MINUTES

I. ROUTINE ORGANIZATION
A. Roll Call
Committee Members Present: R. S. Shook, R. S. Robinson, and
Commissioner Laden

B. Minutes
It was moved and seconded to waive the reading of the minutes of
December 18, 1980 and approve as distributed. The motion was
carried unanimously.
II. SINGLE SITE APPROVAL PER ORDINANCE NO. 60.05
A. SDR -1.483 - Iry Kovalik, Bonnie Brae Way, Tentative Building Site
Approval - 1 Lot (over 50% expansion)
Staff explained that the applicant was proposing to expand the
existing house over 5.0% and_; therefore, needs site approval.
Additionally, the applicant plans in -the future to place a
swimming pool and tennis court on the site, which may require
Planning Commission approval. However, at this time the map only
shows the expansion of the existing house. The main Staff concern
with the site was to ensure that the drainage for the site is
properly handled. The Fire Department was requesting that the
fire hydrant nearest the house b*e checked for the standard require-
ment of 1,000 gallons per minute for two hours. The department
had been unable to do this by the meeting, and had so conditioned
the site. It was noted that the applicant was not present during
the discussion, so the item was continued until later in the meeting.
When Mr. Kovalik did appear, the Committee asked him whether he had
any concerns over the Staff Report. He questioned the drainage
condition and the Fire Department condition, and then expressed
satisfaction with the report.
It was moved and seconded to approve SDR -1483, per the Staff Report
dated January 12, 1981. The motion was carried unanimously.
:III. PUBLIC HEARING
A. Negative Declaration - SDR -1.482 - Anita Bolin
B. SDR -1482 - Anita Bolin, Sobey Road, Tentative'Building Site
Approval - 4 lots
Staff explained that the site had previously received Tentative
Building Site Approval, with its engineering work almost completed._
The engineer discovered that the squire footage of all four lots
was not necessary for the site approval, and by this application
was removing the lot with the existing house and water tank.
The public hearing was opened at 10:17 a.m.

Mr. Michael Amanatullah, of 1.4312 Evans Lane, stated that he was
being sued by Mrs. Dunne for water damage, due to a drainage problem
which would also impact the lots in this site approval. He explained
that, with the construction of houses on Evans Lane by Mr. Day, water
accumulated on Evans and then went down through this site to Quito.
Mr. Amanatullah explained that the case was in the courts still., and
that he was asking relief of the City Council to have proper storm
drainage improvements put in place. The LDC reviewed this concern and
noted that possibly a drainage easement could be placed on the southerly
lot line.
Mr. Heiss, the applicant's engineer, then explained the history of
drainage in the area and said that, with the construction of Evans
Lane, there had actually been a decrease in the drainage onto the
site. Mr. Amanatullah stated that there was also a claim against the
City. Mr. Shook noted that the Committee should not ignore this
problem and possibly continue the item until the Public Works Staff
has time to review it. Mr. Heiss explained the improvement plans that
he had done for the original site approval.
Mrs. Tennyson spoke for herself and Mrs. Evans, of Evans Lane, stating
that the water problem had been there forever, with lakes being
created during the rains of the 1960s. Since Evans Road had been put
in place, the water originated on the hilltop of Vessing and behind
the Hinz property in back of the new houses, and eventually made its
way to the Christiansen and. Korts site. With the Day subdivision, the
City had said that it could all be handled naturally, and then Mrs.
Dunne had constructed the barn in the middle of the natural drainage
swale. Mrs. Tennyson stated there would be a serious problem if houses
were also allowed to be built in this drainage swale.
It was directed that this item be continued until the Public Works
Staff has time to review the drainage, or until February 19, 1981.
IV. MISCELLANEOUS
A. Clyde V. Martins, Sobey Road, Modification to a Site Development
Plan for a Swimming Pool; Continued from 12/18/80
Staff explained that Mr. Martins had not submitted any new plans
as promised, and it was directed that this item be removed from
the agenda, to be reagendized when appropriate plans had been
received.
B. SDR -1480 - IP $ S Construction, Reconsideration of Tentative
Building Site Approval., Pierce Road - 2 Lots
Staff explained that the applicant had submitted a new map, chang-
ing the location of the driveway, so that the corridor angled at
the end, potentially causing the removal of two large pepper
trees. This had been done in order to reach agreement with the
neighbor owning the corridor.
Mr. Del Zisch, the realtor for the project, explained that the
Lunds dial not want their privacy disturbed, and thus had requested
the change in the driveway. He explained that to not allow this
change would create an economic hardship for Mrs. Volk.
The LDC reviewed the plans and questioned whether or not the
applicants 'had explored an alternative angling of the driveway
with landsc-aping to protect the privacy of the Lunds. Mrs. Volk,
the property owner, explained that she had had a terrible problem
with the roots of the pepper trees getting into her plumbing, and
that these trees were on their last legs. The LDC then suggested
that perhaps she should have the trees looked at by a competent
arborist. If the trees were in bad shape, the LDC would then

take that into consideration.
It was directed that this item be continued to the February Sth meeting,
with the applicants being given the option of 1) going to a horti-
culturist, or 2); submitting new plans showing the driveway slightly
revised to avoid the pepper trees.
C. SDR -1403 - Ra.lph Mares, Mt. Eden Road, Tentative Building Site Approval

D. SDR -923 - Peratd (Wise), Perata Court, Modification to Site Development
Plan for a Swimming Pool on Parcel "A"
The LDC reviewed the plans for the pool at length. It was noted that,
in order to do the work, retaining walls of a maximum 12 ft. in height
would be required, and that the proposed pool did not fit the contours
of the lot. Mr.1 Harison explained that it might be possible to rotate
the pool and,remove some of the decking area so that the retaining
walls and potential grading would be minimized. When questioned, he
stated that thelsite did. not have a better area for the pool. Commis-
sioner Laden noted that some lots did not justify placement of
swimming pools,iand this might be one of those. The LDC explained to
the applicant that they were looking for minimal impact with placement
of a pool. Cliff Beck, the applicant's engineer, stated that possibly
they could build a smaller pool, but this might generate more excava-
tion outside of the property line, particularly if it were rotated. He
then stated that, as proposed now, the pool would have a balanced
amount of grading, but if it were rotated, dirt would need to be
exported.
Mr. Wise asked the Committee what their primary concern was, and the
LDC responded that it was both the wall surface area and the height of
the wall. Discussion of options then ensued, with the observation
that the geology, on the site had not been reviewed. Mr. Harison stated
that this area was designated SLS, and, therefore, a report would be
required, with the City's Geologist's review and approval, and a hold -
harmless statement. Mr. Wise explained that what he was looking for
was a reflection pool, and that he possibly could live with a different
shaped pool. TYe Committee explained that they would want to see the
geology approved prior to any sort of Land Development Committee
approval. Options of shortening and narrowing the pool, rotating it,
and decreasing the distance from the house, were mentioned.
It was then directed that this item be removed from the agenda, to be
reagendized when the applicant'has submitted new plans that he felt
were in conformance with the stated desires of the LDC.
V. ADJOURNMENT
It was moved and seconded to adjourn the meeting. The motion was
carried unanimously.
