REPORT SUMMARY: Attached is the final Resolution, which requires adoption by the Council to annex the Carnelian Glen into the City’s Landscaping and Lighting Assessment District LLA-1. Once adopted, the Resolution approves the Engineer’s Report and confirms the assessments for the upcoming fiscal year. In accordance with Proposition 218, passed by the voters in November of 1996, property owners must approve their being annexed into the Landscape and Lighting District through a balloting process. Ballots can be returned to the City Clerk until the closing of the Public Hearing tonight. The Council can consider the Resolution only after the close of the Public Hearing and after the tabulating of the ballots. The City shall not impose the assessment if there is a majority protest. A majority protest exists if ballots submitted in opposition exceed the ballots submitted in favor of the assessment. FISCAL IMPACTS: All of the costs associated with the administration and operation of the Landscape & Lighting Assessment District are recovered via the assessments levied against the benefiting properties. CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION(S): The Resolution would not be adopted and the assessments would not be confirmed and the annexation would not move forward. If this occurs, the Council will need to direct staff accordingly. ALTERNATIVE ACTION(S): None in addition to the above. FOLLOW UP ACTION(S): The assessment roll will be finalized and transmitted to the County Auditor by August 10 for placement on the upcoming tax roll. ADVERTISING, NOTICING AND PUBLIC CONTACT: The Resolution of Intention and Notice of Hearing have been published in a locally distributed newspaper as prescribed by law. ATTACHMENTS: 1.
