Simple is better.
All signs placed on public property should be treated the same and
subject to the same enforcement rules. The proposed 2 -part 15-30.190
treats some signs differently and the difference, according to the
presentation staff made at the Planning Commission meeting is based on
the sign's content. Isn't that what our city attorney says has be be
avoided?
Proposed 15-30.190 item c subitem 2 starts to get to the point, and I
have a recommendation that I think will make more sense and actually
be logical, and I hope that you find the language acceptable. Rather
than modify what is already there and add another sub -element to item
c, why not just change it to reflect what I think the citizens and council
members really want:
Here is my proposal: Municipal Code 15-30.190(c) Any sign
located upon or affixed to any public property (including, but
not limited to, any median, street, travel lane, sidewalk or
landscaping/parkway strip located between a sidewalk and
street or as prohibited in 15-30.050) in violation of the
provisions of this Article is subject to immediate removal. The
City shall make a reasonable attempt to identify the owner of
the sign and shall mail notice of the removal to the owner of the
sign within three business days of the date of removal. A sign
that has been removed pursuant to the paragraph shall be
retained by the City and may be retrieved by the owner in
accordance with subsection 15.30-190(d).
This removes the 3 -day waiting period to remove a sign from public
property and is pretty easy to understand. If a sign is placed illegally on
public property, it should be removed immediately, not 3 days later.
Plus, this change now refers back to the section of the sign ordinance
that specifically deals with the removal of prohibited signs.
