minutes on matters not on this agenda. The law generally prohibits the council from
discussing or taking action on such items. However, the Council may instruct staff
accordingly regarding Oral Communications under Council Direction to Staff.

1. Discussion of proposed Garrod Annexation
Recommended Action:
Informational only.
In accordance with the Ralph M. Brown Act, copies of the staff reports and other materials
provided to the City Council by City staff in connection with this agenda are available at the
office of the City Clerk at 13777 Fruitvale Avenue, Saratoga, CA 95070. Note that copies of
materials distributed to the City Council concurrently with the posting of the agenda are also
available on the City Website at xvarw.saratoga.ca.us. Any materials distributed by staff after the
posting of the agenda are made available for public review at the office of the City Clerk at the
time they are distributed to the City Council.

SUBJECT: Next Steps in Garrod Trust Annexation Proceedings in light of LAFCO issues
RECOMMENDED ACTION:
City Council to give direction regarding next steps in Garrod Trust Annexation Proceedings.
REPORT SUMMARY:
There are portions of the Garrod Trust lands proposed for annexation which are outside the
City's Urban Service Area. The City needs LAFCO approval to amend its Urban Service Area to
add those lands, even though all Garrod Trust Lands are with the City's Sphere of Influence. In
meetings and conference calls with LAFCO staff, the City and Garrod Trust have been informed
that there are a number of LAFCO- related issues which need to be addressed, including these:
Garrod Trust lands are part of what LAFCO identifies as "Unincorporated Island
#STGO1" within Saratoga's Urban Service Area, containing 89.5 acres, of which 54.04
acres belong to Garrod Trust (see LAFCO Map attached). Orchard Meadows Subdivision
is also in this "Island" (actually a pocket). LAFCO has recently requested all cities to
determine whether to exclude areas not appropriate for eventual annexation from its
USA. LAFCO's position is that all land in an "Island" inside a. USA Boundary should be
annexed. Council Direction is requested as to what portions of Island #STGO1 should be
annexed and what portions should be removed from the USA Boundary.
Annexation of the Garrod Trust lands will leave a triangular shaped area to the north
owned by Mid- Peninsula Open Space District as a true "Island" between Saratoga and
Cupertino. Council direction is requested as to whether to include the triangular shaped
area in the USA Boundary amendment and in the Garrod Trust annexation.
The Garrod Trust annexation is currently proposed to be given an exemption from CEQA
because the lands are already developed and no physical change to the environment is
proposed. Subsequent to Council direction as to the issues above, staff will need to
reevaluate its recommendation as to whether exemption from CEQA remains appropriate.
In addition to Island # STGO1 (the Garrod Trust area), LAFCO has identified another five
Unincorporated Islands within Saratoga's USA Boundary and has requested Saratoga to
advise as to its plans for annexation or removal from the USA as to these Islands too.
Council direction is requested in this regard as well.

FOLLOW UP ACTION: As directed by City Council, and if so directed, calendar and give

RE: Status of Unincorporated Lands within the City of Saratoga's Urban
Service Area Boundary (i.e. Unincorporated Islands)
Dear Mr. Riordan:
In late October 2010, the Local Agency Formation Commission (LAFCO) of Santa
Clara County directed its staff to develop an inventory of the remaining
unincorporated islands within each city's urban service area and to report back to
the Commission on each city's plans regarding its islands.
Six Unincorporated Islands Remain in the City of Saratoga
The City has six unincorporated islands within its Urban Service Area (USA). See
table below and attached maps.

Annex Islands that Qualify for the Streamlined Annexation Process
Islands STG02 and STG04 consist primarily of private residential development
and are eligible for annexation through the streamlined annexation process.
Islands such as these are substantially developed and create inefficiencies /
confusion in terms of provision of emergency and other municipal services.
Furthermore, residents of such islands are politically disenfranchised from the city
government that surrounds them.
Annexation of such islands is a high priority for LAFCO and the County. In order
to encourage these annexations, LAFCO continues to waive its fees for island
annexations and the County continues to provide financial incentives including
covering the costs for preparing Assessor and Surveyor reports and maps, paying
the State Board of Equalization filing fees, and budgeting for road improvements
in islands approved for annexation. As you may be aware, the law streamlining
the annexation process for qualified unincorporated islands sunsets on January 1,
2014.
We encourage the City to take advantage of this process and the incentives
currently being offered by both the County and LAFCO for such annexations.
Please provide us with an update on the City's plans and time -line for annexing
islands STG02 and STG04.
Review Remaining Islands
In terms of the City's four other remaining islands (i.e. STGO1, STG05, STG06, and
STG07 ), please review these islands that may or may not qualify for the
streamlined annexation process, and determine whether the City intends to retain
them within the City's USA boundary for eventual annexation.
For those islands that the City intends to retain in its USA boundary, please
explain what the City's rationale is for retaining them in its USA and when the
City plans to annex them.
For those areas not appropriate for eventual annexation, the City should consider
whether to exclude these areas from its USA Boundary. Please contact LAFCO
staff to discuss the USA amendment process and time -line for resolving these
islands.
A Response from the City is Greatly Appreciated
LAFCO staff is willing to work with and assist the City in resolving these island
issues. We would appreciate knowing the City's annexation and /or urban service
area amendment plans for these islands as soon as possible and no later than June
