4. Ordinance Amendment ZOAl2 -0006; Miscellaneous City Code Updates and Code
Readopti on.
Recommended action:
Waive the second reading and adopt. the ordinance amending various sections of the
City Code and readopting the Code.
Ordinance Amendment ZOAl2 -0007; Zoning Ordinance Amendment Establishing
Design Review Findings for Wireless Teleconununications Facilities.
Recommended action:
Waive the second reading and adopt the ordinance adding Article 15 -44 (Wireless
Tel ecomrnuni cations Facilities) to the City Code.
6. Ordinance Amendment ZOAl2 -0008; Amendments to Article 7 -30 (Noise Control)
and Section 15- 1.9.050 (C -H District) of the City Code establishing new regulations
for outdoor music.
Recommended action:
Waive the second reading and adopt the ordinance amending the City Code to allow
outdoor music within the Village.
7. Ordinance Amendment ZOA09 -0009 & Garrod Development Agreement;
Application of the AP /OS Overlay Zoning over 68 acres in the area of 22600 Mount
Eden Road and Adoption of a Development Agreement With the Garrod Trust.
Recommended action:
Waive the second readings and adopt an ordinance applying the AP /OS Overlay
Zoning and adopt an ordinance adopting the development agreement with the Garrod
Trust. Authorize the Mayor to sign the development agreement on behalf of the City.
Resolution Authorizing Final Disposition of Certain City Records
Recommended action:
Adopt resolution authorizing final disposition of certain city records.
9. Reimbursement of Conditional Use Permit Fees for Previously Approved Wine
Tasting Room in the Village.
Recommended action:
Approve the reimbursement for Martella Vineyards.

Recommended action:

Recommended action:
Review the attached Grand Jury Report and authorize the Mayor to sign the proposed

SUBJECT: Item 12 — Consider Proposed Response to Santa Clara County Civil
Grand Jury Report on Pension and Other Post - Employment Benefits
Council Members:
This memo is to correct a part of the response to the Santa Clara County Civil Grand
Jury Report on Pension and Other Post- Employment Benefits. On Finding 7, the
response will be replacing 403(b) plan with 401(a) plan as shown below.
Finding 7
The Cities' defined benefit pension plan costs are volatile. Defined contribution plan costs are
predictable and therefore more manageable by the Cities.
City Response:
The City disagrees partially with this finding. The City of Saratoga participates in the CALPERS
retirement system as do most other California Cities. Adopting a defined contribution plan would
mean abandoning the CALPERS system and adopting the 401 Ca) plan, which is less common in the
public sector. This may put the City at a competitive disadvantage when attempting to recruit
experienced staff that have many years vested into CALPERS.

VICE MAYOR - CALL MEETING TO ORDER:
Vice Mayor will call the meeting to order, lead the pledge of allegiance, ask for a report on
posting of the agenda, and announce that the Mayor is participating by phone.
VICE MAYOR - PRIOR TO ROLL CALL:
Prior to roll call, I would like to make clear for the record of this meeting, and it should be
reflected in the minutes, that at least a portion of this City Council meeting is conducted .
pursuant to California Government Code Section 54953(b), in that Mayor Page is in San Diego,
California.
Mayor Page is participating by speaker phone. In accordance with the Ralph M. Brown Act,
each teleconference location has been identified in the notice and agenda for this meeting.
Now, I would like to ask the City Clerk to proceed with Roll Call and confirm certain matters for
the record.
CITY CLERK - ROLL CALL:
I would now like to request that Mayor Page respond to the following questions:
(1) Can you hear me well?
(2) Were you able to hear the proceedings on this end up until now?
(3) Do you have a copy of the agenda for this meeting?
(4) Have you posted the agenda at the location where you are?
(5) Is your location reasonably accessible to the public, such that any member of the
public could participate in this teleconference from your location if he or she
wished to do so?
(6) Is there any member of the public there with you?
(7) [If yes] Would that person like to participate in the public comment portion of
this meeting, or otherwise address any agenda item for this meeting?
