B. Minutes
It was moved and seconded to waive the reading of the minutes of April 5, 1979
and approve as distributed. The motion was carried, with Commissioner Zambetti
abstaining since he was not present at the meeting.
II. BUILDING SITES /SUBDIVISIONS
A. SDR -1353 - Richard and Victoria Ohren, Bank Mill Road, Tentative Building Site
Approval - 1 lot
The applicants and Arthur Anderson, their building designer, were present for the
discussion. Staff explained that the geology had not yet been approved for the
Land Development Committee's review by the City Geologist. Don Wimberly stated
that to date the stability of the site had not been completely determined, and
that further verification of the site would be required. The Ohrens were advised
to have their geologist contact the City Geologist. Since the application has
been before the City the maximum time of one year and ninety days, it was moved
and seconded to conditionally deny SDR -1353, so that the Ohrens might reapply
without fees before the ninety days expired. The motion was carried unanimously.
B. SDR -1415 - Brian Kelly, Live Oak Lane, Tentative Building Site Approval for 2
(Single) Lots
The applicant was present for this discussion, which involved the previous adjacent
site approvals, particularly with respect to the road width and right -of -way
conditioned for the subject site approval. A condition to "Comply with the
requirements of Saratoga Fire District" was added to the site approval, in case
there had been agreements with the adjacent property owners and the Fire District
on development of these 2 lots. Staff also mentioned that construction of any
multi -story structures would require an "adjacent or contiguous" multi -story
structure.
A motion was made and seconded to approve SDR -1415, for 2 single lots of record,
for building site approval, per the amended Staff Report dated April 18, 1979.
The motion was carried unanimously.
III. MISCELLANEOUS
A. William Regitz, 21451 Mt. Eden Court, Modification of Site Development Plan for a
Pool and Stable
A representative from Aquarian Pools was present for this discussion, which
involved the ordinance - required location of the stable and the general concept
of allowing horses above residences with respect to drainage. It was determined
that, as long as the ordinance exists to permit it, the Land Development Committee
could not disallow this stable. After discussion of the drainage for the site,
it was moved and seconded to approve the pool and stable location, subject to
receipt of a map reviewed and approved by the Planning, Inspection Services and
Public Works Departments, and the condition that "Drainage of the total lot is to
be made satisfactory to the Inspection Services and Public Works Departments." The
motion was carried unanimously.

IV. CC44TNICATIONS
Written
- 7 SDR -1329 - Joseph Krajeska, Vista Regina, Request for one- �e_aarextension -
It was moved and seconded to approve the one -year extension, per the taff Report
dated September 19, 1977, amended as follows: Add Conditions III -E and F, to read:
III -E - "A drainage plan shall be prepared. prior to final map approval. This
plan shall address all waters reaching, created by, and leaving the site.
Storm drain easements (private or public) may be provided."
III -F - "Prior to final map approval, all existing structures shall be inspected
by a licensed architect or engineer for code compliance. The report of findings
is to be submitted to the City. Deficiencies are to be corrected. Bond to
guarantee correction is to be posted."
The motion was carried unanimously.
