SUBJECT: Heritage Orchard Well and Irrigation Pumping System — Award of
Construction Contract
RECOMMENDED ACTION(S):
1. Move to declare Maggiora Brothers Drilling, Inc. to be the responsible bidder on the
project.
2. Move to award a construction contract for constructing Heritage Orchard well and
irrigation pumping system to Maggiora Brothers Drilling, Inc. in the amount of
$95,475.00 and authorize the City Manager to execute the same.
3. Move to authorize staff to execute change orders to the contract up to $9,500.
REPORT SUMMARY:
Background
Orchard well construction and pumping system installation is part of Phase I Heritage Orchard
Improvements as described in Orchard Master Plan and approved by the City Council in
September 2001. Funding for the implementation of the project has been incorporated into five-
year Capital Improvement Plan and subsequently approved by the City Council.
The proposed well will be situated in the Heritage Orchard at the end of maintenance road off
Saratoga Avenue. The pumping system will be connected to a future irrigation system to provide
irrigation water for the Heritage Orchard as well as for the landscaping around the Saratoga
Library. By connecting to a natural source of water instead of the current metered water source,
expenses associated with orchard irrigation will be substantially reduced. In addition, the labor
associated with the present watering method will be minimized.
Discussion
Sealed bids for Heritage Orchard Well and Irrigation Pumping System project were opened on
Wednesday, May 28, 2003, at 10:00 a.m. The City received one bid from Maggiora Brothers
Drilling, Inc. Staff has carefully checked the bid along with the listed references and has
determined that the bid is responsive to the Notice inviting Sealed Bids dated May 7, 2003. Staff
sent out the bid package to 11 drilling companies and 5 builders' exchanges. The minimal
response is due to the specialized nature of the project.
The scope of work includes all materials, labor, equipment, transportation and services for the
drilling of a test well, the design and construction of a 300 feet deep production well with 10 inch
diameter well casing. The actual production well depth and final design will be determined after
the test well drilling and analysis. The scope of work also includes the supply and installation of
a submersible pump and variable-speed motor to a depth of 280 feet having a design capacity of
275 gallons per minute.
Therefore staff recommends award of construction contract to Maggiora Brothers Drilling, Inc. in
the amount of$95,475.
FISCAL IMPACTS:
Funding for this project is programmed in the Capital Improvement Project — Heritage Orchard
Improvements, which contains sufficient funds for the construction contract and the
recommended change order.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S):
Maggiora Brothers Drilling, Inc. will not be awarded the contract. The Council may make
specific findings to reject the bid and direct staff to re-bid the entire project.
ALTERNATIVE ACTION(S):
None in addition to the above.
FOLLOW UP ACTION(S):
The contract will be executed and the contractor will be issued Notice to Proceed. Work will
begin as soon as possible and be completed within 45 working days.

SUBJECT: Saratoga Speed Zone Study.
RECOMMENDED ACTION(S):
Open the public hearing and accept public testimony on the attached ordinance then close the
hearing, introduce and read the title of the ordinance and waive the first reading. Direct staff to
place the second reading and adoption of the ordinance on the consent calendar for the next
regular Council meeting.
REPORT SUMMARY:
Background
During the May 7"' 2003 City Council meeting, staff presented Council with the results of the
Saratoga Speed Zone Study, which was performed by Higgins Associates in 2002. Council
directed staff to return with a Motor Vehicle Ordinance that would implement the recommended
changes as presented in the Speed Zone Survey.
The recommendations of the Speed Zone Survey were presented to the Saratoga Public Safety
Commission early in 2002 for review, on which the recommendations were individually voted. All
recommendations were accepted as presented with the exception of the speed zones that resulted in
an increase in speed. A summary of the recommendations of the Speed Survey and the PSC
decisions are listed in the attached May 7`" Council report.
Item #14 listed in the May 7`" Council report (establishing a speed limit along Saratoga Avenue at
40 mph) already exists in the City's ordinance. Therefore, no change is needed to implement item
#14. In fact, the City Code contains a redundant sentence concerning the speed limit on Saratoga
Avenue; that sentence would be removed by the attached ordinance.
Discussion
The ordinance will change the speed limits on the following segments of roadway:

