Conference Room, 13777 Fruitvale Avenue Type: Regular Meeting The HPC will meet at 8:30 for site visit to 14195 Saratoga Avenue. Please meet in the front parking lot by the Warner Hutton House and Staff will provide transportation to the site. After the site visit, the HPC will meet in the Community Development Dept. Conference Room. I. Routine Organization A. Roll Call B. Approval of minutes from 7/08/03 C. Posting of Agenda — Pursuant to Government Code Section 54954.2, the agenda was posted on Thursday August 7, 2003 D. Oral Communications E. Written Communications II. Old Business A. Historic Calendar B. Vision for the City's Historic ParkL Rev1eWb:Draft Report for the September lei, t2003'GC meeting. — C. Mustard Walk D. Heritage Orchard update E. Adopt -a -Tree — (Staff has received four interest letters) discuss implementation of program. , F. Review comments discussed at the Heritage Resources Inventory/ Mills Act U� Subcommittee meetings held on June 28`h and August 11, 2003. G. Discuss comments presented at the Joint Meeting with the Planning Commission held on August 5, 2003. III. New Business A. Site visit: App.# 03 -116 - 14195 Saratoga Avenue (on Heritage Lane) — Review of application to demolish main structure and accessory structure, and construct new 2 -story home with a detached garage and a separate detached second unit. B. App.# 02 -182 — 13089 Quito Road - Review of proposed 7 lot subdivision on Dorcich Orchards which is the site of the Frank Mitchell House (Heritage Resources Inventory #64). This application has already been reviewed by the HPC on 9/10/02. However, the applicant has since changed the orientation and access to the Mitchell House. IV. Items Initiated by the Commission A. Retreat B. Village Historic District V. Items Initiated by the Secretary Installation of the Austin Way Sign designating the new Heritage Lane VI. Items to be placed on the next Agenda VII. I. Routine Organization A. Roll Call (at the Saratoga Historical Museum): PRESENT — Bailey, Ballingall, Conrado, Grens, Koepemik, Lowdermilk, Peck. ABSENT: None GUESTS: Ann Waltonsmith, Jill Hunter, Joan Pisani, April Halberstadt, Warren Heid, Bob Louden, Jack Mallory Roll Call (at Planning Conference Room): PRESENT - Bailey, Ballingall, Conrado, Grens, Koepemik, Peck. ABSENT: Lowdermilk GUEST: April Halberstadt. B. Approval of minutes from 6/10/03 — Minutes approved 5 -0 -1 (absent Lowdermilk) C. Historic Calendar — HPC has so far sold 11 calendars which were available at the Saratoga Library opening. 70 more calendars were distributed to Commissioners to sell. B. Joint meeting with the Historic Foundation to prepare a long term plan for the Historic Park — Report for the September 17, 2003 CC meeting. Discuss �► Commissioners Koepernik's and Conrado'.s site survey of Historic Park. 2 0° Prepare document for review at August HPC meeting. — Item discussed. C. Mustard Walk — to be held on Sunday February 8, 2004. Banner is ready. APlanning for food to begin in September. D. Heritage Orchard update — Discussed the new trees planted in front of the W Library. E. Adopt -a -Tree — (Staff has received two interest letters) — another interest letter was received. Staff is maintaining a spreadsheet of all the interest letters. Commission suggested enlisting Girl Scouts to help market the program. F. Review of Heritage Inventory Subcommittee with City Council — Item discussed. III. New Business A. 10:15 a.m. site visit: Review of modification of a home on the Heritage Resources' Inventory, 20611 Brookwood Ln. (Henry Jarboe House, 1858) – Approved w/ condition 5 -0 (Abstain: Grens; Absent: Lowdermilk): Approved as proposed with condition that future modifications to the home be presented to the HPC for review and that it is recommended that redwood lap siding be used for future modifications. B. Review Mills Act Contracts – To be discussed at joint CC subcommittee meeting. C. Joint meeting with the Planning Commission – August 5, 2003 to discuss Village Historic District, Heritage Tree Ordinance, Historic Park and Historic Preservation –item discussed. IV. The Saratoga Historical. Foundation was organized to assist the citizens of the City of Saratoga to preserve the history of this community, including our building. The.residenc,e on this property was constructed in the early part of the 20th Century and is of an elegant two -story Craftsman style of architecture. The or owner, Frank Mitchell, was a very prominent citizen -.of Santa Clara County, including serving as a member of the Board of Supervisors. The Board has unanimously voted to request that this residence be preserved as it exists and not be remodeled. If it must be moved, it should be located at a prominent location at the front of the property rather than be placed in a rear corner as shown on the accompanying Plot Plan with your request for comments. Saratoga is= losing too many of its historical buildings and residences, therefore it is in serious jeopardy of losing its. historical integrity. The electrical supply line will be run from the library, the wire sizing is designed to accomodate the well as future needs, ie. a heritage orchard building /museum. Well construction will start immediately, if adequate volume of water is located to irrigate the orchard, no less than 200 gallons per minute up to 500 gallans per minute. Additional French Prunes have been ordered to replace new trees that were planted for the Library Grand Opening that did not "make it" through the heat of the summer. If the Commission recommends approval to the Board of Supervisors (Board), a preservation contract will be prepared by the Office of the County Counsel which incorporates the standards and /or conditions stipulated by the Commission and agreed upon by the property owner. 4. The recommendation of the Commission and the preservation contract will be presented to the Board for approval or denial. (Note: Entering into a Mills Act contract is discretionary by the Board.) 5. If the Board confirms the findings of the Commission, the preservation contract will be approved and formally executed between the property owner and the County of Santa Clara. 6. The Assessor's office will then make the appropriate changes to the assessment roll. If the property is not already a "qualified historical property"C 1. The owner must complete the historic designation process prior to submitting a Mills Act application. What are the General Terms of a Preservation Contract? At a minimum the contract will include, but not be limited to, the following items: • A 10 year term, automatically renewable each year unless the non - renewable procedures have been implemented. • A plan for restoration, rehabilitation or preservation of the property to conform to the previously cited historic preservation standards and codes as required by the Mills Act. • Requirement for periodic examination of the property by Commission staff to assure compliance with the contract. • Requirement that the contract will be recorded by the Assessor and will bind all future successors in interest for the duration of the contract. • Requirement that the owner or agent shall provide written notice of the contract to the State Office of Historic Preservation within 6 months of entering into the contract. • Use restrictions the Board deems reasonable to carry out the purpose of the contract. • Non - renewable /cancellation provisions as provided by Mills Act. (Note: The Board may cancel a contract after the prescribed process is followed if it determines that the owner has breached any of the conditions of the contract, allowed the property to deteriorated to the point that it no longer meets the standards for a "qualified historical property" or determines the owner has failed to restore or rehabilitate the property in the manner specified in the contract.) • Method of assessment as provided by the Mills Act. How Will My Tax Rate be Adjusted? Property under a Mills Act preservation contract will be valued by the capitalization of income method. The modified property tax rate will vary from property to property based on each individual appraisal. Property owners who have a pre - Proposition 13 tax rate (no change of ownership since March 1, 1975) will probably not see a tax reduction.
