VTA's proposed highway 85 toll lane project through Saratoga violates contractual obligations made to the City by the State. SR 85 was financed by a local sales tax increase so we would not have trucks on highway 85. This toll project is planned as a federally funded project and so will have to allow trucks on highway 85 through Saratoga. This highway 85 toll lane project is part of a regional housing and transportation plan called Plan Bay Area. Plan Bay Area report Map 8, page 84 shows these road pricing improvements and includes highway 85 as part of a regional toll lane network. Plan Bay Area was written to comply with AB32 (Climate change) and SB375 (sustainable community strategy) State legislation which fundamentally reinvents our government and the role ofthe people in their government. MTC and VTA by extension, ABAG and the Joint Policy Committee are operating in our nine counties implementing AB32 and SB375 without the knowledge, understanding or consent of the majority of people living in those Counties. This is by design. Regional agencies are not interested in the opinions or needs of the public. Public comments made at Plan Bay Area public participation meetings were ignored because regional government is not accountable to the public. They have a plan and an agenda called sustainable development and regional governance. These agencies are working to separate us from our government in support of a new governance model where we the people, we the voters are transitioned to powerless ratepayers and. compliant customers. Green house gas emissions reductions required by AB32 /SB375 have already been met with Federal CAFE fuel standards. This VTA /MTC toll plan for SR85 is about extracting more money from drivers to grow regional government without addressing the substantial issues of the SR85 commute. VTA has been shown to be one of the worst managed transportation agencies in the country and our drivers and taxpayers deserve better. I urge you to do your best to compel the State and VTA to live up to their contractual agreements. The drawing represents the difference in finished floor levels as a result of different ground levels rather than different foundation heights. We believe that the drawing can better illustrate the problem by showing the ground level to be the same for both buildings,. and displaying a taller foundation on the house on the left. This would exemplify the specific case that we represented to you, and would embody the issues that the Planning Department and the Planning Commission will likely face in the future. 2. The drawing is a representation of two adjacent two story buildings. Our use case is of two adjacent single story homes, and we believe that the single story usage model will be the large majority of present and future residential developments.
