Recommended action:
Approve City Council minutes for the meeting on June 20, 2012.
2. Review of Accounts Payable Check Registers
Recommended action:
Review and accept check registers for the following accounts payable payment

3. Treasurer's Report for the Month Ended May 31, 2012
Recommended action:
Review and accept the Treasurer's Report for the month ended May 31, 2012.
4. Citizen Options for Public Safety - Supplemental Law Enforcement Services Funds
Grant (COPS)
Recommended action:
Adopt resolution authorizing the continued use of the Citizen Options for Public
Safety Program's Supplemental Law Enforcement Services Fund (COPS /SLESF)
grant as a source of funds for additional public safety services.
Property Tax Levy for Debt Service Payments on the Library General Obligation
Bonds
Recommended action:
The City Council adopt the attached resolution which sets the property tax levy rate to
provide for the Library General Obligation Bond's debt service payment at $.0080 per
$100 of Assessed Valuation.
6. Saratoga Book -Go -Round HVAC Project
Recommended action:
Staff recommends that Council accept the report and authorize the City Manager to
approve the contract with CIM Air, Inc. to replace the heating, ventilation, and air
conditioning (HVAC) system for the BGR premises for $40,090, and accept the 20%
reimbursement from the Friends of the Library.
7. City of Saratoga Street Rehabilitation Program RSTPL - 5332(016) –Notice of
Completion.
Recommended action:
Move to accept the City of Saratoga Street Rehabilitation Program RSTPL - 5332(016)
as complete and authorize staff to record the Notice of Completion for the
construction contract.
8. Notice of Completion -2012 Pavement Management Program
Recommended action:
Move to accept the 2012 Pavement Management Program as complete and authorize
staff to record the Notice of Completion for construction contract.
9. Second Reading and Adoption of Ordinance No. 292 Amending Zoning Regulations
for Tasting Rooms in the Village
Recommended action:
Waive the second reading and adopt the ordinance amending zoning regulations
related to tasting rooms in the Village.
10. Council Resolution to Amend the November 2, 2011 Agreement for Employment of
City Manager David Anderson ( "Anderson ") for FY2012 -2013, effective July 1,
2012, and subsequent years to comply with Assembly Bill (AB) 1344 (California
Government Code sections 3511.1 and 3511.2) which provides for greater
transparency of local agency executives' contracts
Recommended action:
Approve the terms and conditions contained in said Agreement for Employment
which is attached hereto and made a part hereof superseding all prior agreements
between Anderson and the City effective July 1, 2012.

11. Appeal of a Planning Commission Decision Approving a New Mixed -Use Building
and Three Residential Condominiums to be Located at 14651 Big Basin Way
Recommended action:
Uphold the Planning Commission's decision thus approving the project.
12. Appeal of a Planning Commission Decision Approving the Subdivision of a 1.02 -acre
Parcel into Two Lots at 14584 Horseshoe Drive
Recommended action:
Uphold the Planning Commission's decision thus approving the project.
13. Confirmation of Report and Assessment of 2012 Weed Abatement Program
Recommended action:
Open public hearing, close public hearing, and adopt resolution confirming report and
assessment of hazardous vegetation abatement charges.
14. Ordinance Amending Various Section of the City Code, Readopting the Code, and
Making Conforming Amendment to Design Guidelines
Recommended action:
1. Conduct a public hearing. 2. Introduce and waive the first reading of the attached
ordinance amending various sections of the City Code and readopting the Code and
direct staff to place the ordinance on the consent calendar for adoption at the next
regular meeting of the City Council. 3. Adopt the attached resolution amending the
Gateway and Village Design Guidelines to conform to the City Code.
15. Zoning Ordinance Establishing Design Review Findings for Wireless
Telecommunications Facilities
Recommended action:
Conduct a public hearing. Introduce and waive the first reading of the ordinance
adding Article 15 -44 (Wireless Telecommunications Facilities) to the City Code, and
direct staff to place the ordinance on the consent calendar for adoption at the next
regular meeting of the City Council.

Recommended action:
Review Saratoga Community Event Grant Program applications and determine

Recommended action:
Receive report and provide direction to staff regarding the Village Streetscape
Conceptual Design Phase 2 plans prepared by Gates and Associates.

