SUBJECT : Housing Element
ISSUE SUMMARY AND BACKGROUND
State law requires that every jurisdiction have an adequate
housing element as one of the nine mandated elements of its
General Plan. Prior to the passage of AB 2853 in September
1980, existing state law required that these housing elements
conform to the guidelines promulgated by the State Department
of Housing and Community Development in 1977. Localities
within the ABAG area were required to bring their housing
elements into conformance with the 1977 Guidelines by October
1979. The City of Saratoga began preparation of a new housing
element in mid -1979. The Department of HCD granted the City an
extension during the course of development of the element,
and the Planning Commission adopted a draft element on February
27, 1980. The City Council rejected this draft on May 21, 1980.
The new State housing legislation, AB 2853, obligates every
jurisdiction to adopt a housing element which conforms to either
the 1977 Guidelines or the substantive requirements of AB 2853
on or before October 1, 1981.
The principal distinctions between the requirements of the two
are shown below:

If a draft housing element is submitted to HCD by July 1, 1981,'the
jurisdiction has the option of conforming to the 1977 Guide.lines rather
than the more stringent requirements of.AB 2853. In that ABAG has not
been able to yet generate the figures which AB 2853 requires for sub-
stantiation of the housing needs to be addressed in the element, most
jurisdictions-have decided it is.more prudent to proceed under the
Guidelines.
In the long run, it can be anticipated that the housing element con-
tent must conform to the statute; AB 2853 requires review and revision
of the housing element by July 1, 1.984 and the periodic five -year
revisions thereafter. This review requirement is very appropriate for
Saratoga's situation. The General Plan review process now underway
will undoubtedly produce recommendations that will affect the housing
clement. The direction received in the total plan review will be
factored into the housing element, either in the version due for
adoption by October 1, 1981, if known by then, or when the comprehen-
sive amendments occur at the completion of the process. At the present
time, it should clearly be explained to the public and to the General
Plan Citizens Advisory Committee that this action constitutes an
interim measure to bring the City into compliance with state law and
will be superseded by the housing element developed through the
ongoing General Plan review process.
Saratoga is not alone; a majority of cities in-the Bay Area have not
adopted new housing elements. However, HCD has hired additional
personnel to review the draft housing elements which the law requires
be sent to the department for review and comment prior to adoption.
The law also states there shall be no extensions granted beyond the
October deadline.

Assemblyman Konnyu has introduced legislation (see attached AB 1995)
to relieve cities of less than 50,000 population from the requirements
of AB 2853; while the Council may wish to support this bill, it has not
yet been calendared for consideration by the Assembly. The League of.
California Cities will have no position on the bill until at least
mid -June.
RECOMMENDATION
Staff suggests the following calendar for accomplishing compliance
with the law:
May 12 - Council study session to-review requirements
of Guidelines and evaluate various housing
policies and programs.
May 26 - C.ouncil study session to develop consensus
for direction to Planning Commission for
preparation of draft housing element.

The left -hand column contains the mandated requirements of the State
Housing Element Guidelines, adopte i� n 1977. There are permissive
as well as mandatory sections within the guidelines. I have generally
omitted the permissive from the checklist with three exceptions. I.
have marked.the exceptions with asterisks as I feel their inclusion
could add a better understanding to the housing situation in Saratoga.
(They are: Market Constraints, Government Constraints, and Regional
Relationships.)
The second column contains, where applicable, policies and programs
which the City has previously adopted. (These are shown within
quotation marks.) Also listed are goals, policies, and activities
which were recommended during prior discussions of housing programs
for the City. inhere the second column is empty, this reflects either
descriptive information in the left column or the absence of a City
Policy or program to deal with that requirement.
The third column provides for Council response. Where a policy or
program is lacking, or where C.ouncilmembers feel a different approach
would be more appropriate, they should indicate their recommendations.
This technique should facilitate development of consensus for recom-
mendations to the Planning Commission.

An act to amend Section 65582 of the Government Code,
relating to cities, and declaring the urgency thereof, to take
effect immediately.

