STAFF RECOMMENDATION: Adopt Resolution No. 14-007 approving the project subject to conditions of approval. Sign Permit approval by the Planning Commission is required pursuant to City Code Sections 15-30.150(c)(1)(a & b). HPC Recommendation On February 11, 2014, the Heritage Preservation Commission recommended approval of the proposed sign program. Sign Program Overview The purpose of a sign program is to achieve a consistent sign theme and visual harmony on a site. The total area of all permanent signs governed by a sign program may not be greater than the total area allowed per the sign ordinance. However, a sign program may include exceptions to the sign ordinance with regard to the number, size (e.g., height), design, and illumination of individual permanent signs erected and maintained on a property. Signs which are not visible from an adjacent property, public right-of-way, or public parking lot are not governed by the sign ordinance or sign program. Site Description The Fatima Villa site has street frontage on Oak Street and Saratoga-Los Gatos Road, as shown on page 8 of the sign program. Cars enter the site from Saratoga-Los Gatos Road and exit the site on Oak Street. The site currently has one sign located near the Saratoga-Los Gatos Road entrance which will be replaced by a new sign of approximately the same size and location. There are currently no identification signs on Oak Street. Sign Program Description On lots with institutional uses, the City Code allows up to two permanent freestanding sign(s) per street frontage; forty square feet in area (aggregate). The City Code also allows any number of permanent building signs up to ten square feet in area (individual) and forty square feet in area (aggregate). The proposed sign program includes one 20 square foot illuminated freestanding sign near the Saratoga-Los Gatos Road entrance, one 6.77 square foot illuminated freestanding sign near the facility’s Oak Street exit, and one 12 square foot non-illuminated freestanding sign near the building which is closest to Saratoga-Los Gatos Road. Also included in the sign program is one non- illuminated 4.69 square foot projecting sign on the building closest to Oak Street. The Planning Commission shall grant approval of a sign program if all of the following findings are made: (1) The total area of all permanent signs governed by the sign program is not greater than the total area of all permanent signs otherwise allowed on the lot per City Code Article 15-30. The proposed sign program meets this finding. The aggregate area of all permanent freestanding signs will not exceed 40 square feet. No individual permanent building sign will be greater than 10 square feet in area and the aggregate area of all permanent building signs will not exceed 40 square feet. (2) All signs in the sign program are consistent with the applicable specific plan and/or design guidelines for the subject district. This finding is not applicable because there is no specific plan or design guidelines for the project address. (3) The quantity, size, proportion, height, and spacing of signs minimize the perception of clutter. The project meets this finding. The perception of clutter is minimized because the four proposed signs are appropriate in size, proportion, height, and spacing given the size of the property on which they are located. (4) The signs governed by the sign program are compatible with: a) other nearby signs; b) the building and/or site upon which it is located; and c) adjacent structures and the general vicinity. Compatibility shall be determined and limited to the relationships of the elements of form, proportion, scale, color, materials, surface treatment, overall sign size and height, and the size and style of lettering. The stone base of the sign has been designed to blend in with the stone wall near which it will be located. The colors, materials, and surface treatment of the proposed signs are compatible with nearby signs, structures, and the general vicinity. The size, scale, and proportion of the proposed signs are appropriate for the site and compatible with other signs in the general vicinity. Environmental Determination: The proposed sign is Class 11 Categorically Exempt from the Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3. Article 19, Section 15311 (“State CEQA Guidelines”). Class 11 exemptions include on- premise signs. Public Hearing Notification: The project was properly noticed in accordance with City Code Section 15-30.150(d). Sign Program (Exhibit "A") 11 RESOLUTION NO: 14-007 A RESOLUTION OF THE CITY OF SARATOGA PLANNING COMMISSION APPROVING AN APPLICATION FOR A NEW SIGN PROGRAM LOCATED AT 20400 SARATOGA-LOS GATOS ROAD, SARATOGA CA 95070 WHEREAS, on January 29 2014, an application was submitted by Window Graphics Signs on behalf of Fatima Villa requesting approval for a new sign program. The institutional facility has a “Community Facilities” General Plan land use designation and is located within the R-1-10,000 zoning district. WHEREAS, the Community Development Department completed an environmental assessment for the project in accordance with the California Environmental Quality Act (CEQA), and recommends that the Planning Commission determine this project exempt. WHEREAS, on February 11 2014, the Heritage Preservation Commission (HPC) recommended approval of the sign program as proposed. WHEREAS, on March 12, 2014, the Planning Commission held a duly noticed public hearing on the subject application, and considered evidence presented by City Staff, the applicant, and other interested parties. NOW THEREFORE, the Planning Commission of the City of Saratoga hereby finds, determines and resolves as follows: