HomeMy WebLinkAbout13-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DESCRIBING IMPROVEMENTS AND DIRECTING PREPARATION OF ENGINEER'S REPORT FOR ANNEXATION OF A NEW LLAD ZONERESOLUTION NO. 13 -021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DESCRIBING IMPROVEMENTS AND DIRECTING PREPARATION OF ENGINEER'S REPORT FOR ANNEXATION OF A NEW ZONE TO CITY OF SARATOGA LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT LLA -1 RESOLVED, by the City Council of the City of Saratoga, California, as follows: 1. On March 6, 2012, the City Council, pursuant to the provisions of the Lapdscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California, adopted Resolution No. 13 -008 Describing Improvements and Directing Preparation of an Engineer's Report for Fiscal Year 2013 -2014 for the City of Saratoga Landscaping and Lighting Assessment District LLA -1; 2. The improvements to be constructed or installed, including the maintenance or servicing, or both, thereof, in this new Zone (Zone #35) are more particularly described in Exhibit "A" hereto attached and by this reference incorporated herein. 3. The costs and expenses of said improvements, including the maintenance or servicing, or both, thereof, are to be made chargeable upon Zone #35 of said District, the exterior boundaries of which District are the composite and consolidated area as more particularly shown on a map hereto attached and by this reference incorporated herein as Exhibit "B." 5. The City Engineer is hereby directed to prepare and file with the City Clerk a report, in writing, referring to Zone #35 of the assessment district by its distinctive designation, specifying the fiscal year to which the report applies, and, with respect to that year, presenting the following: a) plans and specification of the existing improvements and for proposed new improvements, if any, to be made within Zone #35; b) an estimate of the costs of said proposed new improvements, if any, to be made, the costs of maintenance or servicing, or both, thereof, and of any existing improvements, together with the incidental expenses in connection therewith; C) a diagram showing the exterior boundaries of Zone #35 and the lines and dimensions of each lot or parcel of land within Zone 935 as such lot or parcel of land is shown on the County Assessor's map for the fiscal year to which the report applies, each of which lots or parcels of land shall be identified by a distinctive number or letter on said diagram; and d) a proposed assessment of the total amount of the estimated costs and expenses of the proposed new improvements, including the maintenance or servicing, or both, thereof, and of any existing improvements upon the several lots or parcels of land in said district in proportion to the estimated special benefits to be received by each of such lots or parcels of land, respectively, from said improvements, including the maintenance or servicing, or both, thereof, and of the expenses incidental thereto. Only special benefits are assessable; special benefit means a particular and distinct benefit over and above general benefits conferred on real property located in the assessment district or to the public at large. 6. The Office of the Public Works Director of said City be, and is hereby, designated as the office to answer inquiries regarding any protest proceedings to be had herein, and may be contacted during regular office hours at the City Hall, 13777 Fruitvale Avenue, Saratoga, California 95070 or by calling (408) 868 -1241. The above and foregoing resolution was passed and adopted at an adjourned meeting of the Saratoga City Council held on the 17th day of April, 2013 by the following vote: AYES: Council Member Chuck Page, Manny Cappello, Vice Mayor Emily Lo, Mayor Jill Hunter NOES: None ABSENT: Council Member Howard Miller ABSTAIN: None oo (J110'g fl Jill Hunter, Mayor ATTEST: I (� 0 DATE: Cry 1 Bothelio, City Clerk Hill Avenue Tract 10168 - Zone 35 Description of Improvements The District provides a funding mechanism for the ongoing maintenance, operation and servicing of landscaping and public lighting improvements that provide special benefit to the parcels within the Zone. These improvements may include, but are not limited to, the design, construction or installation, including the maintenance or servicing, or both, thereof, of landscaping, including trees, shrubs, grass or other ornamental vegetation, statuary, fountains and other ornamental structures, curbs, gutters, walls, sidewalks, or paving, or water, irrigation, drainage, or electrical facilities, attachments and appurtenances, including the cost of repair, removal or replacement of all or any part thereof, providing for the life, growth, health and beauty of landscaping, including cultivation, irrigation, trimming, spraying, fertilizing and treating for disease or injury; the removal of trimmings, rubbish, debris and other solid waste; electric current or energy for any electrical facilities or operation of any other improvements; and the maintenance of any other improvements. Maintenance services will be provided by City personnel and /or private contractors. The proposed improvements to be maintained and services are generally described as follows: Zone 35 (Tract No. 10168 Landscaping and Lighting District) — Provides for maintenance of landscaping (bioretention treatment swale) on each lot of Tract 10168.
