Recommended action:

Recommended action:
Review and approve the Investment Policy for Fiscal Year 2014/15.
5. Contract Renewal for Traffic Signals & Lighted Crosswalks Maintenance & Repair Services
Recommended action:
Approve a three -year contract agreement with Siemens Industry, Inc. for City traffic signals
and lighted crosswalks maintenance and repair services and authorize the City Manager to
execute the same.
6. Approving Application for Metropolitan Transportation Commission (MTC) Grant Program
— Active Transportation Program (ATP)
Recommended action:
Approve resolution supporting the MTC ATP Grant Application.

Recommended action:

resolution overruling objections and ordering hazardous vegetation abatement (brush).

8. Santa Clara County Law Enforcement Contract
Recommended action:
Review and approve proposed Law Enforcement contract and authorize City Manager to
execute the contract with Santa Clara County.

Receive report.
10. Joint Exercise of Powers Agreement and Cooperation Agreement to Undertake CDBG
Activities
Recommended action:
Adopt the resolution authorizing the City Manager to enter into a Joint Exercise of Powers
Agreement and Cooperation Agreement with the County of Santa Clara relating to essential
community development and housing assistance activities funded by the Federal government
for the Community Development Block Grant and HOME Program.
11. Fall 2014 Issue of The Saratogan
Recommended action:
Accept report and direct staff accordingly.
12. League of California Cities Annual Conference Designated Voter
Recommended action:
Designate the City of Saratoga voting delegate and alternative voting delegate(s) for the 2014

Please do not sit on the handrails of bridges, buildings, or trails.
Except bottled water, food and beverages are allowed in designated picnic area only.
Picnic areas are for the general public and cannot be reserved.
No smoking in the entire Gardens.
Please be aware that parts of the Bamboo Gardens may be closed seasonally (April -May)
to protect new growth. (May 21, 2013 Bamboo Gardens have,beenreopened)
Wheelchair Access - Because paths and walkways are covered with either fine gravel or
rock, the Gardens have limited access for wheelchairs.
Photography: Commercial, formal occasion, and political photographylvideography require
permits and reservation. Please do not block the garden paths with equipment. .
Buses - Bus access is limited due to the sharp turns and steep grade of the entry road.
Buses longer then 30 feet and larger than 24 passengers are not allowed. Parking for buses is
available at the base of the drive, on Big Basin Way. Visitors may use the hiking trail (114 mile)
from Big Basin Way to the Gardens.
C l Hakone Access for Saratoga Residents
first Tuesday of January, April, July, and October, Saratoga Residents and their
re welcome to Hakone on a free admission basis (free parking Is included) during
operating hours. When entering Hakone, Saratoga residents are requested to provide
on (such as a drivers license or electricity bill) showing that theycurrently reside

Contract
After the agenda packet for the June 18, 2014 City Council meeting was prepared, the
Santa Clara County Sheriff's Office provided the City with additional attachments to
the report on Item 8 - Santa Clara County Law Enforcement Contract. These
attachments include Fiscal Year 2012/13 and Fiscal Year 2013/14 law enforcement costs

3 Monte Sereno's contract with Los Gatos Police Department for police services is for 80 hours per week only. The police
budget noted above is the flat rate for 80 hours.
4 The City of Sunnyvale includes both police and fire protection costs in the Sunnyvale Pulic Safety Department budget.
5 A significant, one time property sale occurred in the City of Cupertino during fiscal year 2010/11 (HP - Apple). Specific
(sales tax) revenues therefore increased by approximately $22.7M, supporting a similar one -time increase to the FY
2013 General Fund expenditure budget. The majority of one time funds were budgeted for FY 2013 retiree medical and
capital improvement reserves. The remainder is represented as small budget increases or flat year over year changes
in the remaining GF categories. Allowing for the anomoly, the Cupertino Law Enforcement Budget is approximately 21 %
of the adjusted GF budget.
All budget numbers were obtained from city websites.
The above information may not reflect full law enforcement costs, since expenditures related to law enforcement may
be budgeted under a separate funding source. For example, vehicle costs may be budgeted under Fleet Operations
rather than Police Services.
The Sheriffs Office budget incorporates full costs associated with law enforcement services.

Dear Mayor and City Council,
Thank you for all of your work on behalf of the residents of the City of Saratoga. It is much
appreciated.
The following are my comments for your consideration regarding your agenda item 10 for your June
18, 2014 City Council meeting:
Joint Exercise of Powers Agreement /CDBG. As you know, the decisions you make as City Council
members on behalf of the residents of Saratoga very much matter.
I am requesting that you defer item 10, to conduct the necessary due diligence required on this
item before consideration to ensure that the residents of the City of Saratoga are best served by
your decision on this matter.
In support of your legal requirements of due diligence in conducting the business of the people, I
offer the following for your consideration:
1. affordable housing as manifest in RHNA and HUD programs is not about affordable housing. It's
about government assigned housing, taxpayer subsidized housing, deed restricted housing and
below market rate housing. it's about the government taking control of what is now a free housing
market. This is occurring through a process known as "gradualism ".
If one extrapolates this affordable housing program to an end result that is unabated, we will all be
living in subsidized, high density, government assigned housing and the free housing market will
then collapse. Is this what you want for your children and grandchildren?

I do not want to live in high density housing to which the government assigns me. People have a
right to make their own choice of where they want to live. Fair housing laws have been about
allowing people to choose where they live free from discrimination because of their race and other
similar factors.
2. The government definition of affordable housing appears to be 30% of any individuals income. It
seems our federal government is trying to engineer the spending of the American people. Note the
parallel with the Farm Bill regarding food costs as a percentage of income. If interested, see the
movie "King Corn" for details. People have the right to spend whatever amount they choose for
themselves on their abode.
3. Joint powers agreements are governance, not government. In reviewing this JPA there are a
number of concerns I have with the language and commitments that the City makes that obligates
our residents to sustainable development principles that they would likely not otherwise consent to
if they understood the meaning of these terms and the intentions of this program.

*Westchester County HUD settlement. It is my understanding that Westchester County has
complied with the HUD settlement and HUD has demanded additional terms outside of that
settlement which Westchester County believes are unambiguously beyond the settlement. In
response, Westchester County has refused HUD grant funds and the myriad of strings attached and
are looking into establishing a local grant program.

Agreement to Undertake CDBG Activities
Dear Mayor and City Council,
I am concerned that the proposed agreement gives away property rights and changes the climate
and culture of Saratoga without sufficient discussion and approval ofthe•citizens.
I don't think we need to agree with terms such as "cooperate to undertake, or assist in undertaking,
community renewal and lower-income housing assistance activities" with entities outside of our
own City government.
I request that this agenda item be deferred and that a community workshop be help this summer to
explore the ideas, terms, economics, and obligations surrounding this proposed agreement.
