R. S. Robinson accepted the minutes of September 18, 19;8.0 as correct,
since he was the only committee member present at. that time.
II. SINGLE SITE APPROVAL PER ORDINANCE NO: 60.OS
A. SDR- 1474- John Fetch, 20221,.Thelma, Tentative Building Site Approval -
1 Lot (over SOo expansion); Continued from,9 /18/80
The applicant, John Felch, was present for the .discusslion. Staff
explained that the proposed site approval was an over '50o expansion
of the existing house; and the matter had .been continued several
times =for lack' of a 20' x, :20''ga'rage. The present plans.were ade-
quate, although Mr. Robinson.indicated that the correct interior .
dimensi:ons`-of the garage need.ed.,to be. shown on the.building plans:
Staff commented 'that the present' res.iden.ce was` hooked up to sewer
and the only concerns related.to ensuring that =the house was evaluated
for code conformance. and that it did'not create . any drainage problem..
When asked. if he had any concerns over the approval conditions, the
applicant stated that he did -not.
It was moved and seconded.to - approve. SDR -1474 per the Staff Report
dated August 19, 1980. The motion was carried unanimously.
III. PUBLIC HEARINGS
A. SDR -1463. - Gerald Jacobsen—Negative Declaration
B. SDR -1463 - Gerald Jacobsen, S,obey Road.,' Tentative Building. Site
Approval'- 2 lots; Continued from 9/18/80
The above two items were'discussed.together. Staff explained that
the applicants stated they had met several times with th.e:: :neighbors,
attempting to obtain enough land to build a public right =of -way; The
neighbors had been uncooperative and, therefore;.at this-ti:me.the
applicants were requesting an exception to*the'Subdivi,sion.`Ordinance
in order to place, a fifth lot on -a minimum access road:`'fihe applicants
were interested in having th.e LDC t ac on,the item at this meeting..
The public hearing was reopened at. 10:1S a.m.
Jonathan Roeloffs explained that the applicant had been unable to
obtain the.right -of -way and was asking for the. exception. Mr. Dick
Kier, the applicant's engineer, felt that the applicant had`no
alternative. Mrs. Laden.exp.lained that the LDC was unable to grant
such an exception and that the'City Council would be ,the appropriate
body to do so, if it so desired; the LDC'has not been a policy - making.
body.

It was moved and seconded to close the public hearing. The motion was
carried unanimously.
A motion was made and seconded to deny SDR -1463 as inconsistent with the
General Plan, per the Staff Report dated August 6, 1980. The motion was
carried, with Mr. Shook (who arrived at this point) abstaining.
C. SDR -1470 - Dick Gabler - Negative Declaration
D. SDR -1470 - Dick Gabler, Piedmont and Park, Tentative Building Site
Approval - 2 lots; Continued from 9/18/80
The above two items were discussed together. Staff explained that they
had received a new map on Tuesday, which showed the new Santa Clara
Valley Water District easement, and stated that the slope underneath
the proposed house did not exceed 310, at its worst. However, Staff
stated that they wish to receive such a map with the engineer's RCE
number and signature placed on it, in order to issue the Staff Report.
The public hearing was reopened at 10:22 a.m., with Mr. Gabler and Mr.
Ed Stelling present for the discussion. Mr. Gabler indurated that he
had no comments, and it was directed that the public hearing be continued
to October 16, 1980.
E. SDR -1475 - Helen Amato - Negative Declaration
F. SDR -1475 - Helen Amato, Saratoga Avenue, Tentative Building Site Approval
4 lots
The above two items were discussed simultaneously. Staff explained that
the applicant was requesting approval for a 4 -lot split on Saratoga
Avenue in the R- 1- 10,000 zoning district. Its major concerns with the
site involved the drainage on the flat site, as well as the potential
removal of several large ornamental trees and some exceptionally large
eucalyptus trees in the buildable area of the proposed lots. Mr. Shook
stated that, additionally, the proposed rainage may not be acceptable to
the LDC.
The public hearing was opened at 10:30 a.m., with Mrs. Amato, her son,
and the engineer, Marvin Kirkeby, present for the discussion. The
applicant's engineer explained that the street was shown as proposed in
order to create a usable back yard for the existing residence. The
LDC noted a potential trade -off might be involved in moving the street
in order to save a few ornamental trees versus the subdivision of the
lots. The LDC also questioned the square footage of the lot shown on
the map and determined that they were gross rather than net square
footages.
At this point the LDC indicated a desire to go out and see the site and
continue the item to their next meeting. It was directed that this item
be continued to the meeting on October 16, 1980.
IV. MISCELLANEOUS
A. Tract 1318 - Lot 39 - Mr. and Mrs. R. G. Duffin, Request for a Modifica-
tion to the Site Development Plan for a Spa and Decking
Staff explained that the applicant was requesting a modification in order
to place a spa and 200 ft. of decking on the site which had a slope of
over 10%. The LDC reviewed the plans, and it was moved and seconded to
approve Exhibit "F", of Tract 1318. The motion was carried unanimously.
V. ADJOURNMENT
It was moved and seconded to adjourn the meeting. The motion was carried
unanimously.
