Adjournment 9:00 a.m. Tuesday October 8, 2002 - Warner Hutton House City of Saratoga Community Development Department MEMORANDUM TO: HERITAGE PRESERVATION COMMISSION FROM: John F. Livingstone, Associate Planner DATE: October 17, 2002 RE: Calendar Sales City Staff had a meeting to discuss the issues related to fund raising and product sales for all City Commissions. The following is a breakdown of the meeting: 1. Any fundraising activity must be approved by the City Council. 2. If the HPC Commission would like to continue the calendar project, the calendars would need to be made available on a donation basis. The down side of this option is that if someone asks for a calendar without making a donation, their request must be honored. Donation would then be deposited into the City general fund and it would take a City Council action to transfer the money back into the Commission fund. The HPC is funded from the general fund and does not have an account which money can go into directly. If the HPC is interested in this the procedure it must be approved by the City Council. The earliest agenda that this could be placed on is November 6, 2002. 3. The City finance system is not set up for retails sales that require sales tax and other administrative procedures. Profiting from the sales is even a bigger administrative issue since the City is a non - profit organization. 4. The Youth Commission fundraising activities are permitted because they occur in conjunction with the Friends of the Warner Hutton House, a separate non - profit organization that is not subject to City constraints. 5. Prior to the end of the year, staff will prepare a report for Council consideration at a regular Council meeting that will explore the issues and options. All of this still needs to be investigated further and I will keep the HPC updated as it moves forward. New Business Budget update - Discussed how to use the $3,000 budget for this year. The HPC decided to use approximately $2,000 for the Mustard Walk, $500 for Austin Way, and $500 for the calendar. The $2,000 for the Mustard Walk included a one -time expenditure for a banner. Funds received as a result of the calendar may be distributed back to the HPC. All training would have to be conducted on a volunteer basis. IV. Items Initiated by the Commission Review Heritage Preservation Ordinance - Item discussed. V. Items Initiated by the Secretary A. Update Heritage Resource Inventory - Reviewed list of potential historic sites starting with homes older than 1925. The list of homes was divided among the Commissioners to start an initial review of the properties. B. Map Historic Resources - Item discussed. C. E -Mail test sent to HPC Commission - Test was successful. D. Blaney Plaza Improvements - HPC approved the move of the arch to the proposed location. Norm Koepernik and Patricia Bailey were selected to be on a subcommittee to work on the Blaney Plaza Improvement project. VI. Adjournment 9:00 a.m. Tuesday September 10, 2002 - Warner Hutton House SARATOGA CITY COUNCIL MEETING DATE: September 4, 2002 AGENDA ITEM: ORIGINATING DEPT: Public Works CITY MANAGER: PREPARED BY: DEPT HEAD: SUBJECT: Blaney Plaza Improvements - Review of Conceptual Design Plans RECOMMENDED ACTION(S): 1. Review Conceptual Design Plans. 2. Direct staff on preferred location of Memorial Arch. REPORT SUMMARY: At the August 7th City Council Meeting the City Council approved a professional services agreement with Greg Ing and Associates for preparation of conceptual design plans for Blaney Plaza. The work performed by Greg Ing and Associates witl accomplish two main tasks: 1) determine the best placement of the Memorial Arch in Blaney Plaza; and 2) the preparation of a master plan and cost estimate for the future redevelopment of Blaney Plaza. The first step in the project is to determine the best location of the Memorial Arch into Blaney Plaza, which will provide the Saratoga Fire District the needed information to move forward with the relocation work. Relocation options will be provided to the Council on Tuesday prior to the City Council Meeting. The Heritage Commission, the Arts Commission, and the Saratoga Historical Foundation have been notified of the project and they have indicated interest in participating in the development of a master plan for the plaza. The second step in the development of the master plan will be the distribution of the conceptual plans to all interested parties for comment. If Council pleases a focus group made up of representatives of the above - mentioned groups can be formed to work with the design consultant to develop the final master plan prior to final approval by City Council. FISCAL IMPACTS: None. CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S): The location of the Memorial Arch will not be determined at this time. ALTERNATIVE ACTION(S): None in addition to .the above. FOLLOW UP ACTION(S): A final master plan for Blaney Plaza will be developed and the approved location of the Memorial Arch will be forwarded to the Saratoga Fire District. This ordinance will prevent the various Commissions left without a quorum with the result of having to cancel monthly meetings. This is in turn is due to the fact that at some point up to four commissioners' terms expire. Please agendize this topic on your next commission meeting just in case your commissioners have questions. If you have any questions, please call me at Ext. 269. Thanks. /attachments ORDINANCE 208 AN ORDINANCE ESTABLISHING STAGGERED TERMS FOR COMMISSIONERS APPOINTED TO CITY COMMISSIONS THE CITY COUNCIL OF THE CITY OF SARATOGA DOES ORDAIN AS FOLLOWS: Section 1. Findings. A. The City