WEDNESDAY, MAY 17, 2017
SARATOGA CITY COUNCIL REGULAR MEETING
At 5:00 p.m., the City Council held a Closed Session in the Administrative Conference Room at
Saratoga City Hall at 13777 Fruitvale Avenue.
At 6:00 p.m., the City Council held a Joint meeting with Santa Clara County Supervisor Joe
Simitian in City Hall, Administrative Conference Room at 13777 Fruitvale Avenue in Saratoga.
At 7:02 p.m., Mayor Lo called the regular session to order in the Civic Theater at 13777
Fruitvale Avenue in Saratoga and led the Pledge of Allegiance.

REPORT ON POSTING OF THE AGENDA
Crystal Bothelio, City Clerk/Asst. to the City Manager, reported that the agenda for this meeting
was properly posted on May 12, 2017.
REPORT FROM CLOSED SESSION
Mayor Lo announced that there was nothing to report from Closed Session.
REPORT FROM JOINT MEETING
Santa Clara County Supervisor Joe Simitian provided an overview of the City Council’s Joint
Meeting, including the many projects the County and the City are working on together. There
were discussions about senior transportation, Hakone Gardens, airplane noise and the FAA, and
the Santa Clara wine trail.
ORAL COMMUNICATIONS ON NON-AGENDIZED ITEMS
Rita Benton spoke about the San Jose Water Company and water rates.
ANNOUNCEMENTS
Mayor Lo announced that the Second Harvest Food bank recognized the City with a Bronze
Award for the City’s annual Food Drive, which donated 4,000 pounds for food. She also
announced that the America in Bloom judges will be touring Saratoga May 17 through 19 and
that there is a community dinner on Friday, May 19 at Bella Saratoga. Mayor Lo also announced
that on May 21 is the Hakone Matsuri festival, May 23 is the Living Room Conversations
meeting, and May 29 is the Memorial Day event starting at Blaney Plaza and hosted by the
Saratoga Foothill Club. May is Heritage Month and there are many events about Saratoga’s
History, including a lecture on May 20 at the Saratoga Library.
CEREMONIAL ITEMS
Commendations Recognizing Outgoing Youth Commissioners
Recommended Action:
Receive presentation on efforts of the Youth Commission during the 2016/17 school year and
present commendations to Charles Debling, Sathvik Kaliyur, Aneesh Medhekar, Elora Pradhan,
and Shefali Vijay recognizing their service on the Saratoga Youth Commission.
The City Council received the presentation by the Youth Commission. Mayor Lo and members
of the Saratoga City Council presented the commendations to Charles Debling, Sathvik Kaliyur,
Aneesh Medhekar, Elora Pradhan, and Shefali Vijay.
Appointment of Youth Commissioners and Oath of Office
Recommended Action:
Approve the attached resolution appointing 5 members to the Saratoga Youth Commission and
direct the City Clerk to administer the Oath of Office.

Proclamation Declaring May 20, 2017 as Kids to Parks Day and Commendation Recognizing the

Recommended Action:
Present the proclamations to the Saratoga Parks & Recreation Commission
Mayor Lo and members of the Saratoga City Council presented the proclamation and
commendation to the Saratoga Parks & Recreation Commission.

1.3. Document Scanning Services – Extension of Contract
Recommended Action:
Move to accept an amendment to extend the contract for City document scanning services
with Peelle Technologies for an additional 3 years through to June 30, 2020.

Recommended Action:
Move to accept an amendment to the contract for Citywide traffic signals, lighted
crosswalks and rectangular rapid flash beacons (RRFBs) maintenance & callout repair
services with Siemens Industry, Inc. for an additional 3 years through to June 30, 2020 with
a revised scope and payment terms.

Recommended Action:
Move to extend Street Sweeping Contract to Contract Sweeping Service from July 1, 2017
to June 30, 2018 in the amount of $186,558.00.

