HomeMy WebLinkAboutCity Council Resolution 14-043 Saratoga Creek Cleanup Resolution RESOLUTION NO. 14-043 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA DECLARING AN EMERGENCY DUE TO A SUDDEN GRAY WATER RELEASE TO SARATOGA CREEK,DIRECTING IMMEDIATE ABATEMENT OF THE RELEASE, AND APPROPRIATING FUNDS IN ENVIRONMENTAL SERVICES FOR THE COSTS OF ABATEMENT WHEREAS,the City discovered a sudden, unexpected, and unauthorized release of gray water into the City's storm drain system and Saratoga Creek threatening public health, property,and wildlife; and WHEREAS,these circumstances constitute an emergency requiring immediate action to contain the released material to mitigate existing damage and prevent further damage to public health,properiy, and wildlife; and WHEREAS, City staff have obtained informal bids regarding abatement costs but cannot proceed with a formal bidding process due to the need for immediate action and abatement of the release is estimated to cost$50,000;and WHEREAS,the City of Saratoga has such funds available due to increased revenue in the General Fund; and WHEREAS, it is necessary to increase the expenditure appropriation in the Fiscal Year 2013/14 Environmental Services Program as follows: Account Description Account Amount To increase appropriation in the Environmental Sef~vices Program: Increase appropriation: 111.5103.64739 $ 50,000.00. NOW,THEREFORE, BE IT RESOLVED that the City Council of the City of Saratoga hereby declares that the public interest and necessity demand the immediate expenditure of public money to safeguard public health and property in and about Saratoga Creek and the City's storm drain system and finds that the circumstances described above will not permit the delay that would result from a formal competitive solicitation for bids, and that immediate abatement is necessary to respond to the emergency; and BE IT FURTHER RESOLVED that the City Council of the City of Saratoga hereby directs the City Manager to abate the conditions caused by the release and authorizes execution of contracts not exceeding$50,000 in total for the abatement costs;and BE IT FURTHER RESOLVED that the City Council of the City of Saratoga hereby approves the above adjustments to the Fiscal Year 2013/14 Environmental Services Budget; and BE IT FURTHER RESOLVED that the City Manager or his designee shall report to the City Council on that status of the abatement and emergency conditions at the next regular meeting of the City Council on July 2,2014; and BE IT FURTHER RESOLVED, the above and foregoing resolution was passed and adopted at a special meeting of the Saratoga City Council held on 25`h day of June 2014 by the following vote: AYES: Mayor Emily Lo, Council Member Manny Cappello, Chuck Page,Jill Hunter NOES: None ABSENT: Vice Mayor Howard Miller ABSTAIN: None / � Emily Lo, Mayor ATTEST: ��,v�s-r�,i ���� �ATE: �%�� 1 ���� Crys�l Bothelio,City Clerk � ; � 2
