) would facilitate the orderly movement of
vehicular traffic and would be reasonable and safe, the Department, with the approval of the CHP,
may declare and post a higher maximum speed of 110 km/h (70 mph) for vehicles not subject to
CVC 22406.
Variable Speed Limits on Freeways - See CVC 22355
Option:
The following speed limits may apply:
• Whenever the Department of Transportation determines based upon an engineering and traffic
survey that the safe and orderly movement of traffic upon any freeway segment will be facilitated by
the establishment of variable speed limits.
• The Department may erect, regulate, and control signs upon the state highway which is a freeway, or
any portion thereof, which, if used, signs shall be designed to permit display of different speeds at
various times of the day or night.
• Such signs need not conform to the standards & specifications per CVC 21400, but if used, shall be
of sufficient size and clarity to give adequate notice of the applicable speed limit.

Minimum Speed Limits on State Hi2hways - See CVC 22400
Option:
The following speed limits may apply:
• Whenever the Department of Transportation determines based upon an engineering and traffic
survey that slow speeds on any part of a state highway consistently impede the normal and
reasonable movement of traffic, the Department may determine and declare a minimum speed limit.
Appropriate signs giving notice shall then be installed on that segment.
• A motorist can be cited for stopping or impeding the normal and reasonable movement of traffic
unless the stop is necessary for safe operation and in compliance with the law.
Engineering and Traffic Survey
Support:
CVC Section 627 defines the term "Engineering and traffic survey" and lists its requirements.
Standard:
An engineering and traffic survey shall include, among other requirements deemed necessary by
the department, consideration of all of the following:
(1) Prevailing speeds as determined by traffic engineering measurements.
(2) Accident records.
(3) Highway, traffic, and roadside conditions not readily apparent to the driver.
Guidance:
The Engineering and Traffic Survey should contain sufficient information to document that the required
three items of CVC Section 627 are provided and that other conditions not readily apparent to a motorist are
properly identified.
Prevailing speeds are determined by a speed zone survey. A speed zone survey should include:
• The intent of the speed measurements is to determine the actual speed of unimpeded traffic. The
speed of traffic should not be altered by concentrated law enforcement, or other means, just prior to,
or while taking the speed measurements.
• Only one person is required for the field work. Speeds should be read directly from a radar or other
electronic speed measuring devices; or,
• Devices, other than radar, capable of accurately distinguishing and measuring the unimpeded speed
of free flowing vehicles may be used.
• A location should be selected where prevailing speeds are representative of the entire speed zone
section. If speeds vary on a given route, more than one speed zone section may be required, with
separate measurements for each section. Locations for measurements should be chosen so as to
minimize the effects of traffic signals or stop signs.
• Speed measurements should be taken during off -peak hours between peak traffic periods on
weekdays. If there is difficulty in obtaining the desired quantity, speed measurements may be taken
during any period with free flowing traffic.
• The weather should be fair (dry pavement) with no unusual conditions prevailing.
• The surveyor and equipment should not affect the traffic speeds. For this reason, an unmarked car is
recommended, and the radar speed meter located as inconspicuously as possible.
• In order for the sample to be representative of the actual traffic flow, the minimum sample should be
100 vehicles in each survey. In no case should the sample contain less than 50 vehicles.
• Short speed zones of less than 0.8 km (0.5 mi) should be avoided, except in transition areas.
• Speed zone changes should be coordinated with changes in roadway conditions or roadside
development.
• The speed limit should be established at the nearest 10 km/h (5 mph) increment to the 85`h percentile
speed. However, in matching existing conditions with the traffic safety needs of the community,
engineering judgement may indicate the need for a further reduction of 10 km/h (5 mph).

