MINUTES

I. ROUTINE ORGANIZATION
A. Roll Call
Committee Members: R. S. Shook, R. S. Robinson, and Commissioner
Zambetti (arrived at 10:00 a.m.)

B. Minutes
It was moved and seconded to waive the reading of the minutes of
December 6, 1979 and approve them as distributed. The motion was
carried unanimously:
II., SINGLE SITE APPROVAL•PER ORDINANCE'NO. 60.OS,
A.. SDR -1442 - Spencer Profit, Norton Road & Kittridge, Tentative
Buildinz Site Approval 1 Lot
Mr. Profit was present for the discussion. Staff explained that the
site had received an exception for a septic tank system from the
Planning Commission, and that the geology had been approved by the
City Geologist. The LDC.reviewed the map and the elevations, noting
the square footage of the building. It was moved and seconded to
approve SDR -1442 per the Staff Report dated December 14, 1979 and
Exhibit "B" filed November 15, 1979. The motion was.carried unani-
mously.
B: SDR -1445 - Peter Noonan, Pike Road, Tentative Building Site Approval
1 Lot
Mr. Shook noted that Staff was requesting additional information, and
it was directed that the item be continued to the meeting of January
3, 1980.
III. - BUILDING SITES /SUBDIVISIONS
A. SDR -1425 - Church of Jesus Christ of Latter Day Saints, Allendale
and Camino Barco,. Tentative Building Site Approval -
2 Lots
Staff explained that this involves a lot split on Camino Barco of
the church property which contained a. riparian area and a playing
field.
The.public hearing was opened at 9:18 a.m.
Walter Muir, of 14156 Shorthill Court, commented that it was the
church's intent to divide the property in order to split off and
sell its extra acreage. Colonel Barco, of 19101 Camino Barco,
presented his concerns: (1) the church was creating a gerrymandering
situation, and (2) the house being built on a lot with 50 -.60 trees
(some of which are magnificent) and numbers of quail, doves, birds
and rabbits. He pointed out that the other side of the creek had
been developed with the houses pulled back from.the creek because of
the ecology, as well as soil instability. He then reminded the
Committee of the drainage problems in the area, specifically, that
there had been water on his property, and that the proposed driveway

might endanger the situation. Finally, he expressed concern about
the use of the playing field, and that it was not consistent with
the residential character of the neighborhood.
Tom Thorkelson, of 19155 Camino . Barco, spoke to the obvious shoe-
horning of a lot with serious environmental concerns. Barbara
Balboni,-of 19100 Camino Barco, questioned the $4,000- $5,000 of.
improvement costs that they had paid when they had bought their lot
for the minimum access street, and wondered whether or not it was to
be abandoned. Mr. Shook responded that the Committee had.an option
as to whether or not to abandon that street.
The Committee then discussed the use permit that had been granted the
church and commented that the noise.from the playing field would be
reviewed.
Mr. Muir explained that the church was interested in preserving the
playing field.. He observed that the church was having-difficulty
controlling who used the playing field, and that much of the noise
was created by neighbors using the field: He pointed out that the
proposed building site was spectacular in its woodland environment.
At this point Mr. Robinson suggested that the Committee make an on-
site inspection before making its decision. Dr. Hardy, of 20561
Montalvo Lane, stated that the flooding was not a problem on the
site, and that certainly the double culvert and curb should handle
the problem. Colonel Barco stated that the road had not been flooded
since a new road and culvert had been.put in'.
The Committee then determined that they would make an on -site visit
during the week of January-7, 1980, and it was directed that the item
-be continued to the meeting of January 17, 1980. The.church was to
be advised of the time of the visit.
B. SDR -1443 - Charles Reed, Quito Road, Tentative Building Site Approval
2 Lots
Staff explained that this item involved a lot split for a 2 -acre
parcel in the R -1- 40,000 area off of Quito.Road. The major concern
involved the proposed,acces's: which was through an adjoining lot. The
public hearing was opened at 10:00 a.m.
Mr. Good, of 14391 Quito Ro'ad., noted that the proposed access was
through an easement across his property, and that he had not yet
been contacted by the developer. Mr. Kier, of Kier and Wright engineers
explained that the proposed access would not remove anything but would
widen and improve the lower driveway., Additionally, the conditions
might require some work near Quito Road to improve the access. Mr.
Shook suggested that the applicant and Mr. Good meet to work out the
access. He requested that the map be.improved to show the trees and
monuments near the access to better.illustra,te to Mr. Good what was
proposed. The hearing was then continued for a short time to allow
Mr. Kier to review the Staff Report for any questions.
The hearing was reopened at 10:10.a.m., and no further comments were
made by the applicant's engineer. It was directed to continue this
item to January 17, 1980.
IV. MISCELLANEOUS
A. 21485 Saratoga Hills, Mr. and Mrs. Scheuermann, Modification to Site
Development Plan
Mr. Scheuermann was present for the discussion. The Committee

