GOVERNMENT CODE 65100 There is in each city and county a planning agency with the powers necessary to carry out the purposes of this title.The legislative body of each city and county shall by ordinance assign the functions of the planning agency to a planning department, one or more planning commissions, administrative bodies or hearing officers,the legislative body itself, or any combination thereof, as it deems appropriate and necessary. In the absence of an assignment, the legislative body shall carry out all the functions of the planning agency. GOVERNMENT CODE 65101 (a)The legislative body may create one or more planning commissions each of which shall report directly to the legislative body.The legislative body shall specify the membership of the commission or commissions. In any event, each planning commission shall consist of at least five members, all of whom shall act in the public interest. If it creates more than one planning commission,the legislative body shall prescribe the issues, responsibilities, or geographic jurisdiction assigned to each commission. If a development project affects the jurisdiction of more than one planning commission,the legislative body shall designate the commission which shall hear the entire development project. (b)Two or more legislative bodies may: (1) Create a joint area planning agency, planning commission, or advisory agency for all or prescribed portions of their cities or counties which shall exercise those powers and perform those duties under this title that the legislative bodies delegate to it. I have been very active in the Boy Scouts of America. I was an Eagle Scout and then when my son became of age I served as an adult leader for Cub scouts and am currently an Assistant Scoutmaster for Troop 535 in Saratoga.)have held this position for?years. With the scouts I have been very involved in Saratoga by doing biannual a-waste drives,service projects for local churches and organizations to planting flags on Veterans graves annually at the Madronia Cemetery every Memorial Day Weekend. I have also served as a Judge in Science Faire competitions and volunteered in various capacities at our kid's school. 2) What is it about this commission that interests you? What qualities,experience and expertise would you bring to the commission? I am interested in serving on the planning commission because I am concerned for the future of Saratoga. I have been a resident forjust over two years but have wanted to five here for many years.I have been a participant in the community with my son's scout troop for the last seven years and have seen how beautiful it is. When we bought our house it was with the intent of remodeling. I went in knowing there were rules to be followed and to that end I spent quite a few hours on the Saratoga city website researching rules for additions,arborist requirements,impervious coverage restrictions and the like. I visited the city offices a number of times to clarify any questions I had. Even though we had an experienced Saratoga designer,I felt I needed to know the rules as well. I spoke to Chris Riordan on a number of occasions and he was very involved in approving our plans. our experience was very positive and the staff at the city was very approachable and helpful in every step of the process. After going through the experience I feel I understand it and want to see that others have the same positive experience that I did. 3) How would you see your role as Commissioner when recommending policy ad working with the council? My role as commissioner would be to see that rules and guidelines are followed to the spirit of the law;that does leave certain issues open to interpretation.That would likely lead to changes in the rules but, I see the spirit of the rules allowing Saratoga to keep its rural flavor while still being close to the hustle and bustle of Silicon Valley. 4) Retaining the character of the City in the midst of a growing metropolitan region is a goal of great importance to Saratoga residents.What steps do you think the City should take to achieve this important goal? Saratoga has an interesting problem. It is a beautiful rural enclave of expensive and desirable property. It does suffer from a shortage of retail space which,unfortunately leads to a lower tax base. We are also under pressure from the state to identify locations for high density housing. Although we are not required to build the housing,the currently identified sites all have commercial real estate potential as well. As seen at the council meeting I attended,there is concern for both loss of commercial space and sensitivity to high density housing in approval of the condo project of the West Valley Muslim Association property on Saratoga-Sunnyvale Road. To achieve this goal the commission should first and foremost encourage properties near the main thorough fares to incorporate as much commercial potential as possible. 5) Should an applicant be allowed to build a new structure that maximizes the height and floor area allowed in the zoning district? An applicant may by law build a property to maximum height and floor area by rules but the surrounding property and neighbors may need to have a say as well if the proposed property significantly changes the character of the neighborhood. In the fast changes that happen here, Saratoga's character needs to be maintained.I moved here for its existing character and feel it is my obligation to try and maintain that character while still moving the city forward in attracting more business and commercial enterprises. 6) How do you feel about construction of two-story homes in single family neighborhoods? Two story homes in single family neighborhoods have to be approached carefully.The properties will need to be in the same design and also maintain the privacy of the neighbors. Options also need to be reviewed such as maximizing square footage on the ground and even considering putting in a basement instead of putting on a second story. 