To:  Michael  Fossati  <mfossati@saratoga.ca.us>,James  Lindsay  <jlindsay@saratoga.ca.us>,Emily  Lo <elo@saratoga.ca.us>,Manny  Cappello  <mcappello@saratoga.ca.us>,Chuck  Page <cpage@saratoga.ca.us>,Jill  Hunter  <jhunter@saratoga.ca.us>,Howard  Miller <hmiller@saratoga.ca.us> Cc:  Dan  Casas  <dcasas@legalteam.com> We  are  responding  to  Mr  Lee's    "Supplemental  Appeal  Letter",  dated  10/28/2014.  He  offers  3  more points  which  we  will  respond  to  in  order. 1)  Mr.  Lee  believes  "  The  City  ought  to  be  consistent  in  the  handling  of  applications".          Cutler  Response:  Mr.  Lee's  statements  are  both  factually  untrue.  First,  The  City  did  not  require  " off  street  parking"  for  the  Saratoga  Dry  Cleaners  because  of  the  newly  implemented  "parking relaxation"  in  {Section  15-­‐35.020  (k)}.  Secondly,  Mr.  Lee  has  fabricated  an  imaginary  scenario between  Craig  Awbrey  and  the  City  of  Saratoga.    According  to  the  City  records  and  Craig  Awbrey, there  was  no  application  for  any  residential  apartments.   2)  Mr.  Lee  believes  "The  intensive  Parking  Demand  is  a  threat  to  the  Existing  Businesses".            Cutler  Response:  It  has  already  been  established  by  the  City  that  there  is  excess  parking  capacity of  41,850  sq.  ft  in  the  Village  of  which  Mr.  Lee  has  been  approved,  and  subsequently  built  his  own Saratoga  Inn  expansion.  If  Mr.  Lee  really  believed  that  the  intensification  of  use  would  threaten  his customers  then  he  would  have  petitioned  the  approved  expansion  of  the  Blue  Rock  Shoot  in  2006. At  that  time,  we  received  approval  to  move  La  Fondue  Restaurant  into  the  Blue  Rock  Shoot  space which  would  have  brought  hundreds  of  cars  to  Parking  District  #  1.  Surely,  that  ought  to  have aroused  a  hint  of  interest  from  Mr.Lee?  Not  the  case,  Mr.  Lee  was  silent.  Neither  the  City  nor  the Cutlers  received  any  complaint  whatsoever  from  him.     3)  Mr.  Lee  believes  "Residential  Units  Need  Covered,  On  Site  Parking".        Cutler  Response:  According  to  Section  15-­‐35.020  (k),  this  Project  is  exempt  from  covered  parking.      Thank  you  for  listening  Council  members,  we  have  complied  with  every  request  that  the  City  has asked  of  us.  Please  deny  Mr  Lee's  appeal  on  it's  rumorous  and  groundless  speculation.