explained that they had vi -sited the site, and that they had, concerns
about where the pool was to be located as it would be viewed from
the flatlands of-Saratoga. Mr. Scheuermann stated that their
original plans had shown a pool in'the flatter lower area, and.t,hat
he would be agreeable to any kind of landscaping to visual.ly'screen
the pool and walls from the lower areas. ,After much discussion,
Mr. Scheu.ermann agreed to a continuance in order for the plan
showing the pool on the flatter area to be submitted and reviewed
by the Staff. It was explained that the.bathhouse.should be located
on an area where the slope di;d not exceed.4-00 It was directed that
this item be continued to January 3,1980.
B. SDR -1328 - Western Finfance (Wong), Saratoga. - "Sunnyvale Road, Request
for a One -Year Extension - 3 Lots
The LDC reviewed the conditions from.the previous Staff Report`; and
it was moved and seconded to grant a ". one- year-extens`ion for SDR -1328.
The motion was carried unanimously.
C. 23- 18- 59 -78S - Ronald Cone.,. Mt. Eden Road, Review of County Con -
ditions of Tentative Building `Site Approval prior
to Annexation to City of Saratoga - 2,Lots
The applicant was not present at the time of discussion on this item.
It was directed that this item be continued to the January 3, 1980
in order for the applicant to be present.
D.. SDR -1366 - Bert Reid, B`ohlman Road, Request: for. -a One -Year' Extension
1 Lot
The Committee reviewed the Staff Report for the subject site and
also additional conditions from the Inspection Services Department.
It was moved and seconded to grant a one. -year extension, with the
following conditions to be adde -d to the Staff Report dated May 31,
1978: Condition III -I, to read: "Leachfi.eld - shall be constructed
in such a way as to minimize environmental impact. A detailed con-
struction plan is to be submitted to and approved by City prior to
construction." Condition III -.J', to read: "The existing non- engineered
fill,along several slopes is to be- removed or adequately retained ,.
if structures or the driveway are t,o be placed on it." Condition
III -K, to read: "Grading, drainage and foundation plans are to be:
prepared by a licensed civil engineer." The motion was carried unani'-.
mously.
E. SDR -1301 - Benjamin Yates (Horvath), Blue Gum Court, Request for
Modification to Site Development Plan - 2 Lots
Mr. Horvath was present for the discussion. Staff explained that
Mr. Horvath had submitted building plans which eliminated a turnaround
area for the Fire Department on one of the lots. In discussions
with. the Central Fire Department, Mr. Horvath had,created a minimum
access road in lieu of the turnaround area.- However,'this minimum
access road would cause considerable amounts .of grading, . and -Staff no
longer felt that the plan was in conformance with.the originally
approved site development plan. The Committee reviewed and discussed
the previous site.development plan and the :proposed plan, suggesting
that the minimum access proposal would not be acceptable. They then
presented three options to Mr. Horvath: (l) reconfigure the garage
turnaround and pool, (2) submit a detailed plan showing the implica-
tions of the proposed minimum access road plan'. and (3) submit the
original house plan for Committee review, showing how visible it
would be from Sobey Road. It was directed to continue the item to
January 17, 1980.

V. COMMUNICATIONS
A. SDR -1397 - David Bamberg, Saratoga - Sunnyvale Road - 3 Lots, Request
for Interpretation
The Planning Director explained that one of the conditions under the
site approval called for removal of the gasoline tank on site. How-
ever, in discussions with the Fire Chief, an alternative would be
to fill them with sand. The Planning Director requested that the
LDC approve this as an alternative. It was moved and seconded to
do so, and the motion was carried unanimously.
VI. ADJOURNMENT
It was moved and seconded to adjourn the meeting. The motion was carried
unanimously.