• Speed zoning should be in 20 km/h (10 mph) increments except in urban areas where 10 km/h (5
mph) increments are preferable.
• Speed zoning should be coordinated with adjacent jurisdictions.
Support:
Physical conditions such as width, curvature, grade and surface conditions, or any other condition readily
apparent to the driver, in the absence of other factors, would not require special downward speed zoning.
Refer to CVC 22358.5.
Option:
When qualifying an appropriate speed limit, State and local authorities may also consider the following
findings:
1. Residential density, if any of the following conditions exist on the particular portion of highway and
the property contiguous thereto, other than a business district:
a. Upon one side of the highway, within 0.4 km (0.25 mi), the contiguous property fronting thereon
is occupied by 13 or more separate dwelling houses or business structures.
b. Upon both sides of the highway, collectively, within a distance of 0.4 km (0.25 mi) the
contiguous property fronting thereon is occupied by 16 or more separate dwelling houses or
business structures.
c. The portion of highway is larger than 0.4 km (0.25 mi) but has the ratio of separate dwelling
houses or business structures to the length of the highway described in either subparagraph a or
b.
2. Pedestrian and bicyclist safety.
Option:
The following two methods of conducting engineering and traffic surveys may be used to establish speed
limits:
1. State Highways - The engineering and traffic survey for State highways is made under the direction of
the Department of Transportation's District Traffic Engineer. The data includes:
a. One copy of the Standard Speed Zone Survey Sheet (See Figure 2B-103) showing:
• A north arrow
Engineer's station or post mileage
Limits of the proposed zones
Appropriate notations showing type of roadside development, such as "scattered business,"
"solid residential," etc. Schools adjacent to the highway are shown, but other buildings need
not be plotted unless they are a factor in the speed recommendation or the point of
termination of a speed zone.
• Collision rates for the zones involved
• Average daily traffic volume
• Location of traffic signals, signs and markings
• If the highway is divided, the limits of zones for each direction of travel
• Plotted 85`h percentile and pace speeds at location taken showing speed profile
b. A report to the District Director that includes:
The reason for the initiation of speed zone survey.
• Recommendations and supporting reasons.
• The enforcement jurisdictions involved and the recommendations and opinions of those
officials.
• The stationing or reference post in kilometers (mileage) at the beginning and ending of each
proposed zone and any intermediate equations. Location ties must be given to readily
identifiable physical features.
City and County Through Highways, Arterials, Collector Roads and Local Streets.

a. The short method of speed zoning is based on the premise that a reasonable speed limit is one
that conforms to the actual behavior of the majority of motorists, and that by measuring
motorists' speeds, one will be able to select a speed limit that is both reasonable and effective.
Other factors that need to be considered include but are not limited to: the most recent two -year
collision record, roadway design speed, safe stopping sight distance, superelevation, shoulder
conditions, profile conditions, intersection spacing and offsets, commercial driveway
characteristics, and pedestrian traffic in the roadway without sidewalks.
b. Determination of Existing Speed Limits -Figures 213-105 & 2B -106 show samples of data sheets
which may be used to record speed observations. Specific types of vehicles may be tallied by
use of letter symbols in appropriate squares.
In most situations, the short form for local streets and roads will be adequate; however, the procedure .
used on State highways may be used at the option of the local agency.
Guidance:
The factors justifying a reduction below the 85`h percentile speed for the posted speed limit are the same
factors mentioned above. Whenever such factors are considered to establish the speed limit; they should be
documented on the speed zone survey or the accompanying engineering report.
. The establishment of a speed limit of more than 10 km/h (5 mph) -below the 85`h percentile speed should
be done with great care as studies have shown that establishing a speed limit at less than the 85`h percentile
generally results in an increase in accident rates; in addition, this may make violators of a disproportionate
number of the reasonable majority of drivers.
Support:
Generally, the most decisive evidence of conditions not apparent to the motorist surface in accident
histories.
Speed limits are established at or near the 85`h percentile speed, which is defined as that speed at or
below which 85`h percent of the traffic is moving. The 85`h percentile speed is often referred to as the critical
speed. Pace speed is defined as the 16 km/h (10 mph) increment of speed containing the largest number of
vehicles (See Figure 213-104). The lower limit of the pace is plotted on the Speed Zone Survey Sheets as an .
aid in determining the proper zone limits. Speed limits higher than the 85`h percentile are not generally
considered reasonable and prudent. Speed limits below the 85`h percentile do not ordinarily facilitate the
orderly movement of traffic and require constant enforcement to maintain compliance. Speed limits
established on the basis of the 85`h percentile conform to the consensus of those who drive highways as to
what speed is reasonable and prudent, and are not dependent on the judgement of one or a few individuals.
The majority of drivers comply with the basic speed law. Speed limits set at or near the 85`h percentile
speed provide law enforcement officers with a limit to cite drivers who will not conform to what the majority
considers reasonable and prudent. Further studies show that establishing a speed limit at less than the 85`h
percentile (Critical Speed) generally results in an increase in accident rates.
Option:
When roadside development results in traffic conflicts and unusual conditions which are not readily
apparent to drivers, as indicated in collision records, speed limits somewhat below the 85`h percentile may be
justified. Concurrence and support of enforcement officials are necessary for the successful operation of a
restricted speed zone.
Guidance:
Speed zones of less than 0.8 km (0.5 mi) and short transition zones should be avoided.
Speed Traps
Support:
Refer to CVC 40802 for Speed Traps.
Standard:
A speed trap shall not apply to a local street, road, or school zone.