The Saratoga Community Band is sponsored by the Los Gatos - Saratoga
Recreation Department and has been in existence. since 1989. It is a concert
band about the size of a symphony orchestra, made up of 75 adult amateur (and
some professional) musicians who rehearse weekly from September to May at
Saratoga High School Music Department, and perform 2 free concerts in
Saratoga at McAfee Performing Arts Center at Saratoga High and one in
Wildwood Park.
For 23 years, the band has been performing a free concert in May at Wildwood
Park. We estimate that the average attendance is about 300 -400 local people.
The audience brings their own lawn chairs or a blanket to sit on. The band's
program includes light classics, Broadway musical medleys, well known folk
music and popular music.
Each band member pays a registration fee of $75 to participate in the band, plus
we get additional funding by receiving donations from the public. All sheet music
supplies, and expenses are paid out of that money. My salary for conducting the
band comes from the Los Gatos - Saratoga Recreation Department. No other
person in the band receives a salary.
We are asking that the City of Saratoga continue, as you have done for 23 years,
to waive any fees and costs for use of Wildwood Park. In May 1999, 1 received a
notice from the City of Saratoga saying, this letter is "a commitment to waive use
and deposit fees for subsequent annual concerts [referring to our annual May
concert].
I request at this meeting that you continue to value the free donation of time,
talent and music given each year by our band to the citizens of Saratoga, and
once again waive all costs for the May 19, 2013 Saratoga Community Band
Concert in Wildwood Park, as you have done for every concert in the past.

Dear Council Member,
My name is Bao Tran and I live on Toni Ann Drive, Saratoga near the
Saratoga high school. While I would prefer to address the Council in person at
your meeting on July 18th, I will be traveling in the East Coast tomorrow so I am
writing to the Council my praise for John Kang's project by way of this
correspondence.
I urge the Council to approve this project because I believe it adds significant
advantages for the city. At present, downtown Saratoga consists of a few
restaurants and small stores, but no artworks or anything interesting to do.
When I have guests, I tend to take them to Los Gatos downtown because our
own downtown lacks interesting points for visitors. While I am very proud of
Saratoga, I think our downtown needs a boost from the art center that John Kang
envisioned.
I attended the last hearing on the development, and most people objected to the
"scale "as not compatible with other structures in the immediate area.
First, it is to be noted that ALL applicable codes have been met, so the only
objection is to the appearance of the proposal. I heard from all that the building
design is beautiful, even those who voted against the project liked the design.
The objection is mainly based on scale.
The people who objected noted that the size of the proposed facility dwarfs the
small townhouses and cottages. It is amazing to hear that the development of
the city is held back by these small private cottages. As they are private, the
cottages and townhomes do not contribute to places that enhance the city's
image as a fun place to visit. The city needs more places that attract visitors.
The absence of the art places such as Mr. Kang's proposed art center is one
reason I bring my guests to visit Los Gatos instead of downtown Saratoga,
because these small private cottages do not serve as points of attraction for the
city. We need an art center to add diversity and interests to the city. The
absence of interesting places in Saratoga stands in sharp contrast to the vibrancy
of Los Gatos. Thus, the needs of the city outweighs the needs of the small
cottages and townhomes that refuse to accomodate anything but the status quo.
I also heard that people objected to the traffic from the proposal. I think it is
strange that people from the townhouse development would object to about 5
new townhomes. The number of new resident there would be small and can't add
much to traffic.
I .urge the Council to take what ever action is necessary to pass the proposed
development in deference to the Planning Commission's expertise. The Planning
Commission is the body designated to review the project and it has done
numerous review and conducted numerous town meetings on the project. The
Council should not override the fine work of the Planning Commission (after
extensive review) on the whims of a few people. The standard of review must be
met and the expertise of the Planning Commission must be deferred to in the
absence of clear mistakes by the Planning Commission. From the comments of
the people who wrote in, I see no clear error by the Planning Commission and I
urge that the Council sustain the Planning Commission's fine work. Otherwise,
the Council will be doing the Planning Commission's work in the future and that is
not a desirable outcome given other important tasks facing the Council.

property on Horseshoe Drive.
If you read further down in the email chain you will see that he will be coming out to do
a site inspection on Monday, July 23rd and also explain how difficult it will be to put a
structure in the path of an existing water channel.
I have also attached the letter I received from Sue Tippets the Engineering Manager
from The Santa Clara Valley Water District express her concerns regarding the
property on Horseshoe Drive.

