The Site Visit Committee is comprised of interested Planning Commission Members. The committee
conducts site visits to properties that are new items on the Planning Commission Agenda. The site visits
are held on the Tuesday preceding the Wednesday hearing, between 3:30 p.m. and 5:00 p.m.
It is encouraged that the applicant and/or owner to be present to answer any questions that may arise. Site
visits are generally short (10 to 20 minutes) because of time constraints. Any presentations and testimony
you may wish to give should be saved for the Public Hearing.
During the Site Visit, the Planning Commission may only discuss items related to the project. The agenda
does not allow any formal votes or motions on the proposed project or other matters. The Site Visit is a
fact-finding meeting where the Commission may discuss the item and ask questions from or hear statements
from members of the public attending the Visit.
No comments made during the Site Visit by the Planning Commission are binding or required to be carried
through to the formal public hearing where actions will be taken on the proposed project.

The Planning Commission approve the attached Resolution 17-028 recommending that the
City Council adopt changes to Sections 15-30.060 (Signs allowed in any zoning district

30.120 (Signs on lots with institutional, public, or quasi-public uses), 15-30.140 (Temporary
on-site sign on lots with residential properties actively marketed for sale or lease), 15-30.145
(Temporary on-site sign on lots with commercial properties actively marketed for sale or
lease), and 15-30.190 (Sign conformance, violations and abatement of illegal signs) of the City
Code.

Summary
PROJECT DESCRIPTION:
The neighbor at 13646 Old Tree Way has appealed (APTR17-0004) an administrative decision to
approve an application for the removal of one English oak tree (Quercus robur) at 13662 Old Tree
Way (TRP17-0309).
STAFF RECOMMENDATION:
Adopt the attached resolution denying the appeal.
Review by the Planning Commission is required pursuant to City Code Section 15-50.100 for any
appeal of an administrative decision.
Discussion
BACKGROUND:
On September 11, 2017, the property owner of 13662 Old Tree Way, Soon Poh, applied for a
permit (TRP17-0309) to remove one English oak growing in the front yard. The reason for the
requested removal was that the tree is lifting the driveway and a walkway by the house and is
threatening the house foundation.
Article 15-50.100 of the City Code states that anyone objecting to an administrative decision
made pursuant to the provisions of the Tree Regulations may appeal the decision to the Planning
Commission according to the procedure specified in Article 15-90. On October 16, 2017 Brian
and Jane Davis filed an application with the Community Development Department to appeal the
administrative determination to approve the tree removal permit application. The reason for the
appeal is that they find the tree to be beautiful, believe removal of the tree will significantly
affect the character of the neighborhood, and that the owner of the tree can accommodate it.
INSPECTION OF THE TREE:
On September 18, 2017 staff conducted a site visit to inspect the English oak. The tree was
determined to be relatively young based on its size. The previous owner had planted the tree close to
the house and English oaks can attain a significant size, with a height of 60 – 120 feet, a trunk
diameter measured in feet rather than inches, and a canopy spread of 50 feet or more.
Following inspection, staff was able to make the determination that the oak required removal as
it was lifting a walkway next to the house, lifting the front steps, and it had cracked and lifted the
driveway. Staff determined that it had outgrown its planting area, was too close to the house to
continue to be retained, and that there are no feasible options that would allow its preservation.
Findings
City Code Section 15-50.080 requires that each application to remove a tree shall be reviewed and
that a determination be made on the basis of the following findings. A tree qualifies for removal if
just one of the criteria listed is met and there is no feasible alternative to removal. In making a

determination on an application, staff determines all of the criteria that have been met in support of
an application for tree removal.
(1) The condition of the tree with respect to disease, imminent danger of falling, proximity to
existing or proposed structures and interference with utility services, and whether the tree
is a Dead tree or a Fallen tree.
This finding can be made because the English oak is considered to be immature and grows
close to the house. The tree was planted between the driveway and walkway with about two
to three feet between it and the paved areas. Because the house is on a cul-de-sac, the front
yard is quite small and there is limited room for trees of any size.
(2) The necessity to remove the tree because of physical damage or threatened damage to
improvements or impervious surfaces on the property.
This finding can be made because the walkway and the driveway on either side of the oak are
lifted, cracked and damaged.
(3) The topography of the land and the effect of the tree removal upon erosion, soil retention
and the diversion or increased flow of surface waters, particularly on steep slopes.
This finding was not considered for this application, but the tree could raise the ground over
time such that water is directed towards rather than away from the house and the front door.
(4) The number, species, size and location of existing trees in the area and the effect the
removal would have upon shade, privacy impact, scenic beauty, property values, erosion
control, and the general welfare of residents in the area.
This finding can be partly made because there are many oaks and other trees on the property.
Removal of this tree will affect shade on the property and may affect scenic beauty on the
street.
(5) The age and number of healthy trees the property is able to support according to good
forestry practices.
This finding can be partly made because although the oak is not crowded by other trees, there
is limited room for trees of any size in the front yard.
(6) Whether or not there are any alternatives that would allow for retaining or not
encroaching on the protected tree.
This finding can be made in that the oak will continue to grow in size and there is no way to
prevent it from doing so.
(7) Whether the approval of the request would be contrary to or in conflict with the general
purpose and intent of this Article.