Adopt resolution supporting the Metropolitan Transportation Commission’s Transportation
Development Act Article 3 Pedestrian/Bicycle Grant Application for the Saratoga Avenue
Walkway Project.
RESOLUTION 17-027
MILLER/CAPPELLO MOVED TO ADOPT RESOLUTION SUPPORTING THE
METROPOLITAN TRANSPORTATION COMMISSION’S TRANSPORTATION
DEVELOPMENT ACT ARTICLE 3 PEDESTRIAN/BICYCLE GRANT
APPLICATION FOR THE SARATOGA AVENUE WALKWAY PROJECT.

2. PUBLIC HEARING
2.1. Declaration of Public Nuisance – Weed Abatement Program
Recommended Action:
Conduct public hearing, receive public testimony and consider requests to remove
properties from the nuisance declaration, and adopt resolution declaring hazardous
vegetation (weeds) on properties specified in the resolution (or as amended) to be a public
nuisance.

RESOLUTION 17-028
MILLER/BERNALD MOVED TO ADOPT RESOLUTION DECLARING
HAZARDOUS VEGETATION (WEEDS) ON PROPERTIES SPECIFIED IN THE
RESOLUTION TO BE A PUBLIC NUISANCE WITH PARCEL NUMBER 503-13-
128 REMOVED AND 503-16-015 IDENTIFIED AS A PROVISIONAL NUISANCE.

2.2. Ordinance Regarding Commercial Marijuana Activity and Marijuana Cultivation
Recommended Action:
1) Conduct a public hearing concerning the attached ordinance that would (a) prohibit the
establishment of commercial marijuana activity within the City limits; (b) prohibit all
outdoor cultivation of marijuana; and (c) regulate the indoor cultivation of marijuana for
personal use permitted by State law; and
2) Introduce and waive the first reading of the ordinance and direct staff to place the
ordinance on the consent calendar for adoption at the next regularly scheduled meeting
of City Council.

ORDINANCE ON THE CONSENT CALENDAR FOR ADOPTION AT THE NEXT
REGULAR MEETING OF THE CITY COUNCIL AND DIRECTED STAFF TO
BRING BACK A REPORT ON OUTDOOR CULTIVATION OF MEDICAL
MARIJUANA IN THE FALL. MOTION PASSED. AYES: LO, BERNALD,
CAPPELLO, MILLER, KUMAR. NOES: NONE. ABSTAIN: NONE. ABSENT: NONE.
2.3. Fiscal Year 2017/18 Proposed Operating & Capital Budget
Recommended Action:
Conduct a public hearing on the proposed FY 2017/18 Operating & Capital Budgets, and
provide direction to staff for budget adoption on June 7, 2017.

item. Tony McFarlane, Finance Manager, also presented a report.

MILLER/BERNALD MOVED TO DIRECT STAFF TO PLACE THE FY 2017/18
OPERATING & CAPITAL BUDGETS ON THE CONSENT CALENDAR FOR
ADOPTION AT THE NEXT REGULAR MEETING OF THE CITY COUNCIL
WITH RECOMMENDED FINANCE COMMITTEE CHANGES TO THE
SARATOGA-TO-THE-SEA TRAIL AND HAKONE GARDENS KOI POND
IMPROVEMENTS CAPITAL PROJECTS, AS WELL FUNDING FOR THE
NEIGHBORHOOD WATCH GRANT PROGRAM AT $300 PER GROUP. MOTION

3. GENERAL BUSINESS
3.1. Saratoga Senior Coordinating Council Support and Facility Use Renewal
Recommended Action:
Authorize the City Manager to execute the Agreement for Support and Use of Facilities
with the Saratoga Area Senior Coordinating Council.

CAPPELLO/MILLER MOVED TO AUTHORIZE THE CITY MANAGER TO
EXECUTE THE AGREEMENT FOR SUPPORT AND USE OF FACILITIES WITH
THE SARATOGA AREA SENIOR COORDINATING COUNCIL AND DIRECTED
STAFF TO PLACE A RESOLUTION AFFIRMING THE RECITALS IN THE
EXISTING AGREEMENT ON THE NEXT REGULAR MEETING FOR
ADOPTION.
City Attorney Richard Taylor recommended placing the agreement and resolution on the
Consent Calendar of the next regular meeting for adoption.
Council Member Cappello, with consent from Council Member Miller, revised his motion.