Here is an excerpt from my email to Chris this morning. Maybe that will make you more comfortable with me
handling this on my own.
"There is a possibility that the brush clearing may have had some impact on a jurisdictional channel. But since
I never saw the site prior to the clearing and the dense vegetation blocked the view of any channel that may
have been present in the pre -brush clearing photographs, my agency would not be interested in taking any
action with respect to impacts on the channel. I only mention this to assure you that I am not coming out to the
site in any sort of enforcement mode.
My main concern is figuring out how future use of the parcel may affect flows on the parcel and in the
neighborhood.

From the pictures submitted by the neighbors, the seasonal tributary has a well defined bed and bank upstream
and downstream of the subject parcel. On the parcel, the pictures suggest that the channel may not be as well
defined. There are several reasons why this may be the case, including, but not limited to:
l.) In many foothill areas in the Bay Area, channels tend to be well defined on steeper slopes, but less well
defined as the channel traverses areas with more shallow gradients. Even though the flow lines are less evident
on these more level surfaces, water will still flow in a fairly predictable route between uphill channels that enter
the shallower gradient areas and the downhill channel that conveys water downhill of the site.
2.) During the recent brush clearing, foot traffic from the workers and the actions of dragging out brush may
have temporarily damaged any bed and bank features on the site. If that is the case, the bed and bank are likely
to become re- established over several rainy season.
Whatever future use the parcel will be put to, it will be important to maintain the flow of water across the site.
Placing a structure in the topographic low point of the site will be problematic from a long -term maintenance
perspective and a local flood management perspective. There are two ways to manage flow if a house is built
in the current path of the channel (however well or poorly it is currently defined on site); culverting the channel
and building the house over the culvert or re- routing the channel. Both of these approaches have down sides.
1. Culverting. Culverting a channel is likely to require permits from the RWQCB, CDFG, and Army Corps.
For the reasons I will explain below, we don't like to see new culverting of even small channels, and we tend to
limit new culvert permits to access routes (which should use the shortest culvert feasible). We would also
require mitigation for culverting a creek channel, and the most appropriate form of mitigation for a culvert
under a new house is day lighting a culverted channel somewhere else. And that is very expensive.
Culverting affects the local hydrograph. Water flowing through a culvert moves much faster than water
flowing over channel surfaces composed of soil and vegetation. People tend to think of flooding as a problem
caused by too much rainfall for a channel's capacity. But the timing of the runoff from a storm is also a major
factor in flooding. The time it takes for a water drop to move from a point in the watershed to the receiving
water is call the time of concentration. The time of concentration is much longer in relatively undeveloped
watersheds than in developed watersheds. As a watershed develops, the time of concentration decreases, and
stormwater runoff reaches the major receiving creeks faster than it did before development. That is why
developed areas flood more than undeveloped areas. So, if a culvert were placed under the full length of a
new residence, it could exacerbate flooding in the downstream properties. The capacity of the culvert under
Horseshoe Ct. would not be a factor in this flooding problem. A culvert with adequate capacity would just
transmit the faster moving water from a long new culvert to the downstream neighbors.
The placement of a culvert must also be matched to the natural gradient of the channel as closely as possible.
Natural channels attempt to adjust to match the gradient imposed by a new culvert. If a new culvert has a
shallower gradient than the existing channel slope, the culvert usually initiates a head cut that moves up the
watershed and leads to bank failures in upstream properties. If the culvert is placed at too steep a gradient,
then incision is often initiated downhill from the culvert.
2. Channel Re- Alignment. Re- routing a channel is always tricky (and would also require agency permits).
Water in a channel has energy that is a product of the amount of flow in the channel and the gradient of the
channel. That energy is partially expended in removing sediment from the watershed and carrying it
downstream through the channel. When a channel is in a good state of equilibrium, sediment will move
steadily through the channel, without causing excessive erosion of the channel bed and banks or depositing
sediment in the channel in sufficient quantities to obstruct flow.
If a channel is made shorter, the gradient along the channel centerline is made steeper. This results in higher
energy flows, which will lead to channel incision. If a channel is made longer, the gradient along the channel

centerline is made shallower. This results in lower energy flows which are not capable of transporting the
sediment loads generated upstream of the re- alignment. This leads to sediment deposition in the new channel,
which will reduce its capacity.
No matter how much effort is put into maintaining a lengthened channel, gravity will always be attempting to
push the channel back into its original pathway. So you can expect lots of ongoing maintenance for a
lengthened channel.
Please share my concerns with Mr. Huesby so he can have a chance to look them over and discuss them with
his engineers /consultants before next Monday.