7) How do you envision the Village being developed? I envision the Village being developed to encourage the demographic of young multi minority and older Saratoga residents to stay in the area and spend money locally. One great example is the new Village Burger Bar. It serves a simple food with an amazing customizable option.While not a unique concept it is unique for Saratoga. I have already been there twice.I spoke with the owner's husband who works at the Madronia Cemetery. He knew Saratoga needed a place like this. It has been packed both times I've been there. I hope it continues to stay busy to keep that busy corner alive.Saratoga needs another place like this.I spoke to my brother,also a Saratoga resident,with two young children. He thinks Saratoga needs a nice pizzeria. I know Florentines has pizza but,a nice sit down place may keep younger families in downtown. Mayor Howard Miller Council Finance Committee—the Finance Committee will be working on the operating reserve and discussing how to pay down the remainder of the CalPERS UAL. Valley Transportation Authority (VTA)Policy Advisory Committee—during the last meeting, a new Chair and Vice Chair were selected and an orientation was held for new members. West Valley Mayors and Managers Association—the group will be meeting soon and discussing agenda items for upcoming meetings. West Valley Solid Waste Management Joint Powers Authority—during the last meeting, the Board selected Steven Leonardis from the Town of Los Gatos to serve as Chair and Mayor Miller was selected to serve as Vice Chair. During the meeting, potential uses of liquidated damages funds were discussed. Additionally, the hauler and landfill agreements were reviewed. Vice Mayor Manny Cappello Hakone Foundation Board—Vice Mayor Cappello reported that he was in attendance at the February 5, 2015 Board Meeting, which Council Member Lo reported on. Santa Clara County Housing and Community Development (HCD) Council Committee—the Committee received presentations from the applicants for CDBG funds. The technical advisory committee will be making funding recommendations for the HCD to consider. The HCD will then make funding recommendations for the Board of Supervisors to decide upon. Saratoga Area Senior Coordinating Council (SASCC)—at the upcoming meeting, the Board will receive an update on efforts to partner with Live Oak to oversee the Adult Care Center. West Valley Sanitation District—during the last meeting, the Board discussed recent flow studies conducted on single family and multi-family uses. The commercial flow study still needs to be conducted. Page 6 of 8 18 Council Member Emily Lo Hakone Foundation Board&Executive Committee—there were a series of meetings on February IOth and 11th for the Hakone Gardens Master Plan. The meetings included site visits, workshops, and opportunities for the public to provide their thoughts on the future of Hakone. There will be additional opportunities for the public to participate in the future. The Board also discussed the Lunar New Year Festival on March 1, 2015 at Hakone from 11:00 a.m. to 3:00 p.m.,with the opening ceremony at noon. Visitors are encouraged to take the shuttle bus or carpool. The Board has been meeting once or twice a month and moving forward, expects to meet at least once a month. The number of meetings may decline during the summer. The update to the bylaws is in progress and preliminary proposals for the bylaws will be discussed at the next meeting. Santa Clara County Library Joint Powers Authority—the District held a forum for library commissions and friends organizations that was well attended. One of the most popular sessions was, "What You Don't Know About the Library." There will also be a workshop on March 28th starting at 9:30 a.m. at Saratoga Library that the Council has been invited to attend. Saratoga Chamber of Commerce &Destination Saratoga—Council Member Lo reported that she attended the Saratoga Chamber and Destination Saratoga meetings on behalf of Council Member Kumar. The Chamber voted to end discussions on the possible merger with the Los Gatos Chamber of Commerce. The Chamber will be surveying businesses and community members to identify the needs of businesses that the Chamber can address or support. The Chamber is also assisting with the Village Directory. Additionally, Destination Saratoga is considering a press event on a smaller scale than the Village Dinner proposal. Council Member Mary-Lynne Bernald Cities Association of Santa Clara County—Council Member Bernald shared that she attended the Cities Association Meeting on behalf of Mayor Miller. During the meeting,the group voted to endorse the Community Plan to End Homelessness. The group also heard a presentation from former San Jose Mayor Chuck Reed on the Silicon Valley Talent Partnership. An update on anticipated State legislation was also provided. Anticipated legislation includes bills that address climate change, medical marijuana, and transportation infrastructure. At the May meeting the group is expected to discuss the next Super Bowl and its economic impact and opportunities for the region. Cities Association of Santa Clara County-Selection Committee—Jeff Cristina was appointed as the ABAG Executive Board Alternate for a term expiring June 2016. Saratoga Historical Foundation—the next meeting is scheduled for February 19, 2015. Saratoga Sister City Organization—the website is currently under development. The group also discussed the Gomersall Scholarship and is thinking of giving a scholarship to a Hakone Gardens staff member for water management classes. Council Member Rishi Kumar Saratoga Chamber of Commerce &Destination Saratoga—the Chamber has been discussing the formation of a business improvement district over the last few months. They plan to seek input on potential Chamber offerings, service enhancements, and priorities that might be addressed through a business improvement district. Valley Transportation Authority (VTA)Policy Advisory Committee—Council Member Kumar shared that he attended the last meeting, which included an orientation for new members. The orientation was well done. Additionally, Council Member Kumar attended the opening of the VTA Innovation Center. BACKGROUND: At the January 21, 2015 City Council Meeting, the City Council directed staff to prepare an ordinance amending the City Code to extend City of Saratoga prohibitions on tobacco use to electronic smoking devices and flavored tobacco. Electronic smoking devices are battery- powered devices that use a heating element to turn a liquid solution, often containing nicotine, into a vapor, which is inhaled by the user. Currently,use of tobacco products is prohibited in City parks,recreational areas, and parking lots. If adopted, the attached ordinance would amending Chapter 11 of the City Code to define electronic smoking devices and make it clear that their use is prohibited in City parks, recreational areas, and parking lots. The ordinance also clarifies that use of flavored tobacco is not permitted where smoking and tobacco use is prohibited. The City Code of the City of Saratoga prohibits smoking and the use of tobacco products in City parks. This applies to electronic cigarettes as well as flavored tobacco and the City Council wishes to ensure that these limitations are clearly understood. 