1. Allendale Avenue between Chester Avenue and Quito Road: Increase posted speed limit
from 25 mph to 35 mph.
2. Beaumont Avenue: Increase posted speed limit from 25 mph to 30 mph.
3. Cox Avenue between Saratoga Avenue and Paseo Presada: Increase posted speed limit
from 25 mph to 30 mph.
4. Saratoga - Sunnyvale Road between Saratoga Avenue and Prospect Road: Standardize
segment's posted speed limit to 40 mph.
FISCAL IMPACTS:
No direct fiscal impacts.
CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S):
Saratoga Speed Zone Survey recommendations would not be accepted at this time and the
recommended changes to the Motor Vehicle Ordinance would not be approved.
ALTERNATIVE ACTION(S):
None in addition to the above.
:FOLLOW UP ACTION(S):
The ordinance will be incorporated into the Saratoga Motor Vehicle Code, and the Saratoga Speed
Survey will be filed with the County Traffic Court.

AN ORDINANCE AMENDING SECTION 9- 30.060 OF THE SARATOGA CITY CODE
CONCERNING THE MODIFICATION OF SPEED LIMITS ON CERTAIN CITY
STREETS
THE CITY COUNCIL OF THE CITY OF SARATOGA DOES ORDAIN AS FOLLOWS:
Section 1. Findings.
A. The City of Saratoga contracted with Higgins Associates Civil and Traffic Engineers to
provide an engineering and traffic survey of Saratoga city streets. Based on the results of
the survey, the City of Saratoga has determined that the speed limit for certain public
streets should be modified to a speed that is more appropriate to facilitate the orderly
movement of traffic.
B. Based on the results of the Higgins Survey, the City finds that the revised speed limits set
forth below are reasonable and safe.
Section 2. Modification of Speed Limits for Certain City Streets.
Section 9- 30.060 of the Saratoga City Code is hereby amended as shown below. Text
inserted by this section is indicated in bold, double - underlined font exam le ; text deleted by this
ordinance is indicated in strikeout font (el e). Text in standard font is unchanged by this
ordinance.
"Based upon a current engineering and traffic survey conducted by the City, the
following prima facie speed limits are established for the streets, or portions thereof, in
the City as follows:
"(a) Twenty -five miles per hour.
Allendale Avenue. From its intersection with Quite Read OR the east Chester Avenue
to a point approximately 150 feet weste-r4y of Chester Avenue.
Arroyo De Arguello. From Via Roncole to approximately 275 feet northerly of Comer
Avenue.
Austin Way. Its entire length.
Bohlman Road. Its entire length.
Braemar Drive. Its entire length.
Brookglen Drive. From Brockton Lane to Prospect Road.
Bucknall Road. Its entire length.
Canyon View Drive. Its entire length.
Chateau Drive. Its entire length.

Tollgate Road. From State Route No. 9 to approximately 600 feet westerly of Bank Mill
Road.
Woodside Drive. Its entire length.
"(b) Thirty miles per hour.
Beaumont Avenue. Its entire length.
Cox Avenue. From Saratoga Avenue to Paseo Presada.
McCoy Avenue. From Quito Road to Villanova Road.
Mt. Eden Road. Its entire length.