Section 1: The recitals set forth above are true and correct and incorporated herein by reference. Section 2: The proposed sign is Class 11 Categorically Exempt from the Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3. Article 19, Section 15311 (“State CEQA Guidelines”). Class 11 exemptions includes “on premise” signs. Section 3: The project is consistent with the purpose of the City’s Sign Ordinance which is to: ensure high-quality designed signs are compatible with adjacent land uses and preserve the residential character of the City; prevent substandard sign generation and sign clutter which is counterproductive to business and visually unattractive to the community; direct persons to various activities and enterprises in the City; protect the public safety and reduce traffic and safety hazards through proper location and design of signs; and provide a reasonable and constitutional system of sign control including the quantity, type, placement, size, illumination and design of signs. Section 4: The project is consistent with the Saratoga City Code sign program findings in that the total area of all permanent signs governed by the sign program is not greater than the total area of all permanent signs otherwise allowed on the lot by Code; all signs in the sign program are consistent with the applicable specific plan and/or design guidelines for the subject district; the quantity, size, proportion, height, and spacing of signs minimizes the perception of clutter; and the signs governed by the sign program are compatible with: a) other nearby signs; b) the building and/or site upon which it is located; and c) adjacent structures and the general vicinity. 12 Resolution No. 14-007 Section 5: The City of Saratoga Planning Commission hereby approves PSP14-0002 located at 20400 Saratoga-Los Gatos Road subject to the Findings, and Conditions of Approval attached hereto as Exhibit 1. Any modifications to the sign program shall require a new application. 4. Building Permit. Construction plans shall be submitted to the Building Division. These plans shall be subject to review and approval by the City prior to issuance of Zoning Clearance. 5. The owner/applicant shall agree to all conditions required by the Saratoga Building Department. 6. The owner/applicant shall agree to all conditions required by the City Engineer, as applicable. 7. On March 12, 2013, the HPC recommended approval of the proposed externally illuminated monument sign. Project Description Two signs would be mounted together at an approximately 45 degree angle. The sign structure will be constructed of concrete blocks and covered in stucco and granite with a stone base. A 14 square foot granite sign board would be attached to one side of each sign and would be engraved with the words “Hakone Estate and Gardens”. Four “low voltage” (12V) 50W Halogen spot lights will be mounted in the ground adjacent to the sign and pointed toward the sign at a 45-degree incline. The sign will be located outside of the 12-foot visibility triangle of the driveway intersection. A sign permit shall be granted if and only if all of the following findings are made: (1) Each sign complies with the regulations of this Article, including, but not limited to, the provisions set forth in Sections 15-30.030 and 15-30.040. The proposed freestanding sign meets this finding. City Code allows up to two permanent freestanding sign(s) per street frontage on lots with institutional, public, or quasi-public uses. The sign will not exceed 40 square feet in area or ten feet in height. The sign will be required to meet all required construction standards to protect the public safety, including but not limited to its height and location with respect to street and driveway intersections. The sign will be located on the Hakone Estate property. The sign will be legible under normal viewing conditions and maintained in accordance with city code. The letter size, sign height, sign area, sign materials and illumination are in accordance with city code. The freestanding sign will be mounted in accordance with city code. (2) Each sign is consistent with any approved sign program for the subject site. This finding is not applicable because there is no sign program for the property. (3) Each sign is consistent with the applicable specific plan and/or design guidelines for the subject district. This finding is not applicable because there is no specific plan or design guidelines for the project address. (4) The quantity, size, proportion, height, and spacing of signs minimize the perception of clutter. The project meets this finding. The perception of clutter is minimized because the proposed freestanding sign is appropriate in size, proportion, height, and spacing given the size of the property on which it is located. The two signs will be mounted together at a 45- degree angle. Each sign is 17.5 square feet in area and approximately five feet-six inches in height. (5) Each sign is compatible with: a) other nearby signs; and b) the building and/or site upon which it is located; and c) adjacent structures and the general vicinity. Compatibility shall be determined and limited to the relationships of the elements of form, proportion, scale, color, materials, surface treatment, overall sign size, and the size and style of lettering. The project meets this finding in that the signs have been designed to match the aesthetic of the Hakone Estate and Gardens. The sign is located on a large property and is not in close proximity to any other signs that might be incompatible. Environmental Determination: The proposed sign is Class 11 Categorically Exempt from the Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3.
