HomeMy WebLinkAboutOrdinance 312 Zoning Map CorrectionsORDINANCE NO. 312 AN ORDINANCE OF THE CITY OF SARATOGA AMENDING THE ZONING MAP TO RECLASSIFY THE ZONING OF PARCELS 503 -82 -006 AND 517 -08 -048 THE CITY COUNCIL OF THE CITY OF SARATOGA DOES ORDAIN AS FOLLOWS: Section 1. Findings The City Council finds and declares as follows: A. The Zoning designation of parcel 503 -82 -006 was inadvertently changed to R- 1- 40,000 in 2007 due to a technical error. B. The Zoning designation of parcel 517 -08 -048 was inadvertently changed to Commercial Historic 2 (CH -2) in 2007 due to a technical error. C. So as to apply the zoning designation consistent with the General Plan, it is necessary to amend the Zoning Map to change parcel 503 -82 -006 to the zoning designation of R -1- 40,000/R -1- 12,500 and parcel 517 -08 -048 to CH- 2/R -M- 3,000. D. Following a public hearing on November 13, 2013 at which time all interested persons had an opportunity to be heard, the City of Saratoga's Planning Commission recommended correcting the Zoning designation of parcels 503 -82 -006 and 517 -08 -048. The City of Saratoga's City Council considered to Planning Commission recommendation at a public hearing at which all interested persons had an opportunity to be heard on December 18, 2013. Section 2. Zoning Map Amendment Pursuant to Article 15 -85 of the Saratoga Municipal Code, the City of Saratoga Zoning Map is hereby amended to reclassify the Zoning District designation of parcel 503 -82 -006 to R -1- 40,000/R -1- 12,500 and parcel 517 -08 -048 to CH -2/R -M -3,000 as shown on Exhibit "A" attached hereto and incorporated herein by this reference. Section 3. Severance Clause The City Council declares that each section, sub - section, paragraph, sub - paragraph, sentence, clause and phrase of this ordinance is severable and independent of every other section, sub - section, paragraph, sub - paragraph, sentence, clause and phrase of this ordinance. If any section, sub - section, paragraph, sub - paragraph, sentence, clause or phrase of this ordinance is held invalid, the City Council declares that it would have adopted the remaining provisions of this ordinance regardless of the portion held invalid, and further declares its express intent that the remaining portions of this ordinance should remain in effect after the invalid portion has been eliminated. Section 4. California Environmental Quality Act The proposed amendments to the City Code are Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline sections 15061(b)(3) - the general rule that CEQA applies only to projects which have the potential of causing a significant effect on the environment. Section 5. Publication. This ordinance or a comprehensive summary thereof shall be published in a newspaper of general circulation of the City of Saratoga within fifteen days after its adoption. Following a duly notice public hearing the foregoing ordinance was introduced and read at the regular meeting of the City Council of the City of Saratoga held on the 10, day of December 2013 and was adopted by the following vote following a second reading on the January 15, 2014.