Quito Road. From its intersection with the southerly city limit line to the center of San
Tomas Aquino Creek, southerly of Bicknell Road, and from Allendale Avenue to Pollard
Road.
Sobey Road. Its entire length exclusive of that portion of said street contiguous to any
school building or grounds which shall still be subject to a twenty -five miles per hour
prima facie limit in accord with, and at the time specified by, Section 22352(b)(2) of the
Vehicle Code.

contiguous to any school building or grounds which shall still be subject to a twenty -five
miles per hour prima facie limit in accord with, and at the time specified by, Section
22352(b)(2) of the Vehicle Code.
Saratoga Avenue. From Fruitvale Avenue to Saratoga /Los Gatos Road exclusive of that
portion of said street contiguous to any school building or grounds which shall still be
subject to a twenty -five miles per hour prima facie limit in accord with, and at the time
specified by, Section 22352(b)(2) of the Vehicle Code.
"(d) Forty miles per hour.
Prospect Road. From its intersection with Saratoga /Sunnyvale Road to its intersection
with Lawrence Expressway, exclusive of that portion of such street contiguous to any
school building or grounds which shall be subject to a twenty -five miles per hour prima
facie limit in accord with, and at the time specified by, Section 22352(b)(2) of the
Vehicle Code.

Section 3. Severance Clause.
Each section, sub - section, paragraph, sub - paragraph, sentence, clause and phrase of this
ordinance is severable and independent of every other section, sub - section, paragraph, sub-
paragraph, sentence, clause and phrase of this ordinance. If any section, sub - section, paragraph,
sub - paragraph, sentence, clause or phrase of this ordinance is held invalid, the City Council
declares that it would have adopted the remaining provisions of this ordinance irrespective of the

portion held invalid, and further declares its express intent that the remaining portions of this
ordinance should remain in effect after the invalid portion has been eliminated.
Section 4. Publication.
The City Clerk shall cause this ordinance or a summary thereof to be published once in a
newspaper of general circulation of the City of Saratoga within fifteen days after its adoption.
Section 5. Effective Date.
This Ordinance shall take effect thirty days after the date of its adoption.
Section 6. CEQA Compliance.
The City Council finds and determines that the enactment of this Ordinance is not a
"project" as that term is used in the California Environmental Quality Act ( "CEQA ") (Cal. Pub.
Res. Code § 21000 et seq.) or the State CEQA Guidelines (Cal. Code of Regs., Title 14, § 15000
et seq.). Therefore, no environmental assessment is required or necessary.
The foregoing ordinance was introduced and read at the regular meeting of the City
Council of the City of Saratoga held on the day of , 2003, and was adopted by the
following vote following a second reading on the day of , 2003:

Re: Proposed Speed Limit Increase

I have just recently signed a petition opposing the raising of speed limits on some
Saratoga streets.
As a native Saratogan, forty -three of my fifty -one years at the Beaumont address,
it hard for me to believe that my own city council would be stupid enough to
consider this action.
Yes, stupid. Both my husband and I know how to write; my twenty -five -years
teaching composition at local colleges and my husband's thirty -three years
(same subject) at West Valley, have taugAt us how to be clear.
I don't expect Saratoga to remain the orchard capital of the valley, but our
increased size does not have to translate into making our city streets a reflection
of the expressways elsewhere in the valley.
We don't have to get anywhere that fast. I walked to Argonaut and then Saratoga
High School —I am sure Stan did, too. We all did, even back in 1970 when we
graduated. My own daughter went to Argonaut, Redwood, and Saratoga High
Schools; she was unable to walk to school because of the Grand Prix attitude of
the kids, and even more of their parents who should know better.
Over fifteen years ago, I tried to have the council put a stop si$n at Beaumont and
Saratoga Vista Court. It did not happen. Dogs have been killed; kids have had
countless near misses, but still no sign. Another case of bad judgment. At least a
stop sign would slow the acceleration that occurs at the crest of the hill where I
live.
Are you waiting for a child to get hurt? Or someone else? My husband, a
quadriplegic for twenty -eight years, travels these streets in his wheelchair to go
to work at West Valley and to bird watch. I walk my dogs. Folks bike and walk
all over the city, especially on my street. Why are their needs any less important?
Residential streets are just that -- streets where people live and not just routes for
people to cross and travel.
This is an ill- considered proposal, and I urge the council to reject it.
