Any member of the public may address the Public Art Committee for up to three (3) minutes on
matters not on the Agenda. The law generally prohibits the Public Art Committee from
discussing or taking action on such items. However, the Public Art Committee may schedule the
item for discussion at a future meeting.

Recommended Action:
Review and approve the Public Art Committee minutes from January 4, 2018.
2. Paint the City Peak Democracy Voting & Kickoff Event
Recommended Action:
Review results of the Paint the City survey on Peak Democracy and consider plans for the
Paint the City kickoff event on March 24, 2018.
3. Wall Mural
Recommended Action:
Consider acceptance and location of mural, as a gift from Peter Mester, Pavel Mester, and
Cal Arte.
4. Amended Public Art Policy
Recommended Action:
Consider draft amendment to the City’s Public Art Policy.
5. Future Meetings
Recommended Action:
Discuss agenda topics and scheduling of future meetings.

PUBLIC ART COMMITTEE
REGULAR MEETING
The Public Art Committee regular meeting was called to order at 12:10 p.m. in the City Hall
Administrative Conference Room at 13777 Fruitvale Avenue in Saratoga.

Deputy City Manager Crystal Bothelio reported that the agenda for this meeting was properly
posted on December 22, 2017.

AGENDA ITEMS:
1. Public Art Committee Minutes
Recommended Action:
Review and approve the Public Art Committee minutes from October 19, 2017.

FROM OCTOBER 19, 2017. MOTION PASSED. AYES: LO, BERNALD. NOES: NONE.

2. Paint the City: Utility Box Painting Project Applications
Recommended Action:
Review Paint the City applications submitted by the December 2, 2017 deadline.
Applications will be provided at the Public Art Committee meeting.
The Public Art Committee reviewed applications and selected two to three submittals per
utility box location. The Committee requested that the Peak Democracy survey on the
selected artwork include a question that asks if the survey participant resides in Saratoga and
to exclude responses from participants who are not Saratoga residents in the final vote
counts.
3. Rock Painting Program
Recommended Action:
Preview rock painting program kits and guidelines.

The Committee reviewed the kits and recommended that staff reach out to several groups in
the community that may be interested in reserving a kit.
4. Wall Mural
Recommended Action:
Consider acceptance and location of mural, as a gift from Peter Mester, Pavel Mester, and
Cal Arte.
The Committee requested that staff provide some recommended locations for the artwork.
5. Public Art Budget
Recommended Action:
Receive update on the Public Art Budget.
Due to time constraints, staff agreed to email the Committee the current Public Art Budget
balance.
6. Future Meetings
Recommended Action:
Discuss agenda topics and scheduling of future meetings.
The Committee scheduled the next meeting for February 12 at 5:00 p.m. and agreed to the
following agenda items:
- Paint the City survey results
- Wall Mural

Subject: Paint the City Peak Democracy Voting & Kickoff Event
The City received a total of 52 applications for Paint the City, 45 of which met program criteria
and were considered by the Public Art Committee on January 4, 2018. The Public Art
Committee then narrowed selections to two or three options for each of the 7 utility box
locations. Residents were then invited to participate in an online survey on Peak Democracy to
select their favorite designs.
The survey opened on January
10, 2018 and closed on February
7, 2018 and the City received 753
responses. Of these, 697 came
from participants that state they
are residents of Saratoga. Votes
of participants that indicated that
they are non-residents or
provided no responses were
excluded from the ranking for
each location.
The graphs below show the ranking from Peak Democracy for each location and a small image
of the most popular conceptual designs. The attachment to this memo includes larger images of
the artwork.

Paint the City Kickoff Event
All artists were informed that painting will begin on March 24, 2018 and must be complete by
April 30, 2018. An event to celebrate the start of painting is planned for March 24.
The event is tentatively planned to take place from 9:00 a.m. to 10:00 a.m. at Saratoga City Hall,
next to location 4 (Allendale and Fruitvale). The event could include the following:
- Welcoming Remarks from the Mayor
- Introduction of Artists
- Presentation of Ceremonial Paint Brush to Artists
- Display of conceptual artwork, artist descriptions of work, and artist profiles
- Refreshments

Subject: Wall Mural
Cal Arte Ensemble, the Triton Museum of Art’s ensemble-in-residence, received a gift from
Central European artists Pavel and Peter Mester to paint a mural. Cal Arte Ensemble’s Artistic
Director Tamami Honma suggested that the artwork be donated to the City of Saratoga. The
artists have painted indoor and outdoor murals in the past. Links to examples of their artwork
are available below.
The artists may request that the City cover cost of supplies, if the desired location is very large
or requires more hardy paints for outdoor exposure. Typically, the artists use acrylic based

Staff has provided several prospective locations for the artwork, if the Committee would like to
recommend acceptance of the artwork and a location for a mural. Locations are listed below.