Thank you for your letter dated July 2, 2012 regarding the proposed subdivision at the subject
address, Lands of Huesby. Your letter requests that the District review and comment on the
drainage issues associated with the creation of a new lot and construction of a residence. I
appreciate the descriptions, maps and pictures provided to explain the situation. Mr. Huesby
also contacted the District at the end of May requesting our review of the project.
While the site is close to Wildcat Creek, it is not adjacent to it and there are no District facilities
on the property, so there are no District permits required for the project. In addition, the site is
not located within a special flood hazard zone on the FEMA flood maps. Because there are no
District land rights on the site and it is not next to Wildcat Creek, the District would not generally
provide review comments. However, the nature of the drainage feature through the site and the
concerns raised by the community prompted our review.
The site is located within a shaded Zone X which denotes areas subject to flooding to depths of
less than one foot, areas protected by levees or areas subject to flooding in the event of a 500
year flood. While flood maps provide broad, high level information for insurance purposes, they
do not provide local detailed analysis of flooding or drainage features. For this, local knowledge
and judgment is paramount to prudent site design and floodplain management.
The pictures provided with your letter clearly show that the drainage feature is significant. The
drainage feature upstream from the subject site has a defined bed and banks which could be
considered a creek under the Guidelines and Standards developed by the Water Resources
Protection Collaborative. The Guidelines, subsequently adopted by the City of Saratoga, define
a buffer area between buildings and the top of banks of a minimum of 20 feet. While this is
mostly for structural integrity, protection of riparian corridor and native vegetation is also a
consideration in site development.
The pictures show that extensive vegetative cover has been removed from the site. The
Guidelines, storm water pollution prevention best management practices and development
guidelines for hydromodification purposes all emphasize and regulate the importance of
preserving riparian corridor habitat and vegetative growth within the watershed to aid infiltration
and prevent or minimize downstream erosion. The function of the drainage feature and
surrounding vegetation should be considered with the development application.

Historic background on the City's prior denial of the proposed subdivision was provided with
your letter. Reasons for the prior denial included impacts to the existing natural swale and
potential erosion caused by the development. It appears that site conditions with respect to
drainage have not changed over the years. Your letter indicates there are opinions that
drainage is no longer at issue because of the adequacy of the 18 inch pipe under Horseshoe
Court to convey the watershed drainage. The adequacy of this pipe does not resolve the likely
potential for downstream erosion exacerbation.
The project plans show that the drainage feature would be realigned to the westerly side of the
property, a 12 inch diameter culvert would be placed under the driveway and the drainage
feature would be rock lined. While minor realignment may be acceptable, we recommend that
the drainage design include a similar area for detaining , ponding and retarding the flow
upstream of the 18 inch culvert. The increased channelization, as proposed, will tend to
increase the velocity of flows and exacerbate downstream erosion and degrading of the channel
invert. We also recommend that the swale be realigned or the driveway be sited so that the
culvert under the driveway is not included in the project design. Rather than lining the swale
with rock, we suggest a wider channel design with flatter side slopes that includes additional
vegetation. If the culvert is placed under the driveway as shown, consideration should be given
to the flow path when the culvert is blocked or capacity is exceeded.

We are planning this event to get everyone in our area to get to know one another.
We hope to get as many folks involved as possible.
There are 88 homes on Shubert Drive and the 3 courts, DeHaviland Drive and the 2 courts.
Part of our plan is to educate our neighbors by inviting the Sheriff and a member of the Fire
Department to speak, briefly to our group. There will be a table with flyers for
NEIGHBORHOOD SAFETY WATCH and EARTHQUAKE PREPAREDNESS. We will also have a
signup for Block Captains as part of our Safety Watch.
We will use Name Tags as a way of introducing ourselves to each other.
There will be tables for finger food and desserts. We will need funds for the following items for
about 100 to 200 individuals.
Music and other entertainment is being arranged as well as games.

