There will be a field trip at 8:30 to review the repair work to the McWilliams
House and the Book -Go -Round building located at 14410 Oak Street. Staff will
provide transportation to the site from the Warren Hutton House for the HPC.
I. Routine Organization

II. Old Business
A. Heritage Orchard update — Reviewed update
B. Orchard information sign — Norm Koepernik updated the HPC.
C. Mustard Walk and Historic Calendar — HPC recommended proceeding with
the planning for the next Mustard Walk, but limit the spending to $1,500. The
HPC also discussed the calendar. Tom Lowdermilk present pictures and made
a recommendation to concentrate the calendar on the downtown Village area
on Big Basin Way. The HPC supported this idea. The HPC also
recommended asking the Historic Foundation if they would take over the
calendar sales for administrative purposes.
'D. Library Grand Opening Booth — The HPC will participate on June 21" for the
grand opening.
E. Existing Heritage Orchard Signs and possible new sign on Saratoga Avenue —
Norm Koepernik is working on a new sign for the corner. The HPC asked
that this item be removed from the next agenda and updated as required on
future agendas.
F. Adopt -a -Tree — Norm Koepernik is finishing the design of the kiosk and
working on cost estimates.
G. Review of Heritage Inventory Subcommittee with City Council — In progress.
III. New Business
A. Review Mills Act Contracts — Norm Koepernik and Paul Conrado are
reviewing sample contracts from other cities.
B. Heritage Lane location on Saratoga Avenue – The HPC voted 4 in favor and 2
against the motion to adjust the ordinance and leave the signs in place. The
recommendation to modify the ordinance will be forwarded to the City
Council.
C. Budget limit of $1,500 – Nick Streit gave an overview of the City budget
concerns.
IV. Items Initiated by the Commission
A. Historic Park – The HPC recommended that the McWilliams House be used
by the Museum.
B. Rehabilitation of City buildings in Historic Park – The HPC reviewed the
proposed work on two buildings. The HPC recommended that the windows
be saved on the Book -Go -Round building and that no money be spent on the
McWilliams house until a master plan is reviewed.

Dear Sir,
We are very sorry this has taken so long to write, but please don't think it
diminishes our gratitude in what you helped accomplish in passing the Mills Act
for the City of Saratoga. We've had a very busy couple of months around here
but we will spare you all the details. It's very encouraging to have a mayor (and a
Town Council) who not only listens to his constituents but also acts upon their
requests.
Since our attendance at the Council meeting was perhaps the catalyst in passing
the Mills Act, we would appreciate being considered one of the first applicants for
a contract with the city. We understand that it will take some time for the
Heritage Committee to finalize a contract, but we hope to be contacted when this
occurs and we thank you in advance.

Saratoga Heritage Orchard is located at the corner of Saratoga Avenue and Fruitval
Avenue. It is an approximately 18 -acre site currently comprised of apricot, cherry an
prune trees. Additionally, the Saratoga Library, now being renovated, is located in th
north corner of the orchard.
Through community meetings and resident surveys, Saratoga residents have showr
commitment to preserving the Saratoga Heritage Orchard. Therefore, the Heritage
Preservation Commission and City Staff worked together with landscape architectur
of Gates & Associates to develop an Orchard Master Plan.
Orchard Master Plan presents two -phase strategy for renovation of the existing orch
and future improvements in the interest of minimizing disruption of the existing char<
of the orchard. This plan was used to develop an Orchard Restoration Capital
Improvement Project.
Phase I improvements include replacement of missing or dead fruit trees throughou.
orchard, construction of an orchard sign, installation of a permanent irrigation syster
construction of an irrigation well, if feasible.
The City has placed an order for 200 apricots, 142 French Prunes, 46 Bing Cherries
for pollination purposes 4 Tartarian Cherries and 4 Van Cherries. The grafting of frui
onto disease resistant rootstock is taking place now; trees will be ready for planting 1
2004.
Installation of an irrigation system is scheduled in early summer of 2003. This irrigati
system is designed to work with both metered water source or a production well and
minimize the labor associated with the current temporary irrigation system.
In order to reduce the expense of a metered water source, the City plans to develop
production well to provide natural source for irrigation of the orchard trees. Drilling o-
well is scheduled for early summer of 2003, subject to the budget. If the test pump

confirms the adequate water supply, the test well will be developed into an agricultui
production well. A variable pump system shall be installed and connect to the perme
orchard irrigation system.
Phase II improvements include "Adopt a Tree" program development, maintenance
construction, and ongoing tree replacement as required. The purpose of the "barn" i
house orchard maintenance equipment and provide a focus for education programs
the orchard. The character of the "barn" shall be consistent with the historic charact(
the orchard.
Other Heritage Orchard improvements are associated with Saratoga Library reno
and expansion project that required removal of some orchard trees to accommodatE
building and parking expansion. Sixty -two of the removed trees have been transplar
other locations in the orchard. The City's Orchardist, Matt Novakovich, recommende
the trees be transplanted now during their dormant season to insure a greater rate c
success.
Additional 140 trees will be planted in connection with library expansion in the corne
Saratoga Avenue and Fruitvale Avenue and along the orchard perimeter facing publ
streets. The City plans to complete planting of these trees in early summer of 2003.
The overall landscaping theme of the new Library highlights the Heritage Orchard, b
planting the fruit trees closer to the building and providing views of the orchard throu
windows and an orchard view terrace. In addition, the library main lobby structural s
elements and lighting fixtures are designed to create the orchard setting. The grand
opening of the improved library is scheduled for June 2003.
One of the highlights of Heritage Orchard events is annual Mustard Walk, organized
City Planning Department each February. Please join us next year for a fun and