Subject: Amended Public Art Policy
In 2017, the Public Art Committee was asked to bring forward a recommendation to give the
Committee broader authority to approve installation of public art. The Committee was also
asked to bring forward the recommendation with the next public art item on t he City Council’s
agenda, which will be presentation of the top ranked designs for the Paint the City utility box
locations on February 21, 2018.
Expanding the authority of the Public Art Committee will require an amendment to the City
Council’s Public Art Policy, which currently states installation of public art on City property must
be approved by a majority vote of the City Council on a case-by-case basis.
Attached is a draft amendment to the Public Art Policy, which would allow the Public Art
Committee to approve installation of artwork on City property that meets the following criteria:
Artwork/exhibits do not impede typical uses of the site where they are proposed to be
installed
Artwork/exhibits are appropriate in scale, media, and context with the intended display
location
Artwork/exhibits do not contain political statements or symbols, religious reference or
symbols, profane or offensive content, graffiti-like style artwork, copyrighted or
trademarked material, or corporate or organizational references, branding, or symbols
Artwork/exhibits are suitable for display to a diverse audience, including children, and
should help create a sense of place and community
There is evidence of community support for the artwork/exhibit
Artwork/exhibits installed outdoors is be able to withstand an outdoor environment
through the public display period
Artwork/exhibits do not pose a threat to public safety

Any costs associated with artwork/exhibits, such as a lease or installation expenses, can
be accounted for within the Public Art Budget approved by the City Council
Artwork that does not meet this criteria would need to be reviewed by the Public Art
Committee. If the Committee recommends installation of the artwork, the City Council would
then consider authorizing installation.
If the Public Art Committee would like to narrow the discretion of the Committee in authorizing
placement of artwork in the City, the draft policy could be amended to allow installation of
artwork that will be displayed for a limited time period, such as no more than 1 year, and also
meets the criteria outlined in the policy.

RESOLUTION NO. 18-____
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AMENDING THE PUBLIC ART POLICY
WHEREAS, the City Council of the City of Saratoga adopted Resolution 03-026
establishing the Saratoga Public Art Policy; and
WHEREAS, this policy was superseded by Resolution 16-028, which declared that
placement of public art on City property by the City of Saratoga shall be approved by majority
vote of the City Council on a case-by-case basis; and
WHEREAS, since adoption of Resolution 16-028, the City Council has formed the
Public Art Committee, which is comprised of two City Council Members and provides the City
Council with recommendations on programs that foster arts and culture in Saratoga for the
enrichment and appreciation of the City and its citizens; and
WHEREAS, with the formation of the Pubic Art Committee and an increasing interest in
public art, some of the responsibility regarding placement of public art can be delegated to the
Public Art Committee; and
WHEREAS, the Public Art Committee hereby is authorized to approve installation of
artwork and exhibits on City property that meet the following criteria:
Artwork/exhibits do not impede typical uses of the site where they are proposed to be
installed
Artwork/exhibits are appropriate in scale, media, and context with the intended
display location
Artwork/exhibits do not contain political statements or symbols, religious reference
or symbols, profane or offensive content, graffiti-like style artwork, copyrighted or
trademarked material, or corporate or organizational references, branding, or symbols
Artwork/exhibits are suitable for display to a diverse audience, including children,
and should help create a sense of place and community
There is evidence of community support for the artwork/exhibit
Artwork/exhibits installed outdoors is be able to withstand an outdoor environment
through the public display period
Artwork/exhibits do not pose a threat to public safety
Any costs associated with artwork/exhibits, such as a lease or installation expenses,

WHEREAS, placement of public art or exhibits on City property by the City of Saratoga
that do not fall within the discretion of the Public Art Committee shall be reviewed by the Public
Art Committee and, at the recommendation of the Public Art Committee, be considered for
approval by the City Council by majority vote on a case-by-case basis; and

WHEREAS, this resolution shall replace and supersede all prior resolutions, policies,
and understandings relating to the Public Art Policy.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saratoga
hereby grants the Public Art Committee with the discretion to approve placement of public art
and exhibits based on the above criteria and any pieces of public art or exhibits that fall outside
the discretion of the Public Art Committee will be reviewed by the Public Art Committee and if
recommended for approval by the Public Art Committee, considered by the City Council by
majority vote on a case-by-case basis.
The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga
City Council held on the 21st day of February 2018 by the following vote:
