A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
DECLARING ABATEMENT OF A PUBLIC NUISANCE AS TO
SPECIFIED PROPERTIES CONTAINING HAZARDOUS VEGETATION
WHEREAS, the Saratoga City Council declared hazardous vegetation to be a public
nuisance on specified properties and set a deadline to correct the nuisance through adoption of
Resolution 17-028 at the May 17, 2017 City Council Meeting; and
WHEREAS, the City of Saratoga gave notice to all property owners of specified properties
identified as containing hazardous vegetation (weeds) described by common name or reference to
the tract, block, lot, code area, and parcel number on the report prepared by and on file in the Office
of the City Clerk and of the Santa Clara County Weed Abatement Program; and
WHEREAS, the City of Saratoga published a Notice to Abate in the Saratoga News on
May 26, 2017; and
WHEREAS, the notice sent to owners of properties specified in Exhibit A, attached to this
resolution, that the City Council would hold a public hearing on July 5, 2017 to consider any
protests or objections to the order for abatement authorizing the Santa Clara County Weed
Abatement Program to perform the abatement; and
WHEREAS, final action on any protests or objections to the proposed removal of weeds
has been made by the City Council;
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga hereby
resolves the following:
1. That weeds, brush, and/or rubbish that create a fire hazard and/or health hazard have been
declared a public nuisance;
2. A Notice to Abate was sent to property owners that failed to meet Weed Abatement
Requirements on May 18, 2017 and printed in the Saratoga News on May 26, 2017;
3. The deadline to correct the nuisance on properties identified in the Resolution Declaring a
Public Nuisance on Specified Properties was June 18, 2017;
4. Properties identified in the attached Exhibit A to this resolution failed to meet the June 18,
2017 deadline and are subject to a $60 Initial Inspection Fee, $485 Failed Inspection Fee,
$434 Contract Work Fee, and actual costs of abatement work; and
5. The Santa Clara County Weed Abatement Program is hereby designated as the responsible
party to, and is directed to, cause abatement of the seasonal and recurring hazardous
vegetation (weeds and brush) nuisance on the specified properties identified in Exhibit A
to this resolution.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 5th day of July 2017 by the following vote:
