adjacent plops with Wily grown fruit trees, € row ing sio, that it was inn possible to divide the plotsi.
Later we were tolc that e 1 r devoted predecessor spent all his time iri the garden. Hi died 3
years ago and siricie nc body agreed to take his plot),, beaaL se ill is too mi. ah work.

years. Residents always were a pric rity,, bit not always wanted to be gardeners,

terrr 'nation. le ere was no waiting list, siorr e plots were not taken.

their passion) ibr gardening. After all, even if the pec pia on the waiting list are sEirioL 51,, th e
waiting time may be not so long.
By the way,, dL rin€ the 05.17.15 Cc i ncil meeting Mayor Mr. Miller asked the Director oil
Recreation whether it isi possible 110 expanc the garden. The answer was "not,, at least not at
th at locatio rim. But nig_ ally there isi space for about 4 plots iIbeilween the garden anc the
narkinglot], a photo ofl 11h is space is attach ed.
We also were ilcild by Recreational Dlepartmenn than after we will be tlenminatec th e trees from
our plotsi will be removed. Why? Ail time, when California isi sdlrag€ ling tic save trees from �.

th e cost of tree removal.

yeas i stocid on the waiting list. Man times we tallded with Msi. Nina . She called us and invited

wonkl in this plot. He bought and planted tre as, he bought wocid material, h uilt a place for sitting
in hot time, planted and covared with beautiful grapasi arour d that. All his life depends on this
palace!. Maybe people, who now stay on the waiting list can wait small time before we fmished

About this petition
NO Tower Near Home, NO Tower Near Kids
Protect Saratoga's Heritage, Natural Beauty, Health, Safety, and Property Value
Rejected by Cupertino, San Jose, Palo Alto, and Los Altos, wireless carriers are finding the city door
wide open in Saratoga. There are 7 new wireless cell towers proposals by Verizon in Saratoga this
year already.
• Three on Prospect Road (City Council hearing on 8/19)
• One next to Saratoga High School (City Council hearing on 9/16)
• Three in South Saratoga
And more will come into our neighborhood. The next one could be on your street, next to your
backyard, and on top of your school playground.
They also come with power generators and large fuel tanks, introducing substantial safety hazards to
our neighborhood.
We, as Saratoga residents, have to stand together and do something, to protect our beautiful natural
environment, our kids, our health and our property value. We propose to amend the city wireless
tower ordinance to require a 300 foot setback from homes and schools.

As a result, many jurisdictions (particularly urban and suburban) have enacted cell tower
ordinances that prescribe how cell towers can be built and sited. Because every jurisdiction is
different, it might be easier to discuss some common threads between many ordinances.

• Prohibit towers in residential zoning
• Encourage placement of towers in industrial and commercial zones
• Limit the height of the tower to that needed by the wireless carrier
• Require Security Fencing
• Require a "setback" from adjacent property lines - typically equal to one foot for every foot
of height of the tower (A100' tower requires at least a 200' by 200' parcel)
• Require that the cell tower is being built for a licensed wireless carrier, i.e., Cingular;

CUPERTINO
Wireless Communications Facilities Ordinance
The City Council approved the ordinance amendments on
February 3, 2009 on a unanimous 5.0 vote. The new
ordinance becomes effective March 19, 2009.
The key changes are as follows:
1. Increase the antenna setback to 75 feet minimum
from a residential property line.
5. Allow antennas to be mounted on all existing and new
utility poles and towers. Exclude such antennas from the
setback requirements from a residential property line.

only considering aspect. The decision was made under pressure and

residents' houses. Verizon's new RF report is dramatically different than
the original RF report. It is not in compliance with FCC requirements

Federal Communications Commission (FCC') Requirements
Under the Teleconununications Act of 1996. the FCC' has exclusive jurisdiction over Radio
Frequency (RF) emissions from personal wireless antenna facilities. The City can evaluate
and regulate only the aesthetic aspects of wireless installations. Any concerns regarding
health and safety aspects of the wireless sites are not within the purview of the Planning
Commission. Pursuant to its authority under federal law. the FCC' has established rules to
regulate the safety of emissions from these facilities.

• "existing" means both a physical and a legal existence (i.e., does a valid permit exist for
the antennas on this structure?). Section 6409(a) does not apply to structures (1) that
merely could support transmission equipment (2) illegally constructed without all proper
wireless site review or (3) legally constructed but at a time when the local laws did not
require wireless site rcview.9
- The utility pole was constructed many years ago, was meant for
utility power. Verizon has NOT provided any legal documents
showing the utility pole had a wireless site review at time the utility
pole was constructed. Verizon has not provided any safety analysis
report for very old wooden pole.

to be 15-25 feet away with 26 feet height (city code
ordinance) and a roofer working on the roof top, RF radiation
could exceed FCC limit. We need an independent report.
