SUBJECT: Final map approval for three lots located at 15202 Quito Road.
Owner: Lexor Investments, Inc.
RECOMMENDED ACTION(S):
1. Move to adopt resolution No. SD -00 -006 granting final map approval of tentative map
application No. SD -00 -006 for three lots located at 15202 Quito Road.
2. Move to authorize the Mayor to execute the Subdivision Improvement Agreement.
REPORT SUMMARY:
Attached is Resolution No. SD -00 -006, which, if adopted, will grant final map approval for three
lots, located at 15202 Quito Road. I have examined the final map and related documents
submitted to me in accordance with the provisions of Section 14.40.020 of the Municipal Code
and have determined that:
1. The final map substantially complies with the approved tentative map.
2. All conditions of the approved tentative map, as contained in Planning Commission
Resolutions No. SD -00 -006, have been completed or will be completed concurrent with
development of the three lots.
3. The Subdivision Map Act, the City's Subdivision Ordinance and all other applicable
provisions of law have been complied with.
4. The final map is technically correct.
Consequently, the City Surveyor's certificate has been executed on the final map and the final
map has been filed with the City Clerk pursuant to Section 14.40.040 of the Municipal Code for
action by the City Council.

FISCAL IMPACTS:
•
The subdivider has paid $21,110.88 in Engineering Fees and $41,400 in Park Development Fees.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S):
The final map must either be approved or rejected by the City Council. If the map is rejected, it
would be returned to the subdivider with findings as to why the map was rejected.
ALTERNATIVE ACTION(S):
None in addition to the above.
FOLLOW UP ACTION(S):
The signed map will be released to the subdivider's Title Company for recordation along with
recording instructions.

Nothing additional.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
APPROVING THE FINAL MAP OF SD -00 -006
15202 QUITO ROAD
The City Council of the City of Saratoga hereby resolves as follows:
SECTION 1: Three lots as shown on that certain Parcel Map prepared by Sandis Humber
Jones, Civil Engineers, dated September 2002, and filed with the City Clerk of
the City of Saratoga on February 19, 2003, are approved as THREE (3)
individual lots.
SECTION 2: All streets and easements shown on said map and offered for dedication to
public use are hereby rejected on behalf of the public, save and except for
public service easements; and to the limited extent that any offers for public
street purposes either expressly or implicitly include offers for easements for
utility purposes along or beneath said street rights of way, then as to such
express or implied offers of easements for public utility purposes, the same are
hereby accepted on behalf of the public.
The above and foregoing resolution was passed and adopted at an adjourned meeting of the
Saratoga City Council held on the 19th day of February, , 2003 by the following vote:

STATE OF CALIFORNIA
LF-xOR INVESTMENTS, INC.; 15202 QUITO ROAD
WHEREAS, application has been made to the Advisor- Agency under the
Subdivision %-Iap Act of the State of California and under the Subdivision Ordinance of the
City of Saratoga, for Tentative Parcel ivlap approval of 3 lots, all as more particularly set
forth in File No. SD -00 -006 of this Ciry; and
WHEREAS, this Advisory Agency hereby finds that the proposed subdivision,
together with the provisions for its design and improvement, is consistent %Kith the
Saratoga General Plan and with all specific plans relating thereto: and the proposed
subdivision and land use are compatible with the objectives, policies and general land use
and programs specified in such General Plan, reference to the staff report dated February
29, 2001 being hereby made for further particulars; and
WHEREAS, none of the conditions set forth in Subsections (a) through (g) of
Government Code Section 66474 exist %virh respect to said subdivision, and rentatiye
approval should be granted in accord with conditions as hereinafter set forth; and
WHEREAS, the Planning Commission has conducted a duly noticed public
hearing at which rime all interested parties were given a full opportunity to be heard and to
present evidence; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA) it has
been determined that the project is Categorically Exempt under Class 3, Class 15 and Class
32 criteria for Categorical Exemptions from CEQA.
NOW", THEREFORE, BE IT RESOLVED that the Tentative Parcel ?slap for the
hereinafter described subdivision, which map is dated December 15, 2000 and is marked
Exhibit 'A' in the herein above referred file, be and the same is hereby condirionally
approved. The conditions of said approval are as follows:
COMMUNITY DEVELOPMENT
Acknowledged. 1. The development shall be located and constructed as shovv-n on Exhibit 'A',
incorporated by reference.
Recordation i n 2. A reciprocal access easement from Twin Creeks Road to lot A and the proposed off
setting Lot Line Adjustment uvith the adjoining parcel to the %vest shall be recorded

Acknowledged. 3. Prior to issuance of a Building Perrnir, a landscape plan shall be submitted for
review and approval by the Community Development Director.
Acknowledged 4. Prior to Final Inspection, all landscaping on the approved landscape plan shall be
installed.
Easement dedicated 5. The development shall comply with the Santa Clara Valley Water Districts request
for an easement dedication to allow access for maintenance and repair purposes.
On Map. The project also must comply with all soil erosion and water run off management
requirements.
All submitted., 6. Prior to submittal of the Final Map to the Public %Forks Department, the fouo%\-in;
shall be submitted to the Platuung Division staff in order to issue a Zoning
Clearance:
a. Four (4) sets of complete Improvement Plans incorporating this Resolution as a
separate plan page and containing the following revisions:
i. U applicable recommendations of the City Arborist.
b. Four (4) sets of complete grading plans incorporating tHis Resolution as a
separate plan page and containing the follov, ng revisions:
i. All applicable recommendations of the City Arborist.
Acknowledged. 7. Construction, alteration or repair actinides (for subdivision irnprovements as well
as the construction of the residences) which are authorized by a valid City of
Saratoga permit, or which do not require the issuance of a City of Saratoga permit,
may be conducted only on weekdays between the hours of 7:30 AX4 and 6:00 PIA so
long as the noise level does not exceed 60 dBA at Project property boundary. No
such construction work shall be permitted on Saturdays, Sundays, or legal holidays.
Construction noise should be reduced whenever possible. The City Engineer may
grant an exemption upon.his /her determination of an emergency.
A sign indicating permitted construction hours shall be posted on the site in a
visible location.
Acknowledged. S. Applicable construction conditions shall be included in any aid all contracts with
each and every contractor and subcontractor working on the Project.

Letters submitted. 43. The Project Georechnical Engineer shall review and approve all geotechnical
aspects of the final subdiNision improvement plans (i.e., site preparation and
grading, site drainage improvements and design parameters for building
foundations, driveways, and the s«-imming pools) to ensure that the plans,
specifications and details accurately reflect the consultants' recommendations.
We recommend that the Project Geotechnical' Engineer consider expanding
demolition recommendations to indicate that depressions created as part of

The results of the plan re,,iew shall be summarized by the Project Engineering
Geologist and Project Geotechnical Engineer in a letter(s) and submitted to the