of Saratoga has established a number of commissions to advise the City Council in reviewing, establishing, and implementing City policy in a number of areas. Commissioners provide an invaluable service to the City and their participation in these civic affairs goes to the very heart of representative democracy at the local level. B. The City Council has established common requirements regarding qualifications, attendance, removal, vacancies, meetings, and rules of procedure for all City Commissions. C. Currently, each Commission has new Commissioners appointed to four year terms every other year. In one year, four Commissioners may leave a Commission and be replaced by new Commissioners. In -the next year there are no new Commissioners and in the following year, three Commissioners may leave and be replaced by new Commissioners. D. The City Council wishes to increase the frequency with which interested citizens may apply for a seat City Commissions and to avoid the loss of significant expertise at a single time. Therefore, this ordinance amends the Saratoga City Code to provide that the terms served by the Commissioners on each Commission shall be evenly staggered. Specifically, on each Commission, the terms of approximately an equal number of Commissioners shall expire each year, and those Commission seats will be open to qualified applicants. E. In order to make the transition from the current schedule of dates on which Commissioner terms expire to the staggered schedule established by this ordinance, section 2.2 of this ordinance authorizes the City Council to appoint Commissioners to transitional terms of less than four years through 2006. Ordinance No. 208 Section 2. Adoption. Section 2.1. Staggered Terms. Article 2 -12 of the Saratoga City Code is hereby amended by adding the following paragraph (c) at the end of section 2- 12.12: "(c) For each Commission, the terms of the Commissioners shall be staggered such that each year the four year terms of approximately an equal number of the Commissioners shall expire. Where a Commission has seven Commissioners, the terms of two Commissioners shall expire each year except that in the year after the first six Commission terms have expired, only one term shall expire. The limitations set forth in this paragraph (c) shall not apply to the Youth Commission. Section 2.2. Transitional Terms. Article 2 -12 of the Saratoga City Code is hereby amended by adding the following paragraph (d) at the end of section 2- 12.12: "(d) Notwithstanding paragraph (a) of this section, where the terms of Commissioners on a Commission do not comply with paragraph (c) of this section, a Commissioner may be appointed to a term less than four years for the purpose of making the terms of the Commissioners on the Commission comply with paragraph (c). No term shall be reduced after a Commissioner is appointed to serve the term, except as otherwise provided by this Code. For purposes of paragraph (b) of this section, a term of less than four years established pursuant to this paragraph is not a full term. This paragraph shall be of no further force and effect after December 31, 2006. Section 3. Publication. The front side of the roof is punctuated by a wide gabled dormer. All of the eaves, including the dormer, feature simple exposed rafters. The house is clad in horizontal clapboard siding, approximately 2" in width. All of the windows are wood sash and feature a variety of pane configurations. The front eave overhangs a wide porch which features two entry columns, also clad in wood siding. The house has 5 bedrooms and 2 baths, and has seen no structural changes. 8. Mitchell for his son, Wilbur when the latter moved in that year. Frank Mitchell was born in Mokelumne in 1864 and came to San Jose with his parents in 1868; his father bought the property on Quito Road in 1878 and planted one of the area's earliest prune orchards (two separate sources put the original plat at 119 and 160 acres). This house sits on part of the original property. Frank Mitchell was a Santa Clara County Supervisor from 1904 - 1920; he was instrumental in having many of the main County roads paved during his tenure, and died in 1940. The Wilbur Mitchell's lived in the house until selling to the current owners in 1961. The residence is an excellent example of the Craftsman style. 20. Mr. Dorcich says no structural changes have been made in the five - bedroom, two - bathroom house in which he and his wife, -the. former Helen Anders, raised nine of their 11 children. Architect and builder: Unknown Present condition:-The house has not, as mentioned above, been alt erec.- It represents an unusual ownership situation in that the present owners are only the second occupants. According to Mr. Dorcich, the house was built (in 1909) by Frank E. Mitchell for his son Wilbur when the latter married.in 1909. The Wilbur Mitchells lived there until selling to the Dorciches in 1961.. Historical significance: Unfortunately, I couldn't get any information. on Wilbur Mitchell who, I understand, died just a few years ago. No discoverable obit at the Mercury News. However, the historical significance probably derives'' from the father, Frank E. Mitchell, who was born in Mokelumne in 1864 and came to San Jose with his parents in 1868. The father bought the property on Quito Road in 1878 and planted one of the area's earliest prune orchards. R.V. Garrod, in "Saratoga Story" (1962) says the original plot was 119 acres. Dave Duril and Thomas L. Nye in their 1984 report give it as 160 acres. Either way, the subject property is part of the original Mitchell property. Frank E. Mitchell was a Santa Clara.
