APPLICATION PSP11-0001 (366-12-072) US Signs / Public Storage, 12299 Saratoga-Sunnyvale Road - The applicant is requesting Planning Commission Sign Approval for two new internally illuminated wall signs for both Public Storage and Allure Beauty located at 12299 Saratoga-Sunnyvale Road. The Public Storage sign would be fabricated with an orange polycarbonate face and black aluminum letter returns, and would include a purple and orange polycarbonate logo box in the upper left hand corner. The Allure Beauty sign would be fabricated with a blue polycarbonate face and white aluminum letter returns. Both signs would be constructed with individual channel letters and low-voltage light emitting diode (LED) lighting on an aluminum raceway support (which would be painted the color of the building). The project location is surrounded by commercial uses to the north, east, and south, with multi-family residential and industrial uses to the west. The property is approximately 3.08 acres in size and located in the Commercial-Visitor (CV) zoning district. APPLICATION PDR11-0008 (403-24-001) AT&T / RealCom, 13686 Quito Road - The applicant is requesting Design Review approval to install three new Long Term Evolution (LTE) panel antennas, six new Remote Radio Units (RRU), one hidden fiber distribution unit and surge protector, and associated cellular equipment. The project also includes the installation of a RBS 6601 repeater within the AT&T equipment shelter. The new antennas and associated cellular equipment would be installed 65 feet above grade onto an existing 115 foot lattice utility tower. There is no proposed increase of height to the existing tower or shelter to accommodate this project. The gross lot size is approximately 1.5 acres and is located in the R1-10,000 zoning district. The new antennas and associated cellular equipment would be installed 60 feet above grade onto an existing 133 foot lattice utility tower. There is no proposed increase of height to the existing tower or shelter to accommodate this project. The utility structure is located on the south of Congress Springs Park and the Railroad Tracks. The gross lot size is approximately 77,000 sq. ft. and is located in the R1-12,500 zoning district. STAFF RECOMMENDATION Approve the Planning Commission Design Review application by adopting the attached Resolution. 7 3 PROJECT DATA ZONING: Commercial-Visitor GENERAL PLAN DESIGNATION: CR (Commercial-Retail) MEASURE G: Not applicable. ENVIRONMENTAL DETERMINATION The proposed project, which includes the proposed installation of two internally illuminated wall signs, is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the Guidelines for Implementation of CEQA. This Class 3 exemption applies to new construction and installation of small, new equipment and facilities in small structures. PROJECT DISCUSSION The City recently approved a monument sign and an addition to the existing commercial building (Public Storage) located at 12299 Saratoga-Sunnyvale Road. The monument sign required a variance because the site had less than five uses. The addition required variance approval due to the continuation and expansion of the existing non-conforming structure. Approval was granted for both entitlement requests on December 22, 2010. The applicant is now requesting Planning Commission approval for two new illuminated wall signs. The approved addition included remodeling the front façade of the building and redesign of the single gable roof structure. The approved design included two new front facing roof gables to be constructed over each retail space. The proposed signs would be located on the wall of the face of the two front facing gables. One sign would be labeled “Allure Beauty” in blue lettering. The other sign would be labeled “Public Storage” in orange lettering. Both signs would include polycarbonate individual channel letters. The applicant is requesting both signs be internally-illuminated with low-voltage LED lighting. Details and images of the proposed signage are shown as Attachment 4. Per City Code Section 15-30.100(a)(1), no sign of any character shall be permitted in the Commercial District that is greater than one-half foot of area for each foot of store frontage. Store frontage of Public Storage is approximately 39 feet and 10.5 inches, allowing 19.93 sq. ft. of signage. Store frontage of Allure Beauty is approximately 20 feet and 11.25 inches, allowing 10.49 sq. ft. of signage. The City of Saratoga allows illuminated signs via Planning Commission approval. Illuminated signs shall be situated so the primary source of light is not visible from off the property and does not cause an annoying glare. Furthermore, the light source shall not exceed over a total of two hundred watts. The proposed illuminated signs are internally illuminated, allowing the primary source of light to be hidden within the sign. Therefore, the light source would not produce any glare. The applicant would use LED lighting, which