I. ROUTINE ORGANIZATION

Minutes
It was moved and seconded to waive the reading of the minutes of the
meeting of June 5, 1980 and approve as distributed. The motion was
carried unanimously.
II. COMMUNICATIONS
A. SDR -1377 - Cocciardi (William Clark), Walnut Avenue at Saratoga -
Sunnyvale Road, Reconsideration of Condition II -B
Mr. Robinson expressed a desire to see the improvements done,
while ensuring that the trees were saved. Mr. Shook explained
that the improvement proposed was for asphalt curbing with no
sidewalk. He noted that it could be handled similar to that of
the Saratoga Oaks subdivision, where there were capped holes
placed in the asphalt in order to ensure the livelihood of the
trees. The Committee then reviewed the improvement plans for the
project. The applicant, Mr. Clark, questioned the need for a
50 ft. right -of -way, given that the surrounding properties have
not dedicated such a right -of -way. Mr. Robinson explained that
those properties had been developed earlier. Mr. Clark expressed
a desire for a Deferred Improvement Agreement, so that the improve-
ment could be done when it was needed. He then noted that the
City sidewalk was on his lot and expressed a desire to trade an
easement to the City for that improvement on the condition that
the existing roadway was sufficient. Mr. Shook explained that the
40 or 50 ft. right -of -way did not mean that the improvements would
be that wide. Additionally, the improvements in question took
place on Walnut, rather than on Saratoga - Sunnyvale Road, so that
CalTrans has little to do with this requirement.
Mr. Clark stated that aesthetically the required improvement would
look silly and stick out like a sore thumb. He stated that he
would like to keep the trees; however, if the City pushes him to it
someone might chop the trees down. Dan Trinidad explained that the
improvement plans show that the trees are to remain, with the
improvement width of 36 ft., including a 10 ft. travel lane and an
8 ft. parking lane on each side. Mr. Clark stated that the site
approval package was not pointed out to him when he bought the
property. After a short discussion on residency and the post
office, Mr. Clark again noted the sidewalk on his property and
stated his desire to enter into negotiations to leave it or have
it removed. Mr. Shook then explained to the applicant that he
should write a letter stating such.
The Committee then stated that they did not wish to revise Condition
II -B, and that if the applicant wished to go further with this
matter, a letter to the Council would be appropriate.

B. SDR -1460 - Tompkins Associates, Brookwood Lane, Preliminary
Map Review - 3 lots
Mr. Guthrie Schwarz was present for the discussion and asked
that the following be put in the record: That he had met with
the Staff and shown them the letter from the Santa Clara Valley
Water District listing four alternative proposals to decrease
the area subject to inundation. In particular, he had presented
the berm alternative in plan form to the Staff, who had expressed
a feeling that it would be an inappropriate solution for Saratoga.
The LDC then explained to Mr. Schwarz that his next step could
be to make a formal application with the City and then, if denied,
appeal that item to the City Council. Essentially at this time
the LDC indicated their rejection of the proposed berm alternative.
III. ADJOURNMENT
The motion was made and seconded to adjourn the meeting; it was carried
unanimously.