Existing law requires the adoption by every county and city
of a local general plan, including a housing element.
Legislation enacted in 1980 (Chap. 1143, Stats. 1980)
imposed substantially more detailed requirements for the
housing element, requiring, among other things, that counties
and cities plan in the housing element for meeting their
( appropriate share of the demand for housing, and requiring
that local agencies conform their general plan housing
elements to the new requirements by October 1, 1981.
This bill would make these most recently enacted
requirements inapplicable to any city with a population less
than 50,000.
The bill would take effect immediately as an urgency
statute.

(a) "Community," "locality," "local government," or
jurisdiction' means a city, city and county, or courrty ,
but sloes not mean or inel"cle any city with a population
of less than 50,000.
(b) "Department" means the Department of Housing
and Community Development.
(c) "Housing element or "element" means the
housing element of the community's general plan, as
required pursuant to this article and subdivision (c) of
Section 65302.
SEC. 2. This act is an urgency statute necessary for
the immediate preservation of the public peace, health,
or safety within the meaning of Article IV of the
Constitution and shall go into immediate effect. The facts
constituting the necessity are:
In order that small cities with restricted financial
resources need not undertake the additional expense of
complying with recently mandated planning functions, it
is necessary that this act take effect immediately.

GUIDELINES. (1977)
Section 6408. Scope. Make adequate provision
for the housing needs of all economic seg-
ments of the community.
Section 6418. The Community to be Served by
the Local Housing Element. — it is not
enough for a locality to measure its
responsi`bilitiles to the community in terms
of the housing needs of its resident
population. ... the housing element must
also be responsi0e to the housing needs of
a fair share of those households in the
general housing market area who do-not
live in the locality but whose housing
opportunities are affected by the planning
decisions of the locality.
Sections 6420 - 6430. Fair Share Allocation
Plans. The Department of H.C.D. shall pre-
pare, or delegate preparation of, a fair
share allocation plan to provide localities
with a general measure of local responsi-
bility for addressing a fair share of the
market area housing need. The plan shall
estimate immediate and projected housing
needs of nonmarket -rate households (i.e.,
low income, those earning below 80% of
the County median income,) The criteria
used in the plan to allocate responsibility
must seek to expand the range of locational
choice for nonmarket -rate households and
improve access to employment, services, and
other opportunities.
H.C.D. developed a plan in June 1979 for
Santa Clara County, Saratoga's general
housing market area.. The County Planning

locality intends to implement to further
its goals, policies, and priorities. Each
plan description shall:
1. identify (and quantify where possible)
the objective;
2. describe the actions to be undertaken;
3. discuss financing;
4. assign agency responsibility;
5. establish time frame.

housing code, City - sponsored paint and fix -up
program, target neighborhoods or areas for
focused street and other public facility main-
tenance activities.
The City will continue to participate in the.
Santa Clara County Housing Authority's Section
8 rent subsidy program, as well as encourage
private developers and groups to seek Section
8 subsidy assistance for their projects.
In order to increase housing choices within
Saratoga, the City will encourage the develop-
ment of multiple- family rental units through
land use designation, consistent zoning and.
appropriate regulation.
The City will continue to protect the balance
of multiple- family rental opportunities by
discouraging unregulated conversion to condo -
miniums or cooperatives. Protection will
occur through enforcement of the City's condo -
minium conversion ordinance.
The City will revise the zoning ordinance to:
a: extend planned residential density con-
cept to include energy conservation,
reduced or modified siting, and other
construction cost- reducing incentives
for family homes as well as housing for
the elderly.
b. develop a mixture of commercial- residen-
tial use within the "C -C" district.
City planning staff will monitor available
public and private funding programs for hous-
ing assistance and report at least annually
with a General Plan update on any nee•+ develop-
ments which may be applicable to Saratoga's
housing goals, policies and action program.

With the exception of the two policies immedi<
tely following, all site- specific action
program housing items from the 1974 General
Plan have been implemented:
"Single- family residential densities should be
extended to the site on the west side of
Saratoga- Sunnyvale between the S.P. tracks an(

The Land Use Element of the General Plan will
be updated periodically to include sufficient
sites, consistent with the needs established
in the Housing Element for elderly and other
assi.sted housing. The public will be involvec
in developing criteria for site selection and
in identifying appropriate sites.
The City should review at least every three
years the sites identified for affordable
housing and update the General Plan Map and
text by: redesignating those already developec
to land use designations consistent with
existing residential densities; re- evaluating
criteria and reviewing previously selected
sites for consistency with re- evaluated
criteria; and identifying new sites. The
public should be directly involved in the
criteria review, existing remaining site
evaluation, and selection of new sites.