is a low-voltage type of lighting requiring approximately 12 watts for each sign. Public Storage and Allure Beauty have proposed signs which meet the allowable illumination requirements. Specific Plan Guidelines Public Storage and Allure Beauty are located within the Saratoga-Sunnyvale Road Gateway (Gateway). The Gateway has established design guidelines in order to address private sector redevelopment that is anticipated to occur adjacent to the public street right-of-way on private, commercially zoned property. The proposed signage would be viewed from the public street along Saratoga-Sunnyvale Road. Therefore, Staff has discussed the applicability of the Design Guidelines with the applicant. Staff believes that the project is consistent with the Design Guidelines objectives and guiding principles in that the proposed signage is internally illuminated with low-voltage LED lighting and meets sign regulation requirements of the City Code. Furthermore, the proposed signage will not directly face any residential properties. Correspondence and Neighbor Review Staff had not received signed Neighbor Notification forms from the applicant. The applicant (US Signs) was unable to discuss the project with adjacent property owners prior to submitting their application. This was due to the fact that US Signs is located out of state. US Signs informed Staff they plan on discussing the signage with neighboring property owners on the day of the public hearing. Staff did notice the project within 500 feet of the property line, but has not received comment to date. 9 5 STAFF RECOMMENDATION Staff recommends the Planning Commission approve the proposed illuminated wall signs (Application PSP11-0001) by adopting the attached Resolution. Sign Plans “Exhibit A” 10 CITY OF SARATOGA PLANNING COMMISSION RESOLUTION NO: 11-019 FOR APPROVAL OF DESIGN REVIEW Application Number: PSP11-0001 Public Storage / US Signs - 12299 Saratoga Sunnyvale Road The City of Saratoga Planning Commission finds and determines as follows with respect to the above-described application: I. Project Summary The project includes the installation of two internally illuminated wall signs. One wall sign would be titled “Public Storage” while the other wall sign would be titled “Allure Beauty”. Both signs would include interior light-emitting diode (LED) illumination. The Public Storage sign would be approximately 18.16 sq. ft. in size and would include an orange and purple vinyl face, five inch aluminum returns, and individual channel letters attached to an aluminum raceway. The Allure Beauty sign would be approximately 10.42 sq. ft. in size and would include a blue vinyl face, five inch aluminum letter returns, and individual channel letters attached to an aluminum raceway. Both signs would have internal LED illumination. The foregoing work is described as the “Project” in this Resolution. II. Design Review Requirement Illuminated signs require Planning Commission Design Review approval per Saratoga Municipal Code (SMC) Section 15-30.060(a). This Design Review Approval requirement implements the Saratoga General Plan, including, but not limited to: (1) Land Use Goal 13 which provides that the City shall use the Design Review process to assure that the new construction and major additions thereto are compatible with the site and the adjacent surroundings; (2) Conservation Element Policy 6.0 which provides that the City shall protect the existing rural atmosphere of Saratoga by carefully considering the visual impact of new development. III. Planning Commission Review On August 24, 2011 the Planning Commission held a duly noticed Public Hearing on the Project at which time all interested parties were given a full opportunity to be heard and to present evidence and argument. The Planning Commission considered the Project, the Staff Report on the Project, CEQA documentation, correspondence, presentations from the Applicant and the public, and all testimony and other evidence presented at the Public Hearing. IV. Environmental Review The proposed project consisting of permitting minor alterations of existing public or private structures is Categorically Exempt from the Environmental Quality Act (CEQA) pursuant to Title 14 of the California Code of Regulations, Chapter 3, Article 19, Section 15311, “State CEQA Guidelines”, Class 11. This exemption allows for the construction and placement of minor structures appurtenant to existing commercial, industrial, or institutional facilities, including, but not limited to on-premise signage. 