2. Electronic cigarettes are often known as "e-cigarettes"or"electronic smoking devices"and are battery operated devices that do not contain tobacco, that are generally designed to resemble traditional cigarettes and used to deliver nicotine, flavor, and/or other substances through a vapor inhaled by the user. 3. There is currently minimal federal or state regulation or control of the use and content of electronic smoking devices and there are health concerns regarding the use of electronic smoking devices, which deliver an unknown mix of potentially harmful compounds. 4. Electronic smoking devices often mimic conventional tobacco products in shape, size, and color,with the user exhaling a smoke-like vapor similar in appearance to the exhaled smoke from cigarettes and other conventional tobacco products such that the use of electronic smoking devices in locations where the use of other types of cigarettes,pipes,and cigars are prohibited may cause confusion and uncertainty and make the enforcement of bans on smoking more difficult. 5. The City Council also wishes to confirm and clarify that flavored tobacco is included among the types of tobacco products the use of which is prohibited in City parks. 6. The City Council of the City of Saratoga held a duly noticed public hearing on February 18, 2015,and after considering all testimony and written materials provided in connection with that hearing introduced this ordinance and waived the reading thereof. Therefore, the City Council hereby ordains as follows: Section 1. Adoption. Section 11-15.010 of the Saratoga City Code is amended as set forth below. (b) Person means any natural person, partnership, cooperative association, corporation, personal representative,receiver,trustee,assignee,or any other legal entity except the City of Saratoga. (c) Recreational area means any outdoor area that is publicly owned and open to the general public for recreational purposes, regardless of any fee or age requirement. The term "recreational area" includes,but is not limited to,parks,picnic areas,playgrounds, sports fields, golf courses, walking paths, gardens, hiking trails, bike paths, horseback riding trails, swimming pools, roller- and ice-skating rinks, and skateboard parks. (d) Smoke means the gases,particles,or vapors released into the air as a result of combustion, electrical ignition or vaporization,when the apparent or usual purpose of the combustion, electrical ignition or vaporization is human inhalation of the byproducts, except when the combusting or vaporizing material contains no tobacco or nicotine and the purpose of inhalation is solely olfactory,such as,for example,smoke from incense.The term"smoke" includes, but is not limited to, tobacco smoke, electronic cigarette vapors, and marijuana smoke. (e) Smoking means engaging in an act that generates smoke,such as for example:possessing a lighted pipe, lighted hookah pipe, an operating electronic cigarette-smoking device, a lighted cigar, or a lighted cigarette of any kind; or lighting or igniting of a pipe, cigar, hookah pipe, or cigarette of any kind. (f) Tobacco product means any substance containing tobacco leaf,including,but not limited to, cigarettes, cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping tobacco, snus,bidis, or any other preparation of tobacco (such as flavored tobaccol; and any product or formulation of matter containing biologically active amounts of nicotine that is manufactured,sold,offered for sale,or otherwise distributed with the expectation that the product or matter will be introduced into the human body, but does not include any cessation product specifically approved by the United States Food and Drug Administration for use in treating nicotine or tobacco dependence. g)Electronic smoking device means an electronic and/or battery-operated device the use of which may resemble smoking. which can be used to deliver an inhaled dose of vapors including nicotine or other substances. Electronic smoking device includes any such device. whether it is manufactured, distributed, marketed or sold as an lectronic cigarette, electronic cigar. electronic cigarillo, electronic pipe, electronic hookah, electronic vape, vaporize or any other product name or description. Electronic smoking device does not include any product specifically approved by the United States Food and Drug Administration for use in the mitigation,treatment or prevention of diseases. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment,the activity is not subject to CEQA. Staff is recommending updates to the policy to bring it in line with current practices and changes in costs. The draft policy was reviewed by the Finance Committee on February 6, 2015. AB 1234 sets specific standards governing reimbursement of City Council members and appointed officials (such as Commissioners). VI. V-. Cost Control A. To conserve City resources and keep expenses within community standards for public officials, expenditures should adhere to the following guidelines. BACKGROUND: In April 2004, the City Council approved the creation of the Village Fagade Improvement Grant Program to help revitalize the Village and to encourage private investment in the Village Commercial District along Big Basin Way. Property or business owners can receive reimbursement of 50% of a projects cost, up to a maximum of$5000, which are related to fagade improvements. Eligible projects are those that make exterior improvements to storefronts that are visible from Big Basin Way and can include items such as new paint, signage, awnings, or landscaping. Since the program's inception the City has approved 26 applications for fagade improvement reimbursements totaling approximately$85,000. The Program calls for the City Council Village Ad Hoc Committee to review each grant application. In December of 2014 the Council eliminated Ad Hoc assignments as many were deemed unnecessary.
