HomeMy WebLinkAbout103-Attachment 2 - Letter from PEBTAC.pdfMemorandum To: Honorable Mayor and City Council From: Pedestrian, Equestrian, and Bicycle Trails Advisory Committee Date: June 17, 2007 Re: Vacation of Old Oak Way It is the unanimous recommendation of this committee that the city continue negotiations with Mr. House regarding the vacation of a portion of Old Oak Way in exchange for a trail easement across a portion of his property and the revision to the Tank Trail, as Mr. House originally agreed. Just as computers are more valuable when connected, this segment of trail increases the value of our entire trails system. This is a critical connection that will create a loop trail particularly useful for equestrians and provides both pedestrians and equestrians access to Fremont Older Open Space from both Garrod Ranch, Mt. Eden Valley and Parker Ranch Loop Trail. In 2001 Mr. House requested that the city vacate a portion of the end of Old Oak Way, which is public property. It was proposed that a good trade would be for trail easements. Mr. House agreed and the city proceeded in good faith to prepare documents and formalize the agreement. At the city's expense everything was prepared, signed by other neighbors, notarized and his was the only signature the city was unable to acquire. This link has been on the Saratoga Trails Master Plan prior to Mr. House buying the property. It is our considered opinion that Old Oak Way should not be vacated until the loop is in place (dedicated and accepted). Do not accept payment in lieu of dedication and improvement of this segment of the Master Plan.