11 2 PSP11-0001 / 12299 Saratoga-Sunnyvale Road V. Findings for Sign Permit The findings required for issuance of a Sign Permit Approval pursuant to City Code Section Article 15-30.070 are set forth below and the Applicant has met the burden of proof to support making all of those required findings: a. The sign complies with the regulations of Article 15-30 and the regulations of the district in which it will be located in that the proposed identification signs exceed the requirements as established per City Code Section 15-30.040 and 15-30.100. The “Public Storage” sign and the “Allure Beauty” are allowed to be 19.93 square feet and 10.49 square feet, respectively. Both signs are under the allowed requirements, as established per City Code. This finding can be made in the affirmative. b. The size, shape, color, illumination, placement and material of the sign are compatible with the building it identifies and the visual characteristics of the neighborhood and other lawful signs in the area in that the proposed signage would be compatible with other channel letter signs in the area. The proposed signage is both consistent with the newly remodeled building and commercial area where it is located. The colors are basic and from the same palette as other businesses in the immediate area. The illumination is internal and minimal and should not be significantly disturbing to adjacent neighbors. The proposed placement of the signs would be compatible in the method of installation as other signs in the area. This finding can be made in the affirmative. c. The location and design of the sign does not obscure from view or unduly detract from existing adjacent signs in that the proposed signage scale, height, and design will not obscure views or unduly detract from current business signage from properties nearby. The proposed signs are attached to the building and will not detract or interfere with view sheds of other signage. The proposed lighting is low in energy consumption and minimal in brightness. The new design is proportionate to the existing business community and updated building. This finding can be made in the affirmative. d. The location and design of a sign in close proximity to any residential district will not adversely affect the quality or character of such residential area. The existing business is within the Commercial-Visitor (CV) zoning district. The proposed location is surrounded by commercial businesses with similar signage. Residential districts would not be adversely affected by the proposed signage because the proposed installation location does not face towards residences. This finding can be made in the affirmative. VI. Saratoga-Sunnyvale Road Gateway Design Guidelines: The proposed project is consistent with all of the following Saratoga-Sunnyvale Road Gateway Design Guidelines, adopted by Saratoga City Council on November 19, 2003: • Signage should be visible but fit appropriately with building architecture. The proposed identification signs faces the street and would be visible from passing 12 3 PSP11-0001 / 12299 Saratoga-Sunnyvale Road motorists and nearby pedestrians to provide ample visibility while remaining appropriate in scale and style with the existing contemporary building architecture. • Sign materials should be complimentary and consistent with architectural materials. The proposed signage will be fabricated with aluminum letters and a polycarbonate face. Although different from the exterior materials of the building, aluminum and polycarbonate materials are the standard with the existing signage along Saratoga-Sunnyvale Avenue. The proposed materials allow the signage to be internally illuminated, which provided consistency with other goals of the Gateway Design Guidelines. • Storefront/Shop Signage Prefer indirect illumination – The proposed signage will utilize internal, indirect illumination, consistent with the goals of the commercial retail signage section of the Gateway Guidelines. Sign Area and Intensity as per Municipal Code – The sign area is less than the 30 square feet allowed for the building and the illumination would be approximately 24 watts total, significantly less than the 200 watts allowed. Individual storefront/shop signage at entries should be encouraged at a pedestrian scale, such as hanging signs under eaves, awning signs, and building mounted signs – The signs would be installed on the front elevation and would be located directly above the front entrance of the stores. Their size would allow visibility to passing motorists while remain in a small, pedestrian friendly scale. VII. Project Approval After careful consideration of the application, site plan, architectural drawings, plans, CEQA documentation, and other materials, exhibits and evidence submitted to the City in connection with this matter, the exemption from CEQA is approved, the required findings are made, and Application No. PSP11-0001 is approved subject to the conditions set forth below. CONDITIONS OF APPROVAL A. GENERAL 1. All conditions below which are identified as permanent or for which an alternative period of time for applicability is specified shall run with the land and apply to the landowner’s successors in interest for such time period. No zoning clearance, or demolition, grading for this project shall be issued until proof is filed with the city that a certificate of approval documenting all applicable permanent of other term-specified conditions has been recorded by the applicant with the Santa Clara County Recorder’s office in form and content to the Community Development Director.. 