This finding can be made because removal of the tree is consistent with the general purpose
of this Article which is to preserve the mature trees in Saratoga whenever p ossible. In this
case it is not possible to retain this tree without further risk of damage to the structures in its
vicinity given that it is not yet mature.
(8) Any other information relevant to the public health, safety, or general welfare and the
purposes of this ordinance as set forth in Section 15-50.010.
This finding cannot be made as the tree does not affect the safety of the public.
(9) The necessity to remove the tree for economic or other enjoyment of the property when
there is no other feasible alternative to the removal.
This finding can be made because the owner would experience an economic benefit for their
property without the tree causing damage.
(10) The necessity to remove the tree for installation and efficient operation of solar panels,
subject to the requirements that the tree(s) to be removed shall not be removed until solar
panels have been installed and replacement trees planted in conformance with the City
Arborist's recommendation.
This finding is not applicable as solar panels are not proposed.

RESOLUTION NO: 17-0029
A RESOLUTION OF THE CITY OF SARATOGA PLANNING COMMISSION
DENYING APPEAL APTR17-0004, AND
APPROVING TREE REMOVAL PERMIT APPLICATION TRP17-0309
AT 13662 OLD TREE WAY
WHEREAS, the City of Saratoga Planning Commission has received an appeal of an
Administrative Decision permitting a request to remove one English oak at 13662 Old Tree Way;
and
WHEREAS, the Planning Commission held a duly noticed public hearing at which time all
interested parties were given a full opportunity to be heard and present evidence; and
WHEREAS, the goal of the City is to balance the rights and privileges of property owners
for the use of their land with criteria for establishing and sustaining an urban forest, including the
establishment of basic standards and criteria for the removal and replacement of trees; and
WHEREAS, after considering all of the criteria for the application of a Tree Removal
Permit set forth in Section 15-50.080, the Planning Commission finds that overall the applicant has
met the burden of proof required to support said application for the Tree Removal Permit for one
English oak.
NOW THEREFORE, the Planning Commission of the City of Saratoga hereby finds,
determines and resolves as follows:
Section 1: The recitals set forth above are true and correct and incorporated herein by reference.
Section 2: The administrative decision is consistent with the General Plan, Conservation Element
Policy:
Arbor Resources Element:
The City has adopted . . . International Society of Arboriculture standards, (which) together with
Saratoga’s Tree Regulations contained in Article 15-50 of the Saratoga Municipal Code,
establish the basic standards and recommendations for the protection and preservation of trees in
Saratoga. The City’s Tree Regulations are designed to provide a stable and sustainable urban
forest . . . and to enhance the unique aesthetic character and environment of the City.
The English oak was requested for removal through the City’s process to remove protected trees as
set forth in the Tree Regulations. The Planning Commission has reviewed the application for tree
removal and the appeal, and found that the request to remove the oak does meet the required
criteria in the City Code.
Section 3: The administrative decision is consistent with the Saratoga City Code Section 15-50.080
in that the tree is damaging the driveway and walkway by the house and has outgrown the area in

which it was planted. Criteria 1, 2, 4, 5, 6, 7 and 9 have been met. Criterion 8 is not met. Criteria 3
and 10 do not apply. How each criterion has or has not been met is detailed below.

Section 4: The City of Saratoga Planning Commission hereby denies APTR17-0004, approving
TRP17-0309 for the removal and replacement of one English oak, located at 13662 Old Tree Way.
Section 5: Unless appealed to the City Council pursuant to the requirements of Article 15-90 of the
Saratoga City Code, this Resolution shall become effective fifteen (15) days from the date of
adoption.

NOTICE OF OF PUBLIC HEARING
The City of Saratoga’s Planning Commission announces the following Public Hearing on:
January 10, 2018 at 7:00 p.m.
The Public Hearing will be held in the City Hall Theater located at 13777 Fruitvale Avenue.

DESCRIPTION: An administrative decision by the City Arborist permitting the removal of an
English oak (Quercus robur) at 13662 Old Tree Way is being appealed. The owner of the
property applied for a permit to remove the tree because it was damaging the driveway and
walkway by the house and he is concerned about damage to the house foundation if it is left in
place. The oak grows in the front yard close to the house and has lifted the walkway and lifted
and cracked the driveway.
All interested persons may appear and be heard at the above time and place. If you challenge a
decision of the Planning Commission, you may be limited to raising only those issues you or
someone else raised at the meeting.
This notice has been sent to all owners of property within 150 feet of the permit application that is
the subject of this notice. The City uses the official roll produced by the County Assessor’s office
annually, in preparing its notice mailing lists. In some cases, out-of-date information or difficulties
with the U.S. Postal Service may result in notices not being delivered to all residents potentially
affected by a project. If you believe that your neighbors would be interested in the project described
in this notice, we encourage you to provide them with a copy of this notice. This will ensure that
everyone in your Community has as much information as possible concerning this project.
