HomeMy WebLinkAbout103-Attachment B .pdfFOR SANTA CLARA COLINTYA April 30, 2007 TO: HHW Subcommittee FROM: Rob D'Arcy, Hazardous Materials Program Manager RE: Execution of Amendments - Action required by June 30, 2006 First Amendment for AB 939 Agreement FY 2007/2008 First Amendment for HHW Agreement FY 2007/2008 Dear HHW Subcommittee Member: Enclosed are two master copies each of the First Amendment to the Agency Agreement for Countywide AB939 Implementation Fee and the First Amendment to the Agency Agreement for Countywide Household Hazardous Waste (HHW) Collection Program for approval by your city or town council. The enclosed First Amendment for AB 939 Fee provides for continued collection of the AB939 Fee for at an adjusted level for FY 200712008. The Amendment also reduces the AB939 Fee by $0.17 per ton in FY 200712008, for a total of $3.55 per ton for a period of one year (July 1, 2007 to June 30, 2008) and returns it to $3.35 in FY 2008/2009. Of the $3.55 Fee, $2.05 per ton will fund countywide HHW services; the remaining $1.50 per ton will be paid to jurisdictions to fund other AB939 compliance activities. The return of the AB939 Fee to $3.35 per ton will fund HHW activities at $1.85 per ton unless a second amendment is executed. On May 22, 2007, the Board of Supervisors will consider a resolution approving continued collection of the AB939 Fee as outlined above. I have previously emailed a copy of the Resolution and the Board transmittal for your reference. Please remember to fill in the amount for your augmentation in EXHIBIT A, SECTION 18 of the HHW Amendment. As noted above, Council action to approve collection of this fee must be taken by June 30, 2006. Please have the two master copies of each of the two Amendments signed as original documents, and return them BOTH to me.