Subject: Historic Preservation Ordinance (draft)
Dear Interested Party:
The Planning Office is pleased to announce the distribution of the draft of a new ordinance for
Santa Clara County concerning the treatment of historic properties located in the unincorporated
areas of the county.
On April 18, 2000, the Board of Supervisors accepted the "Final Report of the Historical
Heritage Assessment Project: Improving the Effectiveness of Santa Clara County's Historical
Heritage Activities." The report calls for the creation of a system that functions effectively and
efficiently when dealing with historic properties in the county.
Subsequent to the Board of Supervisors' action and in keeping with the Board of Supervisors'
direction, the Historic Preservation Ordinance was prepared to improve the organization and
clarity of county regulations pertaining to historic properties in a variety of ways:
■ Enhances the implementation of the County's General Plan policies:
Inventory and Evaluate Heritage Resources;
Prevent or Minimize Adverse Impacts on Heritage Resources; and
Restore, Enhance and Commemorate Resources.
■ Defines the roles of the Historical Heritage Commission and clarifies its powers and
duties.
• Clarifies the roles and content of the existing Heritage Resource Inventory.
• Provides review procedures and criteria for designating landmarks, heritage
properties and heritage trees.
■ Protects designated resources by providing a framework for development review
appropriate to the level of designation of the resource.
■ Provides timelines, sequences of steps in process, necessary findings, and appeal
procedures for the treatment of historic properties.

• Facilitates the County's compliance with the California Environmental Quality Act
with regard to historic properties by providing a process for identifying eligible
resources and reviewing proposed work on designated and eligible landmarks,
heritage properties and heritage trees to avoid adverse impacts to historic properties.
• Enables the County to apply for Certified Local Government (CLG) status. The CLG
program encourages the preservation of cultural resources by promoting a partnership among
local governments, the State of California, and the National Park Service, which is
responsible for the National Historic Preservation Program. Becoming a CLG can provide
local staff and commissions grant monies, technical training, and more meaningful leadership
roles in the preservation of the community's cultural heritage. Local interests and concerns
are integrated into the official planning and decision - making processes at the earliest possible
opportunity.
A preliminary schedule for the review and adoption of the Historic Preservation Ordinance is
provided below. Depending on the amount of interest or inquiries, the schedule may be
extended.

SUBJECT: Heritage Orchard Well and Irrigation Pumping System — Award of
Construction Contract
RECOMMENDED ACTION(S):
1. Move to declare Maggiora Brothers Drilling, Inc. to be the responsible bidder on the
proj ect.
2. Move to award a construction contract for constructing Heritage Orchard well and
irrigation pumping system to Maggiora Brothers Drilling, Inc. in the amount of
$95,475.00 and authorize the City Manager to execute the same.
3. Move to authorize staff to execute change orders to the contract up to $9,500.
REPORT SUMMARY:
Background
Orchard well construction and pumping system installation is part of Phase I Heritage Orchard
Improvements as described in Orchard Master Plan and approved by the City Council in
September 2001. Funding for the implementation of the project has been incorporated into five -
year Capital Improvement Plan and subsequently approved by the City Council.
The proposed well will be situated in the Heritage Orchard at the end of maintenance road off
Saratoga Avenue. The pumping system will be connected to a future irrigation system to provide
irrigation water for the Heritage Orchard as well as for the landscaping around the Saratoga
Library. By connecting to a natural source of water instead of the current metered water source,
expenses associated with orchard irrigation will be substantially reduced. In addition, the labor
associated with the present watering method will be minimized.
Discussion
Sealed bids for Heritage Orchard Well and Irrigation Pumping System project were opened on
Wednesday, May 28, 2003, at 10:00 a.m. The City received one bid from Maggiora Brothers
Drilling, Inc. Staff has carefully checked the bid along with the listed references and has
determined that the bid is responsive to the Notice inviting Sealed Bids dated May 7, 2003. Staff
sent out the bid package to 11 drilling companies and 5 builders' exchanges. The minimal
response is due to the specialized nature of the project.
The scope of work includes all materials, labor, equipment, transportation and services for the
drilling of a test well, the design and construction of a 300 feet deep production well with 10 inch
diameter well casing. The actual production well depth and final design will be determined after
the test well drilling and analysis. The scope of work also includes the supply and installation of
a submersible pump and variable -speed motor to a depth of 280 feet having a design capacity of
275 gallons per minute.
Therefore staff recommends award of construction contract to Maggiora Brothers Drilling, Inc. in
the amount of $95,475.
FISCAL IMPACTS:
Funding for this project is programmed in the Capital Improvement Project — Heritage Orchard
Improvements, which contains sufficient funds for the construction contract and the
recommended change order.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S):
Maggiora Brothers Drilling, Inc. will not be awarded the contract. The Council may make
specific findings to reject the bid and direct staff to re -bid the entire project.
ALTERNATIVE ACTION(S):
None in addition to the above.
FOLLOW UP ACTION(S):
The contract will be executed and the contractor will be issued Notice to Proceed. Work will
begin as soon as possible and be completed within 45 working days.