BACKGROUND
A lifetime of skating and a world of
experience led to the creation of
Artificial Ice Events (Al Events).
Founded by Michael N. Gallant
a nationally competitive speed
skating veteran and owner of event

Al Events is the
marriage between
his two passions-
Ice Skating and
Special Events.
In February of
1980 at the age of
4 Michael Gallant
began a 17 year
speed skating career. Michael
skated 3 -5 nights a week with the
Bay State Speed Skating Club, and
while in high school took part time
classes at the National Sports
Academy while living and training at
the United States Olympic Training
Center in Lake Placid, New York.
Since then Michael has skated in 3
Olympic Trials and has earned
recognition as a top national skater.
In a career that began at the age of
5, Gallant has won or placed in
meets that include Bay State Winter
Games, The Eastern Seaboards,
and the New York State Short Track
Championships. Gallant also touted
gold and silver medals at two
Olympic Festivals and over a half
of dozen National Championship
medals. In 1995 Michael deferred
his Merrimack College education
and trained fulltime at the Pettit
National Ice Center in Milwaukee,
Wisconsin. There he trained 8 -10
hours per day under world recog-
nized Olympic Medalist coach
Dianne Holum, with an end goal
being a spot on the 1998 Nagano,
Japan Olympic Team. When Gallant
failed to secure a spot on the 1998
Olympic Team, he channeled his
energy to a new dream - pursuing a
career in the entertainment industry.
It is the entertainment industry and
his background in speed skating
that inspired the Al Events vision.
The vision of Al Events was to
provide a realistic yet entirely mobile
solution to ice skating. Coming from
an extensive background as a
speed skater Gallant learned the
importance of good ice. "In the sport
of speed skating ice is more than
just a surface it is a science," Gallant
explained. It is this knowledge of ice
that has forced him to offer the
most superior ice on the market.
Coming from the event industry
Gallant saw an opening for this
product at corporate events, con-
ventions, and other special events,
and hence Al Events was founded.

I N S T A L L A T I O N
Installation time for a temporary ice rink depends on the size of the
surface and ease of load in. For reference sake we can install most
surfaces smaller than a 60'x 60' in less than a day and in some
cases as quick as 4 hours. We recommend leaving approximately
2 -3 hours for disassembly.
Our synthetic ice can be installed on any flat surface capable of
supporting the weight of the panels and skaters. Hard surfaces
like gymnasiums, patio pavers, tennis courts, dance floors, and
concrete floors are all typical installation sites. Panels
can also be installed on hardwood floors or asphalt SPECIAL SOLUTION
parking lots. In some situations compacted earth REDUCES FRICTION & GLIDE
has been used successfully. If this type of surface
is not available a simple sub floor must be installed.

I C E R I N K USAGE
Once your artificial ice surface
has been installed and sprayed
with the special solution, it is
ready to be used by any regular
hockey or figure skate. Most of
our rental packages come with
these types of skates already
included. Our ice was designed
to reduce friction and enhance
performance no matter what
the skate. Simply keep your
skate blades sharpened for
maximum results.
If you are a figure skater, know
that many professional figure
skaters request our ice in show
venues where they want the
best. More forgiving than
conventional ice, our synthetic
ice can enhance training and
enable you to perform all
jumps, spins and figure
skating maneuvers with ease.

If you are a hockey player,
hockey skating maneuvers are
easy on our synthetic ice. The
puck responds as it would on
conventional ice, so you can
practice all of your hockey
moves from the traditional stops
to slap shots to goal tending.
You will find our synthetic ice
installed in a number of hockey
clubs and sports facilities,
as well as family homes in
basements, backyards and
even bonus rooms.
If you plan on using the synthetic
ice for recreational skating, we
recommend 1 person per
40 square feet of ice space.

Our synthetic ice can be used both indoors and outdoors.
It is ok to use the surface in rain or snow, and a wet surface is
actually faster than a dry one. The rink surface is cleaned by

either power washing or by sweeping.
We are fully insured and offer additional
insured listings when requested.
Our employees are all protected by
workers compensation insurance and
we also require all skaters to sign a
hold harmless agreement prior to
skating which is available upon request.
Once our ice surface has been installed it must be misted
with a special solution. This solution is an environmentally
safe spray lubricant that reduces friction and enhances glide
and speed. It is non - toxic, non - flammable and non - detectable.
The spray only needs to be applied a couple times of month
with heavy usage. We can provide you
with the MSDS upon request.

We are planning this event to get everyone in our area to get to know one another.
We hope to get as many folks involved as possible.
There are 88 homes on Shubert Drive and the 3 courts, DeHaviland Drive and the 2 courts.
Part of our plan is to educate our neighbors by inviting the Sheriff and a member of the Fire
Department to speak, briefly to our group. There will be a table with flyers for
NEIGHBORHOOD SAFETY WATCH and EARTHQUAKE PREPAREDNESS. We will also have a
signup for Block Captains as part of our Safety Watch.
We will use Name Tags as a way of introducing ourselves to each other.
There will be tables for finger food and desserts. We will need funds for the following items for
about 100 to 200 individuals.