2. If a condition is not “Permanent” or does not have a term specified, it shall remain in effect until the issuance by the City of Saratoga of a Certificate of Occupancy or its equivalent. 13 4 PSP11-0001 / 12299 Saratoga-Sunnyvale Road 3. Conditions may be modified only by the Planning Commission unless modification is expressly otherwise allowed by the City Code including but not limited to Sections 15- 80.120 and/or 16-05.035, as applicable. 4. The Community Development Director shall mail to the Owner and Applicant a notice in writing, on or after the time the Resolution granting this Approval is duly executed by the City, containing a statement of all amounts due to the City in connection with this application, including all consultant fees (collectively “processing fees”). THIS APPROVAL OR PERMIT SHALL EXPIRE SIXTY (60) DAYS AFTER THE DATE SAID NOTICE IS MAILED IF ALL PROCESSING FEES CONTAINED IN THE NOTICE HAVE NOT BEEN PAID IN FULL. No Zoning Clearance or Demolition, Grading, or Building Permit may be issued until the Community Development Director certifies that all processing fees have been paid in full (and, for deposit accounts, a surplus balance of $500 is maintained). 5. A Building Permit must be issued and construction commenced within 36 months from the date of adoption of this Resolution or the Design Review Approval will expire unless extended in accordance with the City Code. 6. The Project shall maintain compliance with all applicable regulations of the State, County, City and/or other governmental agencies having jurisdiction including, without limitation, the requirements of the Saratoga Zoning Regulations incorporated herein by this reference. 7. Agreement to Indemnify, Hold Harmless and Defend City as to Action Challenging Approval of Application and as to Damage from Performance of Work Authorized by Design Review Approval. As a condition of this Approval, Owner and Applicant hereby agree to defend, indemnify and hold the City and its officers, officials, boards, commissions, employees, agents and volunteers harmless from and against: a. any and all claims, actions or proceedings to attack, set aside, void or annul any action on the subject application, or any of the proceedings, acts or determinations taken, done or made prior to said action; and b. any and all claims, demands, actions, expenses or liabilities arising from or in any manner relating to the performance of such construction, installation, alteration or grading work by the Owner and/or Applicant, their successors, or by any person acting on their behalf. In addition, prior to any Zoning Clearance from the Community Development Director, Owner and Applicant shall execute a separate agreement containing the details of this required Agreement to Indemnify, Hold Harmless and Defend, which shall be subject to prior approval as to form and content by the Community Development Director. 14 5 PSP11-0001 / 12299 Saratoga-Sunnyvale Road B. COMMUNITY DEVELOPMENT 8. Compliance with Plans. The development shall be located and constructed to include those features, and only those features, as shown on the Approved Plans date December stamped July 28, 2011, denominated Exhibit "A". All proposed changes to the Approved Plans must be submitted in writing with plans showing the changes, including a clouded set of plans highlighting the changes. Such changes shall be subject to approval in accordance with Condition A.3, above. 9. Building Division Submittal. Two (2) sets of complete construction plans shall be submitted to the Building Division. The construction plans shall, at a minimum include the following: a. Architectural drawings and other plan sheets consistent with those identified as Exhibit “A” on file with the Community Development Department and referenced in Condition No. B.1 above; b. This signed and dated Resolution printed onto separate construction plan pages; c. All additional drawings, plans, maps, reports, and/or materials required by the Building Division. 10. Staff shall not approve downgrading to the exterior appearance of the approved project. Any exterior changes to approved plans resulting in a downgrade shall require filing an additional application and fees for review by the Planning Commission as a modification to approved plans. Any other exterior changes to the approved plans, which are not deemed a downgrade by staff, shall require approval in compliance with condition A.3 above. 11. The total sign area shall not exceed 30.42 square feet. 12. All illuminated signage are to be on a timer so that all sign lighting shall be switched off between the hours of 10:30 P.M. – 5:30 A.M. 13. The Owner and Lessee of the property, as signatories to the permit, shall ensure that the sign is maintained in good condition. 14.