A section of highway shall be defined as a speed trap if the prima facie speed limit is not justified
by an engineering and traffic survey within five years, and the enforcement of the speed limit involves
the use of radar or any other electronic device that measures the speed of moving objects.
This time provision shall be extended to seven years when using radar and all of the following
criteria are met:
• The arresting officer has successfully completed a minimum of 24 hours of certified radar
operator course training.
• The radar used to measure the speed meets or exceeds the minimal operational standards of
the National Traffic Highway Safety Administration, and has been calibrated within three
years of the alleged violation.
This time provision shall be extended to seven years when using laser or other electronic device
(other than radar) and all of the following criteria are met:
• The arresting officer has successfully completed a minimum of 24 hours of certified radar
operator course training.
• The arresting officer has successfully completed a minimum of 2 hours of additional approved
certified training.
• The radar used to measure the speed meets or exceeds the minimal operational standards of
the National Traffic Highway Safety Administration, and has been calibrated within three
years of the alleged violation.
Option:
This time provision for an engineering and traffic survey may be extended to ten years when all of the
above conditions are met and no significant changes in roadway or traffic conditions have occurred,
including changes in adjoining property or land use, roadway width, or traffic volume as determined by a
registered engineer.
Truck Speed Zone on Descending Grades
Guidance:
Highway descending grades, if used for posting TRUCK SPEED LIMIT signs for trucks travelling
downhill, should have recorded incident history of runaway commercial vehicles. Descending grades shorter
than 1.6 km (1 mi) should be avoided for posting signs because deceleration of vehicles due to braking action
can generally provide sufficient control on descending grades of less than 1.6 km (1, mi).
Support:
To establish a downhill truck speed limit, a physical profile showing length and gradient and a downhill
speed profile for three or more axle commercial vehicles with a gross rating of 4,536 kg (10,0001bs.) or
more will be provided.
Standard:
Speed profiles for truck speed limits shall be prepared on the same form as other speed surveys.
An analysis of collisions involving trucks shall be prepared.
Guidance:
Posted speeds should be on the low side of the scale, generally within the pace of loaded commercial
vehicles.
Standard:
If warranted, the Department of Transportation's District Director shall issue a standard speed
zone order.
Support:
Posting of the regulation will be by placement of a standard 900 x 1150 mm (36 x 45 in) Speed Limit
(R2 -1) sign with a TRUCK (M4 -4) plate above.
Standard:
A standard End Speed Limit (CA Code 113) sign with TRUCK (M4 -4) plate shall be posted at the
end of the truck zone when appropriate.

Speed Zones in Temporary Traffic Control Areas

Section 2B.117 Bus and Truck Registration Sign (CA Code SR441
Guidance:
The Bus and Truck Registration (CA Code SR44) sign should be placed at all Border Inspections
Stations to relay this information to Interstate carriers.
Section 2B.118 Double Fine Zone Signs (CA Code SR53, SR54 and SR55)
Standard:
The SPECIAL DRIVING ZONE BEGINES HERE — DOUBLE FINE ZONE (CA Code SR53) sign
shall be placed at the beginning of those portions of highways designated and.identified as Safety
Enhancement — Double Fine Zones per CVC 42010.
The SPECIAL DRIVING ZONE ENDS HERE (CA Code SR55) sign shall be placed at the end of
those portions of highways designated and identified as Safety Enhancement — Double Fine Zones per
CVC 42010.
Guidance:
The DOUBLE FINE ZONE (CA Code SR54) sign should be placed at major intersections to those,
portions of highways designated and identified as Safety Enhancement — Double Fine Zone, per CVC 42010,
to advise motorists upon entering the highway that they are in a double fine zone.
Section 2B.119 Garbage Prohibition Signs (CA Code SR22 -1 and SR23 -1)
Option:
The DUMPING PROHIBITED (CA Code SR22 -1) sign may be placed at State highway facilities where
unauthorized dumping of materials or garbage is prevalent.
The NO HOUSEHOLD GARBAGE (CA Code SR23 -1) sign may be placed at State highway facilities
where refuse containers provided for motorist convenience are being used to dispose of excessive amounts of
household garbage.
