Action Minutes from the Regular Planning Commission Meeting of June 23, 2010
ORAL COMMUNICATION
Any member of the Public will be allowed to address the Planning Commission for up to three minutes on matters not
on this agenda. The law generally prohibits the Planning Commission from discussing or taking action on such items.
However, the Planning Commission may instruct staff accordingly regarding Oral Communications under Planning
Commission direction to Staff.

Pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on July 8, 2010
REPORT OF APPEAL RIGHTS
If you wish to appeal any decision on this Agenda, you may file an “Appeal Application” with the City Clerk
within fifteen (15) calendar days of the date of the decision, pursuant to Municipal Code 15-90.050 (b).
All interested persons may appear and be heard at the above time and place. Applicants/Appellants and
their representatives have a total of ten minutes maximum for opening statements. Members of the Public
may comment on any item for up to three minutes. Applicant/Appellants and their representatives have a
total of five minutes maximum for closing statements.
PUBLIC HEARING
1. APPLICATION PDR10-0005 (403-22-004) T-Mobile (Sutro Consulting) 14091 Quito Road - The
applicant is requesting Design Review approval for a wireless telecommunication antenna on a wood utility
pole. The facility is considered a “micro site” because the antennas and associated equipment are smaller in
size than a standard wireless facility. The antennas would be placed at the top of the pole and the associated
equipment would be placed on the lower half of the pole. The pole will be similar in height to other poles in
the vicinity and no equipment will be on the ground. (Cynthia McCormick)

1. APPLICATION PDR10-0006 (397-04-121) May/Luczo, 14810 Sobey Road - The applicant requests
Design Review approval to add 393 square feet to an existing 5,765 square foot residence. The addition
will be on the 1st floor in the front portion of the home. The residence will remain two story and will not
exceed 23-feet in height. The maximum impervious coverage will not exceed the allowable 35% of the net
site area. The lot size is approximately 48,500 square feet, located in the R-1-40,000 zoning district. Design
Review approval is required pursuant to Saratoga Municipal Code Section 15-45.060(a) (6). (Michael

2. APPLICATION CUP10-0004 (386-57-022) Growing Tree Learning Center, 12220 & 12226 Saratoga-
Sunnyvale Road - The applicant is requesting a Conditional Use Permit for a new after school program /
day care facility in an existing building. As proposed, the facility would operate with 5 employees and
provide services to 60 students. The facility would operate Monday through Friday from 7:00 AM to 7:00
PM. The site is located in a shopping center near the corner of Saratoga-Sunnyvale Road and Kirkmont
Drive in the commercial-visitor (C-V) zoning district. A parking study and peer review were completed for

the project and it was found that the existing parking and circulation are adequate to support the proposed
