Recommended action: Waive the second readings and adopt an ordinance applying the AP /OS Overlay Zoning and adopt an ordinance adopting the development agreement with the Garrod Trust. Reimbursement of Conditional Use Permit Fees for Previously Approved Wine Tasting Room in the Village. Recommended action: Approve the reimbursement for Martella Vineyards. On Finding 7, the response will be replacing 403(b) plan with 401(a) plan as shown below. Finding 7 The Cities' defined benefit pension plan costs are volatile. Defined contribution plan costs are predictable and therefore more manageable by the Cities. City Response: The City disagrees partially with this finding. The City of Saratoga participates in the CALPERS retirement system as do most other California Cities. Adopting a defined contribution plan would mean abandoning the CALPERS system and adopting the 401 Ca) plan, which is less common in the public sector. This may put the City at a competitive disadvantage when attempting to recruit experienced staff that have many years vested into CALPERS.
