HomeMy WebLinkAbout2nd Unit CCCity Council December 21, 2016 Second Unit Ordinance Background •September 2016 Legislature enacted SB 1069, AB 2299 & AB2506 •Effective on January 1, 2017 •Affect City’s ability to regulate second dwelling units Existing 2nd Unit Regulations •Allowed on lots w/ 90-percent of zoning district minimum lot size •Approved via staff approval unless Planning Commission review required by Code (e.g. structures > 6,000 square feet or w/ other required approvals) •1 additional covered parking space required •Covered parking requirement may be waived w/ deed restriction for Below Market Rate unit •10% Floor Area bonus w/ deed restriction for Below Market Rate unit •Must meet setbacks and development standards •May not exceed 1,200 square feet or 2-bedrooms •Must match main structure in color, materials & architectural design •Shall be served by the same driveway access as the existing main dwelling •May be attached or detached •Attached unit served by a common entrance or another on the side or at the rear New Accessory Dwelling Unit Amendments •Changes to Accessory Dwelling Units (ADU’s) •Mandates only ministerial review of ADU •Allows one ADU “By Right” located on a lot w/ an existing single-family dwelling •Allows a maximum 1,200 square foot size for the ADU •Prohibits the separate sale of the ADU from the main house. •Allows either an attached or detached ADU •Allows reduced setbacks (5 ft. from rear or side lot lines) for the ADU constructed above and existing garage. New Accessory Dwelling Unit Amendment (Cont.) •Waives any parking requirements if the ADU is: 1)Within ½ mile of public transit 2)Located in architecturally and historically significant historic district 3)Unit is already part of main dwelling or existing structure 4)When parking permits are required by not provided to occupant 5)Within 1 block of car share vehicle •Requires 120-day review of the ADU (ministerial permit approval) •Requires ADU be treated the same as main dwelling (i.e. fire sprinklers, utilities, etc.) •Allows Junior ADU (i.e. an attached ADU) in existing single family residential units RECOMMENDED ACTION: 1.Conduct a public hearing. 2.Introduce and waive the first reading of the ordinance. 3.Direct staff to place the ordinance on the Consent Calendar for adoption at the next regular meeting of the City Council.