COUNCIL ASSIGNMENTS
Mayor Emily Lo
Hakone Foundation Board & Executive Committee – Hakone will be hosting the America in
Bloom judges on Friday morning. Also, Hakone Matsuri festival is on May 21. The County has
proposed a $100,000 matching grant to Hakone for the filtration system.
KSAR Community Access TV Board – staff member Lauren Pettipiece has been approved as
Treasurer and the Board continues to work on the Community Loop program.
Public Art Committee –Jerry Smith, the artist for the Peck bronzes has passed away. Jerry had
handed over logistics for the project to another artist before he passed away.
Santa Clara County Library Joint Powers Authority – during the May 4 meeting, the Board
received the audit report ending June 2016 and discussed the preliminary FY 2017/18 budget and
will consider for adoption at next meeting. On May 26, Mayor Lo was on an interview panel for
a Director level position at the County Library.
West Valley Mayors and Managers – meeting is next week.
Mayor Lo and Vice Mayor Bernald attended an event for the 60th Anniversary of Monte Sereno.
Vice Mayor Mary-Lynne Bernald
Cities Association of Santa Clara County-Legislative Action Committee – there are currently 130
Housing Bills being considered at the State. The Legislative Action Committee considered some
of these bills as well as several others during the May 11, 2017 meeting.
West Valley Solid Waste Management Joint Powers Authority – rates were ratified during the last
meeting.
Council Member Manny Cappello
Cities Association of Santa Clara County – Council Member Cappello attended the May 11
meeting with several other Council Members and the City Manager. There was a guest speaker
on Immigration Law and Congressman Ro Khanna spoke.
Saratoga Area Senior Coordinating Council (SASCC) – there is a meeting next week.
West Valley Sanitation District – had a closed session during the last meeting, there was nothing
to report.
Congresswoman Anna Eshoo hosted an event at Moffet Field last week announcing
appointments to the various military academy, which included a young man from the Los Gatos-
Saratoga Union High School District who will be attending the Naval Academy in the fall.
Council Member Howard Miller
America in Bloom Committee – Council Member Miller will be leading a tour of Saratoga parks
for the America in Bloom judges tomorrow.
Silicon Valley Clean Energy Authority Board of Directors – all businesses and 20 % of residents
have been enrolled in the program. Complaints regarding the program can be referred to Council
Member Miller. During the Executive Director’s review, there were many notable
accomplishments. This includes the authority’s financials and procurement of 2 years’ worth of
100 percent greenhouse gas energy.
Valley Transportation Authority (VTA) Policy Advisory Committee – Largest item of discussion
was the proposed new fare structure in support of Next Network. The Next Network was adopted
by the VTA Board.
VTA State Route 85 Corridor Policy Advisory Board – meets next week.
Council Member Rishi Kumar
Saratoga Chamber of Commerce & Destination Saratoga- meeting last week. Village Design
plan was discussed and Community Development Director Erwin Ordonez recommended that
the Chamber members attend the Planning Commission meetings on the subject.
Last month San Jose Water removed the drought surcharge from water bills. Also, the CPUC
rejected a rate increase for San Jose Water, due in part to letters from residents.

CITY MANAGER'S REPORT
None
Regular session concluded at 10:00 p.m. and the City Council proceed to Study Session in
Administrative Conference Room.
STUDY SESSION
Study Session on City Council Norms of Operation
Recommended Action:
Discuss and review City Council Norms of Operation.
The City Council discussed the Council Norms of Operations, City Council Member
behaviors, and desired changes to the Council Norms.
The City Council agreed to direct staff to prepare an amendment to the City Council Norms
of Operation that would clarify the Mayor’s discretion in making announcements and
announcements should be related to City or City sponsored events and activities.