With the exception of the two policies immedi<
tely following, all site- specific action
program housing items from the 1974 General
Plan have been implemented:
"Single- family residential densities should be
extended to the site on the west side of
Saratoga- Sunnyvale between the S.P. tracks an(
Manor Drive."
"Portions of the Village should be developed it
multiple unit residential and professional
uses which in appearance reinforce the country
atmosphere... mixed residential and commercial
land uses should be encouraged."
The Land Use Element of the General Plan will
be updated periodically to include sufficient
sites, consistent with the needs established
in the Housing Element for elderly and other
assi.sted housing. The public will be involvec
in developing criteria for site selection and
in identifying appropriate sites.
The City should review at least every three
years the sites identified for affordable
housing and update the General Plan Map and
text by: redesignating those already developec
to land use designations consistent with
existing residential densities; re- evaluating
criteria and reviewing previously selected
sites for consistency with re- evaluated
criteria; and identifying new sites. The
public should be directly involved in the
criteria review, existing remaining site
evaluation, and selection of new sites.

REQUIREMENT OF STATE HOUSING ELEMENT
GUIDELINES (1977)
is not required to undertake programs whicP
are economically infeasible in order to
make a good faith, diligent effort. Such
effort must emphasize the use of those
public powers which impact on housing, in-
cluding, but not limited to, land use
controls, development controls, and regula-
tory concessions and incentives. Such
effort must also include a commitment to
pursue and cooperate in available federal
and state housing programs or indicate the
manner in which the locality intends to
address its housing needs without such
assistance.
Section 6462. Environmental Review. Prior
to adoption of the housing element, an
initial study and negative declaration or
Environmental Impact Report must be pre-
pared and filed with appropriate agencies
Section 6464. Relationship to Other General
Plan Elements. Where a locality undertakes
revision of any element of its General
Plan, it should also examine the other
elements to assure internal consistency.
Section 64.66. Housing Assistance Plan. The
Guidelines are structured to encourage an
integrated housing planning process, pro -
viding much of the information necessary to
prepare a Housing Assistance Plan in com-
pliance with federal law relating to com-
munity development block grant funding.

The nature of the document (E.I.R. or Negative
Declaration) will not be determined until
draft element is reviewed by H,C.D. and. final
draft is prepared for Council. However,
environmental assessment of the proposed
policies is ongoing during their development
and public review.
Consistency of the Housing Element with the
other elements of the General Plan will be
assured during completion of the General Plan
review process now underway.
Saratoga will. enter its seventh year of
participation in the Community Development
Block Grant Program in FY- 1981 -82. The
Housing Assistance Plan projects for 1981 -82
are the Paul Avenue improvements and the
application of the SHARP program to another
15 units.

Section 6468. Public Participation. The
housing element shall be developed through
a decisionmaking process which is accessi-
ble to and directly involves all economic
segments of the community. The process
employed by the locality must be described
in the element.
Section 6470. Intergovernmental Coordination.
...the localities within the general hous-
ing market area must cooperate on a
continuing basis. '
Section 6472. Update. The housing element
shall be revised as .need dictates, but no
less than once every five years. This
periodic revision shall include:
a. incorporation of new census data;
b. evaluation of effectiveness of housing
programs, introduction of new plans,
and discontinuation of others.

A series of eleven workshops, study sessions,
and public hearings were held for the prior
draft housing element. Housing issues have
been presented to citizens at the series of
twelve planning area meetings held for the
purpose of General Plan review. The Planning
Commission will hold public hearings on the
proposed housing element.
Saratoga participates with seven other non -
entitlement cities and the County in the
H.U.D. Community Development Block Grant
Program.
AB 2853, with which localities must comply
after 10/1/81, requires revision of the
housing element within 3 years, thus by
7/1/84, and at least every 5 years thereafter.
The first revision will probably be substan-
tial, in order to incorporate the work of the
1981 Community Plan process.
